Foreword

This is the 2015 highlights report of the Maastricht European Private Law Institute (MEPLI). MEPLI conducts fundamental research in the field of European private law, covering the law of contract, property and tort, but also European procedural law, European legal theory and European legal history. MEPLI was established by the Faculty of Law of Maastricht University in late 2010 to mark the importance the Faculty attaches to the international study of law and its commitment to facilitate both internationally leading academics and young scholars in pursuing high quality academic work.

This fifth annual report highlights the main events that were undertaken in 2014 under the MEPLI-umbrella. It does not contain a complete overview of all meetings, publications and other noteworthy information, but merely provides a taste of what we have been doing. The headings in the report reflect what we find important in doing academic work: people, debate, quality output and academic community.

After five years of activities and cooperation, we are proud to say that MEPLI has clearly carved out its own place in international legal academia. We are known for our fundamental work and for the community that we built through academic meetings and social media. We published again in all major peer-reviewed journals in our field, lectured extensively and took the initiative for a number of different activities. Our blog (www.mepli.eu) is widely read and our Facebook page has a high number of ‘likes’. In addition, I am proud to say that many of our researchers and activities are externally funded, which we also see as a sign of recognition.

If anything, this report should convey the message how much we enjoy the academic cooperation within MEPLI. As always, we are open for any comments and questions you may have.

Debate

One of the main aims of MEPLI is to provide an environment that is conducive to academic discussion. To this end, we have set up two types of events: MEPLI Round Tables, that focus on discussion around a specific theme and of which we organize two or three each year, and the bi-weekly MEPLI Talks focused on presenting research by colleagues from Maastricht or elsewhere. In addition to this, a number of other events were organised. A selection of events in 2015 can be found below.

MEPLI Round Tables & Conferences

10 February 2015: ‘The ‘Transnational Principles of Civil Procedure’ in an EU context’ (Maastricht)

This MEPLI Round Table (The ‘Transnational Principles of Civil Procedure’ in an EU context. A new project of the European Law Institute and UNIDROIT) took place on Tuesday, February 10, at Maastricht University’s Faculty of Law. Speakers and participants in the discussion included: G. Hazard (Hastings, US), J. Sorabji (London), A. Uzelac (Zagreb), W. Rechberger (Vienna), B. Karolczyk (Warsaw), E. Silvestri (Pavia), E. Jeuland (Paris), M. Strandberg (Bergen), C.H. van Rhee (Maastricht). The discussion surrounded the following topics: - The Principles in an EU context: What are the main issues that need to be addressed? - Drafting Common Standards and Rules in the area of Civil Procedural Law: What can be learned from the Storme Project, the Federal Rules, the Ibero-American Project and various projects in other fields of law? - The role of the parties: What are the main differences and similarities when comparing the various EU jurisdictions? - The role of the lawyer; - The role of the judge; - Co-operation between parties/lawyers and the judge. 25 September 2015: Consumers Without Borders (Maastricht) In an ever-globalizing world, consumers are faced with fewer and fewer physical borders: whether this entails shopping online beyond their own national jurisdictions, or actually travelling from one jurisdiction to another in the era of low-cost flights and budget holidays. With more international consumers on the move – literally or in the virtual world – law faces inherent challenges: should these developments be the drivers of a new wave of legal globalization, and if so, what would this look like? In what we call ‘Freedom of Contract 2.0’, today, we can contract not only with who we want about what we want, but we have the tools, the technology and the means to actually take advantage of this theoretical construct in reality. While this expansion of tangible choice for consumers increases and augments our capabilities, this development comes with its own questions, which lie at the core of this conference: what is the role of the law in addressing the issues faced by the contemporary consumer, and who should be its maker?

25 November 2015: ‘The European Rules of Civil Procedure’ (Maastricht) This Round Table was organized on Wednesday, November 25 in Maastricht and it discussed the European Law Institute/ Unidroit project on European rules of civil procedure. The Round Table offered insights into topics such as the obligations of the parties, their counsel and the judge. MEPLI Talks MEPLI’s bi-weekly seminars are called ‘MEPLI Talks’. These one-hour sessions feature invited guests who present papers related but not limited to the institute’s research fields, and also incubate or showcase papers from the institute’s members. As such, they provide an opportunity both for external speakers to introduce work connected to the interests of MEPLI’s fellows, and for scholars within the institute to exhibit their respective projects to a wider audience. 1 March 2015: Julietta Marotta was lecturing for PhDs fellows of GPAC2 Cohort 2015 on the use of theories and literature in QL studies (‘The Use of Literature in QL Studies: A Roller-Coaster’). 3 March 2015: Bram Akkermans gave a presentation in Ghent on the future of property law in Europe. 9 March 2015: Bram Akkermans delivered a seminar today on the state of the art concerning the principle of Numerus Clausus in property law at the South African Research Chair in Property Law at Stellenbosch University, South Africa. 28 March 2015: Caroline Cauffman was at the Ius Commune case book meeting on the impact of primary EU law on national law. 29 March 2015: Remco van Rhee presented a paper on the role of superior courts in the administration of justice in the Dutch Republic (17-18th century) at the Free University in Berlin.

