    Dear Sir,

    Most respectfully it is to submit that I am an Officer of 1989 batch of Indian PostalService. In the month of April 2011, I received summons from your Hon'ble Court in which Ihad beendirected to appear as a witness for recording evidence under Section 16& 244.Accordingly I attended the Court on 20.04.2011 as witness in the faujdari case beforeyour Hon'ble Court. (Annexure-I) My problems started immediately after that. My tourprogram for court attendance at Indore had been duly approved by Member (PLI) and at thetime of submission of tour program I had requested the Department to withhold permission asI was under tremendous tension due to pressure from several senior officers to either givestatement in favor of Shri Gauriar or to not attend the court at all. Thus I had requested for theDepartments protection for avoiding Court attendance vide my note dated 11.04.2011.(Annexure-2) However file was received back conveying the approval for tour by Member(PLI) and an amount of Rs. 10,000 was also granted as advance by the Admn. Branch basedon this approval.

    2. Thereafter I proceeded on tour to Indore on 18.04.2011. However on my return fromIndore I came to know that on 19.04.2011, Member PLI re-called the tour program File No.DIR(WS)/Court Cases/2011 pertaining to approval of my Indore visit after I had alreadyproceeded on tour and hastily withdrew the already granted permission.3. Thus my TA bill of Rs. 10,070/- (Rs. Ten thousand and seventy only) has not beenallowed till date. I addressed the Directorate vide my letter No. Alcs-R/10-361/2011 dated,24.08.2011, 01.09.2011, 12.09.2011 and 28.09.2011 but no reply has been given to me.

    As per Swamys FR&SR Part-II Travelling Allowances, vide G.I MHA O.M No.F.15/3/57-Judl. II dated 17th December 1957, as per Para 1(ii) I am entitled for fullreimbursement of travelling allowance in a criminal case in which the State is not a party asunder-1ii). In criminal cases to which a State is not a party. a Government servant givingevidence regarding facts of which he has official knowledge, will be paid travelling allowanceby the summoning court according to the rules under which such Government servant drawshis travelling allowance for a journey on tour, and the cllarges will be borne bv the CentralGovernment or the respective State Government according as the Court is situated in aUnion Territory or in the respective State.4. Thus as per these government rules I am entitled for reimbursement of travelexpenses. I had submitted vide my File Note dated 27.04.2011 and 05.05.2011 that I had notattended the Court on my own volition but it was on the receipt of summons from the Hon'bleCourt. Moreover I had neither filed the case nor was I a party in the case, therefore the

    question of considering this court case as my personal case does not arise. I am not adefendant in the case & hence attending the court at my own level does not arise. This is acase in which a Government Officer has been ordered by the Court to depose before it andgive evidence regarding facts of which he has official knowledge. Thus my evidence wasstrictly related to my official work having worked as DPS Indore, in my official capacity.However my plea was brushed aside by the then Member PU, Maj. Gen. V. Sadasivam, whohas since retired from service on 31.05.2011.5. The officers in the Department are hounding me and I have become a victim ofinstitutional bias as they feel that I should not have attended the Court in a case filed againstan Officer of my own service. My plea is that on my own I could not have refused thesummons or the directions of the Court and unless the Department provided me protection itwas not possible for me to disobey judicial directions. Moreover truth is easier to rememberbut if I had said anything to the contrary I would have fumbled and got into trouble. Thushonesty is the best policy. I have not flouted any rules and have acted in the best interests ofthe Department. I have followed all government directions, as contained in the Postal Manualsin letter and spirit and to the best of my abilities :-Rule-204-A of Postal Manual Volume-III under subheading Responsibility204.- A. Instructions for regulating the enforcement of responsibility or losses.1. The cardinal principle governing the assessment of responsibility is that every publicofficer should exert the same vigilance in respect of public expenditure and publicfunds generally as a person of ordinary prudence would exercise in respect of theexpenditure and the custody of his own money. While, therefore, the competent authoritymay, in special cases, condone an officer's honest errors ofjudgement involving financial loss,if the officer can show that he has acted in good faith and done his best upto the limits of hisability and experience, personal liability must be strictly enforced against all officers who aredishonest,'careless or negligence in the duties entrusted to them.

