We have already started on building a smoking facility on the west side of our property. To offset the cost of the construction and replenish some of our building funds, we will be selling “engraved bricks” for $50 each and placement of the bricks on the walkway is on a “first come - first served” basis. So come in and pick out your spot, as soon as possible. Why we must be “smoke free” I will try to explain as briefly as hu- manly possible. In 2002 a voter amendment was passed by over 71% vote. The Florida legislature created FS 386, which allowed us to designate a por- tion of our facility to be smoke free, still allowing us to smoke at the bar. In 2003 several restaurants challenged the legality of the amendment. In 2007 it went to the Appeals Court of the state of Florida. The Court ordered a clarification of the amendment. FCIAA immediately responded with the following conditions for public and private clubs. A facility which pays employees State Compensation Insurance must be smoke free. This includes vendors who are allowed access for deliveries to the interior of the building. A facility which allows entrance to anyone under 18 years of age must be a smoke free facility. Families are always welcome at our lodge. A facility which grosses more than 10% total revenue in the same facility, wether affiliated or not with food sales, must provide a smoke free facility. Only members and not guests who are served by volunteers are allowed to smoke and drink in a membership association. If guests or associate members are served or allowed access, the facility must be smoke free. In November 2007 the FCIAA requested funding from the state to enforce the smoking ban. $57 million of the settlement from big tobacco was earmarked for this purpose. Since November there have been less than 12 membership organizations warned or fined for violating the smoking ban in Florida, including our own District. The Pompano Elks facility was warned to comply or forfiet its license. We in the lodge management, are all going out of the way to comply with these developments and making transition as easy as possible. As Elks, we took an obligation to uphold the statutes of the State of Florida. Your cooperation and support of these new developments and endeavors, would most certainly be appreciated. At this time, please step forward to support the lodge. Volume 39 Number 12Sal Grilli - Exalted Ruler

I am very pleased to announce we are now a “cyber” Lodge. Please feel free to bring your lap top to the lodge, so we can show you how to access the net and enjoy what is now available to you.

On a more somber note, which has been met with much contro-versy, I must let all members know, as of February 15th our entire indoor facilities will be “smoke free”.

Why we must be “smoke free” I will try to explain as briefly as hu-manly possible.

In 2002 a voter amendment was passed by over 71% vote. The Florida legislature created FS 386, which allowed us to designate a por-tion of our facility to be smoke free, still allowing us to smoke at the bar.

Elks Charity News #2365The Lodge Continues to support

~ Children’s Therapy ~ The Harri Anna Trust ~~ The Florida Youth Camp ~

~ Boy Scouts of America ~ Elks National Fund ~

The holidays are over but we still are keeping up the good work thanks to our members.

We have donated three cases of candy to the Pembroke Pines VA nurs-ing home and will be taking books and magazines to them this week. Our veterans chair, Jesse Clemence, is also planning a bingo and bbq over at the home as soon as we can get a date and Larry Galvin has collected some really wonderful items from our Naval Fleet for prizes for the vets. We are send-ing a check for $1000 from Hollywood West to Grand Lodge for the Elks Na-tional Foundation Fund. We have do-nated $250 to our Scouts that meet at our Lodge on Mondays, chaired by Jim Blanchard. This week we will have a caravan of members delivering cell phones, clothing, toys and lots of stuff for the Women in Distress Thrift Store. The store generates the income to keep their “Safe Houses” open and we are proud to be a supporter of it. We also had a committee of ten members spend a lot of hours to grade 19 of the ENF Scholarship applications that are brought in January. Hopefully we will have a winner again this year.

Thank you for your donations and please keep them coming.

Please remember we always need your donations of clothing, glasses, cell phones, toys, books (audio and

large print) magazines, pop tops and stuffed toys for the different

community charities we deliver to.

Thank you, Jeanne Coffey PER

In the years that I have been writing this column, this is the hardest that I have ever had to write. The reason is simple, I have to report on news that none of the Officers agree with, the Trustee’s do not agree with, the House Committee does not agree with, and many of our members do not agree with. That news is that as of February 15 we can no longer permit smoking in the Social Quarters.

You will recall that a few years ago a revision to the Florida Constitution was passed that severely limited smoking, particularly in restaurants. Although private clubs were specifically exempted by this Amendment, when the rules were promulgated by the State, lodges such as ours were included. These rules were challenged in court, and, in November, the Court of Appeals ruled in favor of the State. The Legislature allocated millions of dollars to enforcement and directed the State Department of Alcohol Beverage and Tobacco to strictly enforce these provisions.

A number of lodges around the state have already been raided and fined. Some are facing revocation of their beverage licenses. Two lodges in our district are among these. It is clear that if we continue smoking, we run the risk of losing our license and that would be a catastrophic blow.

At the recent District Deputy’s Workshop, it was pointed out that we have all taken a solemn and binding obligation that included upholding the Constitution and Laws of the United States. We can’t pick and choose those laws that we agree with, but must obey them all.

Please understand that this is not something coming from within the Elks organization, but is a result of this increased enforcement effort. We will be making some kind of accommodation to provide an acceptable smoking area.

On a happier note, NASCAR returns this month with the 50th running of the Daytona 500. The Lepruchans are planning the St Patty’s Day Gala for March 15, so make your plans now

See you around the house,
