Maritime Industry Authority (MARINA)
HIGHLIGHTS OF ACCOMPLISHMENTS (CY 2011)
The following are the significant accomplishments of MARINA for the period January to December 2011 under the President’s 16-Point Development Agenda, as contained in his Social Contract with the Filipino People and the Philippine Development Plan for CY 2011-2016: A. Anti-corruption, transparent and accountable governance
The MARINA Strategy for the Philippine Maritime Industry (2011-2016) was formulated in line with the strategic direction and advocacy for good governance and anti-corruption of the Department of Transportation and Communications (DOTC). The MARINA Strategy is a governance framework based on the Performance Governance System (PGS) approach, which embodies MARINA’s commitment to undertake the necessary reforms founded on performance, good governance and systems innovation, and is expected to generate the following results: (a) an integrated framework for the various maritime industry sectors of the country; (b) meaningful strategic directions and desired outcomes for the maritime industry and its sectors validated and adopted; and (c) needed essential changes in the Agency to achieve its Vision, Mission and Objectives identified and implemented. Fueled by its three (3) core values of professionalism, integrity and excellence (PIE) and the agency’s critical role as the Maritime Administration in steering the integrated and sustained development of the country’s maritime industry, MARINA commits that: “By 2016, MARINA shall become a premiere maritime administration in Southeast Asia propelling the Philippine maritime industry to global competitiveness.” To ensure realization of its Vision and contribute to the DOTC’s socio-economic impact objective of “improved accessibility, mobility and interconnectivity (seamless), and safe, secure, efficient and sustainable transportation system”, MARINA has identified four (4) important strategic objectives under the socio-economic perspective, from where measures, targets, initiatives and critical action steps or programs and projects have been developed, namely:
� Attractive Philippine ship registry � The Philippines as a major center for shipbuilding and ship repair � Modern and vibrant domestic merchant fleet as part of a seamless
transportation system � Sustained development of globally competitive seafarers

In keeping with the objectives of RA 9485 otherwise known as the “Anti-Red Tape Act (ARTA) of 2007, MARINA issued Administrative Order (AO) No. 12-11 on 23 August 2011 adopting the “Guidelines on the Receiving and Releasing of Documents at the MARINA Central Office” in order to provide efficient handling, recording and tracking of documents. To further promote transparency in the agency, reduce if not eliminate opportunities for irregularities, efficiently deliver frontline services to the public, and in the pursuance of the MARINA Strategy, Administrative Order (AO) No. 13-11 was issued on 22 September 2011, directing all its frontline offices to strictly implement the policies and guidelines in the strict compliance and implementation of Standard Processing Time (SPT) for all applications, streamlining of quasi-judicial issuances for tramping operations, among others. B. Poverty reduction and empowerment of the poor and vulnerable
In order to provide equal access to development opportunities, MARINA shall formulate policies, rules and regulations, and embark in programs that will encourage investment and employment that will eventually redound to poverty reduction. On 30 March 2011, MARINA issued MARINA Advisory No. 2011-03 on the Guidelines in the Implementation of MARINA Circular No. 2009-05 covering the Legalization of Unregistered Motorbancas Operating in the Philippine Waters through the adoption of simplified procedures and documentary requirements and pro-poor vessel fees. In June 2011, there were 72 motorbanca operators and 5 boatbuilders in Binangonan, Rizal that were registered. These motorbancas employ a total of 301 crew and have an aggregate total passenger capacity of 3,034.
On 08 August 2011, the Sangguniang Bayan of the Municipality of Binangonan issued Resolution No. 2011-080 acknowledging the untiring support and efforts of the MARINA and the Philippine Coast Guard (PCG) for helping the members of the Talim Island Passenger Motorboat and Patron Association (TIPMOPA) in securing their Certificates of Public Convenience (CPCs). Such effort has contributed to the safe and efficient transport services for the 45,547 population of Talim Islands which currently comprise 19 Barangays. Additional revenues are likewise expected to be generated by the Municipality of Binangonan with the legalization effort.
MARINA Regional Offices (MROs) have also launched legalization activities in their respective areas of jurisdiction this year. For the period April to June 2011, MRO VII legalized the operations of unregistered motorbancas and boatbuilders in the provinces of Cebu, Bohol and Negros Oriental resulting to the issuance of 231 Certificates of Philippine Registry (CPRs) and Certificates of Ownership (COs), and 87 Certificates of Public Convenience (CPCs). In July 2011, MRO IV conducted mobile registration of motorbancas in Coron and El Nido, Palawan, which aimed to upgrade the level of compliance of tourist boats in the area with MARINA rules and regulations specifically on safety standards. In April 2011, MRO X & XIII conducted legalization of motorbancas in San Jose, Dinagat Island, Surigao del Norte in which 97 motorbancas out of 120 were registered and 98 applications for Boat Captain and Marine Diesel Mechanic were processed. With the aim of bringing MARINA’s services closer to its clientele, eight (8) on-site processing of Seafarer’s Identification and Record Books (SIRBs) were undertaken