2 April 2015: Julietta Marotta lectured on ‘Empirical Legal Research: Using Qualitative Methods for the Understanding of Legal Phenomena’ at the Maastricht Graduate School of Law: Workshop for PhD Researchers. 3 April 2015: Julietta Marotta presented on the ‘Qualitative Research Design and Analysis’ at the Methods and Technology Seminar Group, METECH, UNU-MERIT, School of Governance, together with George Okongo.

22-24 April 2015: Remco van Rhee presented a paper on IT and civil procedure at a conference organised at the faculty of law of the University of Zagreb.

8-13 June 2015: Remco van Rhee organised together with Alan Uzelac from Zagreb the annual Public and Private Justice Conference at the Inter-University Institute Dubrovnik.

28-29 June 2016: Remco van Rhee presented a paper on legal language in translation at a workshop organised by the faculty of law of the Sorbonne University in Paris.

May-August 2015: Sjef van Erp, Jan Smits, Bram Akkermans, Lars van Vliet and Remco van Rhee were consultants for the ‘Joint Project between the European Union and the Council of Europe strengthening the Independence, Professionalism and Accountability of the Justice System in Armenia’, resulting in a report and a workshop to present findings.

24-30 May 2015: Remco van Rhee participated in the World Conference of the International Association of Procedural Law in Istanbul (Van Rhee is counsel member of the association).

5 October 2015: Caroline Cauffman presented on ‘Verschillen tussen de Nederlandse en Vlaamse rechtstaal en hoe daarmee om te gaan bij het vertalen van juridische teksten, Interinstitutionele contactdag EU-instellingen’ in Luxemburg. 4-18 October 2016: Remco van Rhee Held a series of guest lectures on mass litigation at Peking University, Nanjing Normal University and Shanghai Transport University together with Professor Stefaan Voet from Leuven.

Cauffman lectured at this workshop on ‘European consumer law: state of play and future challenges’. 2015: Remco van Rhee presented a paper at a conference organised by the China EU School of Law in Beijing on international developments in civil procedure and their relevance for law reform in China. Prizes, Appointments and Distinctions 17 January 2015: MEPLI student fellow Kate O'Reilly won the prize for the best Bachelor thesis in the European Law School programme, on 'When Law and Culture Collide: The Uniform Application of European Private Law'. On the same occassion, Catalina Goanta received the University-wide Winand Wijnen Education Prize. 19 January 2015: Caroline Cauffman and Niels Philipsen have been nominated for the Antitrust Writing Awards 2015 (Private Enforcement). The article ‘Who Does What in Competition Law: Harmonizing the Rules on Damages for Infringements of the EU Competition Rules?’ investigates whether harmonization of these rules through the recent Antitrust Damages Directive was desirable and whether the main objectives of the directive, the improvement of the possibilities for victims to obtain damages and of the interaction between public and private competition, are likely to be achieved. 20 May 2015: MEPLI fellow Liuhu Luo won the Second Prize of the PhD Forum 2015 organized by the Zhongnan University of Economics and Law in China. Liuhu also gave a keynote speech concerning the protection of personal data and codification of Chinese civil law. Moreover, thanks to Liuhu, you can now find Jan Smits' article 'Of the Vocation of Our Age Against Codification' translated into and published in the Journal of Seeking Truth (first issue of 2015). September 2015: Bram Akkermans and Catalina Goanta (together with Gwen Noteborn) were shortlisted for the Wharton Re-Imagine Education Awards. September 2015: Catalina Goanta (together with Gwen Noteborn) won the Publiekprize at the SURF Innovation Challenge 2015 in Rotterdam. 1 December 2015: Anna Beckers, MEPLI fellow and EUI researcher has been awarded the second prize in the humanities category of the German Thesis Award. The German Thesis Award (Deutscher Studienpreis) is a prestigious prize in Germany awarded by the Körber Foundation (Körber-Stiftung). Annually there are nine prizes awarded in three categories: humanities, natural sciences and social sciences. In each category, one first prize and two second prizes are awarded. In 2015, Sjef van Erp was re-elected as Member of the Council and of the Executive Committee of the European Law Institute, re-elected as Member of the Executive Committee of the International Association of Legal Science and elected as Member of the Board of Directors of the (U.S.) Association for Law, Property and Society and the International Institute for Justice Excellence.

