SUBJECT: Ballot Access for the 2012 Recall Election

This memorandum presents a summary of important and noteworthy information about

candidates requesting ballot access for the 2012 Recall Election.

Summary

The nomination paper filing deadline for the 2012 Recall Election for the offices of Governor,

Lieutenant Governor, and State Senator (Districts 13, 21, 23, and 29), was 5:00 p.m., on

Tuesday, April 10, 2012. A total of 35 candidates registered for the Recall Election: 15 for the

office of Governor, 6 for the office of Lieutenant Governor, and 14 across the various State

Senator contests. Twenty-three candidates filed nomination papers with the Government

Accountability Board, Elections Division, by the April 10 deadline. Please note that incumbent

officeholders are not required to file nomination papers to appear on the ballot per Wis. Stat. §

9.10(3)(c).

The first day to circulate nomination papers was Friday, March 30, 2012. The first candidate

filed nomination papers on Monday, April 2, 2012. All other candidates filed on the April 10,

2012, filing deadline. By the deadline for filing nomination papers on Tuesday, April 10, 2012,

six candidates had also filed additional nomination papers to supplement their original filings.

Two candidates filed correcting affidavits subsequent to the April 10 deadline to rehabilitate

defective signatures.

Note:

� Candidates for Governor or Lieutenant Governor must file a minimum of 2,000 valid

signatures of qualified electors of the state to qualify for ballot access. Wis. Stat. § 8.15

(6)(a).

� Candidates for State Senator must file a minimum of 400 valid signatures of qualified

electors from the district to qualify for ballot access. Wis. Stat. § 8.15 (6)(c).

Staff Recommendations for Ballot Status

A listing of candidates recommended for ballot status is attached and is also available on the

Elections Division website at http://gab.wi.gov. Staff requests Board affirmation of the ballot

status of those candidates listed.

Irregularities in Ballot Access Documents Not Affecting Ballot Status

There was only one notable irregularity. Mr. Kohl-Riggs, a candidate for Governor, filed several

pages of photocopies instead of the original nomination petitions. This was detected during

staff’s initial review and all signatures on the suspected photocopies were rejected. The candidate

was immediately contacted regarding the situation and the candidate returned to the G.A.B.

office before the 5:00 p.m. deadline and filed the missing original pages.

Challenges to Ballot Status

The deadline for challenges to ballot status was Friday, April 13, 2012, at 4:30 p.m. There was

one challenge filed against the following six candidates:

SUBJECT: Recall Nomination Paper Challenge Procedure

April 10, 2012, was the deadline for filing nomination papers for offices to be elected in the May 8, 2012, Recall Elections for the Governor, Lieutenant Governor, and for Senate Districts 13, 21, 23, and 29. Invariably, after nomination papers are filed, challenges to those nomination papers are filed. The Board's members will be asked to rule on those challenges at the April 17, 2012, meeting. The challenge complaints received by the Friday, April 13, 2012, deadline were made available to the Board in advance of the Board meeting. To refresh Board members' familiarity with the challenge procedure, the following review is provided.

I. PROCEDURE

1. April 10, 2012 - Nomination papers must be filed not later than 5:00 p.m., (s.9.10, Stats.), for

all nominations for the recall elections ordered for May 8, 2012. 2. April 13, 2012 - Challenges to nomination papers must be filed not later than 4:30 p.m. (Rule

GAB 2.07). A copy of the complaint will be delivered by the Board's staff to the candidate whose papers are being challenged.

a. Challenges must be made by verified complaint and must establish probable cause to

believe that the paper or signature challenged does not comply with Wisconsin Statutes or the rules of the Government Accountability Board. (See annotation below.)

b. The challenge should be accompanied by affidavits or other relevant documentation.

Any challenge which is not established by the materials submitted as of the deadline for challenge is denied.

3. April 16, 2012 (Monday) - If received not later than 4:30 p.m., a written response to the

challenge, (that will be photocopied or emailed for Board members for the April 17, 2012 meeting), may be filed by the candidate. A written response should also be verified and should also be accompanied by affidavits or other documentation. Just as the burden of establishing a challenge is upon the challenger, the burden of rebutting an established challenge is upon the candidate whose papers are challenged. The Board's staff will try to prepare a written report on the challenges and any available responses. To whatever extent possible, the Board's staff will contact circulators, affiants, and other persons with personal knowledge of the circumstances under which the signatures were obtained. Given the time frame involved, staff verification will probably be limited to close cases.

4. April 17, 2012 - The Board will meet to consider the challenges and responses, and hear any

oral presentation. Attached is a copy of the relevant provisions of ch.8 of the Statutes governing nomination papers and nominations. Also attached are the Board's rules, GAB 2.05 and 2.07, governing treatment and sufficiency of nomination papers and challenges thereto.

Please note: Because challenge proceedings are an administrative proceeding subject to statutory administrative procedures and potential court review, Board staff recommends that any challenge proceedings be handled on a case-by-case basis. In other words, rather than having the Board entertain public comments on all cases before considering staff recommendations, staff recommends that the Board Chair announce each file, request any public comments regarding that matter, consider the staff recommendation, and then vote on each case prior to calling the next file. This procedure would help the Board to recall the facts of each case and the public comments at the time of the Board’s decision, and to create a concise record for any potential court review of a particular decision.

II. ANNOTATION

With respect to the nomination process, the role of the Government Accountability Board, as it was with the former Elections Board, should be to ease ballot access for candidates, not to hinder them. This spirit informs the challenge process as much as possible so as to leave to the electorate its proper role in democratically selecting and eliminating its candidates.

With this in mind, before the Board will consider a challenge, the complaint must establish probable cause that a violation of election law has occurred. The complaint must allege facts which, if true, would constitute a failure to comply with Wisconsin's election (not campaign finance) statutes. The complaint must allege a violation of ch.8, Stats., the statutory chapter governing nominations to the general election ballot. The statutory standard for compliance is "substantial compliance" as set forth in §.5.01(1), Stats., as follows:

5.01 Scope. (1) CONSTRUCTION OF CHS. 5 TO 12. Except as otherwise provided, chs.5 to 12 shall be construed to give effect to the will of the electors, if that can be ascertained from the proceedings, notwithstanding informality or failure to comply with some of their provisions.

