MTNL Executive’s Association
General Secretary’s Report
Good Evening & Warm Welcome to everyone present here this
evening.
Dear friends,
It is a matter of great pleasure to welcome you all in this 1st
AIC of our beloved organization the “MEA” as it is known
among all of us.
MEA was founded in Delhi and Mumbai with the objective of
safeguarding the interests and aspirations of executives
working here in MTNL and now it is more than a decade
older.
Here in MEA, we had been working with full coordination and
synergy during this period under the umbrella of a CHQ Apex
Body. We, the MEA are undisputable protagonist of vitality,
energy, enthusiasm and vibrancy in MTNL for the welfare of
executives and well being of the company. MEA is the
strongest Association in MTNL representing executives of all
streams namely the Telecom, Civil, Electrical, Finance, HR,
Marketing, Legal, Official Language and Personal Staff. It is
the only Association of MTNL which is affiliated to National
Confederation of Officers’ Associations of Central CPSUs. Its
achievements are unparallel. Frankly speaking, all the
settlements of issues pertaining to executives in MTNL right
from CDA to IDA scale conversion with E2 and onward pay
scales to time bound promotion policy to implementation of
2nd pay revision with 30% fitment and all other issues are the
outcome of honest, genuine, candid, sincere and persistent
efforts of MEA.
Now, with aim to enhance organizational efficiency and
effectiveness, we have decided to form two circles in Delhi
and Mumbai with unified CHQ body at central level. By this
restructuring, the strength of MEA will increase manifold,
and its strength and potency will outperform the
expectations and imagination of everyone inside and outside
the MTNL. I specially thank Com S. N. Prasad, the CHQ
President, whose intellect, sincerity, sense of unity, and
marvelous mellowness of trade union consciences has made
it possible to form Circle bodies at Delhi and Mumbai, and
also to conduct the unified CHQ Conference of MEA here in
New Delhi. I also extend my sincere thanks and gratitude to
the office bearers of MEA Delhi and Mumbai, and all the rank
and file who always stood with the MEA to fight against
injustice and unfairness through full support and confidence
in the Association, which made us to feel an empowered
force of MTNL thus enabling many marvelous and incredible
achievements. It is very tiring to pen the feats and
achievements of MEA in any brief and transitory report. I
made a little effort in last conference of MEA Delhi in Nov
2010 to mention some vital issues and activities of MEA in
preceding one decade since its foundation in the Year 2000.
Now also, I solicit your benign appreciation to place a brief
account of some of the developments during the intervening
period.
Recapitulation of some of the significant
achievements of MEA in the past—
E2 to E7 pay scales to executives : It had been
possible because of inexorable struggle,
appropriate legal actions, farsightedness and well-
founded determination of MEA and TEOA(I)- It was
the exclusive achievement of MEA.
Time bound financial up gradation up to E7
had also attained because of MEA’s and SNEA (I)’s
persistent efforts and struggle. The time bound
financial up gradation right upto E7 had been
possible against the MTNL & BSNL Managements’
decision of time bound financial up gradation upto
E4 only but after strong struggle and persistent
persuasion in the DOT by the General Secretary,
MEA along with GS, SNEA(I) for one and half years.
It was exclusive achievement of MEA & SNEA (I)
50% IDA merger—Merger of 50% IDA was not
provided for in the recommendations of PSU pay
revision policies. Decision of 50% IDA merger in
CPSUs could be possible because of consistent
struggle and persuasion of MEA in close
coordination with NCOA, in this struggle, MEA was
the front runner and the leading force.
Implementation of 2nd pay revision with 30%
fitment---Being the conscious defender of
executive’s rights in MTNL, MEA submitted a
detailed memorandum to the 2nd Pay Revision
Committee and we were the only association called
by the committee for face to face deliberation.
The 2nd pay revision committee of CPSUs headed by
Justice M. J. Rao, recommended only 20% fitment
for MTNL. It was opposed by MEA through NCOA,
and ultimately uniform 30% fitment was ordered by
Govt of India for all CPSUs subject to affordability of
the individual CPSU. MEA along with TEAM had a
united and robust struggle to oppose the MTNL
Management decision of 5% fitment with HRA
capping.
Truly speaking, the 30% fitment without HRA
capping was the exceptional and exclusive
achievement of MEA. It was because of the impact
created by MEA through non co- operation which
compelled the management to withdraw 5% fitment
and HRA capping orders. The fear of reoccurrence
of such impact and effective persuasion by MEA,
made MTNL management to consider the legitimate
right of executives of 30% fitment without HRA
capping. It is exclusive achievement of MEA to get
30% from Govt and implement in MTNL.
