At its 2017 Washington Conference March 26-28, NAHRO celebrated the 10 th anniversary of its Housing America campaign. The campaign, which aims to raise national awareness of the need for and importance of safe, quality, affordable housing through education, advocacy, and empowerment, features the annual “What Home Means to Me” poster contest and calendar. This year a resident of MassNAHRO member, the Dedham Housing Authority, took the stage as the 2017 Grand Prize winner. Dedham’s 12- year old Felicia Fox has entered the poster contest every year since she was 6, and her entries were featured on the calendars from 2014-2016. Her persistence finally culmi- nated with the front cover and the coveted trip to Washington, DC to be honored at the national conference. Felicia’s win- ning poster included a Little Free Library. During her remarks at the plenary session, she challenged the 900-person audience to install libraries in their communities. MassNAHRO regrets that this well intended measure has become so confused. A good faith effort was made in Ch. 235 to make one seat available to a tenant on town housing authority boards. If the regulations needed to implement the tenant elections do not exist, then it would seem the provisions of section 5, limiting town-elected members to only three, cannot be implemented. MassNAHRO agrees with PHN 2015-08 issued by DHCD in March 2015. The sooner the regulations are issued, the faster the issue is resolved. An increase in the DHCD portion of state bond cap would be necessary if $120 million in bonding was to be issued in each of the five fiscal years. The current allocation is $90 million a year. I recently had an op-portunity to listen to Dr. Ben Carson speak to the NAHRO membership in Washington, DC. As he spoke of his obligation, not to a political party but to the American people, he had me thinking about what his intentions are as HUD

Secretary. Dr. Carson told a story of a ship with some Americans being the engine and others being the load. All portions of the ship necessary to suc-cessfully reach shore. The engine being the healthy, financially and otherwise, the load being the poor and/or mentally or physically ill. A ship will not float if it has a hole, and he described the hole as the inability to help the vulnerable population. He promised to work to fix the holes in the American ship. Nation-ally, housing authorities assist over 4 million families and individuals. As awesome as this this is, there are millions more who need help. As the President attempts to cut, not millions, but billions from the HUD budget, we will see how Dr. Ben Carson fights to fix the holes.

On the home front, we are approaching the time for Massachusetts NAHRO’s Annual Conference. Numerous important and informative sessions are planned. DHCD staff will be available in the Re-source Room as well as for sessions including Per-formance Management Reviews (PMR) and Agreed Upon Procedures (AUP). Timely information and instructions on several hot topics will be following the Monday Plenary Session and the Tuesday morn-ing Motivational Speaker.

You can support the Scholarship Fund by bringing a basket or item to be entered into the silent auction. Also, Monday night entertainment will be a Scholar-ship Fund benefit.

Be sure to look over your agenda carefully for the best opportunities to rub elbows with your colleagues. This conference is the best time to share information amongst ourselves. Don’t let it pass without reaping some benefits for your agency.

Register Now for Annual Conference - May 21-24 in FalmouthThe Professional Development Committee has drafted an

informative and timely agenda for the 2017 Annual Conference at the Sea Crest Conference Center in North Falmouth. The agenda includes seminars and workshops for board members, administrators, staff, and residents. DHCD and HUD both will be major participants, providing the latest information on changes to rules, regulations and guidelines. A DHCD Resource Room will be available again for delegates to meet with DHCD staff and to benefit from technical assistance directly from the regulatory source. The Local Housing Authority Act of 2014, better known as Chapter 235, will again be a central topic for local housing administrators and local board members. Check out the agenda and visit the MassNAHRO website for updates. Topics are included in response to delegate evaluation forms and member requests. An entertaining plenary session on stress management has been added to the Tuesday agenda. Keynote speakers will be announced shortly. Learn about Ch. 235, the centralized waiting list, the Performance Management Reviews, training, elections, AUP audits, and much more.

life of state-assisted public housing.” The bill would also provide authorizations for bonds for development of community-based housing or supportive housing for individuals with mental illness and intellectual disabilities, for capitalization of the Affordable Housing Trust Fund, for the Housing Stabilization and Investment Trust Fund, and $50 million set aside for a DHCD five-year program to “demonstrate cost effective revitalization methods for stateaided family and elderly public housing that seek to reduce the need for future state modernization funding.” DHCD would be required to establish a 7-member advisory committee including one member selected by the Massachusetts Chapter of NAHRO, one member from CHAPA, one from the Mass. Union of Public Housing Tenants, and four members chosen by the Department.

