He was speaking after the Joint Committee on Education and Social Protection heard submissions from the National Women’s Council of Ireland and the End Child Poverty Coalition regarding the Mangan Report on Child Benefit. Deputy Seán Crowe said: “The Government, via the Tánaiste Eamon Gilmore, Minister for Education Ruairí Quinn and Minister for Social Protection Joan Burton, have sent out mixed messages over the last week regarding child benefit. “Ruairí Quinn has suggested that further cuts to child benefit could be introduced to subsidise an additional free pre-school year. Eamon Gilmore has said after that no further changes to child benefit will happen. But the Oireachtas Social Protection Committee has already heard that Joan Burton has asked the Advisory Group on Tax and Social Welfare, Chaired by Ms. Ita Mangan, to look again at her Child Benefit thresholds. “We know that the first report of the Advisory Group has already been brought to Cabinet by Joan Burton. “I am urging Minister Burton to end the doubt and shelve this Mangan Report and recommit to her original Labour Party election promise, not to cut child benefit. “We know that when Ms. Mangan gave a detailed technical briefing on her report to journalists and lobby groups that she added to the uncertainty. Fine Gael Dublin Senator,Catherine Noone, has urgedDublin communities to getinvolved in the Friend of IrishHeritage initiative launched thisweek by the Minister of State atthe Office of Public Works(OPW), Brian Hayes TD. “In the year of the Gathering, Ithink it is especially importantthat we all get involved in thepromotion and protection of ourlocal heritage. The OPWmanages almost 800 nationalmonuments, including majorattractions in Dublin such asDublin Castle and the PhoenixPark. “The Friends of Irish Heritage

initiative follows on from lastyear’s Community InvolvementInitiative, which was a greatsuccess. Last year, some of thesuccessful initiatives includedlocal community groupsarranging and carrying out toursin the Keep in Trim Castle,Dublin Battlefield Tours, tours ofSelskar Abbey, Co Wexford andNenagh Castle, Co Tipperary.

Speaking at thegraduation ceremony,Ms Finnerty said, “Ourgraduates are rich withskills, knowledge andexperience that willchange their lives.Importantly, they canuse their qualificationsand their experiencesto help to change thelives of other people forthe better. This is animmense privilege andan immenseresponsibility yet onethat undoubtedly ourgraduates will rise to.”

IICP was established in2003 with the aim ofproviding acomprehensive trainingservice for those who

wish to pursueprofessionalaccreditation in themental health services.The Diploma inIntegrative Counsellingand Psychotherapyprogramme is now in its10th year and theceremony marks theeighth conferral forgraduates. Theceremony marks thesecond cohort ofgraduates of the BA(Hons) Degree inIntegrative Counsellingand Psychotherapy.Ms Finnerty continued,“In November 2003, weopened a smallcounselling college inKillinarden, Dublin 24with just 15 studentsand the idea ofproviding a supportiveand interactive learningenvironment wherepeople can reach theirfull potential. Ten years

later - in this academicyear alone - more than300 students haveundertaken courses ofstudy in IICP. Over thelast decade, we haveworked tirelessly toexpand IICP, to achieveaccreditation and towork in closepartnership with theprofessional andacademic bodieswithout compromisingon the dedication andsupport that weprovided to those first15 students.”The Diploma inIntegrative Counsellingand Psychotherapy isrecognised by The IrishAssociation forCounselling andPsychotherapy (IACP)and the BA (Hons)Degree is validated byQuality andQualifications Ireland(formerly HETAC).

