This guide is written for you if you are suffering from mesothelioma or have a family

member or friend who is suffering from mesothelioma.

Mesothelioma is nearly always caused by exposure to asbestos dust.

If you have mesothelioma you will be entitled to compensation.

You get one chance at claiming compensation.

This guide aims to help you use that chance and tells you about the compensation you

could get through the Courts and from the Government.

We will provide you with the expert legal advice you need to ensure that you receive

the compensation you are entitled to.

What is asbestos?

Asbestos is a naturally

occurring mineral that has

been mined for hundreds

of years.

Asbestos fibres are fireproofand very durable and havebeen manufactured into manydifferent materials.

An asbestos fibre is 50 to 200times thinner than a humanhair, can float in the air for along time, can be invisible tothe naked eye and can bebreathed into the lungs.

Working out how and whenyou breathed in asbestos dustcan be difficult.

We will help identify where you could have breathed inasbestos dust by goingthrough your family and work history with you.

Exposure normally happenswhen a product containingasbestos is disturbed andasbestos fibres are releasedinto the air.

Asbestos was manufactured ina large number of products inthe UK particularly between1930 and 1980. These are someof the products whichcontained asbestos:

Approximately 75% ofmesotheliomas occur in thechest. The tumour develops inthe lining of the lung which iscalled the pleura. This is calledpleural mesothelioma.

Most other mesotheliomasoccur in the lining of theabdomen. This is called theperitoneum. This is calledperitoneal mesothelioma.

What causesMesothelioma?

The only known cause ofmesothelioma is breathing inasbestos dust. This will havehappened anywhere between 10and 70 years ago. Mesotheliomais not caused by smoking.

What are thesymptoms ofMesothelioma?

Pleural Mesothelioma

• Chest pain

• Shortness of breath

• Feeling tired

• High temperature

• Sweating

• Loss of weight and appetite

• Difficulty swallowing

Peritoneal Mesothelioma

• Stomach ache

• Swelling in abdomen

• Nausea and being sick

• Loss of weight and appetite

• Diarrhoea or constipation

How is Mesotheliomadiagnosed?

1. The role of the GP

If you have been exposed toasbestos dust and develop oneor more of the symptoms listedyou should see your GP.

Your GP will refer you for achest x-ray if you have oneor more of the followingsymptoms: Cough, tiredness,short of breath, chest pain,weight loss or loss of appetite.

If you have chest pain orshortness of breath your GPshould refer you to a specialisturgently.

There are no NHS guidelinesfor referral to a specialist forperitoneal mesothelioma.

It is always very important to

let your GP know that you have

been exposed to asbestos dust

in the past.

2. The role of the Specialist

To reach a diagnosis some ofthe following procedures arecarried out:

• X-ray of chest or abdomen

• Ultrasound of abdomen

• CT scan of chest or abdomen.

• Drain any fluid around lungs or abdomen and send off to be tested.

• Thoracoscopy/ Laparoscopy. This is done under local or general anaesthetic. A small cut is made in the chest/ abdomen wall and a tube with a camera is inserted. A small sample of tissue called a biopsy is taken and sent off to be tested.

Mesothelioma is a type of cancer that develops inthe outer lining of a number of internal organs.

Clinical Trials

Trials are carried out to find new and better

treatments for mesothelioma. These are constantly

changing. A list of current trials is kept on:

• PET scan. This is used to see if the mesothelioma has spread outside the lung.

When mesothelioma has beendiagnosed further tests maybe carried out to see how themesothelioma has progressedand spread so that theappropriate treatment can beconsidered.

What treatment isavailable?

There is no known cure formesothelioma and treatment is aimed at extending andimproving the quality of life for as long as possible.

Chemotherapy

Anti-cancer drugs are generallygiven intravenously to destroycancer cells. This is normallygiven weekly or once every 2 to 3weeks. The aim of chemotherapyis to control symptoms and toshrink and slow down thegrowth of the cancer.

Radiotherapy

Radiotherapy uses high energyrays to destroy cancer cells.This is normally only used forpleural mesothelioma. It is used

to try and slow the cancerdown, prevent the spread ofthe cancer, and in advancedcancer to try and control pain.

Pleurodesis

This is often carried out at thesame time as a biopsy sampleis taken for pleural mesothe-lioma. This involves sticking thepleura together to prevent thebuild up of fluid in the pleura.This will often relievesymptoms of breathlessness.

Cordotomy

Under local anaesthetic a needleis used to destroy some nervescarrying pain in the neck. Theprocedure is used to providepain relief for mesotheliomapatients with one sided chest pain.

