• You are meeting with the Councillor Melva Hobson, Mayor of Redland City Council, Mr Greg Underwood, General Manager Planning and Policy and Mr Wayne Dawson Manager Land Use and Planning, Redland City Council at 10:30 am on Wednesday 13 May 2009 on Level 12, Executive Building, 1 00 George Street, Brisbane.

• The Departmental representatives to attend the meeting with you are Mr Brendan Nelson, Executive Director, South East Queensland (SEQ) Regional Planning, and Mr David Rowland, Director, Southern Region Division.

• The primary purpose of the meeting is to discuss the draft South East Queensland Regional Plan 2009 - 2031 (the draft Regional Plan) and in particular the Southern Redland Ba¥ area which is identified as a growth area to be considered for future development. -

BACKGROUND SUMMARY

The draft Regional Plan identifies an additional dwelling allocation of 19 500 dwellings of which 10 000 will be infill and 9500 (broadhectare). The draft Regional Plan reduced the regional share of new dwellings in Redland from the current plan.

The main focus for infill development will be around the activity centres of Cleveland and Capalaba. lnfill opportunities also exist at Victoria Point.

The train stations at Birkdale, Wellington Point and Ormiston present opportunities for transit orientated communities in the longer term.

Broadhectare residential development will be in South East Thornlands and Kinross Road area in Thomlands, Bunker and Double Jump Roads in Victoria Point.

Southern Redland Bay is an Identified Growth Area being considered for future urban 1 development.

Thomlands Integrated Enterprise Area is a Future Growth Area capable of providing high levels of local employment. Red land City currently has comparatively low levels of job self containment in the locaiQovernment area.

• Approximately 4500 lots on Southern Moreton Bay Islands previously within the Urban / Footprint were identified as Regional Landscape Rural Production at the request of the Council.

• The Council requested an extension of the public consultation period . / ISSUES AND SUGGESTED APPROACH

Draft SEQ Regional Plan 2009-2031

• Redland City has re-emphasised its position on limiting future urban growth, to protect its significant bio-diversity values and quality of life. In response, the draft Regional Plan focuses urban development around a framework of existing and committed activity centres with the protection of biodiversity corridors, waterways, wetlands, bushland habitat and the foreshore in the Regional Landscape and Rural Production Area.

• The Redland City Council submission on the draft Regional Plan recommends that Southern Redland Bay area be removed from the Investigation Area designation.

• The submission from Redland City Council states "that in 2008 within the Local Growth Management Strategy that Southern Redland Bay was not required. With a settlement pattern that achieves a compact urban form and consolidation through land use efficiency, planned infill, the 2031 dwelling target can be achieved without the necessity to expand the Urban Footprint in the southern extremity of the City".

• In response to this position it is important to acknowledge that Southern Redland Bay is not needed in the life of the draft Regional Plan if Redland City Council is meeting the dwelling targets, particularly infill of 10 000 dwellings.

• The provisions established regarding Identified Growth Areas provide for appropriate investigation and resolution of land use and environmental issues before inclusion in the Urban Footprint. The Identified Growth Area designation will ensure that the area is properly investigated before any development could commence.

Major Development Area Structure Planning - South East Thornlands and Kinross Road, Thorn/ands

• In 2006 the Council commenced the preparation of structure plans for South East Thornlands and Kinross Road identified then as Major Development Areas under the SEQ Regional Plan 2005-2026.

• The South East Thorn lands Structure Plan is significantly progressed and is close to finalisation of the second State interest review. A separate briefing note will be forwarded outlining concerns to be addressed to finalise the second State interest review.

• The matters of concern relate to the changes undertaken between the publicly notified version (March 2008) and the version submitted for the second State interest review (November 2008). Some of the changes were made in response to public submissions and other changes were made in response to Councillor workshops. The changes resulted in a net reduction in dwelling yield and an increase in greenspace. The briefing note will outline further details.

• The Kinross Road Structure Plan is not well advanced and has also been the subject of Councillor workshops to review land uses.

• On 9 April 2009 the Council refused two development applications lodged in 2004 for residential development (107 lots at 104 Kinross Road, Thornlands and 1021ots at 89-101 Kinross Road, Thornlands). The Council concluded that the development proposals were inconsistent with other development in the Emerging Urban Community zone and prejudice the finalisation and implementation of the structure plan. Should the applicant choose to lodge an appeal to the Planning and Environment Court about the decision the appeal must be started within 20 business days (i.e. by 13 May 2009).

• The Department of Infrastructure and Planning has placed a high priority on finalising both Structure Plans as part of the contribution these areas will make to the SEQ greenfield land supply strategy.

Interim draft Koala State Planning Regulatory Provisions (draft Koala SPRP)

• Koala protection is key matter for Redland City and it makes a range of recommendations to strengthen koala protection, for example "the goal of no net loss of habitat and in fact increasing habitat must be seen as a priority of Government". In addition it seeks the support of additional regulatory protection mechanisms.

• The Department has been working very closely with the Department of Environment and Resource Management on progressing and implementing the outcomes of the "Premiers Koala Taskforce". Work on updated koala habitat mapping is progressing as is work on a comprehensive response through a State Planning Policy (SPP). The proposed SPP will provide additional statutory support for the protection of koala habitat.