South Dublin CountyCouncil have welcomedthe publication of theFramework ServiceLevel Agreement (SLA)between localauthorities andEnterprise Ireland forthe new LocalEnterprise Offices(LEOs). The SLA alongwith the new brandingfor the LEO officeswere revealed byMinister for Jobs andInnovation, Mr RichardBruton TD, Minister forEnvironment,Community and LocalGovernment, Mr PhilHogan TD and Ministerof State for SmallBusiness John Perry TD.LEOs will act as aone-stop-shop tosupport micro and smallbusinesses in eachcounty. The LEOs arebeing delivered througha Framework Service

Level Agreementbetween EnterpriseIreland and the LocalAuthorities. SouthDublin County Council iscommitted to playingits part to ensure thatthe LEO will be up andrunning by the end of2013.The Ministers launchedthe initiative, in FingalCounty Council,Swords. The LEOs arethe result of a majorrestructuring of Statesupport for small andmicro sized businesses,which was previouslydelivered by Countyand City EnterpriseBoards.“The LEOs are a newinitiative to furthersupport localeconomies andentrepreneurship withhigh level supportdelivered at local level”said Philomena Poole

County Manager. “Theultimate aim is tocreate enhanced,integrated and tailoredsupport in South DublinCounty, benchmarkedby Enterprise Irelandand delivered inpartnership with SouthDublin County Council”

The LEOs will be part ofthe broad range ofsupport given by SouthDublin County Councilfor economicdevelopment but it willhave a clear focus onlocal enterprisedevelopment. The mainservice provided byLEOs include; businessinformation andadvisory services,enterprise supportservices,entrepreneurshipsupport services andlocal enterprisedevelopment services.

Jobseeker’s Transition isdesigned to allowformer recipients ofOne-Parent FamilyPayment (OFP), whose

youngest child is under14 years of age, toreceive the full supportof the Department’sactivation services tohelp them return towork, training oreducation, whilerecognising theparticular difficultiesthey face, such aschildcare and long-termabsence from the

The key element ofJobseeker’s Transition isthat recipients will beable to seek work on apart-time rather than afull-time basis if this isbetter suited to theirfamily requirements.They will also be ableto access existingchildcare supports to

Thesereforms are aimedsupporting former OFPrecipients back intowork and financialindependence, and toprevent long-termdependency onwelfare.Jobseeker’s Transitionwill be a targetedversion of theJobseeker’s Allowancescheme, providingmeans-tested financialassistance tojobseekers who areunemployed andlooking for work.

under Jobseeker’sTransition, former OFPrecipients will berequired to fully engagewith the Department’sactivation process.As part of this process

they will be profiled,participate in groupengagement sessions,and will develop apersonal developmentplan in conjunctionwith their case officer.This personal plan willidentify suitableeducation, training andemploymentprogrammes that willenhance their skill setsand make them morejob-ready. Recipientswho do not engage inthe activation processwill be subject to thesame penalty rates anddisallowances as everyother jobseeker.

However, recipients ofJobseeker’s Transitionwill be exempted for atransitional period fromthe full conditionalityof the Jobseeker’sAllowance scheme,specifically the criteriathat jobseekers must beavailable for andgenuinely seekingfull-time work.This will allow former

OFP recipients to seekpart-time work ratherthan full-time work ifthis better suits theirfamily circumstances.The transitional periodwill run until theiryoungest child reaches14 years of age.

Minister Burton said:“Seeking full-time workis not a reality for somelone parents, who, untiltheir child is older, willonly be able to workpart-time. It is also thecase that some loneparents are much moredistant from the labourmarket because theymay not have been in aposition to completetheir education or workfor extensive periods.under this scheme, loneparents will get the fullsupport of theDepartment’sactivation services tohelp them on thepathway back to work,but in a manner thatrecognises the reality oftheir circumstances.”

Chris Hass took his own life on February 1st,devastating his family and friends. Chris's parents,Jean and Danny, handled things in a unique way.They had an ‘Open Door’ for more than 2 weekswhich allowed Chris's friends go to his room andspending time talking and playing music. Onegroup left and another came to take their place.This had the effect of drawing parents to the Haashousehold to empathise with the family. This veryopen approach brought together the community ofKingswood which lead to Chris’s mother, Jean, toestablish NINA (Need Information Need Advice). NINA is a community based Suicide Awarenessgroup.Jean formed a committee and has held HSE SafeTalk Training nights which has had over 30 peopleincluding sports couches, youth leaders, teachersand concerned parents from the Kingswood estate.She said "Chris was a very strong young man bothmentally and physically who was the one hisfriends came to for help." I believe that if Chriswas able to take his own life then anybody can.There is no protocol for suicide - everybody isvulnerable." “Sometimes I get upset that I had to lose my sonfor this to happen, but i think it is so important toprovide awareness and educate people about