Protection of increment earned during
officiating at the time of financial up
gradation or regular promotion---
After a long persuasion of the MEA, this issue was
also resolved and clarification on the subject was
issued by corporate office.
Time Bound Vertical Promotion as per
CPSU hierarchy: ---
MEA is of firm opinion that post-based functional
promotion policy can not remove the stagnation in the
promotions of the executives. So, it cannot give
satisfaction and motivation to all the executives. For
this purpose, a vertical time bound movement is
required, which can be achieved through time bound
functional promotions only. MEA is the only
Association which has given proposals and has made
many round of discussion in the recent period on this
issue with the confidence that the issue will be
resolved in the days to come.
Regular promotions in different cadres of
executives:-
JTO (T) to SDE(T)--- It is the MEA only, which has
been pursuing and getting regular DPCs conducted
against SCF quota for promotion from JTO (T) to
SDE(T) on regular basis. Competitive quota was kept
unfilled by MTNL management since 2002 with the
intension to abolish these posts. Neither it was filled
up through LICE nor converted in SCF quota in last ten
years. Now, after strong persuasion in 2012 by the
MEA, the process of filling all the unfilled posts of SDE
was started and SCF promotion orders against 468
vacancies were issued in recent past. Side by side the
LICE against competitive quota have also been
notified against 232 posts. LICE are likely to be held
shortly. Promotion orders of ST candidates were not
issued in these orders because of some court case on
gradation list of Mumbai, but when MEA took up this
case, management has started the process to issue
the regular promotion of these left out ST candidates.
With this development almost all JTOs of 1994 year of
recruitment of General category and 1997 year of
recruitment of SC category and current in ST category
have been promoted in these promotion orders except
14 JTOs of 1994 year of recruitment.
Regular Promotions from JTO(T)/AM(T) to
SDE(T)/DM(T) against upto date resultant
vacancies- Association has again taken up the case
of promoting left out cases of JTO’s of 1994
recruitment year also of the subsequent years, by
conducting DPC against resultant vacancies as on
date. Management has assured to call for ACRs in
month of Dec, 12 and hold the DPC in Jan, 13.
Promotion of left out ST candidates in JTO
(T) to SDE (T) --- We have took up with the
management, the case of JTOs of ST category of
recruitment years of 2003 & 05, who were eligible but
could not be promoted in recently issued promotion
orders, while ST quota still remaining unfilled. After
our persuasion, screening/vig reports have been called
for of the left out candidates from both the units. Delhi
unit have sent the report and report from Mumbai unit
is awaited. After getting report from both the units,
promotion orders will be issued.
JTO (C) to SDE(C) and JTO (E) to SDE (E) ---
We have astonishing achievement in this matter by
getting promotions on all the available vacancies.
After long persuasion of MEA, regular promotion
orders of remaining 8 JTOs Civil were also issued this
year.
SDE (T) to DE/Sr Manager----Ever since the
completion of absorption process in 2004, MEA have
been perusing for the single line orders to make all
adhoc DEs regular from the date of their absorption i.e
Oct 2000. However after long persuasion of this
Association first ever regular promotions in the cadre
of DE were issued by MTNL corporate Office in June
2009. Again due to our persistent efforts, 2nd DPC was
held in Nov 2011 for ----officers. Now, we have taken
up the issue for holding next regular DPC in the cadre
of DE. After our persuasion, Corporate Office has
started the process to fill up the approximately 118
post by calling of CRs of 250 Sr SDE/SDE.
SDE(Civil)/(Elect) to Sr Manager (XEN) We
have been constantly pursuing the issue of regular
promotion in XEN civil & Elect grade and have been
able to get regular promotions twice, the latest being
this year and all available posts in seniority quota
were filled up. Six Regular promotions are ordered in
Elect and Four in Civil recently.
As there is no proposal for DR in civil & Elect in E5
level, we are pursuing for filling up all vacancies
through SCF.
The only eligible XEN Elect and our esteemed member
have also been promoted as SE (Elect) very recently.
AO to CAO---
JAO to AO----
Sr Manager Recruitment Rules and court
case-----As per Sr Manager RR, 50% posts in Sr
Manager level in all streams are to be filled up through
seniority cum fitness and 50 % through competitive
exam ( 25% from internal candidates and 25% from
external candidates). MEA along with all executives’
Associations of MTNL and BSNL has been opposing
external recruitment at any other level of executives
and for age and qualification criteria for internal
candidates thereby never accepted external
recruitment provision in Sr Manager RRs and
challenged the external competitive exam for Sr
Manager in Principal Bench CAT, New Delhi. Case is
listed for final hearing on 14th December 2012. it is
because of MEA’s initiatives the age limit for internal
candidates has been increased from 40yrs to 55/50
years and qualification has been reduced from B Tech
to BSc, and B Tech Mechanical was also included in
the eligible qualification. All out efforts are being
made to benefit the internal candidates in real sense;
we are sincere in our efforts and frank in approach.
