The Section for Long-Term Care Regulation (SLCR) is required by Section 198.029,RSMo, to immediately issue a Notice of Noncompliance when it finds a violation orviolations in a facility which present either an imminent danger to the health, safety orwelfare of any resident or a substantial probability that death or serious harm wouldresult. The SLCR issued such a Notice of Noncompliance to Sells Rest Home based onthe Class I violation found during the complaint investigation completed 02/14/2013.The SLCR informed you of the Class I violation, in writing, and in an exit interview on02/14/2013. The Class I violation and additional Class II violation cited during thecomplaint investigation are listed in the enclosed Statement of Deficiencies.

The SLCR has reviewed the available information and determined that although theconditions in your facility constituted Class I at the time of the complaint investigation,the deficiency was found to be lowered to a Class II prior to exit. Even though the Class Iviolation was lowered to a Class II prior to exit, the facility may still face liability for aClass I Civil Monetary Penalty pursuant to 198.067 RSMo.

You must submit an acceptable plan of correction for the Class II violations within ten(10) calendar days of your receipt of the Statement of Deficiencies to the SLCR Region2,2875 James Blvd., Poplar Bluff, MO 63901. Your Plan of Correction MUST NOTINCLUDE THE NAMES OF RESIDENTS. In addition, your plan of correction should notinclude other resident specific information such as medical records.

Representatives of the SLCR will monitor the facility until further notice and will conducta revisit in the near future to determine whether you are taking appropriate steps toaddress the violations. If at the time of the revisit the violations in the Notice ofNoncompliance are found to be uncorrected, the SLCR may seek any sanctions andremedies provided by Section 198.066 and 198.067, RSMo, or may take any actionauthorized by law. In accordance with Section 198.067, RSMo, the SLCR may alsorefer this matter to the circuit court for consideration for a monetary penalty.

In accordance with Section 198.545, RSMo, you have one (1) opportunity to questioncited deficiencies through an informal dispute resolution process. To be given such an

This request must be sent during the same ten (10) calendar days you have forsubmitting a plan of correction for the cited deficiencies. The informal dispute resolutionmay be conducted by telephone, in writing or in a face-to-face meeting. An incompleteinformal dispute resolution process will not delay the effective date of any enforcementaction.

As required by Section 198.029, RSMo, the SLCR will make public the fact that a Noticeof Noncompliance was issued and will send copies of the notice to appropriategovernment agencies. Please note that based on the fact that the deficiency was foundto be lowered to a Class II prior to exit, you will receive no further notification regardingthe lowering of the classification of the deficiency.