suicide”.'The seminar has given local people, many of whomare working with young people, the tools to see thewarning signs, If you are concerned for some bodynever be afraid to ask the question.“We are networking with agencies like PIETAHOuSE, HSE, Dublin 15 Suicide Awareness,TeenLine and Village Counselling in Killinarden.”“We have touched base with other communities inTallaght which are also losing their young peopleto suicide. All we want is for our young people tobe safe and to know where to go if they need help.We would also like to teach our young people toexpress how they are feeling and to take thestigma away from talking about your mentalhealth.”Jean and Danny cannot thank the communityenough for their help and support. NINA for lifeSuicide Awareness will endeavour to create amodel within the community that will touch allages and let people know that help and some oneto talk to is only a phone call away.

Cllr. Bonner isdetermined that hardpressed homeowners inClondalkin be givenrelief with a maximumreduction in theProperty Tax allowedunder the law. Breeda Bonner said: "Nobody likes this taxbut after Fianna Fáilsigned us up to it in2010 there was simplyno getting out of it. I

am glad that theGovernment is givingcouncils the power tovary the property taxrate by 15% from 2015,and I will be pushing forthe rate to be reducedby the full 15% from2015. Many families inClondalkin arestruggling to get by andpay for the basics, andI think it is only rightthat they be given asmuch relief as possibleas soon as possible." "As soon as we have thepower to lower this tax,I will be pushing for afull reduction of 15% tolower the burden onfamilies in Clondalkinand the rest of SouthDublin. We've had taxincreases, cuts and highunemployment for 5years now and peopleneed to be given some

relief to help them getby. I think that if we inthe council can easethe burden on peoplewithout hittingservices, we should dothat. For that reason Iwill be pushing for a fullreduction of 15% in theProperty Tax from2015." "80% of the Property Taxwill be going straight tothe county council withno middleman. Thismeans that 80% of themoney paid locally willstay locally to pay forcouncil services. Frommy understanding, thecouncil will be well ableto absorb a 15% cut inthe Property Taxwithout hittingservices, and wouldmost likely still increaseits revenue from what itwas under the old

system. If the Councilcan take a 15% cut andstill be in the black,then we should go allout and reduce theProperty Tax by 15%." "I want to also paytribute to Robert DowdsTD for all his work tomake sure that themoney which was raisedlocally would staylocally. The originalplan from the ThornhillReport was for less ofthe tax to stay local.Thanks to the work ofRobert and others inLabour, that figure wasincreased to 80%staying local. Thismeans the councilshould be able to lowerthe rate paid byhomeowners, give reliefto people in SouthDublin, and still be inthe black."

A photographic exhibition ofwork by young children takingpart in the Crafts Council ofIreland’s CRAFTed Learning Skillsfor Life Primary Schoolsprogramme has opened at theCounty Library, Tallaght and runsuntil June 5th 2013. CRAFTed isorganised in partnership with theEducation Centers in Ireland.

The CRAFTed exhibition featuresa critical selection ofphotographs documenting thevibrancy of craftwork created inclassrooms by children takingpart in CRAFTed projectsthroughout the country.Showcasing an array of craftdisciplines such as textiles,fashion, jewellery, ceramics,glass and woodwork, thephotographs wonderfully depictthe enthusiasm and imaginationof young children engaging withcraftsmanship and making.

In addition to the photographic

prints, the exhibition features astriking display of textile hatsmade by 3rd class pupils from StThomas’ National School,Jobstown, Tallaght. Sinn Féin Dublin Mid-Westrepresentative Eoin Ó Broin hascalled on Fine Gael and Labourto increase the funding provisionfor suicide prevention services.The call comes after newresearch reveals that every 18days a child under the age of 18takes their own life.