in various maritime schools as of 2nd quarter of 2011. These schools include the Philippine Merchant Marine Academy (PMMA), Philippine Merchant Marine School (PMMS), Central Luzon College of Science and Technology (CELTECH), Dr. Yanga’s College and Philippine Nautical Training Center Colleges (PNTC) and Jose Feliciano College. At the same time, in This activity, according to the officials of the schools which availed of this service, had contributed to the timely processing of SIRBs and ensured the safety and convenience of their cadets considering that they do not have to leave their campuses for the purpose.
A similar on-site SIRB processing activity was conducted at North-Western Mindanao Institute of Technology at Ozamis City on 29-31 March 2011 in which 84 SIRBs were issued. In order to monitor, assess and rate the standard services being offered to passengers by domestic liner and ferry operators and at the same time instill public awareness of the differences in shipping service standards, MARINA conducted Passenger Service Rating System (PSRS) surveys in selected interisland shipping routes from 17-28 May 2011 in the implementation of its existing MARINA Memorandum Circular No. 125 covering the Adoption of the PSRS:

For the primary routes/long haul, three (3) vessels owned and operated respectively by Philippine Span Asia Carrier Corp. (formerly Sulpicio Lines, Inc.), Negros Navigation Corp. (NENACO) and Aboitiz Transport System Corp. were surveyed under the PSRS and results showed that the average passenger service rating of the 3 vessels is 66.71% out of 100%. On the other hand, 29 vessels were covered under the PSRS survey for the secondary routes which resulted to an average passenger service rating of 50.61% out of 100%. In a consultative meeting held on 08 November 2011, these shipping companies agreed to improve the quality of their services to the public. In recognition of the invaluable contribution of the country’s seafarers in terms of dollar remittances, Presidential Proclamation Order 183 was issued on 03 June 2011 declaring June 25 of each year as the Day of the Filipino Seafarers. In this regard, the Department of Transportation and Communications (DOTC) through the MARINA spearheaded the week-long nationwide celebration of the Day of the Filipino Seafarers from June 21 to 25 and July 4, 2011 in collaboration and

coordination with relevant government agencies and private individuals and organizations in the maritime community. Highlighting the event was the conduct of a National Forum on Piracy at Sea: Orchestrating the Response, organized by the Philippine Association of Maritime Training Centers, Inc. (PAMTCI) and the Philippine Association of maritime Institutions (PAMI). As a related activity, MARINA was likewise designated as the lead agency in the celebration of the 2011 National Maritime Week from 25 September to 01 October 2011 in line with IMO Circular Letter No. 3126 dated 01 December 2010 relative to the celebration of the 2011 World Maritime Day. Activities for the occasion were successfully conducted by MARINA in close coordination with relevant government agencies, maritime schools, maritime organizations/associations and other entities. The First National Seafarers Congress held from 29-30 September 2011 at the Epifanio Delos Santos Auditorium of the National Library served as the center of the celebration with its theme of “Empowering the Filipino Seafarers through Accurate Information”. Presented during the Congress are issues relevant to the seafarer’s profession, education, training and employment. On 27 September 2011, a Memorandum of Agreement was entered between the Maritime Industry Authority (MARINA) and the Movie and Television Review and Classification Board (MTRCB) for the effective and equitable enforcement of relevant content-regulation laws requiring passenger vessels to properly observe the provisions of PD 474, RA 9295 and its Revised IRR and PD 1986 and its IRR to protect the public from any public exhibition of television programs and motion pictures which are deemed offensive for being immoral, indecent, contrary to law and/or good customs and injurious to the prestige of the Republic of the Philippines or its people. C. Rapid, inclusive and sustained economic growth
To foster and sustain economic growth, provision of basic transportation services is still being encouraged to stimulate economic activities especially in the regions through the continued implementation of OP Administrative Order No. 123 and OP Executive Order Nos. 170A/170B to support the government’s Strong Republic Nautical Highway (SRNH) project with three (3) components, namely, (a) the Road RORO Terminal System (RRTS); (b) Cold Chain and (c) the Grains Highway. As of November 2011, 24 shipping companies which are grantees of Certificates of Public Convenience (CPCs) covering 42 vessels provide shipping services to the identified routes in the Western, Central and Eastern Nautical Highways, as shown below:

A recent adjunct to the existing SRNH Project under the DOTC is the Local Central Spine Nautical Highway Project for the construction and operation of an integrated transportation system combining a RORO port network and services with new toll roads linking Manila to Panay, Negros, Cebu, Bohol and Northern Mindanao. For the effective pursuit of requisite technical studies and coordinative efforts with concerned government agencies, DOTC Special Order No. 2011-191 was issued on 20 September 2011 creating a Task Force on Project Central Spine RORO (Nautical Inter-Island Super Highway), which included the MARINA as one of the Members.
D. Strengthening of Institutional and Legislative Framework for the
Philippine Maritime Administration
MARINA has pursued several programs and activities that will further strengthen its role as the Maritime Administration. From 17 to 21 January 2011, MARINA conducted the National Workshop on Flag State Implementation (FSI), the first of the three (3) capacity building programs approved by the IMO mainly to assist the Philippines in the effective discharge of its overall responsibilities as the Flag State Administration through provision of knowledge and guidance on the structure and mechanisms necessary for enhancing the capacity of the Flag States towards the effective implementation of the mandatory IMO instruments.

To strengthen the ties of friendship and cooperation between the Philippines and other countries, the 12th Joint Committee on Maritime Affairs (JCMA) Meeting between the Republic of the Philippines and the Kingdom of the Netherlands was held at Casa Marinero, Intramuros, Manila on 17 May 2011 with the objective of obtaining substantive progress in bilateral relations especially in the field of maritime transport and manpower. Likewise, MARINA submitted its comments on the Revised Draft Agreement between the Philippines and China on Sea-Land Intermodal Freight Vehicle Transportation Shipped via Roll-On-Roll-Off (RORO) vessels to the Department of Foreign Affairs (DFA) on 13 May 2011. To further enhance the technical expertise of MARINA, two (2) Memoranda of Agreement with the Philippine Center for Advance Maritime Simulation and Training, Inc. (PHILCAMSAT) and the Mariners Polytechnic Training Center referred to as “MARINERS” were forged on 16 June 2011 relative to the provision of training, use of equipment and related facilities to MARINA officials/personnel to ensure that they possess adequate and/or update their knowledge on the various specialized disciplines in maritime affairs which can serve as tools for the provision of better services to its stakeholders and further promotion of maritime safety in the country. To adopt a national policy that will enhance the performance of the MARINA as the Maritime Administration setting the directives of the maritime industry towards its Vision of becoming a Premier Maritime Administration in Southeast Asia by 2016, a Technical Working Group (TWG) was created under SO No. 381-10 dated 29 July 2010 which will be responsible in the review and finalization of the Philippine Maritime Act (PMA) of 2011 taking into consideration pending relevant Bills under the 14th Congress. The passage and implementation of the PMA envisions to strengthen the MARINA as the Maritime Administration and to make the country’s maritime industry more competitive.
A Familiarization Seminar on the 2010 Manila Amendments to the STCW Convention and Code was conducted on 23-24 August 2011 in coordination with the Philippine Association of Maritime Training Centers, Inc. (PAMTCI) to MARINA personnel to orient them in the implementation of the said Convention and Code by January 2012. Prior to this, a National Seminar on the same subject was conducted on 18-22 July 2011 at the Maritime Academy for Asia and the Pacific (MAAP) which was attended by MARINA officials and representatives from government agencies and the private sector as a Philippine initiative to comply with the implementation of the 2010 Manila Amendments to the STCW Convention and Code.
E. Integrity of the environment and climate change mitigation and adaptation
Under the technical assistance/cooperation program approved by the International Maritime Organization (IMO) for the Philippines in 2010, two (2) marine environment-related IMO Conventions have been the subject of National Workshops conducted in 2011. On 13-15 April 2011, the National Workshop on the International Convention on the Control of Harmful Anti-fouling Systems (AFS) on Ships was held at the Casa Marinero, Intramuros, Manila. This Convention aims to mitigate the harmful effects of

