Our Goal
• Bring representatives from medical waste community together for participation in the rulemaking process.

House Bill (HB) 2244
• Filed by State Rep. Zerwas - 84th Legislature
• Signed by the Governor -June 10, 2015 and effective immediately
• Section 5 - No later than June 1, 2016, the TCEQ shall adopt rules
to implement the changes made by this Act. The rules must be
adopted in the form of a new chapter of the Texas
Administrative Code that includes all rules of the commission
relating to medical waste regulation.
• Also states that rules adopted to implement the change must
minimize the effect on other rules regulating municipal solid waste
facilities.

Scope of HB 2244
Requires:• Extracting rules from Ch. 330 regarding:
water pollution control and water quality aspects; air pollution control and ambient air quality aspects; and the protection of human health and safety as they relate to
medical waste
• Adopting rules relating to Ch. 330, Subchapter E and other portions that apply to medical waste facilities, such as: buffer zones storage times, and container labeling requirements

• The new rules must address: procedural requirements for applications site development notice duration and limits for authorizations
• Existing authorizations not required to comply unless they choose to modify and/or seek new authorization