Ó Broin said ‘Suicide is a majorproblem in our society that hasbroad reaching effects. It issomething that all publicrepresentatives and widersociety must try to combat. ‘A new report funded by suicideprevention campaign 3Tspublished this week highlightedthe fact Ireland has the fourthhighest suicide rate in the Eu of

people aged between 15 and 24.That is very worrying societaltrend.‘Areas with high levels ofunemployment and deprivation,such as Dublin Mid-West,experience higher than averagelevels of suicide.‘The report also found that over80% of victims were male with17% of those aged just twenty.‘It is also deeply worrying that,as revealed in the report, ahospital would refuse to treat anindividual displaying suicidaltendencies, as they claimed theperson in question was, ‘not ourarea’.‘This attitude is unacceptableand those who are responsiblefor administering care should do

so accordingly.‘This is a damning indignation ofthe attitude of many peopletowards suicide. Suicide is atragedy and it should not bestigmatized. The Governmenthas attributed funding of €35million towards mental healthservices, €13 million of which isdirected for suicide prevention.‘This is clearly not enough giventhe scale of the problem. I amcalling the Government toincrease funding for suicideprevention services. Fine Gaeland Labour TDs must put morepressure on Government toensure that in Budget 2014sufficient funding is provided totackle what is clearly a growingproblem.’

Q. I HAVE BEEN CALLED FOR JURYSERVICE BUT DON’T REALLY wANT TODO IT. I DON’T EVEN KNOw IF I wILL BEPAID IF I TAKE TIME OFF wORK. AM ILEGALLY OBLIGED TO ATTEND ON THEDAY APPOINTED?

A. Jury service is governed by theJuries Act 1976, as amended by the CivilLaw (Miscellaneous Provisions) Act 2008.Since the 1st January 2009, people whofail to turn up for Jury Duty without avalid excuse will face a €500.00 fine (atenfold increase on the previous penaltyof £50 set down by the 1976 Act). Inaddition to this increased fine, theremoval of the upper age limit of 70 yearsfor Jury members means that every IrishCitizen aged 18 years and over, who isentered on the Register of Electors, isnow eligible for Jury service.

While Jury service is meant to beexpression of service to ones country,recent figures released to RTE, under theFreedom of Information Act 1997,pointing to the high number of personsexcused from Jury service in 2007,indicate otherwise. In other words, thereseems to be a substantial number of'excusals' from Jury service.

With regard to your question concerningpay in your absence from work on Juryduty, this is covered under Section 29 ofthe 1976 Juries Act, when an Employeeor Apprentice is called for Jury service,he/she is deemed to be employed duringthe period he/she is absent from work.In other words, Jury duty does notconstitute a break in service and all pay,annual leave and other benefits due tothe employee will continue to accrue.Employers can verify attendance at Juryduty by asking the employee to producea Certificate of Attendance, which willbe produced by the County Registrar.Anyone with a Contract of Employment isentitled to be paid by their employerwhile they are on duty service. Anycontractual provision or agreement thatattempts to exclude or limit anemployer’s liability for the payment ofwages during such absence is void.However, the 1976 Act does not set outany method for calculating pay anddifficulties can arise in relation to thecalculation of overtime, commission andbonuses. Employers will often take theposition that the most reasonablesolution is to average the employees' pay.

An employee may receive a JurySummons, specifying the date and timetheir attendance has been requested forJury service. The Summons will set outthe list of persons that are ineligible,disqualified or excusable as of right fromJury service. Section 7 of the 1976 Actsets out persons who are deemedineligible for Jury Service. to the Registrar who summonedhim/her and state the reasons whyhe/she should be excused as fully aspossible on the relevant form J2. TheEmployee should enclose anycertificate or documentation thatsupports this application. Such anapplication may be made on theEmployees behalf where he/she is tooill or injured to apply. However, anemployer cannot make such anapplication on behalf of any of hisemployees. A self-employedindividual, whose attendance at Juryduty may mean he/shecannot earn a living, may also qualifyfor excusal. If the Registrar refusesto exclude the individual, thisdecision may be appealed to theCourt at which he/she had beensummoned to attend. The decision ofthe Court is final. under Section 60of the 2008 Act, failure of anindividual to serve without an excusemay result in a fine of up to €500.