marine pollution to the environment. The Workshop, which was jointly organized by the IMO with the Government of the Philippines and hosted by the MARINA for and in behalf of the DOTC, was attended by 61 representatives from various government agencies, non-government organizations and private sectors. The Workshop has achieved its objectives of familiarizing the participants with the key aspects of the AFS Convention, in particular, on the national responsibilities and steps towards its ratification and implementation. On 08-10 November 2011, the National Workshop on the Growth of an International Ship Recycling Industry in the Philippines Based on Compliance to International Safety and Environmental Standards was held at the Casa Marinero, Intramuros, Manila. The Hong Kong Ship Recycling Convention for the Safe and Environmentally Sound Recycling of Ships, adopted in Hong Kong, China, from 11-15 May 2009, aims to ensure that ships, when being recycled after reaching their economic lives, do not pose unnecessary risks to human lives, safety and environment. The Workshop consisting of nine (9) sessions, including the Plant Visit to a Polychlorinated Biphenyls (PCBs) Treatment Facility in Bataan, has twelve (12) Resource Speakers including nine (9) experts from various countries and three (3) from the Philippines. The nine (9) international guest speakers represented international organizations such as the IMO, ILO, UNIDO, UNEP and Prime Ministry of the Republic of Turkey and the business sector group from UK, Germany and Japan. In the local scene, MARINA has participated in three (3) Writeshops/Workshops on the Implementation of the Operational Plan for the Manila Bay Coastal Strategy (OPMBCS) to support the clean-up program to rehabilitate the Manila Bay:
� Updating of the Operational Plan for the Manila Bay Coastal Strategy
(OPMBCS) held on 16-20 May 2011 at Sierra Madre Resorts and Hotel, Tanay, Rizal;
� Finalization of the revised OPMBCS held on 07-08 June 2011 at Lewis Grand Hotel, Don Juico Avenue, Clarkview, Angeles City, Pampanga; and
� Synchronization of the Implementation of the OPMBCS held on 24-26 August 2011 at the Estancia Resort Hotel, Tagaytay City
As part of MARINA’s commitment to the OPMBCS, a MARINA Circular has been drafted requiring Philippine shipyards to submit their Shipyard Waste Management Report to MARINA designed to monitor the waste disposal system of shipyards. The draft MARINA Circular has yet to be subjected to comments/consultation with the concerned stakeholders prior to approval.
Project Updates
1. Categorization of Navigational Areas in the Philippines cum Geographical
Information Systems (GIS)
In collaboration with the Japan International Cooperation Agency (JICA) and the National Mapping and Resource Information Agency (NAMRIA), the Project was pursued with the end in view of reducing the number of maritime accidents in the

country through categorization of the existing navigational and restricted areas with the use of the GIS software and to determine the type and size of ships that can be allowed to ply therein. In this regard, the identified set of parameters such as ship design, weather conditions and hydrographic factors to determine the type of ships that could navigate in specific navigational areas were pilot tested in Subic, Corregidor, Central and Western Nautical Highway routes. Relative to this, series of a 5-day On the Job Training (OJT) in the Central and MARINA Regional Offices on Basic Application of the GIS and the operation of the Manifold Software and its applications to concerned MARINA employees were conducted from March to October 2011.
The final Seminar on the Categorization of Navigational Areas in the Philippines was conducted on 21-25 November 2011 which resulted to the identification of parameters in the categorization of navigational areas into protected waters and coastal waters or open seas and the corresponding license to be issued to vessels based on these categories.
2. Feasibility Study on the Gradual Shifting from Wooden-Hull to Fiberglass Reinforced Plastic (FRP)-Hull Type Ships
The Japan International Cooperation Agency (JICA), through its Technical Assistance Program, and as part of the Work Program of the JICA Expert assigned at MARINA, commissioned the Almec Corporation to undertake the Feasibility Study which commenced in February 2011. The Study aims to promote the FRP-hull type ships to replace WHS and contribute to the modernization and standardization of small ships in the Philippines with the ultimate goal of promoting safety for this type of ships. The 3-month Study covered the areas in Batangas, Mindoro, Bicol, Caticlan, Cebu, Bohol and Iloilo and was completed in April 2011. As Part II of the Study, a Project component relating to the construction of the FRP Prototype Boat was completed in May 2011 by ALS Marine Center Corp. Correspondingly, the sea trial of the Prototype Boat was conducted at Tanza, Cavite on 31 May 2011 with representatives from MARINA and JICA-Manila as observers. Highlighted during the MARINA Anniversary celebration on 01 June 2011 was the launching of the FRP Prototype Boat Project.
Relative to the above Study, a Seminar on Modernizing the Small Ships in cooperation with the JICA was conducted on 21 June 2011 at the Garden Plaza Hotel & Suites at Paco, Manila which was attended by MARINA employees (CO and MROs) and representatives from other government agencies, associations of small boat operators, shipyards and private sector.

