Dear Mr Kelly:

On behalf of AIRPEAK Communications, LLC ("AIRPEAK''), and in accordance withthe directives set out in the January 6, 2005 Press Release from the 800 MHz TransitionAdministrator ("TAn), AIRPEAK hereby advises the TA that it has elected the first optionidentified in the Press Release for the relocation of its 800 MHz Enhanced Specialized MobileRadio ("ESMR'') network. AIRPEAK elects to relocate all of its stations in all of the markets inwhich it holds Economic Area ("EA") authorizations into the new ESMR portion of the 800MHz band (862-869 MHz). The stations to be relocated to the ESMR band include site-basedstations that were an integral part of the ESMR system as of November 22, 2004, as defined inthe Press Release and as described in more detail herein.

The Federal Communications Commission ("FCC'') already has identified AIRPEAK asan ESMR in the 800 MHz rebanding proceeding. See, e.g, Report and Order, Fifth Report andOrder, Fourth Memorandum Opinion and Order, and Order, WT Docket No. 02-55 , 19 FCCRcd 14969 at ~ 159 (2004); Supplemental Order and Order on Reconsideration, WT Docket No.02-55, FCC 04··294 at ~ 75 (reI. Dec 22., 2004). Nonetheless, to ensure that AIRPEAK's ESMRrights are protected, attached please find the following information:

AIRPEAK believes that the above-identified documentation demonstrates that thecompany has satisfied all applicable requirements for qualifying both its EA and site-basedstations for relocation to the ESMR band. Should the TA believe that additional information isneeded, AIRPEAK would be pleased to discuss what further documentation is requested and, ifnecessary, how highly sensitive information about the operation of its network not generallyavailable to the public could be reviewed by the TA without compromising the confidentiality ofthe data.

PHONE BOOK ENTRYTo store a new number into your phonebook press

under PHBK (bottom left). New entry will be

highlighted press (i.lli:~';!, under select (bottom

right). Enter the contacts name scroll down

to type: Use your button to scroll over to thetype of number (example: Home, Mobile, Work orPrivate) Then move down again to number, enterthe number; Then select, Done. Or if you want youcan enter multiple numbers for each name. To dothiS instead of preSSing done scroll down to typeand repeat process.

To EDIT A STORED NUMBER

From the Phonebook screen, press to scroll

to the entry you want to edit. Press ~to view

the Phonebook Menu. Press to scroll to edit.-~_. ;-<-,

Answering incoming calls

To answer a call, either press the Q3t~>key under

Yes or the ~{S'key. (Pressing "No" will send thecall directly to Voice Mail or if you do not havevoice mail it will tell the caller you are unavailable.)

Dial the number you wish to call. (Note: Whenmaking a long distance call, )fou do not need to

dial "1."r Pres~the green ii:~~ to place the call.r~;'

Press the red '0;;o'to end the call. Pressunder SPEAKER to turn speakerphone either onor off during a call. (Only on some models)

SET UP & ACCESS VOICE MAIL

1. USing your handset. enter your 7-digitPersonal Telephone Number (PTN). If callingfrom a phone other than your handset, dialyour PTN. When you hear the greeting, press• to access your voice mail. Enter yourpassword when prompted. Your temporarypassword is: 1 2 3 4

2. Follow the system prompts to create a newdigit password, record your name, and recorda greeting.

To set up your voice mail box:

To retrieve Voice Mail messages from themessage center: .You 'must first receive amessage in order to call into your vOice mail boxfrom the message center on your handset.

1. From the idle screen, press '''"~{>' key underMesg.

2. Use the key to scroll to Voice Mail.

3. Press key under Call; enter yourpassword when prompted.

4. Follow the prompts for playing, saving, anddeleting messages. For more voice mailoptions, see the vOice mail menu tree below.

USING 2-WayPlacing a call using 2-Way1. Enter the Private ID number of the person

you are trying to call. Be sure to enter: FleetID • Member ID (including asterisk). [refer to

"My Info" to locate Fleet & Member ID2. Press the Push-To-Talk (PTT) button on the

side of the phone. You will hear a chirpingsound. You must hold down the PTT Buttonin order for the caller to hear you.

3. Begin Speaking after the chirp. Release thePTT button to listen.

Receiving a 2-Way Call1. Your phone will emit a chirping sound. The

PriVate ID number or contact name (if listedIn your phone book) of the call initiator willdisplay on the screen.

2. To respond, press and hold the PTT button.After the phone emits a chirping sound, begintalking. Release the PPT button to listen.

1. Slide the back phone cover release button upuntil your hear a click. Then gently slide thephone cover up and over the antenna.

2. Insert the top of the battery into the batterycompartment and press the bottom of thebattery to secure it.

3. Replace the back phone cover, pressingdown until you hear the release button click.
