Girl Scout Week
WHEREAS, the movement now known as Girl Scouts began in 1912 when Juliette Gordon Low
gathered 18 girls in Savannah, Georgia. Juliette Gordon Low envisioned an organization that would
prepare all girls, regardless 0f their class, cultural or ethnic backgrounds, to be leaders in their
communities; and
WHEREAS, Girl Scouts was founded by Juliette Gordon Low whose life mission was to build girls of
courage, confidence, and character and through her legacy continues to have an extraordinary
influence on the lives of millions of girls across the country; and
WHEREAS, Girl Scouts is recognized as a national leader in providing the best leadership development
experience in the world for girls. lt brings time-tested methods and research backed programs that
speak to the strengths of girl leadership development, backed by more than 100 years of experience
and expertise in the field; and
WHEREAS, Girl Scouts offers a Girl Scout Leadership Experience that encourages girls to develop a
strong sense of self, connect to their communities, locally and globally, and feel empowered to make a
difference in the world. Girl Scouts offers hand—on, girl—Ied, girI-centered learning in STEM, the
outdoors and entrepreneurship, and abundant opportunities to develop invaluable life skills, helping
all girls take the lead early and often; and
WHEREAS, the Girl Scout Gold Award, the highest honor a Girl Scout can earn, acknowledges each
recipient’s power and dedication to not only bettering herself, but to making the world a better place
for others; and
WHEREAS, more than 59 million American women are Girl Scout alumnae and 2.6 million girls and
adult volunteers are active member. Today there are 2,065 Girl Scout members in Cherokee County.
NOW, THEREFORE, BE IT RESOLVED that l, Donnie Henriques, Mayor of the City of Woodstock,
Georgia, do hereby applaud the Girl Scout Movement and recognize the week of March 10, 2019 as
Girl Scout Week in the City of Woodstock, in celebration and recognition of the girI—led, a|| girl space
where girls thrive and develop their talents and leadership skills.

forest and, 25,173 acres in farms,- and
Whereas, American’s farmers and ranchers help feed the world, fuel our
Nation’s economy, and lead global markets in output and productivity. Today
the average U.S. farmer feeds 155 people. ln 1960, a farmer fed just 26 people;
and
Whereas, the agriculture sector of the United States is endlessly innovative. It
continuously builds on its centuries of progress through advances in science,
research, technology, safety, production, and marketing to meet the demands of
changing consumer needs and complex world markets; and
Whereas, the agriculture sector provides jobs across our Nation, not just for
farmers and ranchers, but for foresters, scientists, processors, shippers,
firefighters, police and retailers. American agriculture is the largest positive
contributor to our Nation’s net trade balance; and
Whereas, American farmers and ranchers are the heart and soul of America and
they represent the determined, self—reliant character of our nation. We are
proud of American agriculture and we recognize agriculture’s critical role to our
Nation’s bright future.
Now, Therefore, Be It Resolved, the Mayor and Council of the City of
Woodstock, Georgia do hereby proclaim March 22, 2019 as National Agriculture
Day. We encourage all the citizens of Woodstock to observe this day by
recognizing the preeminent role that agriculture plays in American’s daily life,
acknowledging agriculture’s continuing importance to our country’s economy.

MILITARY BANNER PROGRAM
The City of Woodstock and American Legion Post 316 are currently accepting
applications for Woodstock's Military Banner Program. Orders for this year's Memorial
Day will be accepted until May 1. The banners will be on display 1 week before
Memorial Day and taken down 1 week after Memorial Day. Banners will be placed out
again for Veterans Day.

Surplus of Three Handheld GPS Devices
Presented by: Katy Leggett
Summary:
GIS is requesting the surplus of 3 obsolete handheld mapping-grade GPS devices that were
purchased in 2006, and have been out of service since 2015. The devices are running Windows
CE, which is considered "end of life" by Microsoft Support. Thanks to the advancement of smart
phone technology, these handhelds will not need to be replaced. 2 of 3 devices are in working
condition with all supplemental accessories (batteries, cords, cases, etc) and will be going to
auction.

Subject: Inclement Weather Policy
Policy No.: 500-0005
Effective Date: March 11, 2019
PURPOSE:
To establish uniform standards which govern attendance when adverse weather conditions exist.
I. POLICY
It is the policy of the City that all offices will remain open and all operations continue functioning unless
the City experiences serious inclement weather that renders travel hazardous and unduly exposes
employees to the risk of injury.
Essential personnel, that being those employees designated by management as required to provide
emergency services, must be on the job irrespective of weather conditions. Essential personnel should
make arrangements with their Department Head for alternative transportation if they have reason to
believe they will be unable to travel to work in their personal vehicle.
If during a normal work day, weather conditions deteriorate to the point it is deemed hazardous, the City
Manager may call for skeleton crews for the remainder of that day. Each Department Head may use his
own judgment as to which employees should remain as the skeleton crew. Pay will continue until normal
closing time for personnel excused.*
In the event the City Manager does not call for skeleton crews, a Department Head may approve a request
by an employee who is not required to perform emergency services, to be excused for weather-related
reasons. Time off will be charged to vacation or compensatory time.
It is recognized that snow or ice accumulation on occasion renders certain state, county and/or city streets
very hazardous or impassable. In the event an employee who is not required for essential services is
unable to report to work due to weather conditions, time off will be charged to vacation, compensatory
time or the employee’s personal holiday.
*In the event the City Manager calls for a delayed opening or closes Administrative Offices early due to
inclement weather and/or hazardous road conditions, it is understood that non-essential personnel may
only be paid for the hours needed to obtain their normal work week. No overtime will be calculated
based on those hours that were not physically worked.
• All full-time employees will be paid such weather-related time off as Admin Leave. An
employee that has already requested PTO for a day when the City closes due to weather
is not eligible for Admin Leave.
• Permanent part-time employees will only be paid if normally scheduled to work that day
and only for those hours which the employee would normally work.
• Interns, Seasonal and part-time temporary employees do not receive Admin Leave pay
for weather-related closings.