    Thus there was no cause or reason for not allowing the Court attendance Tour Bill. Ido not know the reasons as to why Shri Ravi Poddar has filed faujdari case against ShriSantosh Gauriar or why in retaliation, Shri Gauriar filed a case against Shri Poddar in theMadhya Pradesh High Court. It could be possible that both the parties have some pastdifferences and perhaps some dispute with each other. But unfortunately I am being penalizedfor no fault of mine and for carrying out the orders of the Court. I feel I have unnecessarilybeen dragged into this fight between two parjies. I personally do not have anything to do withthe case. I had not volunteered and approached the Hon'ble Court for giving any statementand instead it was on the orders of the Hon'ble Court that I attended as Witness.6. It was after I first received summons in the month of July 2010 delivered on28.07.2010 with directions to be present in the Court on 12.08.2010 that tremendous pressurewas brought upon me by Shri Santosh Gauriar. I could not bear the tension and stress due toveiled threats and fell ill and could not attend the Court despite my tour program having beenapproved (Annexure-3). Thereafter to put me under pressure, all work was withdrawn fromme and I was kept without work & despite my numerous requests and noting in File No.DIR(WS)/Misc.l2011 vide my Note dated 11.04.2011 and submitted another reminder Notedated 23.05.2010 to DDG(P) but no response was received and I was misguided by theDirector(Staff) and given the impression that I would be adjusted against the existing vacantpost in the Directorate. Thus I remained without work which is very demoralizing for aworkaholic like me because the very purpose and life force had been taken away. All this wasdone to make my position vulnerable and weak and to break my spirit. Such a situation hadnever happened before in my entire service career and I am known to be an efficient andupright officer. The Department has awarded me the Dak Sewa Award in the year 1995 and

    Excellence Award in 2002 and I have received various other awards and appreciation lettersaswill be evident from the contents of Annexure-4.7. It was after I gave Statement in the Court in the month of April 2011, that I wasabruptly transferred from Delhi in the month of June 2011 vide DG Posts Order No.2-8/2011-SPG dated 3rd June 2011, despite the fact that I was not due for transfer and I was the secondseniormost Director and posts were lying vacant at that time and very junior officers wereworking on ad-hoc basis against regular posts of Directors. Moreover I had completed onlyone year whereas tenure is of 4 years. In the Directorate my working was exceptional, as Ihave been graded as Outstanding. (Annexure-5) There was also no complaint against me.Thus there-was no reason or cause to transfer me out of the Directorate so abruptly.8. Shri Santosh Gauriar (IPOS 1978 batch) is very powerful and due to being in a verysenior position had access to the then Secretary Posts, Smt Radhika Doraiswamy (IPOS 1974batch). Smt Radhika Doraiswamy who recently retired from service on 31.10.2011, is knownto go out of her way to oblige corrupt officers and has sympathetic attitude for any officialshavinl corruption cases against them and takes up their cause with fearless zeal. Thus I wastransferred from Delhi to Chandigarh whereas Smt S. Ravichandran who had a CBI caseagainst her in a bribery case and had also remained under suspension, was adjusted in theDirectorate against the vacant post of Director (Training) and I was simultaneously shuntedout.9. I was transferred and posted to Chandigarh against a comparatively junior post ofDPS(R) as the DPS (HQ) belongs to 1997 batch and there was precedent available in thepast as swapping of incumbents against the two posts had taken place between officers withthe senior officer being posted against post of DPS(HQ). I was deliberately posted toChandigarh to work under Smt Ranju Prasad, an officer who is not only his protege but alsobelongs to the home state of Shri Gauriar and who had a tainted service record as she hadbeen chargesheeted in a CBI case against her and had been placed under suspension in theyear 1996-97 and the charge of her office had been taken over by me under dual chargearrangement and I had been directed by the Department to hand over all relevant records andassist the CBI. Thus it is evident that this transfer had been ordered deliberately to humiliateme and put me under pressure.10. I am being harassed on a daily basis and have been denied even basic facilities likeofficial inspection vehicle; stenographic assistance as per my entitlement, lap top computeretc and all work has once again been withdrawn from me. The DPS (HQ) who belongs to1997 batch and is much junior to me has been provided all of these facilities. This has neverhappened to me in the past because I have worked in Punjab Circle as Director from03.03.2004 to 31.06.2005 and had been provided all these facilities by the Department. It isonly now that all facilities have beenwithdrawn without citing any reasons.11. I had been taking the matter lightly thinking that all these incidents are a merecoincidence but after persistent affronts, repetition of situations and going through the seriesof events it is evident that Shri Santosh Gauriar has orchestrated and influenced other officersin the Department due to his high position and they have taken the easy option of complyingwith his wish. Now I am convinced that the creation of false evidence at a later date i.e, oneLetter dated 04.05.2009 (Annexure-6) of Shri S.M Pingle the then A.D (Bldg) with referenceto RO Indore Letter No. D PS/ C O N / 2009 dated 04.05.2009 is a part of a larger conspiracy andhas been created at a later date at the behest of Shri Gauriar in order to implicate me. Irecollect that during recording of my Statement in the Hon'ble Court, I was asked whether Ihad abused & forced Shri S.M Pingle the then A.D (Bldg) to sign the Inquiry Report dated19.02.2008. I was shocked and taken aback and had denied the baseless allegation that hadbeen leveled against me. I was then shown Letter dated 16.09.2009 of the 0/0 PMG Indore inwhich a summary Note (September 2009) had also been attached. As per Para-5 of this letter