While others are simply doing gimmicks to misguide
the officers.
Relaxation in eligible condition to become the
regular/adhoc DGM---When Ist regular DPC in the
cadre of DE was held and date of effect of regular
promotion was given June 2009, then MEA debated
and argued with the Dir (HR) that no promotee officer
will become eligible for promotion to DGM on
regular /adhoc basis for next 4 years, and successfully
pleaded for relaxation in eligibility conditions, which
was principally agreed by Dir (HR). But, after our long
persuasion, one and half year relaxation was approved
by Board of Directors in 2012. A list of adhoc
promotion to DGM is pending in the corporate office
because of certain court case. Association is making
efforts for issuance of regular promotion orders in the
DGM cadre.
Employees Suggestion Scheme:- With the
objective of providing constructive and participative
environment to the employees in particular the
executives, MEA have been raising for last so many
years and at all available opportunities with the
management that an employee’s Suggestion Scheme
be implemented in MTNL so that employees can have
a formal platform where they suggest newer ideas for
improvement of services and working of the MTNL. In
this regards, Dir (HR) made an announcement in our
previous Delhi Conference in Nov 2010 for adopting
and implement this idea of MEA, which was
implemented in 2011. Now we can make formal
contribution under the “Employees Suggestion
Scheme” on link at MTNL’s as well as MEA’s website.
We look forward to see the statistics and audit of the
implementations of this suggestions received under
the scheme.
Pension from Govt as in BSNL:
Payment of pension by Govt has become our
legitimate right on the day when we joined the Govt
Job in DOT. Subsequent development of formation of
MTNL is the unilateral decision of Govt. And
subsequently transfer/ absorption of Govt staff in the
MTNL was with the visible assurance that pension and
family pension will be paid by Govt. Unfortunately for
last 12 years, we have been continuously fighting for
implementation of the assurance given by MTNL
Management/Govt, including assurance given by the
MOC in Parliament after strong agitation by MEA along
with TEOA (I) in 2002.
To strengthen the fight on this very penetrating,
sensitive and important issue, in the year 2010, we
took further initiative to form a united forum
comprising of all the Unions and Associations of MTNL
Delhi and Mumbai. MEA is the most important and
strongest constituent of this united forum has always
been leading all the joint programmes from the front.
After a strong agitation by UF, MTNL management
given the assurance that the issue of pension from
govt will be strongly taken up with
DOT/MOC&IT/Finance Ministry to get the early
settlement of the issue. On this assurance, agitation
programme was deferred. But, Hon’ble MOC & IT Shri
Kapil Sibal, on imprudent advise of DOT officers, gave
a proposal of parity of scale with BSNL to get pension
payment from Govt as in BSNL, which was conveyed
by DOT vide its letter NO.40-21/2001-Pen (T) dated
08-06-2011. This unpractical and unreasonable
proposal was rejected by all Unions and Associations
in the meeting with MTNL board on-----. Com S. N.
Prasad was also present in this meeting along with GS,
MEA.
In June 2012, DOT pressurized and coerced MTNL to
start the process formation of a trust for payment of
pension in MTNL. When it came to our knowledge, a
decision was taken to immediately protest to stop
formation of trust and pressurize MTNL/Govt to take
the decision of payment of pension by Govt in MTNL
as it is in BSNL. Demonstration and Dharna
programmes were organized in Delhi and Mumbai,
where participation of MEA member was supreme and
unprecedented. GS, MEA along with other constituents
of United Forum had series of meetings with MTNL
Management. Ultimately, agreements was reached
between MTNL management and United Forum on 23-
07-12 that MTNL will not initiate formation of trust and
convey this to the DOT, and will further pursue for
pension from Govt as in BSNL. For which an expert
committee will be constituted in corporate office,
which will consult with unions and Associations and
work out a clear road map of pension for submitting to
DOT/Govt for the approval and implementation of
pension for MTNL employees from consolidated Fund
of India on the same lines as that of BSNL. A
committee was constituted in the Chairmanship of Shri
Piyush Agarwal, ED Mumbai. This committee came out
with the same proposal of parity of scales with BSNL
to get pension from Govt as in BSNL. Again United
Forum did not agree with parity of scales and
reiterated its stand that pay scales can’t be the causal
and determining factor for deciding in granting the
Govt pension.