The Board’s administrative rule, GAB 2.05, sets forth the standards for determining whether nomination papers comply with ch.8, Stats. And its rule, GAB 2.07, sets forth the bases and

procedure for challenges to those papers. Note that GAB 2.05(4) provides that "[a]ny information on a nomination paper is entitled to a presumption of validity." Consequently, any challenge to that information must rebut that presumption, (under §.903.01, Stats.), by clear and convincing evidence that “the nonexistence of the presumed fact is more probable than its existence.” Challenges must be based on the personal knowledge of the complainant or of a person whose affidavit or sworn statement accompanies the challenge. As an example: a challenge to the eligibility to sign of various signers of a nomination paper, based on non-residency of those signers, must be accompanied by reference to Voter Public Access or “Who is My Legislator?” web searches, a map of the district showing their address to be outside the district, or by a signed statement from the election official, (municipal clerk or deputy clerk), whose responsibility it is to determine the residency of electors of the district. The complainant challenger’s allegation of the signers' non-residency, without these references, is not sufficient to sustain the challenger's burden of proof.

Challengers will be informed that new grounds for a challenge which are not raised in an initial complaint and which are raised after 4:30 p.m., Friday, April 13, 2012, shall not be considered by the Board.

Challenge complaints are filed by delivering an original and a copy of the verified compalint to the Government Accountability Board at its offices, pursuant to GAB 2.07, and by the Board's staff delivering a copy to the respondent whose nomination papers are being challenged.

III. CORRECTIONS TO NOMINATION PAPERS Historically, the former Elections Board and this Board have recognized that some deficiencies in nomination papers, (or other petitions, for that matter), may be corrected by way of an affidavit from the circulator of the nomination paper (or petition). This is true whether the deficiencies were identified by staff review of the nomination paper or were identified by a challenge complaint. Consequently, some staff-stricken signatures have been “rehabilitated” when a correcting affidavit was submitted after the deadline for filing nomination papers. It is because nomination papers may be rehabilitated that challengers are advised not to assume that the results of the initial staff review are final. A struck signature may be corrected but may still be challenged; however, any challenges to signatures disallowed (tentatively) by staff review must be raised no later than 4:30 p.m., Friday, April 13, 2012, whether or not those papers or signatures have been corrected as of that time.

The basis for this application of the law is the distinction drawn by the courts between statutory requirements that are “mandatory” – strict compliance only -- and those that are “directory” –where substantial compliance is acceptable.

Errors that may be corrected:

a.) Elector errors:

i. The elector wrote in a date other than the one on which he/she signed or left line undated

ii. The elector used an address, which does not reflect his actual residence

iii. The elector wrote in a municipality which does not reflect his actual residence

b.) Certificate of Circulator errors:

The circulator failed to sign or otherwise complete the certificate, or entered inadvertently erroneous data (for instance: the circulator dated the certificate before circulation, not after).

Errors that may not be corrected: a.) Signatures may not be added or replaced after the filing deadline nor after the certificate of circulator has been executed. (However, the date of certification may be corrected.) b.) None of the information in the heading of the nomination paper, (i.e., candidate’s name, candidate’s address, political party represented, date of election, office sought, name of jurisdiction or district in which candidate seeks office), may be altered, amended, or added after circulation of the nomination paper. This is the nomination information that each signatory saw and relied upon in deciding to sign the paper. c.) The date of signing may not be changed to a date other than the one on which the signatory actually signed; nor may any other signatory information be changed from that which was correct at the time the signatory signed. GAB 2.05 Treatment and sufficiency of nominationpapers. (1) Each candidate for public office has the responsibil-ity to assure that his or her nomination papers are prepared, circu-lated, signed, and filed in compliance with statutory and other le-gal requirements.

(2) In order to be timely filed, all nomination papers shall bein the physical possession of the filing officer by the statutorydeadline. Each of the nomination papers shall be numbered, be-fore they are filed, and the numbers shall be assigned sequentially,beginning with the number “1”. Notwithstanding any other provi-sion of this chapter, the absence of a page number will not invali-date the signatures on that page.

(3) The filing officer shall review all nomination papers filedwith it, up to the maximum number permitted, to determine the fa-cial sufficiency of the papers filed. Where circumstances and thetime for review permit, the filing officer may consult maps, direc-tories and other extrinsic evidence to ascertain the correctness andsufficiency of information on a nomination paper.

(4) Any information which appears on a nomination paper isentitled to a presumption of validity. Notwithstanding any otherprovision of this chapter, errors in information contained in anomination paper, committed by either a signer or a circulator,may be corrected by an affidavit of the circulator, an affidavit ofthe candidate, or an affidavit of a person who signed the nomina-tion paper. The person giving the correcting affidavit shall havepersonal knowledge of the correct information and the correctingaffidavit shall be filed with the filing officer not later than threecalendar days after the applicable statutory due date for the nomi-nation papers.

(5) Where any required item of information on a nominationpaper is incomplete, the filing officer shall accept the informationas complete if there has been substantial compliance with the law.

(6) Nomination papers shall contain at least the minimum re-quired number of signatures from the circuit, county, district orjurisdiction which the candidate seeks to represent.

(7) The filing officer shall accept nomination papers whichcontain biographical data or campaign advertising. The disclaim-er specified in s. 11.30 (2), Stats., is not required on any nomina-tion paper.

(8) An elector shall sign his or her own name unless unable todo so because of physical disability. An elector unable to sign be-cause of physical disability shall be present when another personsigns on behalf of the disabled elector and shall specifically autho-rize the signing.

(9) A person may not sign for his or her spouse, or for any oth-er person, even when they have been given a power of attorney bythat person, unless sub. (8) applies.

(10) The signature of a married woman shall be counted whenshe uses her husband’s first name instead of her own.

(11) Only one signature per person for the same office is valid.Where an elector is entitled to vote for more than one candidatefor the same office, a person may sign the nomination papers ofas many candidates for the same office as the person is entitled tovote for at the election.

