Concern No. 41997 There has been a lot of dust the past two days leaving the property boundaries. Yesterday they were blasting, and today they are crushing. There is always dust coming off of the property; everyday, not just yesterday and today.

There is so much track out onto the highway at the quarry entrance today that when you drive by it kicks up so much dust so that you can't see. There is a concrete operation on the opposite side of the road from the quarry, so now the track out is twice as bad. Does the concrete company had the proper permit to be located there?

Trucks exiting AA Quarry were causing some dust as they pulled out onto the highway. AA Quarry is in the process of fixing their water truck to fully comply with BMPs.

The portable concrete plant does have the required permit to be located there.

Concern No. 42042 There's a new home being constructed on-site at this property. The workers there have been burning leftover construction materials on the front and rear of the property. They simply make a pile and leave it burning overnight. I am concerned about embers because other homes and fences are in very close proximity. I'm also concerned about the chemicals in some of these products going into the air. The charred remains are still there, but they have placed more on top, so I fear they will be burning again soon

Concern No. 42528 Neighbor is bringing in waste and burning it. This issue started in summer 2019 after the original property owner died and his son, Christopher, moved in. CP has seen a dark blue truck, a red truck, and a white truck pulling in a flat bed trailer full of waste. She has seen loads of construction demolition waste, vegetative waste, bags of household trash, etc.

RP burns every night after dark. She has called the fire department. and worked with Bill Franz (816-800-1453). Yesterday he gutted an RV then burned all of the demo waste over night. The fire department responded three times last night and the night before.

RP currently has a pile of chairs, couches, and vegetative waste at the site. The burn pile is past the house and the horse barn at the back of the property right by the pond.

She has heard that there is potentially drug activity going on at the site. The Sheriff has responded for fighting.

Concern No. 42506 CP reports that he has lived at his residence for six years, and within the last year there have been noticeable odors and visible emissions from M & H Gas Inc (beverage facility), 4230 Washington Ave, Independence, MO 64055, http://mhgasco2.com/. CP states the worst he had ever seen it was on February 10, 2020, around 8 - 9 a.m. He took video of that episode where the gasses were being released causing a large fog and strong odors. They have tanks lined up outside their facility. He stated that the gas/odors travel across traffic and waft into his house; his garage opens facing the facility.

Odors seem to be strongest early in the morning.

Concern No. 42170 *Concern was previously investigated as ACE #39765 on July 10, 2019.

The Concerned Party (CP) contacted the Northeast Regional Office to report that a St. Louis based outfitting service neighboring their property, Dive Bomb Industries, LLC, is planning to demolish and bury two mobile homes onsite. According to the CP, the company has been slowly cleaning up the property since the concern was first reported, and that they have a roll-off dumpster onsite. However, the CP is concerned that with the dumpster being full, the company will just bury the demolition waste from the mobile homes. According to the CP, a back hoe was delivered to the site this morning (February 19, 2020) by Painter Logging.

Caller states that Harley owns the place (Harley Stocke, assessor shows his mailing address at 1204 Wood St, Fulton), but Gene Hess's name is on the 'for sale' sign. This location is a residence that had recently burned in a house fire. The remains appear to be a small amount of demolition type debris. No untreated wood wastes were note within the foundation. I informed Mr. Jack Warren that he could not open burn this material and that he would instead have to use another form of disposal. Mr. Warren agreed to get the material hauled away to a Landfill or Transfer Station for disposal. I left for Mr. Jack Warren my card and several fact sheets (see below) and a copy of the pertinent air regulation,10 CSR 10-6.045 Open Burning Requirements, with Mr. Chris Day as Mr. Warren was not on site on the morning of February 21, 2020.

I telephoned Timothy J. Pekios of Midwest Environmental Studies to discuss this site. It had been inspected on August 20, 2019, by Tim Pekios as a state-certified asbestos building inspector. The project was also notified as demolition project, which was notified by the City of Poplar Bluff as was processed and approved by the Missouri Department of Natural resources' Air Pollution Control Program as project number D10026-2019. Since the project had been properly inspected and notified as a demolition project I called Timothy J. Pekios, Owner of Midwest Environmental Studies to corroborate his involvement with the project. Tim Pekios stated that his firm had removed the asbestos materials from the building as reported in the notification.

For these reasons, it has been determined that no violation of 10 Code of State Regulations 10-6.080 Emission Standards for Hazardous Air Pollutants adopting by reference Title 40 Code of Federal Regulations Part 61 Subpart M---National Emission Standard for Asbestos has occurred.

According to Kyle Glastetter, he is open burning some household waste and he is also open burning some tree limbs generated at his residential property by recent storm activity. He is open burning on his own residential property. He expanded the former property by purchasing the place next door. He is allowed to open burn trash generated at his residence and tree limbs and yard waste generated on the property.

The regulation that is pertinent is 10 CSR 10-6.045 Open Burning Requirements.

The definition for household waste is garbage, trash and other discarded materials that are generated from residential activities in a household.Open burning is the burning of materials where the products of combustion are emitted into the open air without passing through a chimney or stack. Vegetative waste is defined as tree trunks, tree limbs, tree trimmings, vegetation and yard waste.

While the Missouri Department of Natural Resources does not recommend open burning, there is no prohibition against the open burning of vegetative waste and household waste on a single residence property when it is generated on that property.

