MEMORANDUM CIRCULAR

NO. 01-01-84SUBJECT:GUIDELINES FOR THE REGISTRATION OF AMATEUR CLUBS AND FORMATION OF AN INTERIM AMATEUR RADIO ADVISORY COUNCIL.

1. Basis:

Circular No. 82-007 promulgated by the Ministry of Transportation and Communications on 20 October 1982.

11. Purpose:

1.0 To attain the declared policy for a systematic accreditation of all amateur radio clubs in the country.

2.0 To hasten the selection of a national amateur radio organization with the end in view of effectively coordinating all amateur activities to foster harmony and cordial relations among all members for the promotion of the objectives of amateurism along the policy thrusts and national goals of the government.

111. General Mechanics:

1.0 The Council

1.10 There is hereby created an Interim Amateur Radio Advisory Council which shall hereinafter be known as the Council and shall exercise the following duties:

1.11 To advise the Commission in the formulation of policies and programs affecting the radio amateurs.

1.12 To submit recommendations to the Commission on the effective implementation and/or enforcement of the amateur radio regulations and guidelines.

1.13 To select and indorse to the Commission an amateur radio organization which shall be recognized and accredited by the Commission as the National Amateur Radio Organization, not later than May 30, 1984.

1.14 To recommend to the Commission the appropriate accreditation or withdrawal of accreditation of District Clubs.

1.15 To exercise such other duties as the Commission shall prescribed.

1.16 The Council shall prescribe the rules and regulations in the conduct of its affairs subject to the approval of the Commission.

1.20 Composition of the Council

Every amateur District shall be entitled to a representative who shall be designated by the Commission as member of the council. The number of representatives so designated from the nine (9) Districts shall constitute the Council; provided, however, that the Presidents of the Philippine Amateur Radio Association (PARA) and the Philippine Chamber of Amateur Radio Societies (PCARS) shall be entitled to a membership each in the council.

1.30Membership to the Council

In each of the nine-(9) amateur radio districts which shall hereinafter be known as the Districts, there shall be a district amateur radio club, hereinafter to be known as the District Club, that shall be entitled to one member in the council. However, no District Club shall be entitled to a seat in the Council unless it has been duly registered and accredited as such by the Commission on or before February 15, 1984 and shall have previously complied with the provisions of paragraph 2.2 and 2.4 of Section 2 hereof.

1.40 Term of the Council

The Council shall act as the interim council from March 01, 1984 to June 30, 1984. The term of the Council however may be extended by the Commission as the circumstances my warrant.

2.0 The District Club

2.10 Organization of District Club

2.11 In the District where, at the time of the effectivity of this Circular, their exist various amateur radio clubs from different localities which have been registered and/or accredited with the Commission on or before February 15, 1984, a District Club shall be selected and organized, with other local clubs as affiliate member clubs. The District Club shall inform in writing the Commission accordingly and submit the endorsement of the other local clubs, not later than February 15, 1984.

2.12 Whenever in a District at the time of the effectivity of this circular, there is only one existing amateur radio club and duly registered with the Commission on or before February 15, 1984 to which all or majority of the licensed radio amateurs in the different localities in the District Club if it manifests in writing on or before February 15, 1984 to the Commission its desire to be accredited as such. This shall be without prejudice, however to the subsequent formation and/or organization of the local clubs, which should, however be affiliated to the District Club.

2.20 Requirements for Accreditation as District Club

2.21 Written request for accreditation as a District Club.

2.22 Endorsement as District Club by majority of local clubs in the District.

2.30 Duties

The officers of the District Club shall compose the District Amateur Radio Advisory Council and shall perform the duties as may be prescribed from time to time, by the Commission.

2.40 Disqualification; Withdrawal Accreditation

No District Club shall be entitled to accreditation as such and be entitled to a representative member in the Council whenever it is shown:

2.41 That it unjustly refuse s the affiliation of a duly registered local club, or

2.42 That it has committed gross negligence or willful violation of the Rules and Regulations and Circulars governing the radio amateurs.

Any of the above causes shall also be a sufficient ground for the suspension or revocation of an accreditation already issued to a District Club.

3.0 The Local Club

3.10 Definition

Local Club shall mean any amateur radio club in a District that is duly registered with the Securities and Exchange Commission with a regular membership of at least 25 licensed radio amateurs and properly registered as such by the Commission.

3.20 Affiliation

Every local club shall affiliate with the District Club without unnecessary delay.

3.30 Requirements for Registration of Local Amateur Clubs

3.31 Copies of Incorporation paper and certificate of registration with the Securities and Exchange Commission.

3.32 List of Board Members and Officers.

3.33 List of Membership.

3.34 Certificate of Affiliation with a District Club.

IV. Fees

1.0 The following shall be charged by the Commission:

1.1For accreditation of a District Club

P 300.00

1.3 1.2For registration of a local club

P 200.00

1.4 For any protest or complaint filed with

the Commission

P 300.00

V. Common Provisions

1.0 The provisions hereof shall be constued liberally. In interpreting any provision hereof, that interpretation which shall be in consonance with the Revised Amateur Radio Regulations and any Circular promulgated thereunder for its more effective implementation shall be adopted.

2.0 The withdrawal or cancellation of any accreditation or registration issued to a District or Local Club shall be impose as a consequence of any violation of the provisions hereof, after due notice and hearing have been made by the Commission.

3.0 Any provision of existing Circulars issued by the Commission effecting the Amateurs which is in conflict hereof is deemed amended, modified or repealed accordingly.

VI. Effectivity

This Circular shall take effect immediately.