(12) A complete address, including municipality of residencefor voting purposes, and the street and number, if any, of the resi-dence, (or a postal address if it is located in the jurisdiction that thecandidate seeks to represent), shall be listed for each signature ona nomination paper.

(13) A signature shall be counted when identical residentialinformation or dates for different electors are indicated by dittomarks.

(14) No signature on a nomination paper shall be counted un-less the elector who circulated the nomination paper completesand signs the certificate of circulator and does so after, not before,the paper is circulated. No signature may be counted when the res-idency of the circulator cannot be determined by the informationgiven on the nomination paper.

(15) An individual signature on a nomination paper may notbe counted when any of the following occur:

(a) The date of the signature is missing, unless the date can bedetermined by reference to the dates of other signatures on the pa-per.

(b) The signature is dated after the date of certification con-tained in the certificate of circulator.

(c) The address of the signer is missing or incomplete, unlessresidency can be determined by the information provided on thenomination paper.

(d) The signature is that of an individual who is not 18 yearsof age at the time the paper is signed. An individual who will notbe 18 years of age until the subject election is not eligible to signa nomination paper for that election.

(e) The signature is that of an individual who has been adjudi-cated not to be a qualified elector on the grounds of incompetencyor limited competency as provided in s. 6.03 (3), Stats., or is thatof an individual who was not, for any other reason, a qualifiedelector at the time of signing the nomination paper.

(16) After a nomination paper has been filed, no signaturemay be added or removed. After a nomination paper has beensigned, but before it has been filed, a signature may be removedby the circulator. The death of a signer after a nomination paperhas been signed does not invalidate the signature.

(17) This section is promulgated pursuant to the direction ofs. 8.07, Stats., and is to be used by election officials in determiningthe validity of all nomination papers and the signatures on thosepapers.

GAB 2.07 Challenges to nomination papers. (1) Theboard shall review any verified complaint concerning the suffi-ciency of nomination papers of a candidate for state office that isfiled with the board under ss. 5.05 and 5.06, Stats.; and the localfiling officer shall review any verified complaint concerning thesufficiency of nomination papers of a candidate for local officethat is filed with the local filing officer under s. 8.07, Stats. Thefiling officer shall apply the standards in s. GAB 2.05 to determinethe sufficiency of nomination papers, including consulting extrin-sic sources of evidence under s. GAB 2.05 (3).

(2) (a) Any challenge to the sufficiency of a nomination papershall be made by verified complaint, filed with the appropriate fil-ing officer. The complainant shall file both an original and a copyof the challenge at the time of filing the complaint. Notwithstand-ing any other provision of this chapter, the failure of the complain-ant to provide the filing officer with a copy of the challenge com-plaint will not invalidate the challenge complaint. The filingofficer shall make arrangements to have a copy of the challengedelivered to the challenged candidate within 24 hours of the filingof the challenge complaint. The filing officer may impose a feefor the cost of photocopying the challenge and for the cost of de-livery of the challenge to the respondent. The form of the com-plaint and its filing shall comply with the requirements of ch. GAB20. Any challenge to the sufficiency of a nomination paper shallbe filed within 3 calendar days after the filing deadline for thechallenged nomination papers. The challenge shall be establishedby affidavit, or other supporting evidence, demonstrating a failureto comply with statutory or other legal requirements.

(b) The response to a challenge to nomination papers shall befiled, by the candidate challenged, within 3 calendar days of thefiling of the challenge and shall be verified. After the deadline forfiling a response to a challenge, but not later than the date for certi-fying candidates to the ballot, the board or the local filing officershall decide the challenge with or without a hearing.

(3) (a) The burden is on the challenger to establish any insuffi-ciency. If the challenger establishes that the information on thenomination paper is insufficient, the burden is on the challengedcandidate to establish its sufficiency. The invalidity or disqualifi-cation of one or more signatures on a nomination paper shall notaffect the validity of any other signatures on that paper.

(b) If a challenger establishes that an elector signed the nomi-nation papers of a candidate more than once or signed the nomina-tion papers of more than one candidate for the same office, the 2ndand subsequent signatures may not be counted. The burden ofproving that the second and subsequent signatures are that of thesame person and are invalid is on the challenger.

(c) If a challenger establishes that the date of a signature, or theaddress of the signer, is not valid, the signature may not becounted.

(d) Challengers are not limited to the categories set forth inpars. (a) and (b).

(4) The filing officer shall examine any evidence offered bythe parties when reviewing a complaint challenging the sufficien-cy of the nomination papers of a candidate for state or local office.The burden of proof applicable to establishing or rebutting a chal-lenge is clear and convincing evidence.

(5) Where it is alleged that the signer or circulator of a nomi-nation paper does not reside in the district in which the candidatebeing nominated seeks office, the challenger may attempt to es-tablish the geographical location of an address indicated on anomination paper, by providing district maps, or by providing astatement from a postmaster or other public official.

GAB 2.09 Treatment and sufficiency of electionpetitions. (1) Except as expressly provided herein, the stan-dards established in s. GAB 2.05 for determining the treatmentand sufficiency of nomination papers are incorporated by refer-ence into, and are made a part of, this section.

(2) In order to be timely filed, all petitions required to complywith s. 8.40, Stats., and required by statute or other law to be filedby a time certain, shall be in the physical possession of the filingofficer not later than the time set by that statute or other law.

(3) All petitions shall contain at least the number of signa-tures, from the election district in which the petition was circu-lated, equal to the minimum required by the statute or other lawestablishing the right to petition.

(4) Only one signature per person for the same petition, is val-id.

(5) This section applies to all petitions which are required tocomply with s. 8.40, Stats., including recall petitions, and to anyother petition whose filing would require a governing body to calla referendum election.

GAB 2.11 Challenges to election petitions. (1) Ex-cept as expressly provided herein, the standards established in s.GAB 2.07 for determining challenges to the sufficiency of nomi-nation papers apply equally to determining challenges to the suffi-ciency of petitions required to comply with s. 8.40, Stats., includ-ing recall petitions, and to any other petition whose filing requiresa governing body to call a referendum election.