Now, we have come to know that MTNL and DOT are
exploring the possibilities of formation of single trust
for executives and non-executives of MTNL under Rule
-37 A in DOT. We have conveyed to Hon’ble MOC & IT,
Shri Kapil Sibal, Secretary DOT, Shri R. Chandrasekhar,
Member (Services) DOT, Shri S. C. Mishra, and MTNL
board…... Recently, GS, MEA along with a delegation
of MEA met personally to Member (Services) and CMD
MTNL and conveyed the feelings and resolute of
getting pension from Govt. and we will not leave any
stone unturned to get govt pension.
Friends, Be ready for the struggle on this issue
in the days to come
Meeting with MOC & IT, Shri Kapil Sibal-----
GS, MEA along with representatives of other Unions
and Associations met MOC & IT three times to discuss
pension issue. Every time he gave patient hearing and
assured to look into the matter. In the last meeting, he
stressed on parity of scales with BSNL to get pension
from Govt as in BSNL. We reiterated our position and
elucidated as to how it is not possible and pleaded for
pension from Govt with the MTNL scales of pay.
Meetings with Parliamentary Committee
on pension issue--- GS, MEA along with
representatives of other Unions and Associations
attended Parliamentary Ccommittee meeting on our
pension issue, which was also attended by Secretary
DOT, Member (Services), and the MTNL Board.
Chairman and members of Parliamentary Committee
supported our demand of pension from Govt as in the
BSNL.
Meeting with the then Hon’ble Minister of
Finance, Shri Pranab Mukherjee---
Meetings with Hon’ble Members of
Parliament on Pension Issue:-
GS, MEA along with representatives of other Unions
and Associations met following MPs to submit
Memorandum and seek their support to resolve our
pension issue-
Mrs Sushma Swaraj, BJP MP and the Leader
of opposition in Lok Sabha
Shri Bahubal Mishri, the Congress MP
Shri Oscar Fernandes, the Congress MP
Shri Prakash Javdekar, BKP MP and the BJP
Spokes Person
Revision of Pension of Combined ID
Pensioners/ Family Pensioners of MTNL:-
Revision of pension of retired employees with revision
of pay of serving employees is legitimate right of the
retired employees who get pension as per govt
pension scheme irrespective of source of payment of
pension. This was the strong and clear standpoint of
MEA right from very beginning when we took up this
case with Member (services) along with GS, TEAM
immediately after the proposal of revision of pension
in BSNL was sent to Cabinet by DOT. Later, this issue
was also included in United Forum agenda and MEA
strongly persuaded this demand of revision of pension
at all levels right from MTNL to DOT and to the
Minister of Communication & IT in all the meetings of
UF.
GS, MEA also met concerned officers in the DOT along
with GS of Retired TOWA to expedite this issue. We
also got this point included in recent agitation
programme.
Ultimately MTNL management issued the orders of
revision of pension on 01-10-2012 vide letter No.
MTNL/IRW/21 (119)/2004/317 in accordance with the
DOT letter No.40-36/2011-Pen (T) dated 11.07.2012.
It’s a great achievement which has paved the way for
further revision of pension in succeeding pay revisions
in future.
Exemption of TDS (Tax Deducted at
Source) on Leave encashment at the
time of retirement:-
Earned leave upto 300 days of government
employees on the date of superannuation
/retirement are fully exempted from income tax
under sub clause (i) of section 10 (10AA) of Income
Tax Act,1961. But this exemption is not allowed for
other than Govt employees including the CPSU
employees. In MTNL, income tax was being
deducted from leave encashment amount of total
earned leave at the time of retirement. We took up
for exemption of income tax on the leave earned
while in Govt and were at the credit of employees
on the date of absorption in MTNL vide our letter No
MEA/CHQ/DF dated 14-03-2011 & MEA/CHQ/DF
dated -----. GS, MEA had many round of discussion
with Dir (Fin) and other concerned officers in MTNL
Corporate Office. Ultimately, after our persistent
efforts and untiring persuasions, MTNL Corporate
Office decided that the amount of leave
encashment in respect of leave earned during the
period before absorption is eligible for full
exemption as per Section 10)10AA) (i) of Income
Tax Act, 1961 and conveyed to Delhi and Mumbai
units vide its Order No. 7-2/Tax/Misc/F.Y.2011-12
dated 29.08.2012. With this order, almost all the
employees will get benefit in lakhs at the
retirement.