• Sitting or standing in/on aisle ways, stairs, and walls.
• Helium filled balloons.
• Large shade/patio umbrellas or handheld umbrellas during the show.
• Smoking, vaping or use of tobacco products, illegal drugs.
• Laser pointers or recording devices, bullhorns, or noisemakers.
• Fireworks, confetti, flying objects such as, but not limited to, projectiles, beach balls, Frisbees.
• No Pets, Service Animals Only.
• Skateboards, bikes, or inline skates.
• Personal property that is a potential hazard to others.
• Fires, open flames, charcoal/gas barbecue grills, fuel powered lanterns, camping and “tailgating”.
• Littering, Gambling, Loitering, Picketing or Soliciting.
• Anything that detracts from the entertainment value of the event to other participants.
• Pamphlets, inserts, advertising matter, political handbills or the like.

71. Early Chair Placement – Woodstock Summer Concert Series and Other Events
a. Woodstock Summer Concert Series - Chairs are not allowed to be put out in the park until after 5 pm on
the Thursday before the concert. If any chairs are placed in the park earlier than that, the chairs will be
removed and placed in a non-secure holding area on site until Monday morning at 8 am at which time
they will be determined to be abandoned and will be discarded.
b. Other Events – At the discretion of the Amphitheater Operations Manager, a similar early chair placement
requirement may be made of a rental event if determined that is necessary. Gated/ticketed events will
have no early chair placement.
72. Violations of Guest Rules and Regulations
a. Failure to abide by or violations of rules and policies may result in termination/cancellation
of event or rental contract, eviction from the premises and loss of future rental privileges.
b. The City of Woodstock reserves the right to refuse any group the privilege of using the Amphitheater
due to abuse of the policies of the facility. In addition, any group charged with an occurrence of abuse
may be barred from making any further reservations and any future reservations may be cancelled in
the sole discretion of the City.
c. Failure to cooperate with Amphitheater staff, who are enforcing the policies of the City of Woodstock
and acting in the performance of their duties, could cause the event to be cancelled and the right to
use the facility forfeited without refund.
d. Anyone found abusing, destroying or removing City property could be barred from the premises.
e. These rules and regulations are enforced by the Woodstock Police Department.

The purpose of this study will be to determine the approximate size and location of one or more underground detention facilities necessary to accommodate the City of Woodstock development requirements. The proposed conditions will be based on the concept site plan provided by the Client.
The following scope of services is proposed:
1. Research existing conditions data including development plans for the Woodstock Downtown development. 2. Evaluate the existing conditions survey to determine the existing stormwater flow characteristics such as
discharge points and peak flow rates at those discharge points. 3. Review the design plans and hydrology report for the Woodstock Downtown development to determine how
much capacity in the downstream system was designated for the subject property. 4. Evaluate the concept development plan to determine where one or more stormwater detention facilities may
be placed. The type of facility or facilities will be recommended such as concrete vault(s), chamber system or series of oversized pipes.
5. Prepare a computer simulation model of stormwater flows through the proposed detention facilities and size according to the City of Woodstock development criteria. Water Quality (WQ) requirements will be considered in the selection and sizing of the stormwater facilities.
6. Prepare letter report and indicate stormwater facility locations on the concept site plan.
Understandings and assumptions:
The site will discharge stormwater into at least two separate drainage pipe systems. The stormwater detention facilities will be sized such that the post-developed discharge rates will not exceed the existing discharge rates.
The deliverable will be preliminary in nature. The approximate top and bottom elevations of each facility will be indicated to determine if it can be reasonably placed to accommodate the proposed grading scheme. The proposed drainage basins that indicate the areas required to drain to each detention facility will be delineated and shown on the concept plan. This scope does not include construction details of the detention facilities, outlet control structures or pipe systems.
A letter report will be provided summarizing the work that was completed and a summary of results. The deliverable will also include a sketch of the proposed detention facilities placed on the current site plan.
Any meetings regarding this scope of services or deliverables will be attended on an hourly basis.
Revisions to accommodate site plan modifications are not included.

TASK 2 – TRUCK PATH ANALYSIS
Use AutoTurn software to simulate the anticipated movement paths of a typical delivery truck. The software will determine wheel paths when making turn maneuvers necessary to access designated locations. The deliverable will include a pdf drawing showing the site plan and vehicle paths. The Client shall designate the vehicle size to be used in the analysis.
Any site plan adjustments necessary to accommodate inadequate space for vehicle turns is not included in this scope. Up to two site plan adjustments are included in this scope.

