Good afternoon. Thank you for inviting me to speak to you today. The topic I chose is the question of evaluating packaging, obviously from a surveyor’s perspective. We are the ones on the frontlines having to report back to you. I can tell you that this topic always generates a lot of discussion here internally at EIMC as well!

What I would like to share with you today is first some background on why this question is even asked and then take you through some of the factors we take into consideration when reaching our conclusions. I will finish with three case studies.

A second reason it’s important is that it can have a big impact on potential subrogation. We, as surveyors, have been warned often enough by underwriters and by underwriters’ attorneys to avoid conclusions about inadequate packing or even to make recommendations for improving packaging in the body of our survey report because of the negative impact it can have on subrogation against third parties. So we are trained to tread very carefully and thoughtfully.

So what’s our thought process when we make the decision? We have to consider the nature of the cargo. What are its characteristics and vulnerabilities? Does it need protection against vibration for example? Really crucial is the intended voyage question. One form of packing may be fine for a local truck move, but be completely inadequate for international air or ocean. We also look to see if there are certain industry norms. This does not entirely go to packing, but to preparation – green coffee or cocoa, for example. These are commodities that are hygroscopic and therefore condensation is almost a given. BUT there are published industry standards as to acceptable preshipment moisture content and, in the case of cocoa, recommended use of desiccants inside containers. If the shipper followed industry guidelines, are they at fault if something still went wrong? Another question to consider is who packed? And this can be important for coverage. Was it the shipper? A third party? If a third party, did the shipper provide specific instructions? Was it a professional packing company or a lay/amateur? I touched on it a bit with the cocoa comment, but we also need to be careful to distinguish between packaging issues and stowage/securing issues. Let’s move on to some examples
