    CONTINUEDthe first officers arrived on scene at about 1:08 AM and observed a male laying on the grounddoor of the vehicle who was later identified as Manuel Esteves DOB 2l22lg2 of 33Farm Road, Seymour Connecticut. He was holding his chest and complaining of chest pain and

    soon after transported to Yale New Haven Hospital. There was a male on the southbound shoulderroadway later identified as Michael Dean DOB7l22l1995 of 41 Smith Street, Derby Connecticuthad some facial injuries consisting of minor cuts and one large, deep cut. He was soon afterRaphael's Hospital for treatment. There was a male in the rear seat trying to selfhimself who was identified as Joseph Staffier DOB 4115192 of 200 Hawkins Street, DerbyHe had obvious traumatic injuries and was soon after transported to Yale New Haven

    there was a second vehicle stopped at the scene which was determined to not have been involvedcollision but arrived on scene seconds afterwards. There were two females on scene from thatwho were identified as Shannon Hannon DOB 8/14195 of 24 Silvermine Road, Seymourand Jordan Ballolli DOB 6/14l1 995 of 134 Albion Street, Naugatuck Connecticut. lt wastwo males had been in the second vehicle and had run from the scene. They were identifiedoseph Feraca DOB 3/13/96 of 47 Manners Avenue, Seymour Connecticut and Travis Hames DOB31 Glenn Circle, Seymour Connecticut.

    Matusovich spoke to Michael Dean, and that Michael stated that Manny (Manuel Esteves)operating the vehicle when it crashed. Ofc. Matusovich detected an odor of alcoholic beveragefrom his breath as he spoke. That Ofc. Matusovich also spoke to Shannon Hannon who saidshe was in a car headed north on South Main Street when a vehicle being driven by Manny, headedsame direction, passed them at a very high rate of speed and they lost sight of it until they camethe bend and found it crashed. Ofc. Matusovich detected an odor of alcoholic beveragefrom her breath as she spoke.

    Officer Oczkowski spoke to Joseph Staffier and asked him who was operating the Honda when itJoseph replied that Manny was driving the car. Ofc. Oczkowski detected an odor of alcoholicemanating from his breath as he spoke. Ofc. Oczkowskithen spoke to Manuel Esteves andhim who owned the red Honda Civic. Manuel responded "l do". He then asked Manuelwho wasit that night and Manny responded "Mike Dean was driving". Ofc. Oczkowski detected an odor ofbeverage emanating from his breath as he spoke. Ofc. Oczkowskithen spoke to Michael Dean

Oczkowskito Shannon Hannon who said they were all at a party, had left the party, and were headed towhen Manny's car passed them, got in front of them and then they found it crashed aroundcorner.     CONTINUEDasked if she was positive she said "Yes I am sure he was driving. We all left the party at thetime and I saw him get in his car". Ofc. Oczkowski detected an odor of alcoholic beveragefrom her breath as she spoke. Ofc. Oczkowski again spoke to Manuel before he wasto the hospital and again asked Manuel who was driving his vehicle. Manuel stated 'll wasmy vehicle" and stated this in the presence of Ofc. Oczkowski and both the Nelson AmbulanceEMS workers that were treating him.

    based on the seriousness of the crash, Officer Santanelli and this affiant were both contacted atand requested to come to the scene to assist in the investigation. Both Ofc. Santanelli and thishave received training in the area of Accident Reconstruction and have been involved in severalof serious motor vehicle crashes resulting in serious physical injury as well as death.That Ofc. Oczkowski contacted Yale New Haven Hospital after Manuel had been transported there andthat blood had been drawn from him during the normal course of business due to him being apatient.That on 1116112 Ofc, Santanelli and this affiant met with Joseph Feraca at the Seymour Policewho provided a two page written statement about what had occurred the night of the crash.other things he stated that he went to a pafi in the woods on Pheasant Drive where a bunch ofwere hanging out and drinking. He stated that he met Manny for the first time and didn't talk to himthan to say hello and get introduced. He said that when everyone Ieft he ended up drivingJordan, Shannon, and Travis as passengers, due to them all being drunk. He said thatget into the drivers seat of a red hatchback car that he believed was a Honda. When he

He couldn't see whoin Manny's car and heard the sirens coming closer and he and Travis ended up leaving.1117112 at about 9:15 AM this affiant spoke to Joseph Staffier on the telephone. Joseph saidhe got discharged from the hospitalyesterday and was moved to Montowese Health andCenter in North Haven as was Manny. Arrangements were made with him to get together

    to obtain a written statement from him in regards to what had happened the night of the crash.speaking to him however, he did indicate verbally that Manny had been driving the car at the time ofcrash, and that he had been in the back seat with Michael Dean.

