I/We hereby Tender for MAHARASHTRA STATE ELECTRICITY DISTRIBUTION COMPANY LIMITED for the work in the written memorandum with the time specification and in accordance with respect to the specifications, designs, drawing and instruction in writing and as per Annexure of Contract.

TERMS AND CONDITIONS

1. Area of Operation: The Executive Engineer in charge of O & M Kalyan West Division would decide the area of operation and Sub Division wise no of persons to be engaged on outsourcing basis. The outsourcing contract will be finalized by Executive Engineer as per the vacancy position under Sub Division.

2. Scope of work:i) Line and Sub Station maintenance work.ii) Release of New Service Connection.iii) Maintenance of records as directed including maintenance of complaint register.iv) Attending the complaints as directed by Controlling Officer.v) Computer Data Operator.vi) Office Assistant / Peon work.vii) Any other work as assigned by the Controlling Officer.

3. Period of Contract: Such contract will be given initially for a period of Three Months and will be extended further as per availability of the vacancies. This contract will be purely on adhoc basis and the contract will not be extended beyond the period of 180 days for any reason.

4. Qualification of Persons to be engaged by the outsourcing Agency:i) Should have passed – ITI (Electrician) from recognized institute preferably ex

apprentices of the Board.ii) Person should have passed HSC

5. Safety Precautions and Accidents :i) Adequate precaution shall be taken by the persons sponsored by Agency / Society to

prevent damage to various equipments.ii) All safety measures, procedures laid down by in the statutory Acts & Rules and also

laid down by the MSEDCL shall be observed by the persons sponsored by the Agency / Society of the Apprentices.

iii) Persons sponsored by the Agency / Society of Apprentices shall follow operating instructions issued from time to time by the MSEDCL and Controlling Officer scrupulously.

iv) The persons sponsored by the Agency / Society of Apprentices shall the use of safety equipments properly.The Agency / Society of Apprentices shall be solely responsible for safety of their persons. The Agency / Society shall also be responsible for payment of compensation

in case of any accident to their persons of any nature eg. Electrical / Mechanical fatal / non-fatal etc. etc.

v) The Agency / Society shall apprise the persons sponsored in clear terms that they shall not be entitled to claim any recruitment for whatsoever post / vacancy or lien over any such post / vacancy in MSEDCL in any manner.

vi) The Agency / Society of Apprentices shall be paid at least at the rate as prescribed under Minimum Wage Act.

6. Responsibility of any loss of or damage to MSEDCL Property.

The persons sponsored by the Agency/Society of Apprentices should take all the precautions to ensure that no damage is caused to any equipment / property of the Company due to any action on their part . In case of damage the same will be recovered from the Agency.

7. Security Deposit.The Agency will be have to pay Security Deposit in Cash or by D.D. amounting to 5 % of the Contract value within weeks time from the date of receipt of the order.

8. General i) All the statutory of various Acts and Rules of the Central & State Government

shall be observed by the Agency / Society of Apprentices ie. Minimum Wages Act – 1948, Child Labour Act & Regulations Employees Liabilities Act, 1938, Workman Compensation Act, 1923, LD Act, 1947, Acts of Income Tax, Service Tax, Work Contract Tax.

ii) The ex Apprentices of the aforesaid Societies / Agencies will not be eligible for any claim whatsoever for recruitment in MSEDCL to any post.

iii) The Agency / Society of Apprentices should also comply with followingElectrical Supervisory Licensee to authorize contract persons to work on MSEDCL Lines / Equipments to comply the provisions in the IE Rules 1956, Rules 36 (2) and 45. The Agency / Registered Society of Apprentices should posses Electrical Supervisory License.

9. The persons sponsored by the Agency shall maintain good moral character and decent behavior with all concerned and consumers .They shall not include in drinking liquor . any persons found behaving in a manner contrary to above , shall be replaced forthwith by the Agency / Society of Apprentices .

INSTRUCTIONS TO THE TENDERER

Sealed and super scribed rates are invited from reputed and experienced agency for contract for the work of Providing services of persons for carrying out the jobs like – Meter replacement, disconnection of consumers, line maintenance, Office Assistant, Peon’s duty (Office Boy) etc. etc. and also the work as directed by S.D.O. Bids are to be submitted in two parts:

Part- A shall contain qualification details to meet the work requirement i.e. Technical Bid.

Part- B shall contain the financial offer

The bid shall be furnished in the following manner.Documents required should be enclosed in 'Envelop No'. I and price schedule should be enclosed in 'Envelop No. II'. If all documents are found in envelop I then only the Price Schedule in envelope No. II will be opened. Incomplete offer will be rejected.

All the two envelopes should be put in one main envelope and must be superscribed “Bid offer against TN – 7 pacakage.”

2. Area of operation :- Jurisdiction of Kalyan West Sub Division I.

3. EMD of Rs. 5,000/- is payable by Demand Draft in favor of Maharashtra State Electricity Distribution Company Limited drawn on any Nationalized Bank situated in Kalyan (West). The EMD can also be paid in Cash in the Office of the Executive Engineer, MSEDCL, O&M Urban Division Kalyan West. Tenders submitted without earnest money are liable to be rejected. EMD is exemption person should be quoted along with the necessary documents for EMD exemption otherwise tender liable to be rejected.