In accordance with the intention ofthe Safety, Health and Welfare atwork Act 2005, and the Organisationof Working Time Act 1997, where anemployee works nights, he/sheshould be allowed an adequate restperiod between Jury service andwork. Alternatively, that employeemay seek to be excused in themanner set out above.

An employee is not entitled to travelexpenses from the State for attendingJury service, but will receive a Lunchif they are actually serving on a Jury.

Q. I FEEL THAT I HAVE BEENOVERLOOKED FOR A PROMOTION ATwORK. IS THERE ANYTHING I CANDO?

A. Normally such employmentgrievances are dealt with through theCompany's grievance procedure, andemployees should seek to resolve thematter through this prior to seekingalternative remedy. your contract ofemployment or workplace manualshould set out this procedure. you donot say why you feel you wereoverlooked and this is important. TheEmployment Equality Acts 1998 to2008 (the EEA), prohibits unlawfuldiscrimination in relation to, interalia, promotion on grounds of gender,sexual orientation, marital status,family status, race, religion or belief,colour, nationality, ethnic origin,

disability, age, pregnancy, andmembership of the Traveler Community.

If an Employee feels he or she has beendiscriminated against on any of the abovegrounds, that employee could potentiallymake a complaint of discrimination to theEquality Tribunal for investigation. Thereis also another mechanism which could bean option if the reasons for the refusal forpromotion are more general in nature. Anemployee could make a complaint to theRights Commissioner under the IndustrialRelations Acts 1969-2001 (effectively inrespect of a Trade Dispute). Whilst suchrecommendations are not binding on anemployer, they do exert some pressure toresolve the matter and can becomebinding on appeal to the Labour Court.

Q. I PAID A DEPOSIT ON A NEw CARBUT, FOUND A BETTER DEALELSEwHERE. THE GARAGE IS REFUSINGTO RETURN MY DEPOSIT. CAN THEY DOTHAT?

A. When you paid a deposit on thecar, you created a consumer contract withthe garage to buy their product. Thedeposit served as a guarantee on bothsides that the deal would go ahead. If youback out of a contract after paying adeposit, you are not entitled to have yourmoney returned. The garage may agreeto repay or partly refund your deposit butthat is entirely up to them. They are notlegally required to do so. The garage'spolicy regarding deposits should be laidout in the terms and conditions of thecontract or receipt you got when you paidthem. If they continue to refuse to returnyour deposit, then, you must decidewhether the 'better deal', is still a betterone once you incorporate the loss of yourdeposit. Situations such as this show whydeposits should not be treated lightly.Never pay a deposit unless you are sureyou want to go ahead with the deal, orcan afford to lose the money.

As new data reveals thatmen are better slimmersthan women, one Tallaghtman is certainly doing it forthe boys after losing 7stone.

Research by SlimmingWorld, presented at theEuropean Congress onObesity 2013 this week,shows that when men join aSlimming World group theylose more weight thanwomen, with male slimmerslosing an average of 6.1 percent of their weight in threemonths compared to theirfemale counterparts wholose an average of 4.6 percent of their weight in thesame time.

Irish MEP Sean Kelly hasvowed to lobby stronglyagainst a uS Senate proposalwhich he warns wouldeffectively “wipe out” theJ1 visa.The Fine Gael MEP wasresponding to a clause in theimmigration reform billcurrently going through theuS Senate, calling for a €500charge to be imposed on thepopular J1 visa. Therestriction would mean thatIrish and European studentswould not be granted thevisa unless a potentialemployer in the Statesagreed to pay thesponsorship fee.Mr Kelly described theproposal as “unfair andunworkable” and pledged toraise the issue at theTransatlantic Legislators’Dialogue, which takes placein Dublin at the end of May.The annual meeting of uSand Eu parliamentariansaims to improve thepolitical discourse betweenlegislators in bothcontinents.“I would hope to build upenough momentum totorpedo this before it getstoo far. I will be very firm;