    CONTINUEDThat on 1117112 Ofc. Santanelli and this affiant prepared a Search and Seizure Warrant Affidavit andfor the medical records of Manuel Esteves 2122192 for his treatment at Yale New Havenbeginning on 10131112. Officer Santanelli and this affiant went to Derby Superior Court andthe affidavit to Judge Matasavage who then approved and subsequently signed the Search

    That Officer Santanelli and this affiant then served the Search Warrant at the Yale New Haven HospitaRoom. Seized were 125 pages of medical records for Manuel Esteves 2122192 from the time hebrought to Yale on 10131112 to the time he was discharged on 1116112. That the records showed thatwere positive readings for Opiates and Benzodiazepines in the Urine Screens and that there wasan Ethanol reading of 181 H mg/dl. The records also showed that Manny sustained left forearm andfractures, a dislocated hip with several fractures, a right ankle fractured in several places, bruising tolungs, and two fractures on the lower Lumbar spine "wings". The records further showed that the righ"posterior and superior dislocation" which would indicate it was dislocated rearward and upward.That this affiant then contacted and spoke to a chemist at the State of Connecticut Department ofand Public Protection Controlled Substance/Toxicology Lab. She was informed of thereadings for Opiates and Benzodiazepines in the Urine Screens and asked for clarification for whameant. She stated that it is just a screening and it shows the presence of those substances. Anythingwould have to be tested from a blood sample in order to give precise information as to types andShe stated that typically, hospitals will hold onto blood samples for one to two weeks from thedrawn.That this affiant then contacted the State of Connecticut Medical Examiners Office in regards to theperformed on Korey Jordan 8113193. This affiant learned that the Autopsy had been conducted onand that the Causation of Death was Multiple Blunt Traumatic lnjuries and the Manner of DeathAccident. This affiant was told to contact the secretary of Dr. Kanfer who had performed the Autopsyto get a Police Notification that would show causation and manner.That on 1118112 this affiant faxed a request to Lynda Dalton of the State of Connecticut Department ofServices and Public Protection Controlled Substance/Toxicology Lab asking for the Ethanolin the hospital records to be converted to a Blood Alcohol Concentration. lncluded was a copyhospitals toxicology page. At about 4:10 PM a reply was received which indicated that a serum

    of 181 mg/dl is equivalent to a "whole blood" Alcohol concentration of .156 gl100ml, using aserum:blood ratio.

    That on 1118112 afficer Santanelli contacted Yale New Haven Hospital to inquire whether the bloodthat were drawn from Manuel Esteves were still accessible. He learned that they had beenthe previous day and were no longer accessible.That on 1118112 Officer Santanelli and this affiant went to Montowese Health and Rehabilitation CenterHaven and met with Joseph Staffier. Joseph stated he was unsure how long he would be in theCenter but that he was starting physical therapy and was starting to walk with the assistance of anurse. He stated he wasn't sure exactly on his injuries but he knew his hips had shifted andput a screw in each hip. His right femur is broken, his thinks his left lower fibula is broken, his pelvistailbone are broken, five ribs are broken ( four on the rear right side and one on the front left side), andalso has fractured vertebrae. He had undergone surgery when he was at the hospital for his injuries.agreed to sign Release Forms for his medical records for when he was at the hospital anddid so.That Joseph agreed to give a written statement and subsequently did provide a 5 page hand writtenwhich he signed. The statement detailed the events leading up to the crash, the crash itself andevents following the crash. Amongst other things he said were that he had been with Manny Esteves,Dean, and Korey Jordan in Manny's car and they had met up with Jordan Ballolli, Shannonguys named Joe, Travis, and some other guy. They all went to a party in the woodsmostly everyone was drinking, including Manny. When they left there, he got into the back seat ofwith Michael Dean. He said he sat behind the passenger seat where Korey was sittingfront, and Michael sat behind the drivers seat where Manny was sitting. He said that Manny wasthe car and they were following Jordan's car which was being driven by the kid named Joe, on