4. The tender documents shall be issued to the competent tenderers on non- refundable cash payment of Rs. 500/- (Rs. Five Hundred only) in case of collection in person and Rs. 550- (Rs. Five Hundred Fifty only) in case of it is to be sent by post. The payment is by way of D.D. drawn in favour of Executive Engineer, MSEDCL, Kalyan West payable at Kalyan only. The cost of the specification once paid will not be returned under any circumstances. In case the tender is down loaded from website (www.mahadiscom.in) then the cost of the tender schedule i.e., Rs. 500/- shall be paid along with the bid by way of D.D.

5. The tenders dully filled in shall be submitted in person in the Office of the Executive Engineer, MSEDCL O&M Urban Division Kalyan (West). Tenders will be opened, if possible on the due date at 15.00 hrs, at the above office in the presence of such tenderers who choose to remain present.

6. Period of contract will be not more than Three months from the date of placing of the order.

7. The successful tenderer shall be required to pay the Security Deposit amounting to 5% of the value of the contract either by DD / Bank guarantee / Pay order etc.

8. This is the work to be executed according to our requirement. The tenderer is requested to get inspected all the Kalyan (West) Division area including sub division particularly the roads and see for himself the site conditions regarding approaches and all the other matter affecting the work before filling the tender .

9. The tenderer should posses the Registration certificate of Sanstha, Firm License, Permit, PAN card, P.T. Registration No, Electrical License, Supervisory License, PPF registration with details etc. as required under relevant status.

10. Preference will be given to Registered Berojgar Sanstha.

GENERAL TERMS AND CONDITIONS

The tenderer shall indemnify the MSEDCL against any payments to be made under and for the observance of the regulations, for the time being in force without prejudice to his right to claim indemnity from his subcontractors.

1. The tenderer shall be responsible for rectification of defects immediately from date of placing of order onwards from the certified day of completion of work by the MSEDCL. This period onwords shall be known as Defects Liability period. Any defects during this period shall be rectified immediately. If the same is not carried out immediately the tenderer is liable for penalty like Rs. 100 / - The MSEDCL have the right to get it done departmentally or through any other agency. The cost of the same shall be recovered from the tenderer

2. All the works should be guaranteed for the contract period from execution of work and agency must give the decide out put.

3. If the tenderer has any doubt about the meaning of any portion of the tender he should at once get clarification from Executive Engineer in writing sufficiently in advance and also personally meet him in this respect, before the due date. No additions or alterations in the tender form / conditions etc. should be made by the Tenderer. Tenderer should quote his rate in the schedule.

4. The tenderers must return the form of Schedule duly filled in the rates in figures and in words in Schedule duly signed .Any schedule not bearing the signature of the Tenderer, the tender is liable to be rejected.

5. Special attention is invited to the requirements that all corrections must be initialed and dated by the tenderer and that all the pages should bear the full signature of the tenderer at the foot of each page and each schedule should bear the seal of the tenderer.

6. Tenders which do not fulfil all or any of the above conditions or incomplete in any respect are liable to be rejected.

7. The submission of a tender by a tenderer implies that he has read these instructions the conditions of contract etc., after acceptance of the offer we shall not pay any extra charges for the lead or for any other reasons in case the Tenderer is found later on to have misjudged himself.

8. Tenders shall remain open for acceptance for a period of 90 days from the date of opening of the tender. During this period no tenderer shall be allowed to withdraw his offer. Any such withdrawal during the said period will entail forfeiture of the Earnest Money deposited with us.

9. The Tenderer should furnish details of his organization, technical experience, equipment and financial capacity to carry out the works set out in the tender within the time stipulated for completion. He shall furnish details of value of works, authority under whom it was executed and period of completion, during the past three years.

10. The right to reject any or all the offers is reserved by Ex. Engg. Kalyan West Division and we will not be bound to accept any offer without as signing any reason thereof.

11. Tenderers shall submit his offer in the form of the schedule enclosed of quantities and rates, any tender not bearing signature of the Tenderer on all the documents accompanying the tender is liable to be rejected.

12. Before submitting his tender the tenderer shall examine closely the specifications and carefully study all documents.

13. The tenderer is requested to visit the site and for himself the site conditions regarding approaches, material, transportation labour etc. and all the other matter affecting the work, before filling in the tender . The tenderer is further requested to study the specifications to the

tender and then submit his offer .The company shall not, however, after acceptance of the contract rate pay any extra charges for lead or for any other reasons in case the agency is found later as to have misjudged himself .

14. The firm / agency / Sanstha must arrange for all conveyance and include all such cost in the rates quoted by them for work .

15. The schedule of quantities as indicated in this tender are approximate some variation is possible while finalizing the Tender.

16. Any part of the contract shall not be subject without the written permission of the Executive Engineer or his authorized representative.

17. Further information required , if any, can be had from the Office of the Executive Engineer, but it must be clearly understood that the tenders must be received by the due date and time and according to the instructions .

18. These instructions shall also form a part of the contract. 19. Time is the essence of the contract : Time being the essence of the contract , various items of

works shall be completed in accordance with the work time programmed decided by the Engineer-in-charge

20. Payments : Payments will be made in reasonable time on submission of bills by the agency and necessary measurements in M.B. Books by Engineer – In-Charge.

21 Income Tax : Income tax will be deducted from the contractor’s bill as per rules unless the necessary exemption certificate from the income tax authority for the purpose is produced well in time.

22. The work involved is within specified times and as per approved methods wherever required. 23. In case of breakdown in power supply the work will have to be carried out continuously till it is

completed.24. The undersigned reserves rights for modification or cancellation of the tender at any stage.
