Historically, at least in my 20 years, the Spring and Summer months are the busiest for real estate. So here we are in September, the start of a busy time of the year with school and sports activities kicking in and several big holidays just around the corner. The next event coming up is our annual Texas REALTORS® Conference in Fort Worth, September 12 th thru the 15 th . If you are in need of continuing education to fulfill licensing requirements, this is your chance to get in on some great classes for free. Here are a few classes you might be interested in: Getting Past No: Negotiating Strategies for the Real Estate Professional”, “Beyond the Transaction: The Impact of Agency from a Clients Perspective”, “How to Be and Island of Excellence in an Ocean of Mediocrity”, and there are more great courses dealing with anything from Feng Shui to Appraisal Obstacles. There is something for everyone, so mark your calendars to attend. Register online at www.texasrealtors.com. On October 15 th we will be hosting another TREPAC Bowling Tournament at Film Alley. Many of you have already signed up for that event. This is an abbreviated version of what we did in the Spring. Always loads of good food, fun and fellowship! Only 4 open lanes — some sign up NOW! On October 24th we will be hosting our last Association Luncheon for the year. At this luncheon we will announce the new Board of Directors for the term beginning 1/1/2020. Watch for an announcement coming to you via email showing those running to fill director vacancies. Please review these candidates and be prepared to cast your vote in October once voting opens (details will be coming to you soon). Also at the October luncheon the Community Service Committee will draw for the winners of the Women and Mens baskets they have been selling raffle tickets for. The proceeds from the sale of the tickets will go to Hearts Full of Lovean organization that helps the homeless here in Parker County. You can purchase tickets at GMWAR during the week or at the October luncheon. Proposed Rules Changes Here are some of the changes proposed August 12, many of which were necessitated by action during the 2019 legislative session which will be discussed again at the November TREC meeting. §535.112, Branch Office: As a result of Senate Bill 624, a branch office license is no longer required as of September 1, 2019. Message from the President…….

I hope you all have had a busy and productive summer. Historically, at least in my 20 years, the Spring and Summer months are the busiest for real estate. So here we are in September, the start of a busy time of the year with school and sports activities kicking in and several big holidays just around the corner.

Adopted Rules

How the Late-Fee Bill

Affects Rentals in Texas

Senate Bill 1414, which Texas REALTORS® supported in the 2019 legislative session, goes into effect Sept. 1 and amends the section in Chapter 92 of the Texas Property Code regulating fees for the late payment of rent. The bill prohibits the collection of late fees until any portion of the rent has remained unpaid for two full days after the original due date. (Previously,

late fees were allowed after one day).

The bill establishes a safe harbor where if late fees do not exceed a certain percentage, the fee is automatically considered reasonable under the law. (Under the safe harbor act a structure with no more than 4 units

a late fee of 12% of the rent is reasonable whereas a structure with more than 4 units 10% of the rent is considered as being reasonable).

A late fee that exceeds those amounts can still be considered reasonable (exceeding the limits above can be considered reasonable, as long as the fee is in line with the damages to the landlord that might reasonably result from the late payment of rent).

The bill allows a tenant to request a written statement of his late fee. (The tenant can ask for a written statement of whether he owes a late fee and, if so, the amount of that fee. The landlord must provide the statement to the tenant through a means regularly used for written communication between the landlord and the tenant).

This bill applies to leases entered into or renewed on or after Sept. 1, 2019. (Changes have been made to the Residential Lease (TXR 2001) and the Residential Lease for a Multi-Family Property Unit (TXR 2011) to reflect the increase in the number of days that the rent must remain unpaid before collecting a late fee, and other minor changes have been made as a result of additional legislation)

There has been some confusion on

the Realtor.com Pro launch. The new icon on the

NTREIS dashboard replaces the old "Find" icon

and at first glance, appears to be a link to the

Realtor.com consumer site. That is by design -

Move is using the same architecture for both the

consumer version and the Pro version. The link

from the dashboard is taking the user to the Pro

version which contains information on a property

that is not available on the consumer view. It

also provides a button for feedback from the

agent to Realtor.com and a link to log in to the

agent Realtor.com profile dashboard

Flood Insurance Information for Texas

The National Flood Insurance Program (NFIP) is essential

to completing half a million property sales each year, but it

must be reauthorized by September 30, 2019 to continue

providing flood insurance. REALTORS®support H.R.

3167 and urge Congress to find a way forward on a long-

term NFIP reauthorization.

Properties at Risk: Every property in the state has some

risk; wherever it rains, it can flood, yet not all at-risk are

insured.