It is anticipated that additional engineering related services will be needed to assist with preparing the concept plan. Concept planning services will be performed on an hourly basis or agreed lump sum amount prior to performing work. 1. PAYMENT OF CONSULTANT. Monthly invoices will be issued by CONSULTANT for all work performed under the terms of this AGREEMENT. Invoices are due and payable upon receipt. The CLIENT who signs this agreement will be solely responsible for full payment. The CONSULTANT will not be responsible for collecting payment from multiple parties or anyone other than the CLIENT represented herein. In addition to any other remedies CONSULTANT may have, CONSULTANT shall have the absolute right to cease performing any basic or additional services in the event payment has not been made, without any liability to CLIENT, pending payment of CLIENT’s outstanding indebtedness. An interest charge of two percent per month will be added to invoices not paid within sixty days.
2. STANDARD OF CARE FOR CONSULTANT. CONSULTANT shall furnish services in a manner consistent with industry standards and to the level of professional skill generally acceptable in the industry with regard to services of this kind.
3. LIMITATION OF LIABILITY. The owner agrees to limit the CONSULTANT’s liability to the owner for any cause of action or combination of causes, whether arising out of claims based upon contract, warranty, negligence, errors and omissions, strict liability or otherwise, is in the aggregate, limited to $25,000, the CONSULTANT’s total fee for the services rendered on this project (whichever is greater) or other amount agreed upon when added under Special Conditions.
4. LEGAL EXPENSES. In the event legal action is brought by CLIENT or CONSULTANT against the other to enforce any of the obligations hereunder or arising out of any dispute concerning the terms and conditions hereby created, the losing party shall pay the prevailing party its reasonable amounts for attorney's fees, costs and expenses incurred as a result of that action.
5. PROJECT TIME. Should completion of the services be delayed for cause(s) beyond CONSULTANT’s responsible control, including, but not limited to, force majeure and rain delays, the time for performance shall be extended for a period at least equal to the delay and the parties will mutually agree on the terms and conditions upon which the services may be continued.
6. PROJECT DELAYS. The CONSULTANT will provide services in a timely manner, but it is agreed between the parties to this AGREEMENT that the CONSULTANT cannot be responsible for delays occasioned by factors beyond CONSULTANT’s control, nor by factors which could not reasonably have been foreseen at the time this AGREEMENT was prepared and executed.
7. LIMITATION OF PROFESSIONAL SERVICES. Unless expressly stated to the contrary, the professional services to be provided by the CONSULTANT do not include meetings and consultations in anticipation of litigation or arbitration or attendance as an expert witness in any deposition, hearing or arbitration. If requested, these services will be provided by an amendment to this AGREEMENT, setting forth the terms of compensation to be received by the CONSULTANT.
8. CONFIDENTIALITY. The CONSULTANT shall not disclose nor permit disclosure of any information specifically designated by the CLIENT as confidential, except to its employees and other subconsultants who need such information in order to properly execute the services of this AGREEMENT.
9. OWNERSHIP OF WORK PRODUCT. CONSULTANT shall remain the owner of all drawings, reports and other material provided to CLIENT. CLIENT shall be authorized to use the copies provided by CONSULTANT only in connection with the Project.
10. TERMINATION. Either party may terminate this AGREEMENT at any time by giving thirty days (30) notice to the other party. If this AGREEMENT is terminated, the CONSULTANT shall be compensated for work actually performed and expense incurred up to the date of termination.
11. RECORD RETENTION. All records related to this AGREEMENT shall be retained by both parties for a period of four (4) years after the conclusion of this AGREEMENT. Records relating to any claim arising out of the performance of this AGREEMENT, or costs and expenses of this AGREEMENT to which exception has been taken by either party, shall be retained by the other party until the claim has been resolved.
12. GOVERNING LAW. This AGREEMENT shall be governed in all respects by the laws of the State of Georgia.

Summary:
This software was discussed at the Planning Retreat. It will be used City-wide to track, manage,
maintain and organize Open Records Requests. A list of Georgia Clients are attached. I spoke
with Cherokee County's Clerk and she had nothing but great things to say about the program.
Because several Council Members are not attending the GMA Conference, there is a surplus of
funds in Travel and Training We would like to utilize the funds to go ahead and start the
implementation/setup and training for this software so we can begin utilizing it July 1. This
budget amendment will be on the March 18th agenda for Council consideration.
The cost for this fiscal year will not exceed $4400 and for next fiscal year it will be $6750.
Summary of How It Works:
1) There will be two processes: One for Police/Court (Danielle) and one for General
Requests (Me). We can customize our forms as needed.
2) Either the applicant or a staff member can enter the request via JustFOIA.
3) The request is then dated/time stamped and the request is routed to the appropriate staff
member based on what type of request was selected. We can customize who can view a
request, who its routed too, and monitor fees and time estimates. We can even include you in
the loop for certain types of requests. Protecting the document is key and being able to
customize who can view it will help us do that.
4) There is a discussion component between departments so that communications aren't lost.
This will keep everyone in the loop and will keep the request organized by managing the
communications and general notes.
5) During the life-cycle of the request, the requester can create an account, check the status,
process payment, retrieve the fulfilled request document and view their previous requests.
6) This will allow staff in each department to be accountable for their requests. It will
streamline the process, minimize delays and help us run comprehensive reports to see what
we've done, when we did it or identify issues and bottlenecks.

7) This software also allows us to calculate time and material, and allow us to post fees and
invoice the requestor. This will insure consistency among all departments and will help us
better track those who make a request and then never pay.
8) JustFOIA integrates with our records management software - Laserfiche and with our
financial/community development software BS&A.
9) We will be able to upload documents, redact them if necessary, assign authorized viewers
and keep these requests neatly organized by requester, topic or date.
This will ensure that if someone makes an open records request and it turns into a lawsuit
later - we can efficiently retrieve the documents and provide to our attorneys; protect
documents from being destroyed that may be needed in a lawsuit and prevent staff from
duplicating efforts by producing the same documents over and over again to the same person
or to someone new who makes the request 6 months apart.

EXECUTIVE SUMMARY
MCCi has been a leader in document management and business process improvement for the

JUSTFOIA IMPLEMENTATION
REMOTE CONFIGURATION – Configuration services are provided remotely. As part of the standard
configuration services MCCi will work with the client to configure up to two records request intake
processes, unlimited users, as well as the departments, and security rights. The configuration of all forms
and processes are to be completed as part of the initial project; if the client desires to take advantage of
configuring a second process, it must be done as part of the initial configuration services and prior to
training. Subsequent form/process configurations and users will be configured by the client, or the client
may contract with MCCi for additional services.
REMOTE TRAINING – JustFOIA is a simple and easy to use solution, therefore all training is provided remotely.
One remote user training session is included for each form process that is being configured. In addition,
one administrative training is included for the organization. All training is conducted in a train the trainer
format. Onsite live training can be conducted at a negotiated rate.
JUSTFOIA LICENSING AND FEATURES - JustFOIA is an open records request tracking solution. It allows you to
record, track, fulfill, and report on the records request process. Below are the feature sets offered:
� Public Facing Form Site – Online public request form accessible through client’s website.
� Email Notifications – Status and department updates, automated reminders as well as daily digest
and alert notifications.
� Correspondence – Emails can be generated within the system and tracked under the specific request.
Emails can be custom created or through pre-configured templates. In addition, other forms of
correspondence related to a request can be tracked (phone calls, letters or in person conversations).
� Fee Tracking – Track fees, due dates, and payments.
� On-Premise Archival – Export capabilities for archiving record request data locally.
� Proactive Status Reporting – Dashboard interface allows for immediate status update.
� Performance Metric Reports – Measure processing times by request type, department or user.
� Global Reporting – Measure performance for all departments and request types.
� Configurable Intake Form – Client branded intake form that can be configured remotely or locally.
� Mobile compatible – Compatible with most cellular devices.
� Public Portal – Requesters can track their request through a secured private portal. Status updates,
invoices and request documents can all be provided for the requester.
� Payment Portal (Optional) - Requestors can view or print the invoice and make partial or whole
payments. This feature requires an account with Authorize.net, which is the third-party payment
processor for this integration. Authorize.net handles all monetary transactions and sensitive credit
card data.
HARDWARE/SOFTWARE REQUIREMENTS
JustFOIA is a completely web-based hosted solution and therefore has no server-side hardware
components. End-user access is provided through a web interface, which means no client-side software is
required. We test and support the following browsers: Microsoft® Internet Explorer® version 10 or higher;