Types of surgery

The following surgery issometimes undertaken forpleural mesothelioma. It is nota cure but aimed at extending

and improving the quality oflife. Surgery for peritonealmesothelioma is very rare.

1. Pleurectomy

This is the removal of the liningthat coats the inside of theribcage.

2. Radical Pleurectomy

This is the removal of as muchof the tumour as possible. Thelining that covers the inside ofthe ribcage, the lining of thelung, part of the lining of theheart and the diaphragm areremoved.

3. Extrapleural Pneumonectomy

This is the removal of the wholelung, the lining of the lung, partof the lining of the heart andpart of the diaphragm on theaffected side.

4. Decortication

This is the removal of the liningof the lung.

If you believe that you needequipment in the home, youcan ask your local authority tocarry out a care and supportneeds assessment. Even if theydo not provide any equipment,they should be able to provideyou with details of otherorganisations that can help anddetails of the equipment thatmay help you.

If you choose to buy anyequipment, we may be able torecover the cost of this for youin your claim for compensation.We can advise you about this.What equipment you may wantor need varies from one personto the next.

The things you may want toconsider include:

• Pillow protectors• Mattress protector• Bed fleece• Heel/elbow protectors• Adjustable table• Motor rise reclining chair• Commode• Non-slip tray• Walking stick• Grab rails• Additional hand rails on the stairs

• Stair lift• Portable scooter• Wheelchair• Adjustable single bed• Sock/stocking aid• Pill dispenser

It is also sometimes necessaryto make adaptations to yourhome such as for exampleinstalling a walk-in-showerrather than a bath. It issometimes possible to claimthe cost of these adaptationsfrom your opponent and wecan advise you about this.

You may need equipment to help you in the home.Sometimes this is provided free of charge by localauthorities or charities but there can sometimes be longwaiting lists for certain equipment for example a stair lift.

Respite careRespite care provides planned

short-term breaks for families

and other unpaid carers.

Respite care can be provided invarious ways. It may beprovided by a local authorityfollowing an assessment or bya hospice or other charity.

If you are finding it difficult tocope with caring for a lovedone, it is important to get helpas soon as possible byspeaking to your doctor orspecialist nurse. They will beable to help you obtain thehelp you need.

Respite care can involve thesufferer going into a hospice ornursing home for a shortperiod of time before returninghome. It can involve day-sittingservices where someone comesto your home during the day sothat a carer can go out or takepart in activities or intereststhey enjoy.

It can be for just a few hours ora full day. Respite care can be anight-sitting service to allowthe carer to get some muchneeded rest.

Hospice careHospice care aims to improve

the lives of people whose

illness may not be curable.

Many people think of hospicesas providing care just in thevery final stage of their illnessbut often hospices can provideother help and support in theearlier stages. They can assistwith helping to controlsymptoms and improving asufferer’s quality of life.Hospices can also help familiesduring their bereavement.

Hospice care is provided free ofcharge. Hospices are often partfunded by the NHS and partfunded by donations.

The services offered will varyfrom one hospice to anotherbut may include:

• Medical and nursing care• Pain and symptom control• Rehabilitation therapies• Physiotherapy• Complimentary therapies• Occupational therapy• Respite care• Spiritual support• Practical and financial advice• Bereavement care

Whilst hospice care is providedfree of charge, it is sometimespossible in a claim for compensation to reclaim fromyour opponent the cost of thecare provided by the hospice.This money can then be paid as a donation to the hospice to help them provide care tofuture patients.

Bringing a mesothelioma claimis very much like putting ajigsaw puzzle together.

There are various parts to the puzzle that have to be

investigated and hurdles thathave to be overcome before the jigsaw puzzle fits together.

In a case where exposure wasat work you have to prove:

Claiming compensation forMesothelioma through the courts

If you were exposed to asbestos

dust and are diagnosed with

mesothelioma, then you may

be entitled to bring a claim

for compensation through

the courts.

Breach Of DutyProve the Defendant broke thelaw that applied at the time.

DefendantIdentify theemployer or itsinsurance company.

Employment Prove the sufferer was employed by theDefendant using witnessevidence and/or documents,e.g. HMRC Employment History,Apprenticeship Deed.

Value Prove the value of theclaim by gatheringwitness, expert anddocumentary evidence.

Exposure Prove the sufferer was exposedto asbestos dust during theemployment using witness evidence from the sufferer and others.