Potential investors have painted a bright future in the country’s economic position due to so many factors, among them the drive against graft and corruption by the government, the improving peace and order situation in the country and other internal concerns which accounted for a 21% increase in the accreditation of Domestic Shipping Companies under MC 2006-003 and 79% in the accreditation under Memorandum Circular 186, respectively over those recorded in the previous year. The Regional Offices accredited 548 representing 80% of the total while the rest were issued by the Central Office.

New entrants were recorded at 324 or a 65% increase from previous year’s data of 196, and renewals were posted at 361 or a decrease of 3%.
Ship Acquisition

Vessel acquisition for domestic utilization increased remarkably by 44% over those acquired for the same period in 2010, as the strength of the Philippine peso stirred demand for ships for domestic utilization. The period under review reflected a total of 162 vessels acquired thru importation as against 114 in 2010 or an increase of 42%, while Bareboat Chartering manifested also an increase of 64%. Importation for the period were mostly cargo ships followed by miscellaneous ships which are largely service boats acquired by resort owners to cater to foreign and local tourists of the resorts.

The issuance of Certificate of Philippine Registry (CPR) manifested a decrease of 15%. Figure showed a decrease of 23% in the total number of Certificate of Ownership (CO) issued from the figure of the same period the previous year. Although there is a 5% increase in the number of issuance of new COs due to the increase number of vessel acquisition thru importation, renewals has recorded a decrease of 35% for the period under review.

Licenses issued for the period under review totaled 4899 or an increase of 3% as against those issued in 2010. CWL accounted for 66%, BRL is 23% and PYL 2% of the total issuances.

Special Permits/Exemption Permits issued to overseas vessels deployed in the domestic trade increased by 67%, due to the entry and utilization of highly specialized ships in the country, mostly utilized in the oil exploration projects/activities in Palawan.

For the period under review, 55 applications were processed, 14 of
which are for Tax Exemption and 41 were for VAT Exemption were
indorsed to Board of Investment (BOI) under the investment
Priorities Plan (IPP) or the Department of Finance for the availment
of incentives. Compared to last year’s record of 69, the number of
indorsements decreased by 20%.

Certificates of Compliance are being issued by the MARINA covering particular ship types with respect to their compliance with the requirements under MC Nos. 65/65-A, 112, 134, 150, 151 and 196. The total number issued Certificate of Compliance for the period under review increased by 43% due to the efforts of the Agency in insuring the protection of the riding public against unreasonable, poor and inefficient service.
B. OVERSEAS SHIPPING SECTOR
Accreditation of Overseas Shipping Companies

Data showed that there was a decrease by 33% in the accreditation of overseas shipping companies under Memorandum Circular No. 181 to operate vessels under the Philippine Registry, while accreditation of

other maritime-related enterprises under Memorandum Circular No. 186 posted a decrease by 6%. Applications processed for this key performance indicator as mostly for renewal.

Acquisition of vessels through bareboat chartering decreased by 33% which can be attributed to a lesser number of vessels scheduled for renewal. Of the total number, 12 were newly bareboat chartered or a decrease of 25% than those acquired for the same period in 2010.

Application for Deletion of vessels from the Philippine-registry showed a decrease of 4%. This indicates that there were lesser number of vessels sold, scrapped or whose bareboat charter contracts were terminated.

Issuance of safety-related certificates posted an increase of 5%. Issuance of Civil Liability Certificate (CLC) which is mandatory to answer for the liability for pollution damage under CLC92 increased by 10%, while issuance of Minimum Safe Manning Certificate (MSMC)

which serves to provide security measures for Philippine-registered ships engaged in international voyages also increased by 4%. There was no transaction for Dispensation Permit (DP) for seafarer onboard Philippine-registered seagoing ships.

period in 2010. 18% or 27,837 were for new issuances, while 82% or 126,721 were renewals. The MARINA Regional Office accounted for 33% of the total issuances while the rest were issued by the Central Office.