PAYMENT & BILLING TERMS
MCCi will invoice one hundred percent (100%) of the subscription amount upon providing the Client online
access to the JustFOIA service. Balance of total project will be invoiced upon completion of the proposed
professional services. Sales Tax will be included where applicable. Payment will be due upon receipt of an
invoice. The Client’s annual subscription renewal date is set based on 30 days after contract is received.

ADOBE ACROBAT PRO PLUGIN
With the Adobe Acrobat Pro Plugin, you can easily upload documents you are working on in Adobe to a
specific JustFOIA request. Use Adobe to create and edit documents, as well as to apply redactions and
other features available in the Adobe software. When you are ready, you simply click on the JustFOIA
button in the menu bar and uploading that document to JustFOIA is as easy as picking the request
number. In order to utilize this plugin, your organization will need to have Acrobat Pro available to the
user.
LASERFICHE INTEGRATION
Our Laserfiche integration makes it easy to leverage the power of Laserfiche to help fulfill records
requests. Do all of your searching, editing, and redaction in Laserfiche. Then with a click of the JustFOIA
menu button send selected documents directly into the response documents of the specific JustFOIA
request you choose. This integration makes it more seamless to use Laserfiche and JustFOIA together to
complete records requests. In order to utilize this integration, each user will need a full Laserfiche license.
PAYMENT PORTAL
This feature requires an account with Authorize.net, which is the third-party payment processor for this
integration. Authorize.net handles all monetary transactions and sensitive credit card data. JustFOIA
integrates with Authorize.net to give you the ability to collect payments from requestors online. The
requestor goes to your site and enters in the request number/security key and is able to see any fees that
they owe. If they owe fees, they are able to pay through a secure authorize.net site. Once they pay, you can
make their request documents available for immediate download.

TERMS AND CONDITIONS
MCCi, a Limited Liability Company, which is duly organized and existing under the laws of the State of Florida, hereinafter referred to as MCCi, hereby offers the JustFOIA solution according to
the following terms and conditions.
JUSTFOIA SUBSCRIPTION
MCCi is the developer and hosting provider for JustFOIA. An active subscription is required to access the solution. The official subscription date is established on the date MCCi grants initial
access to JustFOIA. Adjustments in annual subscription rates may be made to coincide with current U.S. inflation rates – any increase will not exceed the cumulative increase in the Consumer
Price Index (CPI) occurring since the last price increase. All subscriptions are prepaid and non-refundable.
JUSTFOIA IS AVAILABLE “AS-IS”
Though we want to provide a great service, there are certain things about the service we cannot promise. For example, the services and software are provided “as is”, at your own risk, without
express or implied warranty or condition of any kind. We also disclaim any warranties of merchantability or fitness for a particular purpose. JustFOIA will have no responsibility for any harm to
your computer system, loss or corruption of data, or other harm that results from your access to or use of the Services or Software. Some states do not allow the types of disclaimers in this
paragraph, so they may not apply to you.
LIMITED LIABILITY
Notwithstanding anything in this Agreement to the contrary, MCCi’s total liability to the client for any and all claims, damages, or liability arising out of or related in any way to this agreement or the products
or services being provided by MCCi to Client shall be strictly limited to the project fees paid to MCCi by the Client for the preceding 12-month period immediately preceding the event giving rise to the claim
by the Client, and shall also be limited to the fees paid to MCCi for the particular service/product that the Client’s claim was caused by or arose out of.
Due to the intended use of JustFOIA being focused on “Open Records” Requests, MCCi assumes that only public and non-confidential data will be uploaded to the solution, and the full Terms of Use are
accessible on the home page of the JustFOIA solution.
INDEMNIFICATION
If MCCi or our affiliates (owners or partners), or any of our or their respective employees, agents, or suppliers (the “Indemnitees”) is faced with a legal claim by a third-party arising out of your actual or
alleged gross negligence, willful misconduct, violation of law, failure to meet the security obligations required by the Agreement, or violation of your agreement with your customers or end users, then you
will pay the cost of defending the claim (including reasonable attorney fees) and any damages award, fine or other amount that is imposed on the Indemnitees as a result of the claim. Your obligations
under this subsection include claims arising out of the acts or omissions of your employees or agents, any other person to whom you have given access to the Services, and any person who gains access to
the Services as a result of your failure to use reasonable security precautions, even if the acts or omissions of such persons were not authorized by you. You must also pay reasonable attorney fees and other
expenses we incur in connection with any dispute between persons having a conflicting claim to control your account with us or arising from an actual or alleged breach of your obligations to them.
FORCE MAJEURE
Neither party shall be liable for any delay or failure in performance due to causes beyond its reasonable control.
CLIENT FINANCIAL SOLVENCY/BANKRUPTCY
MCCi may require payment in advance for products and services in response to learning of financial solvency or bankruptcy issues.
NO HIRE CLAUSE
Client and MCCi agree that during the period that this agreement is in force, including extensions or modifications thereto, and for an additional 12 months following this period, neither Client
nor MCCi will actively recruit, or solicit employees or independent contractors of either company, or the employees of any of the other Subcontractors; who are on active payroll status and are
currently participating in this Program, without the prior written approval of the party whose employee or independent contractor is being considered for employment. This does not prohibit
any employee from responding to or pursuing employment opportunities through normal media channels, i.e. newspapers, professional journals, etc. so long as it is not related to this
particular program and that it is not an attempt to avoid the intent of the above restriction.
If, during the term of, or within (12) months after the termination of the performance period of this agreement, client hires directly, or indirectly contracts with any of MCCi’s personnel for the
performance of systems engineering and/or related services hereunder, client agrees to pay MCCi 125% of the fees paid to, or in favor of such personnel for one (1) year after such personnel
separates from service with MCCi.
TERMINATION
The services provided in this agreement will be in full force and effect for a period of three (3) years from the execution date of the agreement, or from the initial software/maintenance
subscription date (applicable only when such components are included). Thereafter, this agreement will be automatically renewed from year to year, provided that either party may alter or
cancel the terms of this agreement upon 60 days written notice.
USE OF BASECAMP
Through the course of this project, MCCi may choose to utilize the third-party service Basecamp (http://www.basecamp.com) for project management and team collaboration. Documentation
and correspondence exchanged between MCCi and The Client may be stored in Basecamp. The Client acknowledges that Basecamp is responsible for secure storage of this documentation,
and agrees that Basecamp's security guidelines located at https://basecamp.com/security are acceptable for the storage of The Client's data and correspondence exchanged with MCCi.
PROFESSIONAL SERVICES RESCHEDULING/CANCELLATIONS
Travel Expenses: If the client cancels or reschedules an installation after MCCi has made travel arrangements, travel expenses may be incurred due to circumstances such as non-refundable
airline tickets, hotel reservations, rental cars, etc.
Site Preparation: The Client site should be ready for installation according to specifications outlined within the Hardware section. If site is not prepared and results in cancellation, delays, or
rescheduling of an installation after MCCi has made travel arrangements, the client may incur expenses due to circumstances such as non-refundable airline tickets, training/install charges,
hotel reservations, rental cars, etc.
Project Delays: Requests made by the client to cancel/reschedule delivery of services will cause a delay in delivery of the services and the overall project. The client understands that MCCi will
have to respect the timelines of other scheduled projects when rescheduling services due to a request made by the client.
OTHER CONTENT
The Services may contain links to third-party websites or resources. JustFOIA does not endorse and is not responsible or liable for third-party website availability, accuracy, the related content,
products, or services. You are solely responsible for your use of any such websites or resources.
MARKETING & REFERENCES
Client agrees to allow MCCi to publicly announce the client’s selection of MCCi for the specific solution(s), at the time of the client contracting with MCCi. Additionally, upon the client providing
written consent, MCCi is authorized to publish and publicize testimonials and case study information pertaining to MCCi’s work with the Client. This information, including the Client’s
organization name, logo, and contact information will be used in all media types.
MCCi SOFTWARE CONFIGURATION SERVICES
The customer may elect to contract with MCCi to configure the software. The customer is responsible for testing all software configurations completed by MCCi. By acknowledging this testing
requirement, the customer waives any and all liability to MCCi for any fees, damages, etc., that could be related to software configurations.