Causation Prove the exposurecaused the mesotheliomaby obtaining independentmedical evidence.

My employer exposed me to

asbestos but no longer exists

so how can I bring a claim?

You can, but we need to tracethe employers’ liability insurerson cover at the time of theexposure as they will pay outyour compensation.

I am not sure where or how

I was exposed. Is there any

point in contacting a solicitor?

Yes, because our solicitors haveexpertise, experience andknowledge gained over manyyears from other cases andcould help you identify yourasbestos exposure.

How much compensation will

I receive?

Compensation is normallybetween £100,000 and£300,000, but in some casesit can be a lot higher.

Each claim is assessed individually.

The aim of compensation is tomake sure that you and yourfamily don’t suffer financiallyas a result of the mesothelioma.

There are two parts to thecompensation claim:

1. Compensation for the illnessand its impact on your life.This is called compensation foryour pain, suffering and loss ofamenity. This is normallybetween £50,000 and£100,000.

2. Compensation for your specific financial losses and expenses caused by the

mesothelioma. This includesloss of earnings, loss of pensionand the cost of providing care.

How long will my case take?

Our aim is to finish your casewithin 3 to 6 months of seeingyou. Some cases with complexor unusual issues can takelonger to finish.

Will my case go to Court?

Will I have to attend Court?

The vast majority of cases settlebefore any final court hearing.

How will my case be paid for?

We will make sure that you areprotected against having topay legal costs.

We will talk to you about thedifferent ways your case can befunded and which is the mostappropriate for you.

Most cases are funded on a‘No Win No Fee’ basis. You willalways receive 100% of thecompensation we obtain for you.

If we carry out investigationsin your case but cannot makea claim for any reason then wewill not charge you for thework we have done.

What happens if I die before

the case is finished? What if

someone I know has died of

mesothelioma but had not

made a claim?

If you die part way through thecase then the executors of yourwill or your dependants if youdidn’t make a will can carry onwith your case.

If someone you know died ofmesothelioma but didn’t bringa claim, then their executors ordependants can contact us. Ifthe deceased died withoutgiving any information abouttheir asbestos exposure, thenimmediate investigations willhave to be carried out, so youshouldn’t delay in making a claim.

How long do I have to bring

a claim?

There are strict time limits forbringing a claim through thecourts. The general rule is acourt case has to be startedwithin 3 years of the diagnosisof mesothelioma.

If a sufferer dies of mesothelioma,then it is usually 3 years fromthe date of death. If you thinkthe 3 year time limit has expiredthen it may not be too late toclaim.

If there are good reasons forthe delay then the court mightlet you bring the claim outsidethe usual time limit.

If you are outside the timelimit it is always worthwhilediscussing this with a solicitor.

It is important that you seekurgent advice from a solicitor ifyou don’t know when you werediagnosed or think the timelimit has expired or is about toexpire. The quicker you act themore likely you will be allowedto pursue a claim.

What will have to be done if I decideto bring a compensation claim?We understand mesotheliomasufferers and their family membersmay be worried about bringinga claim.

We understand you may nothave brought a claim before orspoken to a solicitor foranything other than buying or selling a house or perhapsmaking a will.

We will gather evidence

in support of the value of

your case including witness

statements from family

members caring for you

and any relevant documents.

You have an important role here as only

you can tell us about your work and family

life and how you may have come across

asbestos dust. We will then put this in a

statement for you.

We will visit you at your home and discuss

this with you.

Stage 1Investigation

We will obtain your HMRC employment

history, medical records and any other

relevant documents.

We will obtain a medical report

from an independent doctor to

support your case. The report is

in almost all cases prepared on

a review of the medical records

and other papers and you do not

need to be examined.

We will try to obtain

witness statements to

support your exposure to

asbestos dust either from

your old workmates or

people who worked for

the same employer but

didn’t know you.

If your opponent discloses any

documents, witness statements

or expert evidence then we will

discuss these with you and obtain your

comments on them. If the case is being

disputed the court might order that you

give your evidence at home or at some

other convenient place before the trial.

We will prepare the court papers and

start a court action using the fast track

procedure for mesothelioma claims.

Stage 3Court Claim

Your opponent will provide us

with their valuation of your case.

We will update our valuation of

your case and advise you.

If your opponent makes an

offer we will discuss this with

you and advise you on the

best course of action.

In the vast majority of cases

we reach an agreement with

your opponent. If we are unable

to reach an agreement then

the court will assess what

compensation you are entitled to.

