The Middlesex County Bar Association Monthly Newsletter It is my distinct honor and privilege to serve as President of the MCBA, the greatest Bar Association, in the greatest county in the state. I am humbled to have been select- ed to this prestigious position and hope to live up to the expectations of those whom the Bar Association serves. Had you told me 5 years ago that I would eventually take ofϐice during a world- wide pandemic and complete court shut- down, I would have either laughed in your face, or politely declined the opportunity. In truth, it is not just daunting, but also some- what intimidating to be confronted with the challenge of leadership in such a unique and unprecedented time. COVID-19 has had an impact on all of us, in one way or another, but I am conϐident that with the hard work and dedication of the industrious, energetic, and innovative ofϐicers and trustees, adver- sity will give way to adaptation and lead to opportunity for improvement. There are many to whom I personally owe a huge debt of gratitude. Hon. Tara Auc- iello, JMC for motivating me to become in- volved in the Bar Association, making me her co-chair of the Municipal Court Practice Committee (along with John Hogan) and en- couraging me to become a Trustee. Craig Aronow, for encouraging me to seek a lead- ership position on the Executive Committee and for always being there to offer a word of advice and a listening ear when needed. Mere words alone fail when attempting to articulate proper thanks to Jonathan Cowles, the hardest working man in show biz, and Elaine Miller, the MCBA’s best-kept secret. Without their tireless, Herculean efforts this Association would not and could not exist. Their ability to pivot and shift in the face of a “new normal” without missing a beat is nothing shy of inspirational. Though we are navigating uncharted waters, knowing that we have Jonathan and Elaine at the ship’s helm, there is no doubt we shall weather the storm. Thank you to Daria Venezia, the Im- mediate Past-President, for her leadership and guidance in making my transition to the position as smooth as possible and for a phe- nomenal year as President. Thank you to Judge Toto, the PJ’s and all the Judges who themselves have had to adapt and who have been working so cooperatively with us, the practitioners, to keep the virtual doors open and the wheels of justice spinning for the beneϐit of the public we have taken oaths to serve. I look forward to being part of this Asso- ciation’s growth and transformation, in the coming year and beyond. Despite the pan- demic, the MCBA has continued to evolve and answer the call for action when current events and the needs of the public and pro- fession dictate. In 2020 the MCBA once again co-sponsored the McFoods Drive. The Asso- ciation joined the State Bar in opposing pro- posed amendments to the Rules of Evidence concerning the scope of cross-examination in criminal trials. Since quarantine began, the MCBA has created countless webinars offering CLE credits at affordable prices on myriad topics, and has partnered with NJCBN to record the programs and offer them on demand. The Association sponsored the Wills for Warriors project where volun- teer lawyers prepared simple wills for front line workers at RWJ Barnabas Hospital. The LGBTQ+ Committee was formed to acknowledge, support, and serve those who are part of the community. In response to the senseless murders of, and violence against, Black Americans and in recognizing the need to confront racism and work to effectuate true change, the MCBA Board for the Advancement of Racial Equity and Social Justice (BARESJ) was founded and announced, ϐittingly, on Juneteenth. While this is all a good start, there is still much work to be done. IlookforwardtobeingpartofthisAsso-ciation’sgrowthandtransformation,inthecomingyearandbeyond.Despitethepan-demic,theMCBAhascontinuedtoevolveandanswerthecallforactionwhencurrenteventsandtheneedsofthepublicandpro-fessiondictate.In2020theMCBAonceagainco-sponsoredtheMcFoodsDrive.TheAsso-ciationjoinedtheStateBarinopposingpro-posedamendmentstotheRulesofEvidenceconcerningthescopeofcross-examinationincriminaltrials.Sincequarantinebegan,theMCBAhascreatedcountlesswebinarsofferingCLEcreditsataffordablepricesonmyriadtopics,andhaspartneredwithNJCBNtorecordtheprogramsandofferthemondemand.TheAssociationsponsoredtheWillsforWarriorsprojectwherevolun-teerlawyerspreparedsimplewillsforfrontlineworkersatRWJBarnabasHospital.TheLGBTQ+Committeewasformedtoacknowledge,support,andservethosewhoarepartofthecommunity.