Addendum to Terms and Conditions of Agreement between MCCi, a limited liability company and City of Woodstock, Georgia 1. The indemnification provisions of this Agreement are hereby modifified to reflect that any indemnification obligations of the Client are strictly limited to the extent such obligations are permitted under Georgia law. 2. The termination provisions of this Agreement shall be modified to add at the end of said paragraph a new sentence to read as follows: “Notwithstanding the foregoing, this contract shall terminate absolutely and without further obligation on the part of the Client at the close of each calendar year except that it shall automatically renew for a period of one year unless positive action is taken by the Client to terminate this contract.”

Proposed is an amendment to Chapter II – Definitions and Chapter XIII – Floodplain Management/Flood Damage
Prevention Standards as requested by FEMA to maintain the City’s continued eligibility in the National Flood
Insurance Program (NFIP). This request stems from the proposed modified flood hazard determinations
affecting the Flood Insurance Rate Map (FIRM) and Flood Insurance Study (FIS) report for Cherokee County,
Georgia and Incorporated Areas that will go into effect on June 7, 2019.
Chapter II – The definitions for the following terms were amended or added to reflect changes specific to
Chapter XIII per FEMA Guidance: Building, Structure, Violation
Chapter II – The definitions for the following terms were amended to reflect the date of the first floodplain
management regulation adopted by the City on September 17, 1988 per EPD Guidance: Existing Construction,
Existing Manufactured Home Park or Subdivision, New Construction, New Manufactured Home Park or
Subdivision
Chapter II – The definition was added for the following term per Metropolitan North Georgia Water Planning
District (MNGWPD) Guidance: Areas adjacent to the Future-Conditions Floodplain
Chapter XIII
13.220 – Applicability: This is amended to be applicable to all areas of the City, not just areas of special flood
hazard, to eliminate the discrepancy in Section 13.530 that regulates areas adjacent to the future-condition
floodplain. By definition, these are not areas of special flood hazard.
The following sections in Chapter XIII add the language of substantial improvement to new construction. There is
no distinction between the two terms in the minimum requirements of the FEMA NFIP:
13.510 – General Standards (1)
13.520 – Building Standards for Structures and Buildings Within the Future-Conditions Floodplain (1)(b), (2)(a),
(2)(b), and (5)(a). 13.520 (2)(a) and (2)(b) amendments will also require elevation details on non-residential
structures that are floodproofed in the future-conditions floodplain
13.530 – Building Standards for Structures and Buildings Authorized Adjacent to the Future Conditions
Floodplain: This section is amended to require hydrostatic flood vents in areas adjacent to the future conditions

ORDINANCE NUMBER ____-20__
AN ORDINANCE AMENDING CHAPTERS II (DEFINITIONS) AND IV (SOIL
EROSION AND SEDIMENT CONTROL STANDARDS) OF THE LAND
DEVELOPMENT ORDINANCE OF THE CITY OF WOODSTOCK, GEORGIA
Whereas, the City of Woodstock, Georgia (hereinafter sometimes referred to as the “City”)
is a municipality duly formed and existing pursuant to Georgia law; and
Whereas, the 1983 Constitution of the State of Georgia provides for the self-government
of municipalities without the necessity of action by the General Assembly1; and
Whereas, the City of Woodstock, Georgia, has the legislative power to adopt clearly
reasonable ordinances, resolutions or regulations relating to its property, affairs and local
government for which no provision has been made by general laws or which are expressly allowed
by general laws, and which are not inconsistent with the Constitution or any charter provision
applicable thereto2; and
Whereas, the governing body of the City has determined that it is in the best interest of the
City and its citizens to adopt the following; and
NOW THEREFORE BE IT RESOLVED, THE MAYOR AND COUNCIL OF THE CITY OF
WOODSTOCK, GEORGIA HEREBY ORDAINS:
Section 1. That Chapter II – Definitions, of the Land Development Code, as amended, is hereby
further amended by deleting the following definitions:
Building: Any permanent Structure attached to the ground, which has a roof and which is
designed for the shelter, housing, or enclosure or persons, animals, or property of any kind.
Existing Construction: Any Structure for which the “start of construction” commenced
before December 11, 1986, the effective date of the first FIRM map published for the City
of Woodstock.
Existing Manufactured Home Park or Subdivision: Means a manufactured home park or
Subdivision for which the construction of facilities for servicing the Lots on which the

authority of the General Assembly, by general law, to define this home rule power further or to broaden, limit, or otherwise regulate the exercise thereof. The General Assembly shall not pass any local law to repeal, modify or supersede any action taken by a municipal governing authority
under this Code section, except as authorized under Code Section 36-35-6.”

completed on or after the effective date of Floodplain management regulations adopted by
a community.
Structure: Anything constructed or erected which required location on the ground or
attachment to something having a location on the ground. The term shall include such
things as gasoline pumps, signs, mobile homes, and other portable vehicles or Structures
from which products are vended, and similar objects.
Section 2. That Chapter II – Definitions, of the Land Development Code, as amended, is hereby
further amended by inserting the following definitions:
Areas adjacent to the Future-Conditions Floodplain: Means those areas that are at or below
either three (3) feet above the base flood elevation or one (1) foot above the future-
conditions flood elevation, whichever higher, unless the area is hydraulically independent
(meaning absolutely no connection to the flooding source such as through pipes, sewer
laterals, down drains, foundation drains, ground seepage, overland flow, gated or valved
pipes, excavated and backfilled trenches, etc. with no fill or other manmade barriers
creating the separation).
Building: Any permanent Structure attached to the ground, which has a roof and which is
designed for the shelter, housing, or enclosure or persons, animals, or property of any kind.
However, for use in Chapter 13, see “Structure.”

Structure means a walled and roofed building, including a gas or liquid storage tank, that
is principally above ground, as well as a manufactured home.
Violation: An act of breaking or disregarding an ordinance or law. However, for use in
Chapter 13, a Violation is the failure of a structure to be fully compliant with the
community’s floodplain management regulations. A structure or other development
without the elevation certificate, other certifications, or other evidence of compliance
required by the community’s floodplain management ordinance is presumed to be in
violation until such time as that documentation is provided.
Section 3. That Chapter XIII – Floodplain Management/Flood Damage Prevention Standards,
Section 13.220 of the Land Development Code, as amended, is hereby further amended by
deleting, “This Ordinance shall be applicable to all areas of special flood hazard within the City”
and inserting in lieu thereof the following:
This Ordinance shall be applicable to all areas within the City.
Section 4. That Chapter XIII – Floodplain Management/Flood Damage Prevention Standards,
Section 13.510 of the Land Development Code, as amended, is hereby further amended by
deleting, “1” and inserting in lieu thereof the following:
1. New construction and substantial improvement of principal buildings (residential or
non-residential), including manufactured homes, shall not be allowed within the limits
of the Future-Conditions Floodplain, unless all requirements of sections 13.430,
13.440, and 13.450 have been met;

Section 5. That Chapter XIII – Floodplain Management/Flood Damage Prevention Standards,
Section 13.520 of the Land Development Code, as amended, is hereby further amended by
deleting, “1(b)” and inserting in lieu thereof the following:
1. Residential Buildings
(b) Substantial Improvements. Substantial improvement of any principal
structure or principal buildings, including manufactured homes, shall not be
allowed within the limits of the Future-Conditions Floodplain unless all
requirements of sections 13.430, 13.440, and 13.450 have been met. If all
of the requirements of sections 13.430, 13.440, and 13.450 have been met,
all substantial improvements shall have the Lowest Floor, including
basement, elevated no lower than three (3) feet above the base flood
elevation or one (1) foot above the future-conditions flood elevation,
whichever is higher. Should solid foundation perimeter walls be used to
elevate the structure, openings sufficient to equalize the hydrologic flood
forces on exterior walls and to facilitate the unimpeded movements of
floodwaters shall be provided in accordance with standards of subsection
13.510 (5).
Section 6. That Chapter XIII – Floodplain Management/Flood Damage Prevention Standards,
Section 13.520 of the Land Development Code, as amended, is hereby further amended by

thereof other than the provisions specifically declare to be invalid. The Mayor and Council hereby
declare that it would have passed this Ordinance and each subsection, sentence, clause and phrase
thereof, irrespective of the fact that any one or more subsections, sentences, clauses or phrases
may be declared illegal, invalid or unconstitutional.
Section 9. This ordinance shall take effect immediately upon its adoption at the 2nd Reading.