• Further investigations with respect to the effect of environmental 'offsets' for loss of koala habitat are currently being undertaken. This includes the expansion of lands identified as being suitable for rehabilitation.

• The draft Koala SPRP does not cover the broadhectare residential development areas of South East Thornlands and Kinross Road by recognising the significant efforts already made to achieve net koala benefits for these areas.

CULTURAL IMPACT

• You extended the public consultation period which allowed for an individual letter to all land holders on the Southern Moreton Bay Islands where their property had been re­classified as Regional Landscape and Rural Production. In total 4500 properties were affected and 611 individual land holders. In addition two public meetings were held which Councillor Hobson attended. Finally a presentation was made to the Council by Departmental staff in February 2009 on the draft Regional Plan.

EMPLOYMENT IMPACT

• The planning and delivery of Thornlands Integrated Enterprise Area and ongoing focus on Capalaba and Cleveland as Principal Activity Centres is central to the provision of jobs in Redland City over the life of the Regional Plan.

CONSULTATION WITH STAKEHOLDERS

• The key elements of the Redland City Council submission are supported by a significant number of form submissions from groups. These submissions are being considered in the review process.

FINANCIAL IMPLICATIONS

• There are no additional financial implications.

POTENTIAL MEDIA

• The Redland City Council has made its submission public and it is highly likely that the finalisation of the Regional Plan and decisions regarding the Southern Redland Bay Identified Growth Area and koala protections measures will be media issues.

• The finalisation of the SEQ Regional Plan is supported by a comprehensive communications plan and media strategy which addresses the Redland City Council issues.

RECOMMENDATIONS

• That you note the contents of this briefing note.

BACKGROUND SUMMARY

• The Thornlands Integrated Enterprise Area is commonly referred to as Woodlands Drive as the road is the northern boundary of the 568 hectare area.

• The area comprises 155 lots under various ownership ( 153 landowners) and is identified in the Redland City Council planning scheme as an important employment node and an economic development area. The majority of the area is zoned as 'rural non-urban', with the remainder in Environmental Protection and Conservation zones which severely limits any further commercial or residential development.

• The draft Redland City Council Local Growth Management Strategy reinforces the importance of this area as a significant land use resource needed to provide for future economic development and employment within Redland City.

• The draft South East Queensland (SEQ) Regional Plan released in December 2008 placed this area in a holding pattern under the regulatory provisions to ensure that the orderly planning of the area can occur.

• The draft SEQ Regional Plan subregional narrative for Redland identifies the Thornlands Integrated Enterprise Area as a proposed economic and enterprise area capable of providing high levels of local employment:

'The area will accommodate key industry sectors, and provide opportunity for compatible recreational and education uses and a district level activity centre. '

'As a future growth area this area will require further land use and infrastructure planning and possibly infrastructure agreements in place prior to development. '

ISSUES

Change to SEQ Regional Plan

• Under the final SEQ Regional Plan (SEQRP) as endorsed by Cabinet on 13 July 2009, the Woodlands Drive area has been changed from an Urban Footprint designation to a Regional Landscape and Rural Production Area (RLRPA) designation.

• The removal of the area from the Urban Footprint was based on the latest Department of Environment and Resource Management (DERM) koala mapping and consideration of submissions received during the review.

• The RLRPA designation significantly limits any further urban development and allows for further rehabilitation of koala habitat in the area.

• DERM has the potential coordinate rehabilitation consistent with the recent habitat mapping undertaken which identifies the site as having 70 per cent rehabilitation value.

Current applications on the site

• The Council has faced pressure from developers to approve significant residential based development in the Woodlands Drive area, including Andiworth Ply Ltd whose application for a mixed use development at 37 Woodlands Drive, Thornlands, was refused by Council on 10 November 2008. J T George Nominees Ply Ltd lodged a section 3.1.6 application for a Neighbourhood Centre, Open Space and Residential uses over three parcels of land totalling 31.2704 hectares at 197 Woodlands Drive, Thornlands, and was refused by Council on 22 June 2009. A subsequent appeal has been lodged in the Planning and Environment Court on 15 July 2009.

• The above applications were lodged before the SEQRP placed the area in a holding pattern through the MDA process in 2006 and therefore the Department of Infrastructure and Planning (DIP) had no concurrence agency role for the applications and therefore does not have a statutory role.

• The State decided not to call-in these applications, allowing the appeal process to determine the appropriateness of the applications.

• The Planning and Environment Court can have regard to the latest policy position of the State to remove the area from the Urban Footprint.

CULTURAL IMPACT

• The Department is not aware of any cultural impact that may occur.

EMPLOYMENT IMPACT

• The Department is not aware of any employment impact that may occur.

CONSULTATION WITH STAKEHOLDERS

• DIP's consultation with the Redland City Council has been ongoing, particularly in the context of the finalising of the existing structure plans for Kinross Road and South East Thorn lands.

• The Greenfield Land Supply implementation team have also met with developer/landowners with interests in the Kinross Road, South East Thornlands MDA and Woodlands Drive areas.