All the decisions on this matter were taken on our
instance and persuasion. And it is also an exclusive
achievement of MEA.
Amendment in MTNL Leave Rules, 2001—
removing restriction of 120 days HPL:
After determined efforts and persuasions of MEA,
board of directors in its 282nd meeting held on 30th
June, 2012 approved deletion of clause No.5.3.1 (C) of
MTNL Leave rules, 2011 thereby removing the
restriction on availing of Commuted Leave to the
employees of MTNL governed by MTNL Leave rules.
Orders issued vide letter No. MTNL/CO/Dir (HR)/2006-
07/191 dated 23-08-2012. This is also one of the
big achievements of MEA. It is particularly
beneficial to new comers and the lady employees
(while availing maternity leave).
Pay anomaly cases:-
Many pay anomaly cases are pending in Corporate
Office/Delhi unit & Mumbai unit. These were the cases
of the nature which can not be settled under the given
FRSR, and required policy decision to be taken by
Corporate Office. MEA proposed to constitute pay
anomy committee at Corporate Office so that pending
cases can be decided expeditiously. After our
persuasions, Corporate Office has constituted a Pay
Anomaly Committee comprising of Jt GM (HR), DGM
(A/Cs) and CAO (IF), CO. MEA is pursuing the cases
with the committee.
NCOA (National Confederation of officers’
Associations of Central CPSUs) activities:
NGC (National General Council) of NCOA
was held in Bangalore on -dated—which was
attended by GS along with other CHQ office
bearers, Com R. K. Mudgal, Com Sunil Kumar,
and Com Satyavir Singh. In this NGC meeting,
GS, MEA was elected as Dy Secretary General of
NCOA.
Seminar in Institute of Public Enterprises,
Hyderabad—a seminar on “Pay Compensation
of CPSU Executives” was held in IPE, Osmania
University Hyderabad on dated-----. Secretary,
DPE and Dir (HR)’s and other senior officers of
50 CPSUs gave presentation on implementation
of 2nd Pay Revision and PRP. From MEA, GS MEA
gave Power Point Presentation on MTNLs
financial position and implementation of 2nd pay
revision. GS highlighted that MTNL has not
implemented fitment with 78.2 % IDA
neutralization and requested organizers to write
to Govt that implementation of basic
components of pay revision, i.e., Basic Pay, HRA
and fitment should not be linked with the
affordability of the CPSU rather it should be
mandatory for all CPSU to implement these
components regardless of affordability. Com
Sunil Kumar Dy GS also attended this seminar
along with GS, MEA. NCOA demanded next
pay revision w.e.f 01-10-2012 i.e. after 5
years; because 2nd pay revision committee
has not recommended any periodicity of
pay revision, instead left this issue open
ended with the view that pay can be
revised in view of the market conditions.
Coal Sector has made agreement with its
unions for pay revision in five years.
Meeting with Hon’ble Minister of Heavy
Industries & Public Enterprises, Shri Praful
Patel:
GS, MEA and OS Com R.K.Mudgal attended the
meeting with Hon’ble MOHI&PE along with
Secretary General, NCOA, Com Baby Thomas.
Issues like PRP, next pay revision w.e.f. 01-01-2012
and revival of sick units were discussed. GS, MEA
raised the issue of non implementation of 78.2%
IDA neutralization in MTNL on pretext of non-
affordability by the company. GS stressed in the
meeting that implementation of basic components
of pay revision should not be linked with the
affordability, because non-affordability of CPSUs is
basically because of mismanagement and the
wrong policies of Govt. MOHI&PE principally
agreed, but expressed inability to take decision and
asked to have detail discussion with Secretary & Jt
Secretary, DPE, Govt of India.
NEC in Shilong : GS along with Com
R.K.Mudgal attended Shilong NEC of NCOA, where
many issues including PRP, next pay revision and
revival of sick units and also pay revision in sick
units where pay revision could not be implemented
after 1992 were discussed and resolutions were
passed for taking up these issues with the Govt.
Meeting with Jt Secretary DPE: GS, MEA
along with GS, SNEA (I) Com K. Sabestin and
President NCOA Com . K. Ashok Rao met Jt
Secretary DPE on dated----and again met with Jt
Secretary DPE along with Secretary General NCOA
Com Baby Thomus on dated--- and discussed the
issue of next pay revision w.e.f. 01-01-2012, PRP,
revival of sick units and pay revision of sick units.
Finally, Govt has taken the decision of bring all
those CPSU which are still operating on 1992 pay
scales to the 1997 pay revision.