Inresponsetothesenselessmurdersof,andviolenceagainst,BlackAmericansandinrecognizingtheneedtoconfrontracismandworktoeffectuatetruechange,theMCBABoardfortheAdvancementofRacialEquityandSocialJustice(BARESJ)wasfoundedandannounced, ittingly,onJuneteenth.Whilethisisallagoodstart,thereisstillmuchworktobedone.Inthecomingmonthswe

Arevolutionhasoccurred.Therewerenoheroicsacri ic-es,nomassiveprotests,norammingtheramparts.Noonemadeaspeechthatchangedthetidesofhistory,nooneral-liedthemasses,noonestoodupandsaid,“I’mangryandI’mnotgoingtotakeitanymore!”Notasingleshotwas iredinanger.Notadropofbloodwasspilt.Itoccurredfasterthananyonecouldhaveexpected,changinganinstitutionthatwithstoodwellintentionedreformforoverseventyyears.Itwasrandom,suddenandfromallappearances, inal.

Seemingly,inapuff,theNewJerseyMunicipalCourtsys-temcamecrashingdownasaresultofacon luenceofevents.Takenbythemselves,theseeventshadlittletodowiththeministrationsoftheCourts.Togetherhowever,theycreatedasynergythatonlythemostprescientofuscouldhaveantici-patedwouldleadtotheendoftheMunicipalCourtsystemaswehaveknownit.

Threefactorscreatedthisperfectstorm.Themostobvi-ousisthepandemicwhichhasravagedourstate,countryandplanet.Intheabsenceofa“miracledrug”tosaveusallfromthisscourge,wehavebeendirectedto“sociallydistance”fromothers.InthecontextofNewJerseyMunicipalCourtsthishasmeantabstainingfromwhathascometobeknownas“inpersonappearances”.ItisobvioustoanyoneappearinginmanyoftheMunicipalCourtsthroughouttheState,thatessential“socialdistancing”wouldbedif icultifnotimpossi-bleduetoeachcourtroom’suniquedesigncharacteristicsandspace.Consequently,ourSupremeCourtsuspendedthesesessionsinmostcases,becauseoftheimperativesofpublichealth.

Thesecondfactoristheongoing,insatiableneedforrev-enueotherwisegeneratedinnormaltimesfrommunicipalcourts.Inround igures,thesecourtscollectedabout400milliondollarsinrevenuefrom inesandsurchargesin2019.Thisrevenuesourceessentiallydriedupasaresultofcourtsessionsending.Themissingrevenuescreatedanevengreat-erproblemfortowns,countiesandstategovernments,whoweregettinghithardbecauseofotherrevenueshortfallsthatalsooccurredasaresultofcovid-19.WhatdidPlatosay?Necessityisthemotherofinvention.

Thecon luenceoftheseeventschangedaMunicipalCourtsystemthatsimplyseemedincapableofchange.The“system”of560someoddredundantcourts,eachduplicatingtheservicesofneighboringcourts,hasenduredcallsforre-formovertheyears.WhentheoldCountyDistrictCourtandCountyCourtsweremergedintotheuni iedNewJerseycourtsystem,MunicipalCourtsretainedtheirstandalonestatus.Whenthecrushofgovernmentalexpendituresdemandedef icienciesofscaledeliveringmorecomplexandinvolvedcourtservices,theonetown-onecourtsystemsurvivedun-derthebannerof“homerule”.Evenwhenitbecameclearthatproblemsfacedbyonetownseemedmoresimilarthannotwithneighboringtowns,courtsremaineddistinctandseparate.Worstofall,theprospectofProsecutorsandJudgesmakingdecisionsknowingthat“doingtherightthingmightbeapoorcareerdecision”,couldnotchangetheinstitution.

Virtualcourtappearances,however,havechangedevery-thing.Now,almostallmunicipalcourtdispositionsresultfromappearancesconductedovertheinternet.Onlyveryspecializedmattersrequiringpretrialhearingortrialareconducted“inperson”andthesehearingsandtrialsrarelyifeveroccur.

Beyondresolvingcasesbyvirtualappearances,theSu-premeCourthasinitiatedaprogramthatwillfurtherhastentheendofmunicipalcourts.DefendantscannownegotiatedirectlyonlinewithProsecutorstodowngradechargesandenterpleasthroughtheOnlineDisputeResolutionprogram.ThisprogrambeganinMayinalimitednumberofcourtsandiscontinuouslyexpanding.Unlikepleasbymail,adefendantdoesnothavetodemonstrateanyunduehardshiptoresolvetheircomplaintthroughthisprogram.