(2) (a) Any challenge to the sufficiency of a petition requiredto comply with s. 8.40, Stats., shall be made by verified complaintfiled with the appropriate filing officer. The form of the complaint,the filing of the complaint and the legal sufficiency of the com-plaint shall comply with the requirements of ch. GAB 20; the pro-cedure for resolving the complaint, including filing deadlines,shall be governed by this section and not by ch. GAB 20.

(b) The complaint challenging a petition shall be in the physi-cal possession of the filing officer within the time set by the statuteor other law governing the petition being challenged or, if no timelimit is specifically provided by statute or other law, within 10days after the day that the petition is filed.

(3) The response to a challenge to a petition shall be filed with-in the time set by the statute or other law governing that petitionor, if no time limit is specifically provided by statute or other law,within 5 days of the filing of the challenge to that petition. Afterthe deadline for filing a response to a challenge, the filing officershall decide the challenge with or without a hearing.

and Debbie Christiansen, by their attorney Jeremy P. Levinson, submit this verified complaint

against the Republican Party of V/isconsin, Gladys Huber, Isaac Weix, Gary Ellerman, Tamra

Lynn Varebrook, James Engel, and James Buckley.

INTRODUCTION

The Republican Party of 'Wisconsin ("RPW") has publicly admitted that it recruited six of

its supporters to register for and seek placement on the ballot for the upcoming May, 8,2072

election as representatives of the Democratic Party. The stated purpose of having these RPW

supporters run as Democrats is to create false primaries thereby delaying all general elections

that would otherwise occttr on May 8 until June 5, 2012.

Canying out this scheme required, among other things, the hling of official documents

with the Government Accountability Board and the successful circulation and submission of

nomination papers. The respondents falsiflred information on these documents, asserting that the

six phony primary candidates were "affrliated" with and "represent" the Democratic Party,

In their many public statements, the respondents conltrm that there is not any dispute of

fact. The six phony primary candidates have made false statements to the GAB and the public

through their filings: that they are representatives of the Democratic Party who are seeking to

win the chance to face Republican incumbents in the recall general election. Respondents have

admitted that the six phony candidates are seeking ballot placement on behalf of the RPV/ in an

overt and blatant effort to manipulate the upcoming elections to protect and advantage the

Republican incumbents facing recall.

As described below, this scheme disenfranchises electors who signed nomination papers

for the phony candidates believing they were assisting a Democratic effort to unseat a

Republican incumbent. The RPW's scheme involves serial election fraud and invalidates each of

the six phony candidacies because each is founded on fraudulent f,rlings with the GAB and

fraudulent nomination papers.

FACTUAL CKGROIID

1. Judith Winzenz is a Wisconsin resident and elector residing at 1922 N. Lawe St.,

Appleton, Wisconsin.

2, Sarah Koeppen is a V/isconsin resident and elector residing at 202 N. Hamilton

St., Madison, Wisconsin.

3. Susan Finnel is a Wisconsin resident and elector residing at907 Richards Ave.,

Vy'atertown, Vy'isconsin within Wisconsin State Senate District 13,

4. Debbie Christiansen is a Wisconsin resident and elector residing at 2lI0 Crown

Pt. Dr., Racine, V/isconsin within Wisconsin State Senate District 21.

5. Donna Martin is a Wisconsin resident and elector residing at 20279 77th Ave.,

Chippewa, Wisconsin within Wisconsin State Senate District 23.

6. Richard Dennis O'Flyng is a Wisconsin resident and elector residing at 414

Franklin St., Vy'ausau, Vy'isconsin within Vy'isconsin State Senate District 29.

7 . On March 30,2012, the Government Accountability Board ordered the Governor,

Lieutenant Governor, and the State Senators representing Senate Districts 73,21,23,and29 to

stand for recall elections. By operation of Art. XIII, $ 12 of the Wisconsin Constitution and $

9.10,V/is.stats.,thoseelectionswilloccuronMayS,20T2. If"arecallprimaryisrequired,"$

9.10(3XÐ, V/is. Stats., requires that it shall occur on that date with the general election for the

particular office occurring on June 5,2012.

8. The RPW promptly announced a strategy to manipulate the scheduling of these

elections to give its incumbents facing recall elections an advantage. Despite the constitutional

and statutory timing of recall elections and any "required" primaries, the RPW has declared that

it will cause all the ordered recall general elections to occur on June 5,2012,

9. The RPV/ has fuither announced that it will manipulate the timing of these

elections by having its representatives fraudulently register as Democrutic Party primary

candidates in each of the recalls in an effort to trigger false Democratic primaries.

10. The RPV/ has explicitly acknowledged this scheme in detail:

a. "GOP spokesman Ben Sparks says Gladys Huber will run for governor; Isaac

Weix will run for lieutenant governor; and Gary Ellerman, Tamara Varebrook,

James Engel and James Buckley will run for state Senate." Exhibit A

b. "In an effort to ensure election fairness, the Republican Party has recruited

protest candidates to run in all of the upcoming recall elections. The protest

candidates will run as Democrats to guarantee that there is one clear date for

the primary election and one clear date for the general election." Exhibit B

(RPW press release from WISGOP.ORG NEWS)'

c. "The protest candidates will run as Democrats to guarantee that there is one

clear date for the primary election and one clear date for the general election,"

said Stephan Thompson, the party's executive director. Exhibit C (JS Online

article entitled "GOP to run fake Democrats in recalls" dated March 30,

2012).

d. "'The recruitment of protest candidates was done by the Republican Party of

Wisconsin,' said Dan Romportl, executive director, Committee to Elect a

Republican Senate. 'The party decided to run Democrat primary candidates in

order to line up all of the election dates on June 5."' Exhibit D (Daily Union

article entitled "Ellerman running as a protest candidate" dated Aprll2,2012).

e. A RPW mailer sent on behalf of Gladys Huber and Isaac Weix stated the

following: "Help Walker and Kleefisch fight Back. Support Gladys Huber

and Isaac Weix's Candidacy!" Exhibit E (Mailer paid for by Republican

Party of V/isconsin, Bob Geason, Treasurer).

f. "Today protest candidates turned in the required number of signatures to

appear on the ballot in all six recall elections. Their candidacy will ensure

election fairness going forward and guarantee there is one primary and general

election date for all candidates." Exhibit F (RPW press release from

V/ISGOP.ORG NEWS).

