RE: Environmental Impact Statement – Proposed South CountyConnector

To Whom it May Concern:

It is the opinion of the City of Maplewood that the DraftEnvironmental Impact Statement (EIS) for the South CountyConnector project is fundamentally flawed and the costprojections are woefully underestimated. Therefore, the City ofMaplewood opposes the project in its current form and requeststhat the Draft EIS be rejected. At the very least, the Draft EISshould be revised to ensure it meets all requirements andprovides accurate estimated costs.

Below are specific elements of the Draft EIS that City ofMaplewood has determined to be flawed. These were determinedwith assistance by attorneys and engineering consultants.

1. The Draft EIS completely ignores vital issues regarding theUnion Pacific Railroad at Hanley Road.

The area surrounding the Union Pacific Railroad Bridge is a keydriving element in the design and feasibility of the entire project,but is lacking sufficient detail. Without more specific details ofthe project alignment and how the transition under, or over, theUnion Pacific bridge will occur, the current evaluation of theproject is meaningless. Depending on the work required, thisconnection could nearly double the estimated cost of the projectbut it appears as though it was glossed over.

Maplewood contacted numerous representatives from UnionPacific and could only determine that a single phone callapproximately six months ago was made to Dave McKernan – theLocal Manager of Industry and Public Projects. Mr. McKernanindicated that he had a brief phone conversation with St. LouisCounty and he informed St. Louis County at that time that UnionPacific has specific requirements that would have to be met andthat it would be extremely difficult to add lanes under the bridge. Mr. McKernan added that St. Louis County did not ask for norreceived the required specifications and no plans have beensubmitted for even a cursory review by Union Pacific.

An additional contact at Union Pacific, Mr. Adam Studts, SeniorManager of Structures Design, stated that he was unaware of theSouth County Connector project, or any proposed work in thearea. After reviewing the bridge alignment and project area,including a street view through Google Earth, Mr. Studts statedthat it was “highly unlikely” that adding lanes under the existingspans would be possible and that a new bridge would probably

have to be built to Union Pacific specifications.

The City of Maplewood measured the horizontal clearancebetween the pier cap and abutment of the bridge and there isonly 26 feet between them when measured perpendicularly. Thisamount of room seems obviously too little to accommodate thenecessary roadway width, shoulder areas, sidewalk/bike facilities,safety barriers, retaining walls and other necessary setbacks fromthe existing bridge’s supporting structure all with a proposedalignment that will be skewed to the bridge that will likely reduceeven that minimal clearance. Furthermore, creating split lanes inthis project will create a condition that is inherently unsafe, whencompared with properly aligned and configured lanes, and isdirectly contrary to one of the stated purposes of this projectwhich is “improved safety”.

It is also noted in the Draft EIS that the existing bridge providesless than standard vertical clearance and that with the skewing ofthe new roadway it will have to be lowered under the bridge inorder to maintain this unsatisfactory vertical clearance. Thedrainage structure under the bridge is tied directly to Deer Creekand constitutes the low point of the roadway. As a result, thelowering of the new road profile and the proposed elevation of theSouth County Connector elsewhere through the Deer Creekfloodplain will actually increase the flooding frequency of theroad. What is the rational used to justify the spending of tens ofmillions of dollars on a new road that will flood more often?

Considering that splitting the outside lanes around the existingrailroad structure is “highly unlikely” and any work around thisbridge would be extremely costly, a responsible planning agencymust consider and explore alternatives more thoroughly andproactively, as well as including the associated cost estimates andenvironmental impacts of these alternatives in the Draft EIS.Moreover, in order to submit a meaningful cost estimate for thiscritical stage of the project, one would have to be aware of theUnion Pacific building requirements, which St. Louis County isnot.

St. Louis County merely acknowledges two alternatives tosplitting the lanes, and again, provides few details:

a) Constructing a South County Connector bridge over the UnionPacific Railroad b) Relocating and rebuilding the Union PacificBridge entirely

The City of Maplewood believes that a total project cost of $110million is a grossly underestimated amount if any of thesealternatives are actually carried out. Moreover, even if the splitoutside lane alternative is pursued, the City of Maplewood wouldlike to see more details for how the County arrived at an estimateof $560,000 for utility relocation for the project section where therelocation of a 54” sanitary sewer is necessary without havingany build specifications.

2. Business Relocation Impacts are understated and out-of-date

Current “access” points, as planned and foot-printed on page S-9,to the Deer Creek Center on the southwestern edge literally endat the front door of the Deer Creek Center’s tenants. Includingdrive lanes for the parking lot that would have to be included inaddition to the project’s current footprint, the City of Maplewoodestimates that no fewer than four businesses would have to beeliminated to accommodate the access points. Due to the natureof the lease agreements signed with the rest of the tenants at theDeer Creek Center, this option would void all remaining leaseswhich would kill the center.

The result would be the loss of 20 existing businesses in the DeerCreek Center alone and based on the commercial displacementslisted on page S-11, it is clear that these impacts were either notconsidered at all or considered, but completely ignored. Note theaforementioned figure of 20 businesses lost as a result of theproject do not include the potential loss of an addition 14 to 16businesses that would be lost should the proposed South CountyConnector run through Big Bend Industrial Court. To not includethese businesses in the Draft EIS is irresponsible and totallymisleading.