Both the responsible party and the concerned party have received or been directed to the pertinent air regulation (10 CSR 10-6.045 Open Burning Requirements) and the fact sheet (Facts on Open Burning Under Missouri Regulations).

No violation was observed.

David Barlher purchased an abandoned property and was cleaning up the property for habitation. During the cleanup he opened burned vegetative waste and some household items remaining in the home from the previous owner. Two city workers and a police officer came by and reviewed the items he was burning. They requested he not open burn the clothing and a few others items from the home because they had flame retardant applied to the cloth. David Barlher placed those items in another location for removal to the landfill.

An online search of the address given came back with the conclusion that the concerned party was correct and the involved structure was a house with a slate roof. When asked, Mr. Hayes confirmed that he did not observe any walls or load-bearing structures being removed or demolished. Mr. Hayes explained that he lives next to this site and is concerned about potential asbestos exposure.

This site is the location of a previous Superfund Investigation, initiated in 2016. It was determined that there was no release of hazardous substances and did not warrant entry in EPA’s SEMS (Superfund Enterprise Management System) Database for further CERCLA Action.

I explained to Mr. Hayes that I would refer his concern to the APCP – Asbestos Unit, and they would be in contact with him if further action is warranted."

I investigated the concern on 2/19/20. Midwest Service Group (MSG), the contractor responsible for the asbestos abatement, submitted an abatement notification A8045-2020. The abatement was originally going to take place from 2/10/2020 to 2/21/2020.

When I arrived at the property, there was no abatement taking place. I observed only a dumpster on the property and a few parked trucks, but nobody at the site. I called MSG, and spoke with Gail Kieffer-Hall, Project Coordinator, and Cory Elliot, Project Manager. They explained that the project was on hold while the owner removed more property from the building. They did not know what materials were being removed that would have prompted the concern. When I returned to the office, I saw that an amendment had been submitted on 2/7/20 that placed the project on hold.

Tom Sims, Environmental Supervisor, received a call from Mr. Jake Gallegos, a third party contractor involved in the abatement. After speaking with the property owner, Mr. Gallegos informed Mr. Sims that the owner was removing some pallets of bricks from storage on the property. This is likely what prompted the concern from Mr. Hayes.

Additionally, MSG was informed that they needed to submit a separate demolition notification for the demolition of a boiler structure on the property.

On 2/21/20, MSG submitted another amendment, noting that the abatement would take place 2/24/20 - 3/6/20.

On 2/24/20, I called Mr. Hayes and explained what we found. I let him know the new abatement start date. Mr. Hayes told me he lived next door and was watching the abatement. He told me he just wanted to make sure that proper precautions were being followed. I told Mr. Hayes to let me know if he had any further concerns.

The operations at the business result in metal pipe shavings being blown in the air and the neighboring businesses report damage to the paint on their cars from the shavings. According to Mr. Noland, Acid Piping uses a giant saw outside of the facility that results in "6-inch dust particles." Acid Piping occasionally sprays water to mitigate dust from leaving the property and Mr. Anold stated that Acid Piping claims to have cleaned up the dust shavings last week. Mr. Noland would like to be informed of any updates related to the site.

lately, the street sweeper has been wetting down the white dust, creating an entire roadway of wet, sloppy paste. This paste is splashing up onto our vehicles, and creating a hardened crust all over the undercarriages, up the sides, inside wheel wells, and under the doors of our vehicles. This crust is thick, and hardened, and unable to just be wiped off.

Is it dangerous silica dust? Is it rotting our vehicles? Is it dangerous for us to breathe, as we follow trucks and street sweepers that are surrounded by a cloud of white dust?

After multiple emailed complaints, we, the residents, are receiving NO response from FWI/US Silica.

This roadway problem is becoming unacceptable. Many of us are business owners, driving expensive lettered vehicles, which we are unable to keep clean. The paste that is being splashed onto our vehicles is causing decay. The center lines on the roadway are not visible. And the constant parade of dump trucks and tanker trucks often create dangerous situations for us, as residential drivers, as they often run stopsigns, take up our lanes to make turns without yeilding to us, etc.

When all of us built our homes here, US Silica did not even exist. But, now it is a 24 hour/day operation. We have tried to be civil, and reach out to quarry and sand plant personnel. However, we are receiving no response.

Concern No. 42150 Property is being cleared and burned for a gas station. The caller was not sure who the RP is. Burning started on 2/19 afternoon, and has continued today (2/20). The main concern is that they are next to a Childhood Learning Center and bus barn, burning right next to the property boundary. Ash and smoke is filling the school buildings and buses. No one was notified at the school, and no one appears to be attempting to contain the fire. The Seneca Fire Department was contacted today (2/20). They arrived on the scene and determined there was no further action needed.

Concern No. 42408 RP's are bringing in all types of remodeling and demolition wastes from homes they are "flipping." Have been bringing in the wastes from the business to their personal residence for the past year. CP states she has tried to contact the fire dept, planning and zoning to try to do something about it, but was unaware of DNR regulations. States that the pile and burning has got out of hand. RP's brought in multiple mattresses and a hot tub yesterday (3/10/2020) and are planning to burn it soon (has been placed on top of previously burned business/ demolition/ remodeling waste)- remnants of the burning are left on site. CP states pile is much larger than the size of hot tub and mattresses. Wife also has a realstate business- may be bringing in waste from this business too.