NEC Palghat : GS, MEA attended NEC of
NCOA meeting in Palghat, Karela on dated---
Recruitment Rules of Dy Manager (HR)/
Mktg/Legal/CS—
MTNL has recruited AM executives in several new streams
as (HR)/Mktg/Legal/CS, but no promotional channels are
made available to these young and talented officers, in
absence of any RR for next promotion to the post of Dy
Manager in these discipline. MEA has been regularly
raising this issue in corporate office with all concerned
officers’ right from DGM to CMD. Now, our efforts are
likely to bear fruits and we hope that RRs will be notified
shortly.
Improved pay scale to JTO (Civil & Elect)
ACP:-
JTOs (Civil & Elect), who were absorbed in MTNL with ACP
in the AE Scale under Govt, were deprived of improved
IDA pay scale of SDE(C) in MTNL under ACP Scheme in
Mumbai unit. We took up this case in MTNL Corporate
Office vigorously and after our persistent efforts, orders
are likely to be issued shortly.
Below bench mark cases:-
Bench marks of DPC were arbitrarily raised by
management on dated -----vide letter No----. We opposed
these new bench marks through JF of MTNL Executives
Associations. And now MEA is perusing this case with the
demand that DPCs in which CRs of the period before
December 2010, the date on which new bench marks
were notified, are to be considered, should be conducted
with old bench marks, and new bench marks be reviewed
in the light of the proposed new bench marks in BSNL by
management there. A list of dropped cases has been
provided to the Dir (HR), and matter has been discussed
with Dir (HR) and CMD many times. Both of them have
assured to look into the matter with a positive approach,
but issue is still unsettled.
This issue is critical to all of us and certainly not in the
overall interest of the company as well. When the issue is
still unresolved, now, we have to think of other available
options like organizational and legal actions to pursue this
issue. This will be one of the prime issues before us in
days to come.
Cancellation of unwarranted transfer of-- --
officers from Delhi to Mumbai: -
MTNL management arbitrarily transferred ---officers from
Delhi to Mumbai and was to transfer many officers from
Mumbai to Delhi in the name of non-performers. But, this
ill-gotten and preplanned victimization of officers was
strongly opposed organizationally by MEA through
demonstrations in all GM offices. Ultimately these
transfers were withdrawn and the process of transfers
from Mumbai to Delhi was also dropped. Had the
management been successful in implementing these
orders, it would have been regular practice in MTNL for
future to harass and victimize the officers.
Inter Circle Rotational Transfer Policy:-
Management deceitfully tried to form inter- circle
rotational transfer policy and even ordered several
transfers. MEA strongly opposed it, gave call for agitation
programme and immediately exterminated and stopped
the move of formation of such a policy which was
detrimental to all of us.
Joint Forum of MTNL/BSNL Unions &
Associations:-
With the broader objective to oppose perpetual deputation
of ITS officers, a Joint Forum of MTNL/BSNL Unions and
Associations was formed to press the demand of
repatriation of unabsorbed ITS officers from MTNL/BSNL
OR to take all absorbed and MTNL/BSNL recruited officers
and employees back to the DOT and keep them all in
MTNL/BSNL on deputation as is being proposed for ITS
officers to maintain the same status of all officers and
employees in MTNL/BSNL.
MEA is the important constituent of JF. GS along with Shri
R. K. Mudgal & Shri Sunil Kumar attended all meetings of
JF in Delhi, and played central and significant role in
deciding the demands and programmes of JF. MEA’s
members participated in remarkable number in 8th
November 2012 in the demonstration in Delhi and Mumbai
in large numbers and the rally to parliament in Delhi on
22nd November, 2012.
Meeting with MOC &IT: ---
A meeting on ITS issue was held with MoC & IT, Shri Kapil
Sibal on 30-10-12 in his chamber in Sanchar Bhawan at
New Delhi, which was also attended by Com S.N.Prasad,
CHQ President. MOC & IT listened patiently to the Joint
Forum representatives and assured to do the needful to
resolve the issue.
Meeting with MOS, Shri Milind Deora:—
GS, MEA along with GS, SNEA (I) & GS AIBSNLEA & GS,
TEAM attended meeting with Shri Milind Deora last year
on dated----to demand repatriation of ITS officers.
Meeting with Mrs-Karuparani Killi,MOC &IT-
All affiliates of JF including MEA met to Smt-Karuparani Killi
on 24-11-12 at her residence and apprised her about the
intricacies of ITS repatriation issue. She assured to further
discuss this matter with MOC &IT, Shri Kapil Sibal. Com
Sunil kumar, CS Delhi
Refund of BWA Spectrum Charges : It was only
MEA who took this issue up with Hon’ble Prime Minister
of India, Minister of Communication &IT, Secretary DOT
& the MTNL Management vide its letters No----. From
the very beginning, we have been raising the issue for
surrender of substandard and unutilized BWA spectrum
and refund of spectrum charges of Rs 4,554/- crore.