What is most perplexing is the fact that St. Louis County staff hasmade no attempt to contact the owner of the Deer Creek Centerwith regards to right of way costs, linked lease agreements,parking requirements, or pedestrian/shopper safety issues. TheCity of Maplewood contacted Deer Creek Center owner, John Rossof Summit Development, and has been informed that the projectcosts associated with the recent renovation of Deer Creek Centeris in excess of $37 million. With the current leases tied toparking and linked tenants, the proposed South CountyConnector would kill the center and result in a total taking of $37million. Therefore, the estimated cost for right of way listed onpage 3-39 of $8.2 million for the Deer Creek Center as well asproperty along Big Bend Boulevard is completely inaccurate. Twoattorneys who specialize in condemnation law in regards toacquiring public right of way concur with the need for a totaltaking.

Additionally, the project will not improve access to proximatebusinesses, and instead, will promote bypassing them. Theexisting roadways promote traffic patterns and volumes that maynot be ideal, but are certainly amenable to the City of Maplewoodand its businesses and are preferred over any proposal found inthis Draft EIS.

Based on the current businesses within Deer Creek Center andbusinesses on Big Bend Boulevard and Big Bend Industrial Courtthat will be lost due to right of way acquisitions the City ofMaplewood estimates it will lose $500,000 in revenues each year.This project would cripple the economic prosperity of the entireCity, not simply close the dozens of businesses along its proposedroute.

Should this project move into the design phase it will deter futurebusinesses from locating within the project area, whether theproject ever actually gets funded or not. Given the large numberof unfunded projects currently in the design phase with St. LouisCounty, this effect would last for years and further cripple theeconomic potential of an otherwise vital area in our community.

3. Constructing the South County Connector in the Deer Creekfloodplain/floodway is NOT the only alternative.

The Draft EIS states that there is “no practicable alternative” tothe proposed encroachment into the Deer Creek floodway andfloodplain. The City of Maplewood completely disagrees with thisassessment.

The alternative to construct the roadway on the south side ofDeer Creek, where it has no impact on the floodplain/floodway,was rejected without serious consideration and theadvantages/disadvantages listed in the table on page 3-11appear to have been inappropriately weighted to justify theelimination of the south side option from further consideration.Especially given the alignment and elevation concerns raisedabove with regards to the Union Pacific railroad bridge, the City of

Maplewood must insist that a thorough evaluation of this buildalternative be explicitly detailed in a revised Draft EIS.

Pursuing the aforementioned south alternative would allow theroad to be constructed out of the floodplain and floodway. TheCity of Maplewood believes it is poor planning to construct aroadway within the floodplain and floodway when otheralternatives, out of the floodplain and floodway, clearly exist andwere inexplicably glossed over.

Flood studies for the two build alternatives have not beenconducted and have been dismissed until the “Final Design”phase. The City of Maplewood considers these flood studies asintegral components of the project and an Environmental ImpactStatement because the results of the studies will ultimatelydictate the construction cost, right of way costs, impacts on theenvironment, as well as impacts on other properties andinfrastructure proximate to the floodway/floodplain. The City ofMaplewood must issue the Floodplain Development Permit and,based on the Draft EIS, we are completely unconvinced of thesuitability of the project and therefore would reject said permitapplication.

The roadway as purposed will not be elevated high enough toeven take it out of the 10 year floodplain. How can you evenconsider spending tens of millions of dollars to provide analternative route to two roads currently subject to flooding andnot build the road out of the 10 year floodplain?

4. The project study area is insufficient to study the full effects ofthe project. Page S-6 of the Draft EIS states: “The project willincrease traffic on Hanley Road, north of the study area, with abottleneck forming at Interstate 64 regardless of which buildalternative is selected.”

The City of Maplewood questions the wisdom on spending tens ofmillions of dollars to shift one conflict traffic area to anotherlocation. Additionally, not including the above mentionednegative effects in the study area and ignoring them as a part ofthe traffic/accident evaluations undermines the proposed goals ofthe entire project which include reducing congestion, improvingtraffic conditions and improving safety. The Draft EIS shouldexplain, comprehensively, all of the foreseen impacts of theproject, not only those that are convenient to detail.

The City of Maplewood requests that the EIS include future trafficand accident analysis along Hanley Road through to Interstate 64and Clayton or some other logical point in the “Central County”.Omission of this data completely ignores the proposed goals ofthe project and undermines the integrity of the Draft EIS and theproject as a whole.

5. Traffic data

Table 2-4 on page 2-7 indicates that level of service (LOS) on thestudy area roads will generally not deteriorate and, in somecases, actually improve in the long term if the South CountyConnector is not built which begs the question, why this roadwayis even being considered?

Given that delays graded D or better denote a delay of under 60seconds, the City of Maplewood is unconvinced that such a costlyand invasive project is actually needed at all, let alone a “highpriority”.