Attheendoftheday,itisperfectlyclearthatwithelec-tronicdispositions,“inperson”appearancesarebyinlarge,nolongerneeded.Thenewrealityisthatthemunicipalcourtroomhasbeenreplacedbyascreen.Becauseofthis,courtsarelesspersonalandlesslocalastheJudge,Prosecutor,De-fendantandDefenseCounselarejustimagesonthatscreen.Thereisnomorecourtassuch,justimages.Consequently,anyJudgeatanylocation,atanytimecanpreside,anyProse-cutorcanprosecute,andanyDefenseCounselcandefend.Assuch,anyJudgeonascreencanandwillhearanynumberofcaseswithouttheneedforcourtrooms,parking,courtat-tendantsandevenlocaladministrativestaff.Townbounda-rieswillnotmakeanydifference.MunicipalCourtswillhavenoreasontobeMunicipalCourtsbynecessity.

  Iwasgoingtonamethismonth’scol-umn Avoid Clichés Like the Plague. Ithoughtitwouldbeawittywaytostartthings off, but when I googled thephrase, I saw at least a dozen similarlytitledarticles.Somuchfororiginality.But the recommendation is still a solidone. Legal writers sometimes think cli-

ches add to their writing, but most often they detract. Whilephrases like slippery slope, strenuously object, and crystal clearmay seem helpful, they’re actually tired and overused. Yes, intheirheydaytheywerefreshandalive,butnomore.They’rebestreplaced.

I’mnot saying it’seasy tohuntdownclichesandkill them.It’s not. In fact, when I’ve looked back at my own writing –whether inbriefsas apractitioneroropinionsasa judge - I’vecringedmorethanafewtimes.DidIreallysaythecourtshouldthinkoutsidethebox?AndhowmanytimesdidIsaymyadver-sarywantedasecondbiteattheapple?

Sowhat’sthebestwaytoavoidcliches?Herearemysugges-tions:Whenyouedit, lookforphrasesyou’veheardbefore.Youmaywant to skim some of the lists of cliches available on theinternet.Also,beespecially carefulwhenyouuseaphraseyouthinksoundsclever.For instance, ifyou’re telling the judge thedefendant isplayingfastand loosewiththe facts,youmaywantto indafreshwaytomakeyourpoint.Usually,astrong,simplestatementworksbest.2Maybesaythedefendantisexaggerating

Thedataseemstoindicatethatwhileincreasedtraf iccon-gestionandtraf icjamsleadtomoreaccidents,theseverityofcrashesislessenedbecausespeedsarereduced.Nowthatdriverscandrivefasterontheopenroads,thedatashowsanincreaseincrashseverityandfatalities. InNewYorkCity,thenumberofvehiclemilesdrivenbe-tweenMarch2andApril8ofthisyeardropped84%com-paredto2019accordingtodataprovidedbyStreetLight.However,thatsameperiodhasresultedinmorecrashfatali-tiesthanthesameperiodinfourofthelast iveyears.Withlesscongestedstreets,speedingticketsissuedbyspeedcam-

erasinNewYork’sschoolzonesincreasedby36%inthedaysafterNewYorkCityenacteditsquarantine.However,therewasalsoadramaticdecreaseintheamountofspeedingticketsissuedbyNewYorkpoliceof icers.Speedisalikelyexplanationfortheincreaseintraf icfatalitiesgiventheopenstreetsandreducedpolicepresence. Ruralareashavealsoseenadramaticincreaseinfatalities.InMinnesota,thenumberofcarcrashesandcrashfatalitieshavemorethandoubled.AccordingtotheMinnesotaOf iceofTraf icSafety,therewere24crashesand28fatalitiesbe-tweenMarch16andApril7thisyear,comparedtojust12crashesand13fatalitiestheyearprior.This115%increaseinfatalitiescomesatatimewhentheMinnesotaOf iceofTraf icSafetyreportsthattraf icvolumedropped47%. NewYorkandMinnesotaarenotalone,however.Similarincreasesintraf icfatalitiesdespitefewercrashesarebeingreportedinTexasandMassachusettsaswell. Locally,thedataprovidedbyStreetLight,showsthattraf icvolumeinHunterdon,SomersetandMiddlesexCountieshasdroppedbetween87%and90%.However,withRoute78,Route287andtheTurnpikecuttingthroughthosecounties,drivingspeedislikelytoincrease.Ifthedatafromacrossthecountryisanyindication,NewJerseymayalsoseeariseintraf icfatalitiesduetospeed.