    Main Street. Both cars were speeding and the front car would speed up and then slow down andwas "riding Joe's ass". The music was blasting in Manny's car and they were jumping aroundand having a good time. The other car took off and got way ahead of them and Josephhe and his friends making comments like "they think they're going fast huh?" They were tellingcould beat them and then Manny gunned it, flew through his gears, and they were flying downMain Street. They caught up to the other car by the turn to go towards John's Deli (Pearl Street),the other car had hit its brakes and had almost come to a stop. Manny was already trying to passbut then Manny slammed on the brakes and cut back in, in front of the other car. Joseph estimatedwere going about 1 10 MPH when Manny first slammed on the brakes and swerved back in. He saidalso noticed the other car stopping because he hit Joseph in the arm and they were both"slow down, slow down " He thinks that is what made Manny realize what was happening and whyslammed on his brakes. He remembered hitting the curb and then seeing a telephone pole in front ofHe saw Manny turn the wheel to the left and the tires had no grip and they just slid right into the

    He said he knew there was no way they were going to avoid the pole and remembered thinkingwere all going to die. They hit the pole and he must have blacked out. When he came to, he thoughtwas dead because Manny wasn't in the car. He could see Korey and tried shaking him to wake himHe could see his (Joseph's) leg was snapped and couldn't feel anything below his waist. Thingsup and he heard girls screaming, heard sirens, and saw flashing lights. He saw a firemanin and check Korey's pulse and then shake his head. Joseph started yelling "no" and people werehim to stay still and not move but he was freaking out so he reached up with his hands and grabbedthe roof on the drivers side, pulling himself to the edge of the seat and then out of the car. He fell outlanded on Manny who was sitting on the ground next to the door. He told Manny that Korey was deadManny immediately said "Joey, don't tell them I was driving". He said that the paramedics then came,him on a board and stretcher and into the ambulance. He said things were blurry after that and heremember much of the next couple of days. After he got transferred to the Rehab Center, he saidManny's father came in to see him almost right away, as soon as the transporting paramedics broughtin. He stated that Manny's father was making comments to him about how Michael Dean was drivingcar when it crashed and felt like Manny's father was trying to influence him into saying Manny wasn'tat the time of the crash, when in fact he had been.That after concluding our interview with Joseph, Officer Santanelli and this affiant spoke to a nurse atnurses station and asked if she could contact Manny in his room and see if he would be willing toto us. A few minutes later she returned to the nurses station and said that Manny did not wish toto us, and that he said he had a lawyer.

    Officer Santanelli and this affiant then proceeded to the the Yale New Haven Hospital Medicaland presented the clerk there with the original signed medical release authorization formshad signed earlier. The clerk did turn over 151 pages of medical records for Joseph Staffierfor his treatment while at Yale New Haven Hospital from the time he was brought there onuntil the time he was discharged on 1 116112. ln reviewing the reports it was found amongst otherthat he sustained four broken ribs, a broken pelvis, broken vertebrae and sacrum, and severalto the right femur which required a metal rod. Additionally, it appeared that screws were alsoin his hips.That on 11110/12 this affiant took a three page typed statement from Shannon Hannon regarding theof the crash which she swore to and signed. She provided great detail about the night including

    the bonfire and drinking. She stated that Manny Esteves was driving his car when they left theand headed on South Main Street. She further said that Manny drove past them "really really fast",remembered somebody giving them the middle finger through the rear window.

She stated that Manny said to her "do me a favor, I wasn't drivinwas driving". She then saw Joey laying in the back seat unconscious who woke up soon after andhimself out of the car.