We will send the evidence we

have obtained to your opponent

and invite them to settle your

case without taking it to court.

If your opponent makes any

offer then we will contact you

and advise you what to do.

We will always advise you on your options

and the best course of action. There may be

some negotiation before we can settle your

case on terms favourable to you.

If we are unable to settle your claim at this

stage then we will move to stage 3.

Once stage 1 has been completed

we will advise you on the prospects

of winning your case and what

compensation you will receive.

Stage 2Negotiation

Within a few weeks there will be

a hearing at which the court will

fix a timetable for resolving the

case. You won’t need to attend this hearing.

We will inform you what the timetable is.

The court sometimes enters judgment

which means the only issue left to decide is

how much compensation you are entitled to.

If this happens the court is likely to tell your

opponent to make a part payment to you

of £50,000. If judgment is not entered then

the judge will timetable your case to a trial.

There are a number of

Government benefits

and payments for people

diagnosed with mesothelioma

or whose family member has

died from mesothelioma.

If you make an application forthese benefits or paymentsthen it is usually fast trackedwhich means you will receive a decision and your benefit or payment very quickly.

We can assist you with applyingfor these or put you in touchwith benefit advisors withexperience of working withmesothelioma sufferers.

Most of these benefits are notmeans tested and so yourincome and capital are nottaken into account. Howeverthese benefits can affect anyother means tested benefitsyou are receiving which is whyyou need advice before applying.

Weekly or monthlybenefits

1. Industrial Injuries Disablement

Benefit (IIDB)

You will be entitled to IIDB ifyou are diagnosed withmesothelioma and wereexposed to asbestos dustwhilst employed.

If someone has died frommesothelioma then thedeceased’s representative canmake an application but thishas to be done within 12months of death.

2. Attendance Allowance (AA)

or Personal Independence

Payment (PIP)

If you need help with personalcare and/or mobility then youmight be entitled to one ofthese benefits. AA is paid topeople who are over 65 andPIP to those under 65.

3. Constant Attendance

Allowance (CAA) and

Exceptionally Severe Disablement

Allowance (ESDA)

If you receive IIDB and needdaily care and attention thenyou might be entitled to CAAand ESDA. There are 4 payment

rates for CAA. If you are in either of the top two rates thenyou may also qualify for ESDA.

One off lump sumpayments

Act 1979

If you receive IIDB you canapply for a lump sum paymentunder the 1979 Act. How muchyou receive will depend onyour age when you werediagnosed.

You can't receive this payment ifyou have already started a courtaction or received compensationfrom your employer.

You have 12 months from thedate you were awarded IIDB toapply but you should applystraightaway.

If someone has died ofmesothelioma their dependantcan apply for a payment within12 months of the date of death.

you do not know where youwere exposed then you will notbe eligible for IIDB or the 1979Act payment but you can applyfor a lump sum under the 2008Scheme. For example, if you wereexposed from washing asbestoscontaminated clothes, from theenvironment you lived in orwhen you were self-employedyou can apply for this payment.How much you receive willdepend on your age when youwere diagnosed.

3. Diffuse Mesothelioma

Payment Scheme

If the employer that exposedyou to asbestos dust no longerexists and their insurers oncover at the time can't befound then you might be eligibleto apply for a payment underthis Government scheme.

The Scheme is only open tothose who were diagnosedafter 25 July 2012 and wereexposed in the UK.

To succeed in your applicationyou have to prove youremployment and exposure withthe employer and that theemployer broke the law andcaused your mesothelioma. How much you receive willdepend on your age when youwere diagnosed.

If someone died of mesothelioma,their dependant can apply forthe payment. The time limit formaking any application is 3 yearsfrom when the sufferer wasdiagnosed with mesothelioma.

The payment from theGovernment includes a fixedamount of £7,000 to coveryour solicitor’s costs in makingthe application for you.

Armed ForcesExposure

If you were exposed toasbestos dust in the ArmedForces before May 1987 then youcannot sue the Government forcompensation because of thecrown immunity rule.

If you are diagnosed withmesothelioma you might beeligible for one of the following:

1. War Pension Scheme

This is very similar to IIDB.If you were exposed toasbestos dust whilst serving in the Armed Forces you canapply for this pension. The pension is paid weekly and is not means tested.

If someone has died frommesothelioma then theirwidow/widower may beentitled to a war pension.

2. War Pension Payment

If you are diagnosed withmesothelioma you have thealternative option of receivinga one-off lump sum paymentwhich is currently £140,000,rather than a weekly warpension.