this is not a significantamount of money in termsof promoting good relationsbetween the uS and theEu,” said Mr Kelly.“We had over 7,000 Irishstudents who went out tothe States last year. The J1visa is very important tostudents; it gives them thechance to make a few boband pay off their fees. Mostof them only get jobs whenthey’re out there. Whatemployer is going to fork out€500 to get a student for thesummer who they’ve nevereven met?” he added.If the new bill is passed, itwill come into force nextyear, thwarting the hopes ofmany Irish students planningto work in the States in thesummer of 2014.

The President of theEuropean Parliament MartinSchulz has agreed to givethe go-ahead for an Irishlanguage version of theparliament's officialwebsite, following intensivelobbying by Irish MEPs.The website,www.europarl.europa.eu, iscurrently available in 22 out

of the 23 official Eulanguages, excluding Irish.Fianna Fáil MEP Pat theCope Gallagher, who hasbeen pushing for years forthe site to be accessible asGaeilge, said the decisionwill reverse what has been“a matter of discrimination”against the Irish language.“I raised the issue publiclyin March and charged theparliament of discriminatingagainst Ireland and the Irishlanguage. President Schulzoffered me a meeting, andtold us that he will now givethe necessary instructions tothe governing body of theparliament to establish anIrish language version.Hopefully it will be up andrunning by the end of theyear,” said Mr Gallagher.“There were suggestionsfrom some Eu quarters thatit could be quite expensiveto translate the site andthat there was no need todo so, as everyone in Irelandunderstands English. Buteverybody in Malta alsounderstands English, yetthey have their ownwebsite. This is a majorbreakthrough, and it'simportant that it cameduring the course ofIreland's Eu presidency,” headded.

Victims of domesticviolence, stalking orgender-based harassmentwho have protection ordersin Ireland are to be giventhe same protection in allEu member states,following a decision by MEPsthis week.The European Parliamentvoted in favour of new civillaws to ensure that victimsof abuse can move freelythroughout Europe with thesame level of protectionthat they have in their homecountry. The cross-borderregulation will take effectfrom January 2015, once ithas been approved by theEuropean Council of

Ministers.Labour MEP Emer Costello,who supported the measure,said it will give greatreassurance to the 1,000 orso women in Ireland whobenefit from protectionorders. “I’ve spoken towomen who have barringorders or protection ordersagainst someone who hasabused them, and they feelnervous about travellingabroad because they’re notoffered the sameprotection. This will givethem the freedom to travelabroad for holidays, work orfor longer periods withoutfear,” said Ms Costello.under the legislation, anyvictim of gender-basedviolence who has beengranted protection in onemember state will just needto complete a standardmultilingual form to havetheir right to protectionenforced in every other Eucountry. The only exceptionis Denmark, which has notopted in to the new law.

MEPs back EU-widebanking supervision

Eu-wide banking supervisionmoved a step closer thisweek when MEPs inStrasbourg approved draft

laws setting up a singlesupervisory system. TheEuropean Central Bank is tosupervise the eurozone’slargest banks directly, andwill have a say in supervisingother banks.However, the EuropeanParliament will only give itsfinal seal of approval whenit is satisfied with the ECB’sinternal accountabilityarrangements. MEPs insistedthat extensiveaccountability rules withinthe ECB must match its newsupervisory powers, andthat the displacing ofauthority from nationallevel must go hand in handwith creating transparencyat Eu level. Fine Gael MEPGay Mitchell said theestablishment of an Eu-widebanking supervisor is aimedat preventing the kind ofreckless banking practicesthat have fuelled thecurrent economic crisis.

“National central banks andregulators will continue todo what they do, but theECB will have the authorityto oversee this. If there isany systemic risk, or threatto the eurozone, it will havethe right to intervene andgive instructions,” said MrMitchell.
