    SUBJECT: APPLICATION FOR PLACEMENT OF FARMLAND IN AGRICULTURAL DISTRICT- SCHERRE H. MUMPOWER

    RECOMMENDATION: That Council consider the renewal application of Scherre H. Mumpower for placement of farmland in an Agricultural District.

    BACKGROUND: The County has forwarded the application of Scherre H. Mumpower, 1629 Lytle Road, to have 25.15 acres of ground, located on Lytle Road, continue to be placed in an Agricultural District. This parcel of land has been in an Agricultural District since 1995, as requested by the late Harold Hines, father of Ms. Mumpower.

    This request was made to the County Auditor, in accordance with ORC Section 929.02. As the property is within the corporate limits, the request must also be approved by the City. The ORC requires that the City hold a public hearing within 30 days of the date the application is filed and that Council make a determination within 30 days of the public hearing.

    Applications were previously filed for this land in 1995, 2000, 2005 and 2010- all of which were approved. The designation is for five years, with renewal applications also considered by the City so that every five years the City is given the opportunity to determine if the land should continue to remain in an Agricultural District. The primary advantages to the property owner for being in an Agricultural District are:

    1) The property owner can continue the current land use even though the land is now zoned M-2, Light Industrial District. (In other words, surrounding property owners have no basis to complain that an "agricultural" operation is taking place inside the City.)

    2) Should the City decide to extend water and sewer across this property by assessment, the assessment would be deferred until any part of the land ceases to be used for agricultural purposes (i.e., land use change).

    As far as the City is concerned, the only disadvantage in having the Hines property included in an Agricultural District is the same reason as in item 2 above- that is, if the City should assess the property, the collection of the assessment would be deferred. However, as noted above, the designation can only stand for five years, and renewal applications must be reviewed and acted upon by Council.

    REQUESTED ACTlON: It would be appreciated if this could be assigned to a Committee of Council. Sue has advised that the public hearing will be set for March 2. Council must then act no later than the March 16 meeting.

    That the bidding of the 2015 paving program be authorized by Troy City Council at a cost not to exceed $766,000.

    BACKGROUND: On an annual basis, the City of Troy bids the repair and repaving of roadways and parking lots following the City Engineer's priority list. For 2015 funds are budgeted as follows related to projects to be included in the paving program:

    RECOMMENDATION: That the acceptance of a highway easement on Troy-Urbana Road be authorized by Troy City Council. This easement is related to the North Market Street/Piqua-Troy Road/Troy-Urbana Road intersection realignment project.

    BACKGROUND: In order to complete the North Market Street/Piqua-Troy Road/Troy-Urbana Road intersection realignment project, the City will need to accept a highway easement from TTF Brown, LLC for a total area of 0.431 acres. Attached is a copy of the highway easement plat.

    REQUESTED ACTION: It would be appreciated if you would assign to a Committee of Council authorizing the acceptance of the Highway Easement on Troy-Urbana Road as show on the attached plat.

    SUBJECT: Acceptance of Highway Easement for Troy-Urbana Road Realignment

    Attached is a copy of an easement plat that the City of Troy Engineering Department is requesting to be dedicated by the TTF Brown, LLC. The easement is for a total of approximately 0.431 acres.

    The highway easement is being requested for the realignment of the Troy-Urbana Road at the intersection of North Market Street (i.e. Piqua-Troy Road).

    We are requesting that legislation be prepared to accept this easement from TTF Brown, LLC so that the City can complete the realignment of Troy-Urbana Road.

    SUBJECT: BIDDING AUTHORIZATION - McKAIG ROAD IMPROVEMENT, PHASE II

    RECOMMENDATION: That the Director of Public Service and Safety be authorized by Council to advertise for bids and enter into a contract for the McKaig Road Improvement Project, Phase II, at a total cost not to exceed $1 '142,000.

    BACKGROUND: Council authorized the submittal of an Ohio Public Works Commission (OPWC) grant to partially fund the McKaig Road Improvement Phase II project, and that grant application was approved in the amount of $450,000. Council then authorized the design of the project. The project area is 1370 lineal feet of McKaig Road from Monroe Street to the railroad at Madison Street, including the area of the railroad crossing. The project scope includes roadway construction, utilities, new LED traffic signal, retaining walls if necessary, and sidewalk, curb and gutter

    The project design is now complete with a total estimate of $1,142,000. This does exceed the $939,000 budgeted for this project; however, the budget estimate was made prior to the final design being completed. The cost difference is discussed in the attached communication from the City Engineer. Sufficient funds are available within the various fund balances; however, a reappropriation will need to be authorized. We will be reviewing the schedule of the reappropriation with the City Auditor.

    REQUESTED ACTION: It would be appreciated if you would assign to a Committee of Council authorizing the Director of Public Service and Safety to advertise for bids and enter into a contract for the McKaig Road Improvement Project, Phase II at a cost not to exceed $1,142,000.

    At the beginning of 2015, the City began the design of the street reconstruction and utilities upgrade for McKaig Road from Monroe Street to Madison Avenue (i.e. Railroad Tracks). The project includes street reconstruction, sidewalk replacement, storm sewer installation including a jack and bore under the CSX railroad, and water and sanitary sewer upgrades.

    The design estimates for this project is $1,142,000, which is estimated to be paid from the following:
