The construction Manager's contract dtffers from the hrehitectural11 contract tn that the construction Manager provides manpower fore f f ic ien t bu stn e ss a dm in ist r a t ion an d m n n ag em en t se r vic e s r eq u i r ed to

complete the project within the budget and on schedule. Thejj Constructton Manager is compensated for this work by payment for thea ctu a l m an -h ou r s sp en t in p e r fo rm in g h is du t i e s , p lu s a fe e , w h ich i s

of the Construction Manager. If the contract with the Constructionjj Manager is severede there is no guarantee that the person we selectedw ill be av ailab le at a later date . In addition , the C ity is

c on tr ac tu a l ly ob lig a t e d t o p ay th e t e rm in a t ion c o st s , tn cu r re d b y th e

Construction Hanagement firm. When the project starts up aqain. new11 start-up costs will be incurred, which would include relocation eosts,an d the tim e req uired to qet th e n ew personn e l up to sp eed .

severance cost of $83,500. When the project starts up again, a decisionjj would have to be made on whether to undertake a new selection process,o r t o g o w ith th e o r ig in a l firm . S tar t -u p c o s ts fo r b r ing in g th e

Constructton Manager back on board are estimated to be $85 ,500 . In

jj summary, the cost to delay and then restart will be $169,000.option 2 . If the project is envisioned to start-up again before August

of 1991, the Construction Manager should be kept on board. The11 Construction Manager has advised that all work required to finish up hisportton of th e sch em atic design ph ase w i ll b e comp leted by Janu ary 25 ,

1991. At that time, he will dtsmiss all staff except for himself. Thejj projected costs for the Construction Manager through July, tncluding allseverance costs for the Constructton Manager would be $163 ,257 . Thisop t ion w i l l a l low s c on t inu e d p r od u ct iv e w o rk t o b e p e r fo rm e d w h tch w i l l

be required whether the project is deferred for either a short or long11 period of time. It also allows the City to retain the services of thecurrent Construction Manager , which was a major consideration in the

selection process, and who has acmx-llated six months of detailed11 knowledge of the project.

Some of the work that would be done by the Construction Manager duringjj e

th is period w ou ld inc lude prep aration o f the Genera l and Specia l

ond it ton s D ocum e n t s fo r th e 28 in d iv idu a l c on t r al t p a ck ag e s th at w i l l

be awarded , development of an M/WBE contractor data base that would

include all information required for them to bid or subcontract to other11 bidders, and be available for other required special work assignments.Th is op t ion a lso a klow s th e su sp en s ton o f th e C on st ru c t ion M an ag e r

contract after the next 90 days, when the evaluation of the financingjj plan is scheduled. The cost for carrying the Construction Manager'sservices for the next 90 day s wou ld be approx tmate ly $3 6 ,000 .00