The Draft EIS contains no information as to where the trafficoriginates from, or where it is heading to, and therefore we feel itis impossible to state with certainty that this project will actuallyalleviate any real problems or if the added traffic capacity willsimply compound the problem or create a larger conflictelsewhere.

When comparing 2007 (before the I-64 closure project began) to2010 (after the I-64 closure project ended), total accidents in theproject area have decreased by 9.6%. Moreover, fatal andpersonal injury accidents in the study area have decreased from76 incidents in 2007 to 42 incidents in 2010 – a 44.7% decrease.To suggest that the traffic and safety conditions are worsening isillogical.

Regarding roads within Maplewood specifically, we note thataccidents on both Hanley Road/Laclede Station Road and BigBend Boulevard have both decreased substantially between 2007and 2010 – by 43.3% and 20.5% respectively.

Accidents are not the only thing decreasing in the study area,local population and the number of vehicle miles drivenCounty-wide are also decreasing. With work from home policiesand technology changing the work world, the need for thisroadway will continue to diminish. The Draft EIS inexplicablydoes not consider these critical issues and utilizes datedpredictive formulas that do not reflect the above referencedproven trends.

6. Multi-modal transportation concerns in the region are severelylacking, and this project will at best have no meaningful effectand at worse create massive barriers to future progress.

As a result of this project, the City of Maplewood stands to lose amuch valued bike and pedestrian trail along Deer Creek and intoDeer Creek Park.

Bike and pedestrian connections are already lacking in Maplewoodand the St. Louis region due to large, heavily trafficked, arterialroadways that cut through our community. We have seen nodetails nor been given any meaningful assurances that thisproject would do anything other than bisect and segregate ourcommunity further. The City of Maplewood is currently workingto implement its 2009 Walkable/Bikeable Community Plan and ispursuing a Bike Friendly Community Award. This project, asproposed, would cripple those efforts.

Portland Oregon has the best bike and pedestrian improvementsin the nation, bar none. They accomplished this feat for only $600million over several years and through much cooperation. It nowincludes fantastic greenways, multiple bridges and on-roadaccommodations specifically catering to bike and pedestriantraffic. The same $110 million budget, which we again assert isvery low and inaccurate, could make the St. Louis region one ofthe premier bike and pedestrian friendly regions in the nation.

We believe that the No Build option was not properly vetted as analternative and should be reconsidered on the basis that thesame amount of funding put into bike and pedestrianimprovements in the same footprint would accomplish the samegoals of reducing traffic, promoting mass transit use, andimprove safety.

The one complaint Ihave heard the most is regarding the headline of this article and Ifind it ridiculous. If the businesses are threatening to leave, letthem. This will be a very attractive business center if the plans gointo place. Right now, Deer Creek plaza has too much parking (evenif it is mandated by zoning) and the thoroughfare con only bringmore visibility and regular business to a shopping center which iscurrently isolated and unknown my many.THE BIGGEST problem with the counties plans, though, asmentioned by my fair city council is the lack of planning ofpedestrian and bike access. As I explained in my post at stltoday<http://tinyurl.com/kovele4> (a small news outlet not quite as ontop of things as the Patch), there is an awesome ability toCONNECT deer creek park, River Des Peres Greenway, theGreenwood neighborhood of Maplewood, Deer Creek Plaza, and allthe Metrolink stations in between by means of this project, but theCounty has no plans of this. Please give me your thoughts on this,just don't give the short-sighter comments I heard at the publichearing. Explain your reasons. Thank you.

Larry Stone June 2, 2013 at 10:07 amThe City of Maplewood is to be commended for their level of duediligence in examining the proposed South County Connector's EISdocument. It lends further substantial credence to the manyreasons this proposed project should not go forward.

The City of Maplewood insists that the EIS must provide somesort of meaningful assurances as well as explicit details as to howthe project will benefit multi-modal transportation. Without thesedetails, your claim of multi-modal consideration and the supposedbenefits that the build alternatives provide over the no buildalternative (page S-11) appears inaccurate.

7. Build alternatives are unpopular

Page S-12 references the open house public meeting commentsthat showed support for neighborhood preservation,transportation alternatives, and minimal community impacts. A9-lane by-pass (including turn lanes) is in no way a reflection ofthese opinions. Building more roads to accommodate morevehicle traffic is not a transportation alternative, nor does itpreserve any sense of community. None of the four corridoralternatives received more than 10% of the first choiceresponses. Such a low level of support for any build alternativewould indicate to a responsible planning agency that the plan anddetails of the plan are insufficient. It seems that in the case ofthis project the desires of the public are secondary to vaguetraffic statistics.

In conclusion, the Draft EIS does not come close to estimatingthe true cost of the project. The cost estimate falls tens ofmillions of dollars short in light of the known problems with theUnion Pacific Railroad Bridge the estimated cost of acquiring rightof way in the now fully occupied Deer Creek Center.

To state there are no alternatives to building the road in the floodplain is disingenuous at the very least, if not outright misleading.

Finally, the negative economic impacts as outlined in the DraftEIS are grossly understated.