On February 16, 201 8, you were notified 0f proposed modified flood hazard determinations affecting the
Flood Insurance Rate Map (FIRM) and Flood Insurance Study (FIS) report for Cherokee County, Georgia
and Incorporated Areas. The statutory 90—day appeal period that was initiated on March 2, 201 8, when the
Department of Homeland Security’s Federal Emergency Management Agency (FEMA) published a notice
of proposed flood hazard determinations for your community in the Cherokee Tribune, has elapsed.
FEMA received n0 valid requests for changes in the proposed flood hazard determinations. Therefore, the
determination 0f the Agency as to the flood hazard information for your community is considered final.
FEMA will publish a notice of final flood hazard determinations in the Federal Register as soon as
possible. The modified flood hazard information and revised map panels will be effective as of
June 7, 2019, and revise the FIRM that was in effect prior to that date. For insurance rating purposes, the
community number and new suffix code for the panels being revised are indicated above and 0n the mapsand must be used for all new policies and renewals. Final printed copies of the report and maps will be
mailed to you before the effective date.
The modifications are pursuant to Section 206 of the Flood Disaster Protection Act of 1973
(Public Law 93-234) and are in accordance With the National Flood Insurance Act 0f 1968, as amended(Title XIII 0f the Housing and Urban Development Act of 1968, Public Law 90—448),
42 U.S.C. 4001-4128, and 44 CFR Part 65. Because ofthe modifications t0 the FIRM and FIS report for
your community made by this map revision, certain additional requirements must be met under Section
1361 0f the 1968 Act, as amended, Within 6 months from the date 0f this letter. Prior t0 June 7, 2019, your
community is required, as a condition 0f continued eligibility in the National Flood Insurance Program
(NFIP), t0 adopt 0r Show evidence of adoption of floodplain management regulations that meet the
standards 0f Paragraph 60.3(d) 0f the NFIP regulations. These standards are the minimum requirements
and d0 not supersede any State 0r local requirements 0f a more stringent nature.
It must be emphasized that all the standards specified in Paragraph 60.3(d) 0f the NFIP regulations must be
enacted in a legally enforceable document. This includes the adoption 0f the effective FIRM and FIS
report t0 which the regulations apply and the modifications made by this map revision. Some of the
standards should already have been enacted by your community. Any additional requirements can be met
by taking one 0f the following actions:

To assist your community in maintaining the FIRM, we have enclosed a Summary of Map Actions
(SOMA) to document previous Letter of Map Change (LOMC) actions (i.e., Letters 0f Map Amendment[LOMAS], Letters 0f Map Revision [LOMRSD that will be superseded when the revised FIRM panels
referenced above become effective. Information 0n LOMCs is presented in the following four categories:
(1) LOMCS for Which results have been included on the revised FIRM panels; (2) LOMCs for whichresults could not be shown on the revised FIRM panels because of scale limitations or because the LOMCissued had determined that the lots 01' structures involved were outside the Special Flood Hazard Area as
shown on the FIRM; (3) LOMCS for Which results have not been included 0n the revised FIRM panels
because the flood hazard information 0n which the original determinations were based is being superseded
by new flood hazard information; and (4) LOMCS issued for multiple lots 0r structures where the
determination for one or more of the lots or structures cannot be revalidated through an administrative
process like the LOMCS in Category 2 above. LOMCS in Category 2 will be revalidated through a single
letter that reaffirms the validity 0f a previously issued LOMC; the letter will be sent to your communityshortly before the effective date of the revised FIRM and will become effective 1 day after the revised
FIRM becomes effective. For the LOMCs listed in Category 4, we will review the data previously
submitted for the LOMA or LOMR request and issue a new determination for the affected properties after
the revised FIRM becomes effective.
The FIRM panels have been computer—generated. Once the FIRM and FIS report are printed and
distributed, the digital files containing the flood hazard data for the entire county can be provided t0 your
community for use in a computer mapping system. These files can be used in conjunction With other
thematic data for floodplain management purposes, insurance purchase and rating requirements, and manyother planning applications. Copies 0fthe digital files 0r paper copies ofthe FIRM panels may be
obtained by calling our FEMA Map Information eXchange (FMIX), toll free, at 1—877—FEMA-MAP(1—877-336—2627). In addition, your community may be eligible for additional credits under our
Community Rating System if you implement your activities using digital mapping files.

FRIDAY NIGHT LIVE
The first Friday Night Live of 2019 takes place this Friday, March 1, 6p-9p, and the theme is
Mardi Gras!
Friday Night Live returns in 2019 for what is approximately the 15th anniversary of the exciting
monthly series of themed events. The event occurs the first Friday of each month from March-
December and gives the downtown Woodstock shops and restaurants an evening to stay open
late, host events and live music which creates a street-party style atmosphere that is sure to offer
everyone something to do. Mark your calendars and make plans to join us for FNL!
The 2019 FNL season is once again presented by Reformation Brewery.
TOUR OF SOUTHERN HIGHLANDS
This Friday, March 1, ‘Tour of the Southern Highlands, a 3-day cycling race, will kick-off in
downtown Woodstock. Traffic delays should be expected in the area.

MILITARY BANNER PROGRAM
The City of Woodstock and American Legion Post 316 are currently accepting applications for
Woodstock's Military Banner Program. The Military Banner Program salutes our brave men and
women who are currently serving and those who have served in our military by displaying a light
pole banner in their honor to be exhibited in Woodstock in celebration of Memorial Day and
Veterans Day for years to come. We are currently accepting applications for this year's Memorial
Day. Orders for this year's Memorial Day will be accepted until May 1. The banners will be on
display 1 week before Memorial Day and taken down 1 week after Memorial Day. Banners will
be placed out again for Veterans Day.

1. Fire Department Response Presentation
COMMENTS - Current Meeting:
Jeff Moon, City Manager stated that 2 weeks ago, he spent time with all three fire shifts talking to
the Fire Department employees about the upcoming Comp Study. Some employees at that time
expressed concerns over comments made by the County at a recent work session. (This is
nothing negative toward the Cherokee County Fire Department or the men and women of that
department). This is about the County using the fire department’s as a pawn in an annexation.
Bottom line is the City is helping the County more than they are helping the City.

The City Manager stated he elected to address this tonight in order to not sway the vote on the
annexation request coming up. We don't have just a mutual aid agreement (meaning if they need
us, they call and visa versa), but we have an automatic aid agreement as well (meaning the closest
station answers the call.)

In summary: The County responded inside the City Limits of Woodstock 1953 times 2014-2018
(does not include EMS) - our residents (incorporated County residents) pay for the EMS service
the same as Cherokee County unincorporated residents do. And the City responded out into the
County 6,412 times since 2014-2018. The City Manager stated maybe the County Attorney is on
to something….maybe we should charge the County.