MTNL management has now surrendered the unutilized
spectrum and demanded refund of spectrum charges.
We have written to MoC &IT recently also to refund the
spectrum charges vide our letter no----. We have also
committed other Unions and Associations to get this
issue included in protest action notice of Joint Forum of
MTNL/BSNL Unions and Associations.
Redeployment of CWG equipment:
All our endeavors are for the welfare of members and
wellbeing of the company. We are here for this only, so
when it came to our notice that in the name of
redeployment of CWG equipment, management is going
to purchase additional equipment costing about Rs.200
Crore, immediately after gathering all relevant information
related to the issue, we wrote to CMD vide our letter No.
MEA/CHQ/CMD dated 12-06-12 not to allow this
unpromising additional purchase of Rs 200 Crore, because
the equipment’s which were proposed to be purchased
were not at all required. CMD asked the Chairman
Purchase Committee to hold discussion with MEA on this
matter. After exhaustive discussion with our delegation,
that purchase of about Rs. 200 Crore was called off. Our
active, sensible and pre-emptive move in this case had
saved sizable and substantial amount to the company. We
thanks and appreciate the exemplary initiative and
courage of our alert comrade Sh… in foreseeing this
issue.
Replacement of Officer’s CDMA service connections with
Dolphin connection—
-A large number of officers particularly in Delhi were
having CDMA service connections while ED Delhi was not
agreeing to replace these connections with dolphin
connections. GS took up the issue with CMD, who took
decision in ECM, and all CDMA connections were replaced
with Dolphin connections.
Child Care Leave:—
Keeping in view the hardship of particularly the newcomer
executives, MEA took up this case long back vide its letter
No.----,and had many discussions with Dir (HR) and Dir
(Fin). They did not agree on the basis that issue is still
unsettled in BSNL also and any decision in MTNL may
create problem in BSNL that may also be objected by
DOT. So let the issue be decided uniformly in both the
CPSUs. So, MEA ensured to get this issue included in
United Forum of MTNL Unions and Associations trade
union notice vide letter Nos---------. This was also the
agenda of BSNL United Forum. Now, Ultimately, Hon’ble
MoC & IT has announced to implement child care Leave in
MTNL & BSNL.
Regular Promotion of E2- Non- Technical
cadres-----
118 posts of E2 non-Technical Posts have been created
by Corporate Office in Delhi and Mumbai each for
promotion of NE-12 Non Executives. These E2 non-
technical cadres are now the member of MEA. Many of
them are working on these posts on officiating basis. We
have taken up their case and process has started to
promote them on regular basis.
Relation with MTNL Unions and
Associations:—
MEA is having very good and cordial relations with all the
Unions and Associations of MTNL. Whenever there is need
for combined efforts for any common issue related to
company’s financial viability or staff welfare, we always
come forward together for united fight on such issues.
MEA has always given importance to the settlement of
issues of its members over the Association’s individuality.
Relations with BSNL Unions and Associations:
—
MEA is having good relations with and patronage of all
Unions and Associations in BSNL also. For common issues
of MTNL and BSNL, we actively participate in all meetings
and decisions. We have been one of the leading forces of
all the Joint Agitation Programmes in Delhi and Mumbai. It
definitely imparts more strength to achieve our objectives.
Relation with SNEA (I):—
Our relation with SNEA (I) are excellent and we work
together with full synergy. MEA and SNEA (I) are like two
arms of a body. During the intervening period, GS, MEA
attended their AIC at Nandad, Maharashtra, National
Seminar, and inauguration function of SNEA Bhawan in
New Delhi. Countless meetings took place with GS and
President of SNEA on various issues related to financial
viability of companies and welfare issues of executives.
Relation with Retired Telecom Officers’
Welfare Association:-
MEA is having very good relationships with RTOWA also.
GS, MEA regularly attending their executive committee
meetings and Annual General Body meetings. Even we
took up many issues of retired officers along with them.
Simultaneously, Retired Officers also participating in large
numbers in our Joint Front & United Front Programmes.