The phony primary candidates have also acknowledged this scheme:

a. "'They'll say what they say,' Ellerman said. 'It's something both parties have

used. In my personal opinion, the recall is dirty politics since these people

didn't do anything wrong. That's my Republican, conservative view of

things,"' Exhibit D (Daily Union article entitled "Ellerman running as a

protest candidate" dated April 2, 2012),

b. "Gladys Huber, an 8O-year-old Mequon woman who has filed papers to run as

a Democrat in the 8th Senate District recall election made an odd comment

when reached by a reporter: 'I really have no comment at all,' she said. 'I will

refer you to the Republican Party of Wisconsin."' Exhibit G ('Whitef,rsh Bay

Patch article entitled "Who is 'Fake Democrat' in Recall Race" dated June 1 1,

20Ir).

c. A 2011 letter from the Weix campaign stated as follows: "We need to make

sure Democrat challengers face primaries to allow our Republicans time to

mount a campaign, The GAB is delaying Democratic elections to give them

more time to organize. V/e need the same! A Democratic primary will push

the general election back by one month so that Senator Harsdorf can have

more time to organize a campaign against her liberal challenger," Exhibit H

(Mailer Paid for by Friends of Isaac Weix, Earl Gunderson, Treasurer).

d. "In two and a half hours, Varebrook said she flagged about 100 signatures.

Varebrook, a stay-at-home mom, said the reason why she was helping verify

signatures is: 'Van is my senator. I voted for him and I don't want my vote

taken away."' Exhibit I (Racine Journal Times article entitled "Verifying the

signatures - As checking begins, some dated wrong, others allegedly from out

ofstate" dated January 26,2012).

e. "'I was out there in the cold weather, snowing, freezing, getting signatures,'

said Jim Buckley, a Kim Simac suppoerter, He has backed Kim Simac from

the beginning." Exhibit J (NIBC 26 story entitled "Recall Election Preview"

dated August 15,20II).

12. Beyond the recruitment of the fraudulent candidates, the RPW expended money

and effort to obtain suffrcient signatures on nomination papers. A March 3l mailing from the

RPW disseminated fraudulent nomination papers, urged people to obtain signatures on them, and

laid out the fraudulent scheme in detail. Exhibit E. This effort to support claimed "Democratic"

candidates included the following exhortation:

13. The mailing included the statement that it was:

candidates. Exhibit A.

15. Gladys Huber is the fraudulent primary candidate in the recall election of the

Governor.

Lieutenant Governor.

17. Gary Ellerman is the fraudulent primary candidate in the recall election of the

State Senator for Senate District 13.

18. Tamra Lynn Varebrook is the fraudulent primary candidate in the recall election

of the State Senator for Senate District 21 '

ß. James Engel is the fraudulent primary candidate in the recall election of the State

Senator for Senate District 23.

20. James Buckley is the fraudulent primary candidate in the recall election of the

State Senator for Senate District 29.

Fraudulent Camnaisn Resistration Statements

21. Each of the above-named fraudulent candidates filed Campaign Registration

Statements (Form GAB-I) with the GAB stating that their "Party Affiliation" is with the

Democratic Party. Exhibit K. Each of them "certif[ied] that the information in this statement is

true and complete." Each candidate intentionally provided false information as to their "Party

Afftliation."

Fraudulent Declarations Of Candidacv

22. Each of the above named fraudulent candidates filed Declarations of Candidacy

(Form GAB-162) stating under oath that they are 'orepresenting" the Democratic Party in the

recall elections. Exhibit L. In each instance, this sworn statement was fraudulent and made with

the intent to mislead the government agency which administers elections and the public.

Fraudulent Nomination Papers

23. For each of the above-named fraudulent candidates, nomination papers were

circulated which specifically stated that each was "representing" the Democratic Party. Each

nomination paper stated to electors that signing the paper constituted a request that a

representative of the Democratic Party be placed on the ballot for the recall election. These

statements \,vere fraudulent and made with the intent to mislead the government agency which

administers elections and the public.

24. Each of these fraudulent statements on offrcial election submissions constitutes

felony election fraud.

Criminal Election Fraud

25. Section 12.13(1Xb), Vy'is. Stats., prohibits "makfing] false statements" to an

"election off,tcial," in this case the GAB.

26. Section 12.13(3), Wis. Stats,, makes it a crime to "falsify any information in

respect to . . . nomination paper, declaration of candidacy or petition for an election, including a

recall petition or petition for a referendum; or file or receive for filing a certiftcate of nomination,

nomination paper, declaration of candidacy or any such petition, knowing any part is falsely

made."

27. Pursuant to $ 12.60, Wis, Stats., violations of the above referenced statutes are

Class I felonies.

28. There is no dispute that the above-described statements are false. The fraudulent

candidates and the RPW have publicly stated so. The fraudulent candidates are not "aff,rliated

with" and do not "reptesent" the Democratic Party.

29. The fraudulent candidates and the RP'W have explicitly acknowledged that, in

fact, these fraudulent primary candidates are part of an effort to manipulate the electoral process

in support of the Republican incumbents facing recall.

30. The fraudulent candidates have officially represented themselves to the GAB and

the public as seeking to represent the Democratic Party in an attempt to unseat the Republican

incumbents when in fact they have acknowledged that their candidacies represent an effort to

support the incumbents' efforts to retain their off,rces.

31. Members of the public who are eligible to vote are permitted to sign only one

nomination paper for the same office. Individuals who signed one of the above-described

fraudulent nomination papers would not be able to sign another candidate's nomination paper for

the same off,rce.

32. Individuals who signed the above described nomination paper in reliance on the

statement that the nomination paper sought to place the Democratic candidate on the ballot to

challenge the Republican incumbent unwittingly supported an effort to protect the Republican

incumbents. In doing so, such a signor also lost the opportunity to support the nomination of a

candidate actually supporting the Democratic Party in an attempt to unseat the Republican

incumbent.

33. Candidacies founded on submission of fraudulent official documents and

fraudulent nomination papers do not meet the requirements for ballot access.

34. Art. XIII, sec. l2(4)(b) of the Wisconsin Constitution states:

For any partisan offrce, a recall primary shall be held for eachpolitical party which is by law entitled to a separate ballot andfrom which more than one candidate competes for the party'snomination in the recall election. The person receiving the highestnumber of votes in the recall primary for each political party shallbe that party's candidate in the recall election. Independentcandidates and candidates representing political parties not entitledby law to a separate ballot shall be shown on the ballot for therecall election only.

35. The Democratic Party is entitled to a separate ballot pursuant to $ 5.62, Wis.

Stats. But a primary is only authorized when "more than one candidate" "from" such a party

"competes for the party's nomination in the recall election," By their own admission, the

candidate-respondents are not "from" the Democ rafic P arty .

36. Section 8,19(3), V/is. Stats., provides in relevant part that "fe]very political party

entitled, under s.5.62, to have its candidates onthe partisanprimary and general electionballots

has exclusive right to the use of the name designating it at any election involving political

parties." (emphasis supplied). By the respondents' own admissions, the RPV/ and its supporters

are purporting to use the name of the Democratic Party in connection with the recall elections.

37. For those recall elections in which there would be no primary absent the

respondent-candidates, no primary is authorized. The usurpation of the Democratic Party's name

is specifically precluded by statute.

38. Section S.30(1Xb), V/is. Stats., specifically denies placement on a ballot if "[i]t

conclusively appears, either on the face of the nomination papers offered for filing, or by

admission of the candidate or otherwise, that the candidate is ineligible to be nominated or

elected." (emphasis supplied).

39. As a separate matter, proper and timely submission for a Declaration of

Candidacy, Campaign Registration Statement, and a sufficient number of valid signatures on

proper nomination papers are each a mandatory requisite for ballot placement.

40. On each of these documents, the six phony candidates falsely claimed to

"represent" or be affiliated with the Democratic Party. Respondents have acknowledged that the

sole purpose of these falsehoods is to cause the GAB to call primary elections that would

otherwise not take place.

4L The nomination papers circulated for each phony candidate repeated the falsehood

- and represented to the voting public that a signature on the papers supported ballot placement

for a candidate representing the Democratic Party in an effort unseat an incumbent Republican.

In fact, such signatures only furthered the RP'W's arìnounced strategy for protecting its

incumbents. This cheated supporters of the Democratic Party out of their right to support recall

of the Republican incumbent because an elector is permitted to sign only one nomination paper

per offrce.

42. A candidate who failed to submit a Declaration of Candidacy, a Campaign

Registration Statement, or sufficient and valid nomination papers would not be placed on the

ballot. Submitting admittedly fraudulent ones requires the same result.

43. Finally, the respondents' own admissions render invalid the certifications of the

circulators of the fraudulent nomination papers.

44. For these reasons, individually and collectively, the names of the six phony

"Democratic" candidates do not qualify for ballot placement,

WHEREFORE, Complainants request that the GAB deem the candidate-respondents

ineligible for placement on the ballot, and initiate investigation of the above-described matters as

provided for by law.

The state GOP has lined up six fake Democrats to run in upcoming recall elections targeting Gov. Scott'Walker

and five other Republicans.

GOP spokesman Ben Sparks says Gladys Huber will run for governor; Isaac Weix will run for lieutenant

governor; and Gary Ellerman, Tamara Varebrook, James Engel and James Buckley will run in four state Senate

recalls.

Engel will be running as a fake Democrat against former state representative Kristen Dexter, an Eau Claire

Democrat who declared her candidacy against Republican State Sen. Terry Moulton in Chippewa Falls inJanuary.

The elections are scheduled for May 8 and June 5. If primaries are needed they'll be held May 8.

Sparks says running what he called "recall protest candidates" guarantees a clear primary date and ensures no

Republicans will face a general election that day, when Democrats likely will turn out in huge numbers to select a

gubernatorial challenger.

He says the party doesn't plan to spend any money on their campaigns.

IMADISON, Wl]- Republican Party of Wisconsin Executive Director Stephan

Thompson released the following statement on the decision to run protest candidates:

"ln an effort to ensure election fairness, the Republican Party has recruited protest

candidates to run in all of the upcoming recall elections. The protest candidates will run

as Democrats to guarantee that there ìs one clear date for the primary election and

one clear date for the general election. The Republican Party w¡ll not actively

campaign for the protest candidates, other than collecting nomination signatures to

ensure their place on the ballot.

"Without protest candidates, the Democratic Party would be able to control the dates in

which Republican officials face election, potentially separating the elections for State

Senate and Lieutenant Governor from the Governor. The Democrats and their union

bosses are the ones who decided to force these baseless recalls on our state, and by

ensuring every Democratic candidate faces a primary election, we will limit their ability

to once again create chaos within the election process."

Madison - The State Republican Party announced Friday it intended torun fake Democratic candidates in the six upcoming recall elections,ensuring that primaries will be necessary in May and forestalling thehead-to-head recall elections until lune.

The announcement came just hours after state elections officials orderedrecall elections against Gov. Scott Walker, Lt. Gov. Rebecca Kleefisch andfour Republican state senators.

Primaries will be conducted May 8 and the general election will be June 5for all of the races, assuming the primaries come about as planned, MayB becomes the general election date in any races that do not attractenough candidates for a primary,

"The protest candidates will run as Democrats to guarantee that there isone clear date for the primary election and one clear date for the generalelection," said Stephan Thompson, the party's executive director,

He said the move was made because otherwise some or all of thegeneral elections could fall on the same day as the primary for governor- when Democrats will flood to the polls to pick their candidate forgovernor.

