Desperate Times Call for Desperate Measures In this turbulent economy, there are many small businesses that benefit from the services provided by a cash advance/funding company. Unfortunately, in addition to these hard working small businesses, there are also many dubious individuals who try to take advantage of the cash advance/funding companies. A business that looks legitimate on paper may in fact not be a business at all.

To assist the cash advance/funding companies, and others that provide similar services, the merchant site inspection has become a valuable tool. Merchant site inspectors will meet with the merchants, conduct interviews, photograph the business sites and inventory to confirm the legitimacy of the business. Since the processing of these types of loans is usually not completed locally, these inspectors become the eyes and ears of the underwriters.

National Vendor Management Services (NVMS) specializes in these types of inspections and has completed inspections numbering in the thousands. “We have come across everything you could imagine, from addresses that have led us to empty warehouses to angry supposed “merchants” upset that inspectors have shown up and there is no evidence of any business”, says Joe Volk, Director of Business Development.

Mystery shopper inspections are also common in the industry. In this scenario, an inspector from NVMS will appear as a customer and make a purchase with a Visa or MasterCard. The receipt from the sale is examined to ensure the merchant has not switched out the terminal they should be using to repay their loan. “One of our inspectors actually witnessed a merchant switching out cables from one terminal to another right in front of him while making a purchase”, says Volk.

Even with these deterrents, criminals have still managed to swindle thousands of dollars from cash advance/funding companies. As economic woes continue and small businesses are unable to get loans elsewhere, they are finding the merchant cash advance/funding companies to be their only saving grace. Having a merchant site inspection company by your side has become a necessity to ensure these loans are helping legitimate small business owners to succeed.

The Economic Crisis Continues 3 years ago the housing market was booming, the economy was skyrocketing due north, consumers were spending and over spending and banks were lending at an astonishing rate. Fast forward to 2009, The Housing Market is in shambles, The economy is under water, consumers are not spending and banks are not lending, even if you were to find a great deal on a house you wouldn't be able to receive the financing needed to purchase it. The economy feels like it did back in the mid to late 80's when we were in a similar predicament. We overcame it then and we will hopefully overcome it again, yet the underlying question remains as to when the bloodbath will stop and when will we be able to come up for air and sustain ourselves. As I write this article the Dow is down 25% from the beginning of the year and trailing downward, there is no possibility or inkling of any forthcoming positive news and any upticks will surely be followed by a downtick. The question is when and why and more importantly for what reason will the economy turn around? I always like to use myself in the first person as an example when considering what the impact in the economy is from a birds eye perspective. I can tell you from a personal consumption and spending point, I have stopped eating out, I watch every dollar spent and have seen my savings slowly dwindle. Money is nowhere as easy to come by if available at all as it was several years ago. I check prices when I fill up the tank at a gas station (or put in half a tank), I look for coupons when shopping for groceries and have not gone shopping for clothes in ages. I am doing all I can do to make it work in this environment and still stay positive that the tides will turn and we will weather the storm. The problem is I feel like I am lying to myself. We are truly in terrible times, I personally do not see what good will come of this and for that matter, what will take place not only domestically yet worldwide to turn us around? Believe me I am open to suggestions.

The Economic Stimulus plan of $787 Billion dollars is another provision of wasted dollars spent to help who? Big business? I don't feel the impact, do you? Here's what the Government should have done, They should have paid off every outstanding mortgage in the US which would allow for all of the monthly mortgage payment capital to be applied as consumer spending and disposable income. That's how to jump start the economy, not by bailing out the U.S auto companies who haven't put out a decent car in the last 40 years!