    Thal on 11111l12lhis affiant took a three page typed statement from Jordan Ballolli regarding the nightcrash which she swore to and signed. She provided great detail about the night including attendingbonfire and drinking. She stated that when they left the party she saw Manny Esteves get into theseat of his car and that he was driving it and pulled alongside the car she was in just prior to themThey then left and got out onto the main road and Joey Feraca was driving her car and was doinglimit. Manny then passed them and "they were going real fast". Someone gave them the fingerthe passenger window and Joe Staffier told her after the fact that it was him that did that. She lost sightManny's car and 5 to 10 seconds later they rounded a bend and found his car smashed up. She ranthe car and saw the drivers door was still closed and Manny was still in the drivers seat. The doorthen Manny fell out of the car and onto the road. When he fell out Manny said "don't tell themdriving, tell them Joey was driving". She said she saw Joe Staffier in the back seat and he was yellingme" and then he got out of the car too. She could see Korey in the car and he wasn't moving and shhe was dead. She said she talked to Michael Dean who was on the other side of the road and that hher there was a little space that he was able to crawl out of.on 11l12l12lhis affiant took a three page typed statement from Michael Dean regarding the night

    crash which he swore to and signed. He provided great detail about the night including attending thedrinking. He said when they left, they walked down to the cars and he got into the rear driversof Manny Esteves car, Joe Staffier got into the rear passenger side of Manny's car, Korey Jordan gotfront passenger seat and Manny got into the drivers seat. They left and were following a group ofthat were in Jordan Ballolli's car and some boy was driving it because Jordan was pretty drunk.car kind of sped up so Manny started going really fast to catch up to them. There were no carsthe music was really loud so Manny yelled "all right, I'm gonna pass these fuckers". He saidwas going really fast and started passing them and the other car was probably just doing the speedManny kept speeding up faster, shifting, and going faster and passed them and cut back in by the iceshop. There was a curye in the road and they were going too fast for it and Manny tried turning anthe brakes and they started sliding and went right into the utility pole. He said that he was able toManny's door and fall out of the car. He asked if everyone was all right and the only person who saidwas Manny who said "what the fuck just happened". He then got up and went across the street,911, and then cops were showing up.

    That Michael stated he was brought to St. Raphaels Hospital in New Haven and had cuts on the righthis face that needed 8 stitches, and he was told to follow up with a plastic surgeon in the future.also had a really bad sprained right ankle that he needs to follow up with with an orthopedic doctor. Hisforearm was very sore and there were minor cuts and bruising to his right shin and left knee.That on 11120112 a Notification to Police fax was sent to this affiant by the Office of the Chief MedicalThe form indicated that Korey Jordan was deceased on 10131112, an autopsy was performed

    1112112 and that the cause of death has been certified as "Multiple Blunt Traumatic lnjuries" and theof death has been certified as "Accident". The original form was also mailed out and this affiantit on 11125112.

    That on 11126112 this affiant took a one page typed statement from Travis Hames regarding the nightcrash which he swore to and signed. He provided some detail about the night including attendingbonfire and other people drinking. He said he was with his friends Shannon Hannon, Jordan BallolliJoey Feraca and that another group of kids followed them to the bonfire. He said that he only knewthem and that was Korey Jordan, and that they were in a red Honda. He said when they left thedrove Jordan's car because she was too drunk, and they were going to go to McDonalds.kids in the Honda were going to follow them and he saw Korey get in the front passenger seat. He didthe kid who was driving but said he thinks he had a little facial hair, and may have been PuertoHe said he could probably lD him from a picture. They all left the party and got onto South Mainwere doing the speed limit and then the red Honda passed them at a "really high rate ofJoey kept driving and a few hundred feet down the road they came upon the Honda crashed inroadway. They got out of their car and Joey started running so he ran too because he was scared ofhe saw. He said he didn't remember where anyone was in the crashed car at that point.during the initial on scene investigation Officer Santanelli and this affiant made severalof the scene and took measurements of the scene. Sergeant King also took severalof the scene. One of the observations made was the presence of black tire marks thatto be made by tires skidding. One mark was determined to have been made by the left front tirevehicle and was approximately 314.5 feet in length from point of origin to point of impact.mark was determined to be made by the front right tire of the crashed vehicle and was140.3 feet in length from point of origin to point of impact. The skids started on relatively flatlevel ground and continued on a downhill grade to where impact was made with a telephone pole.

    then rotated about 180 degrees clockwise to where it came to rest in the travel lane. Thedry at the time of the crash, the temperature was about 51 degrees out and the area wasdark due to there being no power as a result of a hurricane that had recently occurred.
