• DSCA. Support provided by the U.S. Federal military forces, DoD civilians, DoD contract personnel, DoD component assets, and National Guard forces (when the Secretary of Defense, in coordination with the Governors of the affected states, elects and requests to use those forces in title 32, U.S.C., status) in response to requests for assistance from civil authorities for domestic emergencies, law enforcement support, and other domestic activities, or from qualifying entities for special events. Also known as civil support.

Immediate Response Authority

Federal Military commanders, heads of DoD Components, and/or responsible DoD officials may provide an immediate response by temporarily employing the resources under their control, subject to any supplemental direction provided by higher headquarters, and provide those resources to save lives, prevent human suffering, or mitigate great property damage within the United States.”

• Legality: What is the legal authority that permits or prohibits the assistance requested by civil authorities? If generally prohibited, are there any exceptions?

• Lethality: Is there any potential for the use of lethal force by or against DoD forces? If yes, has the Secretary of Defense (SecDef) approved the carrying of weapons? If yes, has the Combatant Commander issued an arming level policy? Will the Standing Rules for the Use of Force (SRUF) be sufficient or does a commander need to submit supplemental Rules for the Use of Force (RUF) to the SecDef for his approval?

Cost: How much will the assistance cost? Who is going to pay or reimburse DoD?

• Risk: What are the potential health (communicable disease, chemical/biological agents) and safety (weather, terrain, environmental) risks to DoD forces?

• Appropriateness: Who normally performs and is best suited to satisfy the request? Can and should the support be provided by commercial enterprise? Is it appropriate to spend DoD dollars on this request under 31 USC §1301? Is DoD the best option?

• Readiness: Will the assistance have an adverse impact on the unit‘s deployment/training/readiness/primary mission?

Exercising Immediate Response Authority

• Immediate action is required and time does not permit obtaining approval from a higher headquarters (SecDef or ASD (HD/ASA)).

• Must notify the National Joint Operations and Intelligence Center (NJOIC), through the chain of command, of the details of the response.

• Request for assistance from civil authority; e.g.. mayor, chief of police, fire chief, sheriff, or emergency manager.

• ONLY assistance to save lives, prevent human suffering, or mitigate great property damage. No law enforcement activities are authorized.

• No DoD unmanned aircraft systems (UAS) will be used for DSCA operations unless expressly approved by the SecDef.

• DoD official must “reassess” whether DoD forces are still needed NLT 72 hrs after receipt of the initial request for assistance