Another thing that frustrates me is the sense that we let this happen and did nothing to stop it from taking place. We ignored all of the tell tale signs that the economy was on the path to destruction. True Story: I remember in late 2000 when I got into a cab in NYC and the driver was on his cell phone with his stock broker buying 700 shares of AOL. It was then and there that I knew I should liquidate my portfolio and sit tight because we were headed for a crash. I was a little early but definitely on the right track. The same type of story took place in 2006, I was at the dentist and the hygienist was telling me that she and her husband owned 4 houses that they bought as flips. When I asked her what her husband did for a living she replied that he too was a cab driver. Need I say more? Now no harm or ill respect to all of our cab drivers who get us from point A to point B, but the analogy is one that truly took place and predicated the fall of both markets within a short period of time. So here we are today, in a dire economy, job losses are at all time highs, people are fighting to get into job fairs where the employers are not even hiring nor have any foreseeable openings in the near future. The bailout plan was implemented to help boost the economy yet the economy continues to dwindle and is in need of emergency life support. All we hear is negative news being released daily, The only positive news I have seen to date was that Shark attacks are at an 8 year low due to people not being able to afford to travel to the coast!

The Frustrated Agent Is Funding 125% of Monthly Average Processing Still A Reality? Is it just me? I submitted a complete file last month to a funding source I will allow to remain unnamed for this article and was expecting an approval at 100-125% of the merchants current and historical processing as the credit scores were impeccable, and was astonished when I received an approval at just under 80% of the Merchants processing average. I could not believe the response I got from the underwriter who basically told me that I need to wake up and smell the new reality. I understand as much as the next guy the risk the funders are taking, My main complaint is that these funding sources who rely on the agents to send them potential business have not introduced any updated guidelines reflecting their new changes. The worst of it all is when I approached my main contact I was told that it is common industry knowledge due to a high level of defaults that times are changing. Well common knowledge or uncommon knowledge funding sources need to step up to the plate and re-train all of their agents on their new guidelines. We are not mind readers; we are sales people who are most efficient when told what to look for and what to do! Is it just me or have all of the funding sources become very difficult to deal with? It seems as if there is a constant flow of PMS running through their halls, they have become similar to secret societies that are guarding national secrets. It's time for them to wake up and smell the new reality! They funded every deal that fell in their lap, good or bad, had tremendous levels of defaults and then had their credit lines pulled due to not being able to reap the returns pitched to their investors! Don't get mad at us for your errors! I have been mistreated for no good reasons in the past 4 weeks from people who I thought were on my side. Just because you are having a bad day at work, don't take it out on me.

remember I was the one helping you make payments on your BMW when times were good, be careful what you say to people on the way up because you will pass them again on the way down!

Leads As in any sales environment, You are only as good as the contacts you make and the data you are provided. Leads play a definitive role in your success. Yet these leads come in many shapes and forms. There are direct inquiry leads, online leads, opt in leads, D&B leads and the standard cold call generated leads. Entering The MCA World

Hello to everyone. This is my first official post on the forums here.

Like many that have joined the agent forces of the MCA industry, I myself am in the transition of putting on my financial combat boots and going to the front lines of the world of working at home for myself once again.

With the climate of the current economy, I hate to say how many of my friends including myself that had great jobs, suddenly faced unexpected layoff, me included. I did some research on the Forbes website and my jaw dropped when I saw how many companies had laid off. The thought then occurred to me as I was getting all of the tedious rendering of my now new and fresh spring smelly and cling free resume that I didn't really want to go back to the traditional job market.

At one time of my life, I did work as a loan officer for a major company. Did I love being in the office 12 hours a day making up to 350 outbound calls, making around 50 contact conversations, and often times getting 8 to 10 refinance applications. I never touched that industry before as well, although I wasn't afraid to talk to people and help others out. Thus, a little phone experience under my belt which was helpful.

At any rate, I got myself out and was doing interviews, from medical sales, to pharm sales, (Didn't really want to be an outside sales guy too much). Then suddenly exploring a new concept. Something that I before had never heard of, the Merchant Cash Advance industry.

I walk in, reminds me a lot of the mortgage business with the white board and numerous businesses listed from (Made up names) Hangs Chinese Food to Larrys Chicken & Frog Legs, most of them having 10,000 dollars and the date funded or potentially funded beside them. People in good spirits for the most part. No one seemed overly stressed out, and the concept of the business seemed outstanding.