    the following submission was made in bold font before the Hon'ble Court to create animpression that this is the government stand and official statement of the Department in orderto mislead the Hon'ble Court :-PARA - 5 of PMG Indore Reply dated 16.09.2009 submitted to Court-5. The enquiry report of Shri S.M Pingle, Assistant Director (Estt & SO) dated19.02.2008 has been found null and void as it was fabricated and got signedunder duress by Shri Ping Ie. Shri Pingle neither created this report nor got a

    chance to read it before signing as revealed by him in his written statementdated 4.5.2009 given before the present Director. (Copy enclosed)In such instances, the normal course is to take Disciplinary action against any officer

    who forces another officer to work against his conscience and which is against governmentinterest. But no such action was ever taken. Instead the Letter dated 04.05.2009 of Shri S.MPingle the then A.D(Bldg) with reference to RO Indore Letter No. DPS/CON/2009 dated04.05.2009 was enclosed as evidence. (Annexure-G) It is felt that the very fact that Shri S.MPingle brought this matter on record after such a long gap of one year two months aftersubmission of inquiry report, as his report is dated 19.02.2008, it is evident it was anafterthought & this letter dated 04.05.2009 had been written under duress as Shri S.M Pingleretired on 30.06.2009 & had just 01 month left for retirement & therefore succumbed to thepressure tactics of Shri V.C Roy, the present DPS Indore, who acted at the behest of ShriSantosh Gauriar. Thus Shri Gauriar, who must have been the mastermind behind it, has goneto the extreme extent of building false evidence at a later date in violation of Section 209 ofthe Indian Penal Code which states as under :-Section 209 of IPC - Dishonestly making false claim in Court - Whoever fraudulently ordishonestly, or with intent to injure or annoy any person, makes in a Court of Justice anyclaim which he knows to be false, shall be punished with imprisonment of either description fora term which may extend to two years, and shall also be liable to fine.