The City Manager further informed Council that when Cherokee County approved Brickmont,
they made zero calls to City Fire Department, Planning Department or to him to ask the City’s
input.
City staff met with Cherokee County staff today regarding the upcoming annexation. The City
Manager explained the comments made are about the County using the fire department’s as an
annexation tool.
Council thanked Jeff for the presentation. CM Usher stated it is sad that County officials don't
know the Woodstock boundaries.
Mayor asked if it's true that the City was asked not to contract out the EMS service years ago.
Jeff replied he was not here when that discussion took place but it was his understanding that he
is correct.
2. Streets Project Update
COMMENTS - Current Meeting:

Two imminent projects to be shared tonight:
1) Arnold Mill Road Turn Lane Project
2) Main Street Signalized Crosswalk at Ridgewalk
After adding 5 new signalized crosswalks in 2018 - Main Street at Ridgewalk is the next needed
area. Can't place on north side because it would block traffic flow. Northbound traffic is
considerably lighter and the traffic is already stopped. Will somewhat disrupt right turns off
Ridgewalk onto Main St. Proceeding with this project - should be complete in next month.

2. 2nd Reading - Ch. 22 Short Term Rentals Ordinance (APPROVED)
Per Council's request, this is the 2nd reading of an ordinance meant to allow regulation and
enforcement of short-term rental (STR) units (aka: AirBNB, VRBO, etc.). This is a minimalistic
approach that requires a property owner to get a home-occupation license for the business, allow
for safety and welfare inspections if deemed necessary, puts in place certain protections for
adjacent property owners and requires the owner to pay the same hotel/motel taxes that are
required for other commercial uses. Once adopted, development services staff will begin the
process of phasing in the requirements on the STR units located within the jurisdiction. There are
currently around 20.

Council awarded the Little River Park design/engineering services contract to GreenbergFarrow.
As part of that contract, it has been identified that further land survey services are needed and are
estimated to cost $67,500. City Manager approved for the work to proceed so as not to slow the
progress of the project. This item is to request Council's ratification of the additional work (i.e.,
change order) in the amount of $67,500. No budget amendment will be needed as the
design/engineering services contract is under budget and this work will come from the same

Ashley Holcombe, Applicant with Sam Investment Holdings
This parcel lies to the north of a sewer main that runs through this property and across
Chatley Way to another commercial property. It makes a good boundary line between
residential and commercial. They do not want to relocate this main. Also, this parcel also lies
to the right of their existing road on Hickory Ridge Trail. That’s why they want to zone this
residential and leave all else commercial.

This project is currently under construction for the original 70 units. No one here is in
opposition from that neighborhood. They seem to be very happy with what their doing out
there.
Holcombe - anticipated this rezoning and made plans for the road to serve three units they are
proposing.
Staff's Recommendation by Niwana Ray was read aloud (see last power point slide.)
CM Ake had a question about #4 condition he said we’ve had a number of cases where
zoning buffers between residential and commercial come into play and when an adjacent
property to residential redevelops the redeveloper of general commercial property feels
they’ve been improperly burdened unduly burdened because we’ve waived a 45’ buffer to a
10’ replanted buffer. Asked what the thought process from Planning Commission for
granting that. Do they not anticipate future issues?
Katie O’Connor answered saying the discussion was what was granted in the previous case.
This was granted previously and they just extended that allowance. It’s the same situation
just extended down. They looked at this and requested they add 3 units to something already
approved. But that's why the #8 condition was added to attempt to deal with that issue and so
that owners would be notified how close they would be to commercial.
Public Hearing Opened/Closed - No one signed up.
CM Ake said he is struggling with this because when this previously came through there was
a different mechanism to look at Towne Homes with Parkway Overlay. Struggles with
turning more GC's into townhouses. We have tried to limit the loss of GC property. He sees
that this is an extension of what was previously approved, but we have to apply the criteria.
CM Collins thinks the commercial will never be developed because it will be hidden.
CM Johnson - agrees with the struggle and thinks this could be combined with Commercial
and be a bigger parcel. We need to hold onto our general commercial.
CM Ake - not our job to see into the future, but we have criteria we wrote to address this and
that's what we have to fall back on.
Ashely Holcombe - Previously protected the general commercial higher than any other. We
have commercial much deeper that this particular parcel. To put that parcel with the front
parcel that he doesn’t own yet, he would like to acquire that parcel in the future between him
and the dog groomer. They've done a good job of protecting commercial and recognize the
City's interest. They have done their due diligence - trying to make it a commercial
heavy/mixed-use development. Doesn't want to put anything on that sewer main - is a good
boundary line.
No viable commercial use off of Chatley Way.
CM Collins said if it goes commercial, they are going to want access off Chatley Way and
the residents won't want that.
CM Potts – Asked what they are doing on the commercial side/front?
Ashley Holcombe answered they have two buildings office/retail and flex space office
warehouse. Tore down the dated building. Tied into traffic signal to make commercial more
viable. Current plans are to hold off right now - they want the perfect person there.
Motion to deny by Council Members Ake/Johnson. All in favor but Wolfe, Collins and
Usher. Mayor broke the tie to vote against the denial. Motion fails 3-4.

Ridgewalk Overlay District. This matter was tabled on 2/11/2019. COMMENTS - Current Meeting:
Jeff stated the City Attorney couldn't be here tonight, but he is in favor of Council adopting the
3rd and final reading.

Katie O'Connor, Senior City Planner stated there have been no further changes to the code but
she gave a brief presentation pointing out some extra things about the old code vs. the new.
Motion to approve the 3rd and final reading by Council Members Usher/Ake. All in
favor. Motion carried 6-0.

2. Vote - January 2019 Zoning Map Amendment
The City Council of the City of Woodstock is adopting the official Zoning Map. This update
addresses annexations, rezonings, and mapping inconsistencies, which have occurred since the
last Zoning Map Adoption and the rezoning of properties in the new Ridgewalk Overlay District.
The public hearing was held on 1/28/2019.
COMMENTS - Current Meeting:
No amendments to the zoning map since last presentation.

3. Request to Lift or Extend the Emergency Moratorium - Ridgewalk Parkway
Upon adoption of the Ridgewalk Overlay Ordinance and Zoning Map Revision, staff would
like to request the emergency moratorium imposed on Ridgewalk Parkway be lifted effective
February 26, 2019.
In the event the Ridgewalk Overlay Ordinance and Zoning Map Revision are tabled again,
we will need to extend the moratorium further. COMMENTS - Current Meeting:
Motion to lift the emergency moratorium for Ridgewalk Parkway by Council Members
Ake/Potts. All in favor. Motion carried 6-0.