A complete break out of the programs and bonding included in the authorization bill will be sent to all members and included in the delegate packet for Legislative Day on April 13 at the State House in Boston. Speedy action is anticipated. The lack of affordable housing is a bipartisan issue, and the bill is usually passed unanimously.

Senate 1385 Gives LHAs GIC Vision and Dental BenefitsS e n a t o r M i c h a e l B r a d y a n d

Representative Michelle DuBois of Brockton have refiled legislation that would allow local housing authorities to join the state’s Group Insurance Commission dental and vision coverage. Senate 1385, “An Act relative to local public housing authorities access to the dental and vision insurance plan managed by the Group Insurance Commission” states: “Notwithstanding Chapter 32A of the General Laws, the Group Insurance Commission shall provide dental and vision insurance benefits to employees of a housing or redevelopment authority upon a vote by its governing body.” The bill was given a favorable recommendation in the last session of the Legislature by the Joint Committee on Public Service, but was held in the Senate Ways and Means Committee as the session expired. Members are urged

to contact their legislators and request their support for Senate 1385.

Corrective legislation, House 674, “An Act relative to housing authority executive director contracts,” was filed by Housing Committee Chair Representative Kevin Honan and 15 other legislative cosponsors. The bill amends section 7A of Chapter 121B by simply repeating the earlier phrase “relevant to state payments” for remuneration in contracts over $100,000.

Section 7A currently states that “the department may review all contracts between housing authorities and executive directors and all terms for payments or monetary remuneration relevant to state payments,” but is silent on contracts over $100,000. In general, Executive Director contracts over $100,000 rely on payments primarily from sources other than the state.

These include HUD budgets, nonprofit management fees, and other sources with no impact on state payments or programs. Members will be notified by Legislative Alert when hearing dates are established.

The New Public Records Law

On June 3, 2016, the Legislature enacted, “An Act to Improve Public Records”, Chapter 121 of the Acts of 2016. Chapter 121, which became effective on January 1, 2017, made significant changes to the Public Records Law. As a result, housing authorities and public entities throughout the state will need to adjust their public records practices. This seminar will cover the changes to the Public Records Law, and provide you with information to implement changes to your current public records practices, which will help you avoid potential fines and punitive damages.

The Southeastern Massachusetts Executive Directors Association (SMEDA) held its Annual Legislative Briefing in Raynham on Friday March 24. Local housing authority officials and legislators discussed the fiscal and legislative priorities for the 2017-18 session of the Legislature in an interactive roundtable format with each making short presentations. Topics included the

impact of the state budget on DHCD expense caps, costs associated wi th implement ing Ch. 235, and the $1.7 billion housing bond bill pending.

SMEDA members advocate successfully every year with their state legislators with many returning for an update on the latest at

their LHA. Among the legislators in attendance were Senator Pacheco of Taunton, Senator James Timilty of Walpole, Senator Walter Timilty of Milton, Representatives Elizabeth Poirier of North Attleborough, Shaunna O’Connell of Taunton, Gerald Cassidy of Brockton, Susan Gifford of Wareham, Jeff Roy of Franklin, Louis Kafka of Stoughton, Angelo D’Emilia of Bridgewater, and numerous legislative aides.

Jane Desberg, Executive Director of the Sharon Housing Authority, was presented with a citation from the Senate offered by Senator Jim Timilty, and one from the House offered by Representative Lou Kafka, honoring her in appreciation of her 28 years of diligent and outstanding service to the Sharon Housing Authority and the community of Sharon. Jane will be retiring from the housing authority in late May.

Board Certification Courses Offered in Falmouth

By popular demand, MassNAHRO is offering all five required classes for its Board Certification program in conjunction with the Annual Conference in Falmouth this May. This is a great opportunity to complete your course work to become certified. This program is separate from the mandatory DHCD training, and does not satisfy those requirements.