    Thus now I am convinced and have a genuine fear that I will be falsely implicated inthis case as Shri Gauriar is very influential and he is capable of manipulating the system to hisadvantage.12. During my posting in Delhi I was staying with my parents and brothers family and Ihave been deliberately transferred to Chandigarh in the same junior position where I hadworked in 2004-05 in order to isolate me and all government facilities to which I am entitledand which I had been provided in the past have been denied to me and conditions are beingcreated deliberately and I am being forced to travel by public transport without anyIPO/ASPOs to accompany me so that my situation is vulnerable and I become an easy target.As a result I am fearing for my life as I can be easily knocked off & it can be passed off as anaccident and there will be no witnesses. Therefore I pray to the hon'ble court to provide meprotection as I fear that I may be eliminated and as a precautionary measure, I have restrictedmy movement to the bare minimum, as I do not have any support system or protection. I am asingle woman presently staying all alone in Chandigarh and my life is in danger as I am facingconstant threats. Since I had attended the court and gave statement on the directions of theHon'ble Court. therefore I request you to please intervene in the matter and provide meprotection.13. Shri Santosh Gauriar has recently been promoted and joined as Member (0) in theHeadquarters Directorate at Delhi and is holding a powerful position and will be retiring fromservice on 31.05.2012. The DDG (Vigilance) in the headquarters at Delhi on promotion has.been posted in his place as Chief PMG Madhya Pradesh Circle. The work situation hasbecome very dangerous and I fear for my safety, life and liberty. Shri Santosh Gauriar is very

    ..powerful and has access to powerful people holding high positions. I am not in a position toretaliate in any way being in subordinate position. Already my service career has been ruinedby him but if this faujdari case against him is closed then I feel that the officers in theDepartment will at least stop threatening me and I will have peace of mind. At present, I amfeeling insecure. I am being persecuted for saying the truth before the Hon'ble court.Therefore, I request your honour. to kindly close the faujdari case against Shri Gauriar forwhich I will always remain grateful to you for this kind gesture, as closure of the case couldperhaps end this institutional bias against me and from officers of my own service and cadre,and end my troubles.

    Subject -Court Attendance - regarding.

    This is regarding Court Summons from Indore Court for attendance ofundersigned on 20.04.2011.2. I received a call from the Reception of Dak Bhawan on 8thApril 2011that a Delhi Police Official wanted to meet me. Thereafter a Delhi PoliceInspector in plainclothes met me & delivered a copy of summons forattending Court in Indore on z o " April 2011. I asked him the procedure incase I am unable to attend due to any unforeseen, emergent reasons. Hesaid in that event the Court will first issue a bailable warrant & then it willissue a non bailable warrant to ensure attendance & that Court attendancecannot be avoided. He advised me to attend the Court & if I feared anythingthen I can be provided Police protection but it will not be proper to ignore thenotice. A copy of the notice is placed at 5 /c which may kindly be perused.3. In this regard it is to submit that an RTI activist based in Indore hadobtained photocopies of records related to various construction activities inthe FN 2006-07 under RTI Act and copies had been provided to him afterobtaining the approval of Shri Santosh Gauriar. the then PMG Indore inrelevant RTlfile. Thereafter it seems the RTI Activist filed a case in Court.4. . I have nothing to do with the case because I do not know anythingabout procedure adopted for floating of tenders or allotment of work to thecontractors etc.' pertaining to any construction activities in year 2006-07because the channel of submission of file pertaining to construction mattersin R.O Indore at that time was from AD (BD/Bldg) direct to PMG (Indore) andthe files were not handled by me at any stage. It was only after the joining oftwo Assistant Directors, who had newly joined Regional Office Indore, thatthe files were submitted and when the Contractors submitted Bills for variousitems of work & the concerned Assistant Directors scrutinized the Files theycould not find. any work order or. details of work to be carried out bycontractor. Shri R.C Borkhadia the then Assistant Director who had sinceretired and had handled the Case files was requested to attend RegionalOffice, but he also could not locate any such records or show the writtenorders in respect of the works billed by the contractor. Shri Santosh Gauriarthe then PMG lndore had ample time from 01.04.2007 to 02.06.2007 but healso did not sanction the bills. Thus the concerned Assistant Directors listedout several shortcomings and as a result the bills could not be sanctioned.5. Thus I am not in a position to tell the Court anything about the tendersfloated or work awarded, if at all I have to give any statement then it will berestricted to facts on record, beyond that I have nothing to say in the matter.6. However since the case is against a very senior officer of theDepartment, therefore in case the Department withholds permission to me for