PhD Defenses Augustin Parise defended his PhD on ‘Ownership Paradigms in the Legislation of Louisiana, Chile, and Argentina (16th -20th century)’ on 11 November 2015.

Teaching 15 January 2015: Seminar on ‘Access to the Legal Professions in the UK and the US’ provided by MEPLI's Mark Kawakami, William Bull and Nicole Kornet. February 2015: Catalina Goanta held a one week intensive course in European Private Law for the master of jurist-linguist students at the University of Poitiers (France). March-June 2015: Mark Kawakami and Catalina Goanta organized an honors masters course in commercial mediation, inviting external speakers involved in practice and policy such as Diana Wallis, Jonathan Lloyd Jones or Linda Reijerkerk. 7 April 2015: Jan Smits on ‘The Future of Private Law’ at the Université de Lorraine. 12 May 2015: MEPLI Fellows Anna Berlee and Mark Kawakami giving a keynote presentation for a Student Conference hosted by the Honours Programme on ‘Proportionate Approach to Data-Protection: The Goldilocks Problem’.

May 2015: Catalina Goanta and Bram Akkermans organized a student project on the use of wearable technology in the classroom, using Google Glass to give real-time feedback during negotiation simulations and moot court exercises.

October-December 2015: Sjef van Erp and Bram Akkermans gave a series of courses for notaries on the European Succession Regulation and two webinars on European private law for lawyers.

As of October 2015, Mark Kawakami and Catalina Goanta have set up the Law Faculty’s first Mediation Clinic, a collaboration with the local mediation firm Nollen & Kneepkens aiming to bring a small group of students in contact with mediation practice.

Research Projects Niels Philipsen was a project member in FP7 collaborative research project EFFACE (European Union Action to Fight Environmental Crime), 2013-2016 (Http: www.efface.eu), a project manager of ITN Project ‘Transnational Migration, Citizenship and the Circulation of Rights and Responsibilities (TRANSMIC), September 2014 – August 2018 (Http://law.maastrichtuniversity.nl/transmic), a participant (advisory board) in research project ‘Smart Mixes for Transboundary Environmental Harm’, KNAW-funded project carried out by Erasmus University Rotterdam and University of Amsterdam, 2014-2016 and a project member in research project ‘Schadecompensatie bij Beroepsrisico’s’ (Compensation of Damage Caused by Occupational Risks), project carried out by Maastricht University for Stichting Instituut GAK fonds, October 2013 – May 2015.

Caroline Cauffman and Catalina Goanta were selected as national rapporteurs (The Netherlands and Romania) by Milieu and VVA Europe for contract CHAFEA/2015/CP/02 concerning ‘The exploratory Study of Consumer Issues in the Sharing Economy’, a study commissioned by Chafea and DG JUST. Remco van Rhee presented interim results on a project on European Rules of Civil Procedure at a meeting at the headquarters of UNIDROIT in Rome. Van Rhee is (together with Professor Alan Uzelac from Zagreb) chairman of a subgroup reporting on the Obligation of the Parties, their Lawyers and the Court in Civil Litigation. The European Rules are drafted within the context of the European Law Institute and Unidroit.

External funding MEPLI’s research activities are to a large degree financed by third party-funding. Currently, 12 out of the total of 15 resident MEPLI PhD-researchers are funded by funding agencies such as the Netherlands Organisation for Scientific Research (NWO), the Hague Institute for the Internationalisation of Law (HiiL) and the China Scholarship Council. Its conferences in 2015 have also been generously co-funded by the Royal Netherlands Academy of Arts and Sciences (KNAW), the Universiteitsfonds Limburg (SWOL) and the China European School of Law (CESL). Research projects have been funded by the European Parliament, the European Commission and the European Land Registry Association (Cross Border Electronic Conveyancing of Land (CROBECO) project).