The MassNAHRO Board of Directors has waived the fee for these certification classes for tenant members of LHA boards. The waiver is limited to one tenant member per housing authority. The five half-day seminars are Legal, Finance, Personnel, Ethics and Professional Relationships. Instructors this May include Teresa Ewald, CPA, of Fenton, Ewald and Associates doing the Finance session. The MassNAHRO program is universally recognized, evaluated as excellent, and a great resource for all housing authority members. The MassNAHRO Insurance Group has donated $25,000 this year to the MassNAHRO Past Presidents Memorial Scholarship Fund for deserving young students. Each year MassNAHRO awards ten or more scholarships to deserving students whose families are MassNAHRO members, LHA staff or public housing residents. The Congressman Barney Frank Public Housing Resident Scholarship is awarded each year to a deserving young scholar who is a resident of public housing in honor of the former Congressman who championed public housing and Section 8 for decades in Congress. All awards will be announced at the Annual Conference in Falmouth. The donation does not impact member surplus or dividends. The Group will offer a Workers’ Compensation technical assistance workshop at the Annual Conference on Tuesday morning, May 23.

In other business, the Nominating Committee of the MassNAHRO Workers’ Compensation Group on March 22 nominated Dan Kelly of Westfield and David Hedison of Chelmsford for reelection as Directors for three year terms. The election will be held during the Annual Conference on Monday, May 22 at 4:30 p.m. at the Sea Crest Hotel. Both candidates are highly qualified in the unanimous opinion of the Nominating Committee.

These members will notice a significant reduction upon policy renewal as the Workers’ Compensation rate 9033 has dropped by 11% this year due to the success of the MassNAHRO PHA Self-Insured Group for Massachusetts housing authorities.

The Violence Against Women Reauthorization Act (VAWA) of 2013 was signed into law on March 7, 2013. This change expanded VAWA protections and contains new notification and transfer requirements. The Final Rule was published in the Federal Register on November 16, 2016. HUD also published a new Notice of Occupancy Rights under the Violence Against Women, Model Emergency Transfer Plan, Model Emergency Transfer Request form, and HUD Certification form. PHAs must implement emergency transfer plans by June 14, 2017. Come to this training for a refresher on existing PHA requirements relative to VAWA as well as a discussion of HUD’s new final rule.

On Tuesday, the NAHRO Capitol Hill day, Felicia met with her Congressman, Stephen Lynch, at the Rayburn Building. Con-gressman Lynch congratulated her and thanked her for sending him a calendar. He told her about his experience growing up in public housing in South Boston, and whole-heartedly agrees with her that everyone deserves a home.

Deputy Executive DirectorThe Framingham Housing Authority (FHA) is seeking an experienced and responsible housing professional for the Position of Deputy Executive Director. The FHA oversees approximately 1056 public housing units (state and federal) and 983 Section 8 leased housing units. It employs an administrative staff of 27 and a maintenance staff of 14. The Deputy works directly under the supervision of the Executive Director and is responsible for assisting the FHA in administration, management, program support, and policy development. The Deputy is responsible for overseeing specific programs as assigned, monitoring and evaluating the efficiency and effectiveness of services delivery methods and procedures, accessing and monitoring the work load of the administrative and support staff, identifying opportunities for improvement, and implementing changes. The successful candidate must have a demonstrated ability to motivate, supervise, and evaluate staff and to respond to and resolve difficult and sensitive inquiries and complaints. The Deputy must also exhibit an ability to negotiate and resolve sensitive, significant, and controversial issues with residents, including the enforcement of leases. The Deputy also represents the FHA in interactions with other agencies. A candidate for this position must have a strong working knowledge of federal

and state public housing, modernization/capital programs, and leased housing laws and regulations. A Bachelor’s Degree in Public Administration, Management Business, or a related field is a prerequisite for the position (Master ’s Degree preferred), along with a minimum of five (5) years of supervisory experience of a staff of five or greater. The successful candidate must hold a Public Housing Management (PHM) certificate or be able to obtain the certificate within one year of employment. In addition, the Deputy must possess a valid driver’s license and have reliable transportation. Preferred candidates should have demonstrated executive level experience in working with municipal, assisted or public housing in Massachusetts, collective bargaining contracts, finance, public procurement, and planning, or a combination of similar experiences that demonstrate an ability to perform the above.