With a potential job offer on the table and not really sure if it is an exact fit, I realized I should determine if I want to learn this from the ground up myself, possibly having a tougher learning curve by not learning in an office, but going through the process of learning this and possibly signing with another company as an agent and work independently.

I have studied the industry now for about a month and a half. I am now in the process of setting up my home office. Those that I have spoken with thus far, I am very pleased to say have been exceedingly helpful.

I was concerned when I heard and read about the cosmo ponzi scheme, and the guy was only 37 years old. Pretty scary, but from what I can tell, at least I have been fortunate in that everyone that I have spoken with has been extremely supportive and very upright good encouraging people that enjoy very much what they do. That is so important in life in my opinion. I like to help people, I get a kick out of meeting new people, and I genuinely like the idea of supporting and lifting up small business owners and helping them to achieve their goals. When banks are being tough and tight with their money, these people really need help.

Now, the thing that I have seen so far, is that a lot of people are going hard after the restaurant industry. I have felt out a few days worth of calls so far, and I find that a lot of places are contacted by this industry on average up to three times a week, and I wouldn't be surprised if not more.

Then my next thought comes to mind, what is the best plan of attack? Maybe attack is not the best word to use. What is the best way to line up my day and my week if I am going to make calls from home and infiltrate and sift through the masses to find those that genuinely need help?

I am beginning to form a few impressions from certain geographic areas and certain industries, but I would be very interested and excited to know any geographic, demographic, or genre of business that has been most effective for you?

Agape lender told to open files to bankruptcy trustee

A Hauppauge commercial lender once touted as the "exclusive" partner of Agape Merchant Advance - which authorities say was part of a Ponzi scheme - was ordered by a federal judge yesterday to open its files to a bankruptcy trustee, court records show.

The lender, Professional Merchant Advance Capital Llc, or ProMAC, once listed itself as being run out of 150 Motor Pkwy., in the same suite as Agape Merchant Advance and Agape World - two companies owned by Nicholas Cosmo, accused by federal authorities of using the firms to run a $370-million Ponzi scheme involving about 1,500 investors.

Kenneth Silverman, the Jericho attorney appointed to oversee the Chapter 7 bankruptcy of Agape World, told Newsday yesterday he wanted to know if Cosmo had an "ownership interest in ProMAC" and whether Cosmo made "loans to ProMAC in support of its business platform."

U.S. Bankruptcy Judge Dorothy Eisenberg, sitting in Central Islip, yesterday granted Silverman's request.

A woman who said she was authorized to speak for ProMAC but didn't identify herself declined to comment.

Cosmo, 37, of Lake Grove, is being held on a mail fraud charge while a bail package is negotiated. His attorney, Stacey Richman, could not be reached yesterday.

ProMAC's Web site says it issues cash advances to businesses and is repaid with a percentage of future credit card sales. State corporate records show ProMAC was founded on Nov. 28, 2007, and has made 13 loans resulting in Uniform Commercial Code liens since May 2008.

According to the Agape Merchant Advance Web site, ProMAC was Agape's "exclusive merchant advance partner." Cosmo's "team at Agape Merchant Advance and ProMAC are in the position to become one of the largest and most reputable firms in the industry," the Web site says.

Eisenberg's order came amid other Agape developments:

Silverman said yesterday foreclosure proceedings have begun against a Louisiana company, United Steel Supply Inc., that defaulted on a $1.4-million loan from Agape World. The company did not respond to a phone message.

Agape World officially went into Chapter 7 bankruptcy yesterday, and a meeting at which Silverman and creditors may question Cosmo or other Agape principals was scheduled for March 30 at 9:30 a.m. at the U.S. Bankruptcy Court. Silverman said Cosmo may not attend because of the federal criminal proceeding.

Three U.S. senators, including Charles Schumer (D-N.Y.), called for Senate hearings on changing laws to make it easier for Ponzi victims to recover their losses.

A Mineola hedge fund manager, Richard Mittasch, has filed a $31-million federal lawsuit against Cosmo and his companies, saying he invested about $6 million of his own money and that of his company, Triton Mezzanine, into Agape World and Agape Merchant Advance.