Four Democrats have said they will run against Walker. A primary hadalso been expected in the race to unseat Kleefisch, but not the senators,

The Republican Party said it would run fake Democrats in all races,including for governor. The strategy ensures all the elections will happenon the same schedule, even if three of the four Democrats running forgovernor drop out of that race.

Thompson said none of the protest candidates would actively campaign.

Running the fake Democrats mirrors the move they made in last year'srecalls to buy themselves more time to campaign. Democrats crítícizedlast year's effort for adding upward of 9400,000 in costs for local electioncl erks.

The primary and general recall election are expected to each cost $9million - $18 million in all,

The protest candidates this time should not significantly add to those costs because a statewide primaryalready appeared certain in the race for governor and lieutenant governor.

Last year six Republican and three Democratic state senators faced recalls, the largest wave of statelawrnakers over a single issue in the country's history, In those recalls, Democrats narrowed the GOPmajority in the Senate from 19-14 to 17-16,

Earlier this month, one of the four Republican senators targeted for recall in the upcoming round, PamGalloway of Wausau, quit, leaving the Senate equally divided, 16-16. The upcoming recall elections willdetermine the control of the Senate, but only in the short term, Signatures are being gathered in an attemptto recall Democratic Sen. Bob Jauch of Poplar, and half the Senate is up for election ín the fall,

Those facing recall in the coming weeks are Senate Republican Leader Scott Fitzgerald of luneau and GOPSens. Terry Moulton of Chippewa Falls and Van Wanggaard of Racine. Recall organ¡zer Lori Compas isrunning against Fitzgerald; former Rep. Kristen Dexter of Eau Claire is running aga¡nst Moulton; and formerSen. lohn Lehman of Racine is running against Wanggaard.

The Galloway recall will still be conducted, as well. Rep. Jerry Petrowski (R-Stettin) and Rep. Donna Seidel (D-Wausau) plan to run in that race.

The plan for protest candidates could create some headaches for Petrowski. This month, he told WAOW-TV inWausau, "I do not condone the practice of running fake candidates in political races. Both political partiesshould focus solely on the issues that matter to this state,"

In ordering the recall elections, the Government Accountability Board also voted 5-0 to post on its websitedatabases of all those who signed recall petitions.

The board had earlier made available on its site copies of all the petitions, but they are not searchable.

Upon doing some investigat¡on, he learned more of what was entailed in runn¡ng as a lake Democral or protesl candidate. H¡shiends wilhin lhe Walker Walkers ol Lake [,4¡lls encouraged him to take on the role.

"lt was a way of basically protesting the recall to start w¡th and creale a primary s¡tuation for Lori Compas so F¡tzgerald d¡dn'thave to do a regular eleclion during the primary - he could do il w¡lh everyone e¡se when the gubernatorial election is held,"Ellerman said.

He spoke w¡th state Republican oflicials several t¡mes and then agreed to add his name to the ballol.

Over th¡s past weekend he started gather¡ng s¡gnalures to get h¡s name on the ballol

"We are not going to actively campaign," Ellerman said. "l have no doubts lhat she is putting a good campaign togelher to beatme. I don't think that's the ¡ssue. The ¡ssue ¡s try¡ng to get everylh¡ng slra¡ghlened out so there is a real primary and a realelection."

He gives Compas and her volunteers credit in starting wilh nothing and being successful in collecting the signatures to lorce arecall against Filzgerald.

"l think she's got a tough road with Fitzgerald," Ellerman said.

As for h¡mself, he has no illus¡ons aboul garnering many votes ¡n the primary

"l plan on being totally embarrassed that day because I'll probably get two votes - me and my w¡|e," Ellerman said. "lt's really astrategic move to get everybody lined up and mov¡n9."

He anticipated the outcry of opponents claim¡ng his campaign was "dirty polit¡cs."

"They'll say what they say," Ellerman sa¡d. "lt's someth¡ng both parties have used. ln my personal opinion, the recall is dirtypolit¡cs since lhese people didn't do anyth¡ng wrong. That's my Republican, conseryal¡ve view of things. We're not deal¡ng wilhcriminal activity or anything like that "

With¡n hours of filing lhe paperwork indicating that he ¡nlends to place h¡s name on the ballot, Ellerman rece¡ved telephonecalls and emails from e¡ther Compas' campaign or her supporters ¡ndicating lhat his campa¡gn would ¡ncrease lhe overall coslof the eleclion.

"ln fact it isn't going lo cost anymore money lor me to be a protest candidale because the gubernalor¡al pr¡mary was alreadygoing lo happen," Ellerman said. "When you get down to the dela¡ls, ¡t doesn't cost any more to put one more name on lheballot."

Fitzgerald previously has sa¡d he plans lo run h¡s recall eleclion câmpaign on his record of seru¡ce w¡th¡n the d¡strict. He hasc¡ted lhe state's improved business rank¡ng, lhe balanced budget w¡th no tax ¡ncrease and creat¡on ol 1 2,500 jobs.

Wh¡le supportive of h¡m, Ellerman noted that the Walker Walkers of Lake Mills have not act¡vely campaigned lor Fitzgerald,other than acknowledg¡ng he is a Republican.

"Our ma¡n dr¡ve was lhe Walker s¡tuation and pushing back on all lhe recall stuff," he said

As for any campâ¡gn, he is not interested in debales and does not want to make speeches

Gladys Huber, an 8O-year-old lVequon woman who has filed papers to run as a Democrat in the 8th Senate District recall election made an odd commentwhen reached by a reporter.

"l really have no comment at all," she said. "l will refer you to the Republican Party of Wisconsin."

State party officials did not return calls about Huber's candidacy but they have been upfronl about its intention to run Republicans as Democrats in an

effort to give incumbent senators like the 8th District's Alberta Darling more time to raise money and campaign.

The staÌe's Government Accountability Board said Friday that Huber has officially registered to run as a Democrat against state Rep. Sandy Pasch of

Whitefish Bay. lf both candidates meet the 5 p,m. Tuesday deadline to file nominating petitions, a primary election would be held July .12 and the winner

of that race would take on Darling on Aug. 9.