Court Case to ban Demonstration and Dharna
within 200 meters of out gates of MTNL
offices in Delhi—
In 2005, Tish Hazari Court have passed a judgment “not to
hold demonstration and dharna with in 100 meters of out
gates of MTNL buildings and also the residences of CMD &
board of Directors in Delhi”. During our 30% fitment
struggle, MTNL management filed a contempt case
against, GS, MEA and GS, TEAM, which was withdrawn by
management after 4/5 hearings in Patiala House Court,
New Delhi. However a new case was filed to extend the
restriction of 100 meter to 200 meters. The case is still
going on and GS, MEA along with TEAM has appeared
about 10 times in Patiala house court. Matter is still
pending. Next date is 18th December 2012. We are
opposing the restriction prayed by MTNL management.
Organizational activities: -- GS has been attended
almost all the Divisional and Area General Body Meetings
and conducted several CEC meetings in Delhi. In Mumbai
also, GS along with other CHQ office bearers attended
foundation day of MEA, Circle Conference of Mumbai
Circle, CEC meetings of Mumbai. GS along with Com
S.N.Prasad, CHQ President, Com R.K.Mudgal, Wkg
President, Com J.J.Mathias AGS/CS & Com Sunil Kumar,
DGS/CS had innumerable meetings with CMD, other board
of Directors and concerned officers of HR wing to discuss
and settle the various issues related to MTNL financial
viability and welfare of the executives.
Concessional broad band connection to MTNL
employees--- We have taken up the issue for
concessional broad band connection to MTNL
employees, and also to other Govt/ PSU
employees. Issue is being pursued with the
concerned offices so that decision can be taken at
CMD level.
Implementation of pay fixation with 78.2%
IDA neutralization ---We have being raising and
fighting for this issue and are committed to get fixation
with 78.2% IDA neutralization instead of the existing
68.2% in MTNL, which we get from Govt after intense
struggle along with NCOA, Oil and Power sector
executive’s associations.
Increase in Perks and Allowances, and
Restoration of withheld Advances, LTC etc----
We have raised these issues individually as well as jointly
with other Unions and Associations. We will continue to
fight and pursue for the settlement of these issues.
Employees’ Medical Scheme— We have experienced that
Employees Medical Scheme through our own company was better than
through the Insurance Company. We have opposed the employees
Medical Scheme through the insurance company along with other Unions
and Associations, and will fight in the days to come to get back to MTNL
Medical Scheme.
Pro-rata-Pension Option date---In 2011, MTNL management had
taken a decision to close the pro-rata pension option date. MEA took up the
case not to close the pro-rata pension option date till the final settlement of
pension issue by Govt. On the basis of letter written by Director, DOT to
GS, MEA conveying the status of pension issue with the mention that issue
of pension in MTNL by Govt as is in BSNL is under consideration of Group
of Secretaries, MTNL management extended the last date of pro-rata
pension option. But, when CCA, Mumbai challenged the authority of MTNL
to extend the date, issue was referred to DOT, which asked MTNL
management not to extend the date without the approval of DOT. We have
written to MTNL management to further extend the date till the final
settlement of pension issue. MTNL management has written to DOT
attaching our letter for further action. We are committed to get the option of
pro-rata pension as and when final decision on pension issue is taken by the
Govt.
Employees / Officers’ VRS: -- We are not against VRS, but our stand
is clear that expenditure for VRS is to be born by Govt and not by MTNL.
MTNL management have put up its demand of Rs. 3,600 Crore to DOT for
meeting VRS expenditure in different cadres with an aim to reduce staff cost
which has gone up to 80% of its revenue.
Dear friends, because of limitation of time, it is not possible
to mention each and every issue and activity of Association
in this brief report, so I conclude this report with few words
that it is continuous and incessant process of Association to
fight and pursue for the resolution of many important issues
related to survival of company and welfare of the Executives.
We have come a long way in MTNL, fighting for the health of
the company and legitimate rights of the officers. We have
done a lot and lot is still required to be done. We have a
tough challenge before us to save MTNL, for which a
dynamic and forceful officers’ Association is inevitable No
doubt MEA is the one, but still we require further
strengthening of our beloved Association to get our voice
heard with full force at the highest level in the Govt.
I can’t forget to extend my sincere gratitude to Com S. N.
Prasad, Com R. K. Mudgal. Com Sunil Kumar, Com J. J.
Mathias, Com Satyavir Singh & Com Arun Dixit without
whom, it has not been possible for me to run this great
organization and get many issues resolved to the
satisfaction of our esteemed members. I also extend my
sincere thanks and gratitude to all of you and through you to
all rank and file of this great organization for the
cooperation, support and faith which shown in your
representatives at Central Head Quarters. I have full
confidence that the set of new representatives, who are
going to be elected in this conference, will be able to take
this organization to its glorious heights and get all pending
issues settled to the satisfaction of members.