Democratic candidate an act¡ve RepublicanWhile Huber won't talk about why she's running as a Democrat, lhere is no doubt that she has longtime roots as an acl¡ve member of the Republican

party in Ozaukee County.

Huber, born in April 193.1 , is one of 10 people elected to serve as a leader in the Ozaukee County Republican Party. For a number of years, she has

served as a member-at-large.

Huber has a yard sign supporting Darling in front of her home. She also donated $100 to Darling on March 28, according to the GAB. Between 2002 and201 0 Huber gave almost $2,000 to Republican candidates or the state party, records show.

Huber is a longtime poll worker in Ozaukee County, most recently serving as the Republican observer in the Supreme Coun recount. ln 1996, she was

the membership chairwoman for the county GOP. She was lhe quoted by the Journal Sentinel as saying: "l am a firm believer in the grassroots. The

ln 1 994, Huber filed a complaint against Eric Grant, who was a Republican candidate for the 60th District Assembly seat. Grant, she said, had not formed

a commiltee before raising and spending money on his campaign. He paid a $150 fine.

She also served on the counly's Department on Aging and on the Lasata Care Cenler board, the county-owned senior apartment complex.

Recall election could be delayedWhile plans now call for a primary election on July 9 and a general election in August, those dates could be delayed. Darling has joined five other

Pasch likened the maneuver to run a fake Democrat to the "d¡rty tricks" of the Nixon administration.

"Given how much taxpayer money will be wasted on this cynical ploy, Senator Darling's hypocrisy is stunning," Pasch said. "l guess her priority is saving

her political skin, not listening to her constituents who are frustrated by politicians who cut priorities like education and health care while giving away huge

tax breaks to corporations."

This whole thing of entering fake candidates is despicable and a slap in the face to the democratic process of elections; it really borders on being un-

American. Obviously Pasch will win lhe primary if entering a fake candidate is legal. And with how upset many people on the right are about this

Joe Peterlin - On the contrary... many Dems don't like the idea of a fake candidate on either side. I think this stinks less than running a fakeopposing candidate, but it still stinks. Period, ln the trade unions we negotiate a gross wage. The membership decides where the wages are assigned. The check,pension, health, trade promotion and training. Now we could get insurance cheaper but by belonging to a union our moral conscious demandedinsurance from a company that paid a living wage. The structure of most union construction companies was the field was union the office was not.The office was only too happy lo get a 401k and live with insurance benefits sub par to the field as long as they got it on the check. Now the officemakes 30% more than the field, and its the fields benefits that are too expensive. So much for saving.

MOUNT PLEASANT - Tamra Varebrook,43, of Racine, said she found recall petitions dated wrong, others not

signed, and a few signed by out-of-state residents. That was just in her first two and a half hours 'Wednesday at

the Racine County GOP Victory Center in Mount Pleasant, she said.

For two months, Democrats flocked to the streets to collect signatures to recall the governor and senators.

Wednesday local volunteers at 6211 Durand Ave. officially started the process of reviewing the approximately

24,000 signatures Democrats turned in last week to recall Sen. Van 'Wanggaard, R-Racine.

Democrats only need 15,353 valid signatures to hold a recall election and they have said without doubt they have

enough valid signatures. But Justin Phillips, Wanggaard's campaign manager who works out of the victorycenter, said reviewing the signatures is necessary to protect the integrity of the process.

In preparation of receiving copies of the petitions, Phillips said they trained approximately 200 volunteers to

review petitions and about 20 people were there Wednesday afternoon helping.

They were looking for signatures dated outside the window between Nov. 15 and Jan. 14,the first and last day

signatures could legally be collected. They were also checking to make sure no signatures are missing and

flagging petitions where all of the information appears to have been written by the same person.

Reid Magney, the Government Accountability Board spokesman, said all signatures need to have dates including

the year to be counted. Also, he said the person who signed the petition must have written in their own numerical

address and the day of the month as well as their signature. The person circulating the petition could not have

filled out that information, he said.

This week volunteers locally are conducting more of a surface review, where they ensure all information is there,

Phillips said. That includes name, date and address. In Madison, workers will more thoroughly review addresses

to verify voters live in district, he said. At this point, volunteers are only reviewing Wanggaard recall signatures

locally, Phillips said, he did not yet know the plan for the petitions to recall the governor and lieutenant governor.

In two and a half hours, Varebrook said she flagged about 100 signatures. Varebrook, a stay-at-home mom, said

the reason why she was helping verify signatures is: "Van is my senator. I voted for him and I don't want my vote

taken away."

Marge Orth, 63, of Caledonia, also had a page filled with notes about flagged petitions. On some of petitions, she

could tell the person that filled out the address was not the same as the person who dated the signature.

"The twos, they don't match," she said. She doesn't know if the signatures she flagged will be thrown out, but she

said, "You have to question it. We'll let the lawyers figure it out."

Judge extends recall verÍfïcation period

MADISON (AP) - A Madison judge has granted state election officials an additional 30 days to verify nearly 2

million signatures on recall petitions against Gov. Scott Walker and five other Republicans.

Democrats and their allies filed the recall signatures against'Walker, Lt. Gov. Rebecca Kleefisch and four GOP

senators, including state Sen. Van Wanggaard, R-Racine, with the state Government Accountability Board on Jan.

17. State law gives the board 31 days to verify the signatures' authenticity. The clock began ticking on Jan. 18.

But the board says it's been overwhelmed by the sheer volume of names and a Waukesha County judge's order

calling for the board to ferret out fictitious names and duplicate signatures.

Dane County Circuit Judge Richard Niess says the board faces an unprecedented task and deserves more time to

do its work.

The judge's decision extends the review deadline into March.

At Jim's Radiator Service in Antigo, owner Jim Buckleyremembers the recall process.

"l was out there in the cold weather, snowing, freezing,getting signatures," said Jim Buckley, a Kim Simacsupporter.

He has backed Kim Simac from the beginning

"When we elect a Senator, we expect them to work for all

the people, not just a select few," said Buckley.

"As you can see, we support Jim Holperin," said DwainePackard, a Jim Holperin supporter.
