Change is never easy, and many times its difficult to embrace. But with change come oppor-tunities, excitement and a fresh outlook.
LP Gas Magazine has undergone a change in recent weeks as longtime Editor in Chief Pat Hyland resigned to become the director of industry pro-grams for the Propane Ed-ucation & Research Coun-cil (PERC). Pat remains in the industry hes grown to love over the past 15 years, and he also will maintain a tie with the magazine as a member of our Editorial Advisory Board.
Pats knowledge of the industry and his journalistic integrity are un-matched, and I have been fortunate to work so closely with him over the past five years. I will take those experiences along on my new journey as editor in chief of LP Gas.
Before Pat packed his belongings and walked out of our Cleveland office for one final time, I had a chance to ask him about his decision, the industry and the magazine.
How difficult was this decision and how important was it for you to remain in the propane industry?Pat:As you can imagine, this was not an easy decision. Even after 15 years, I very much enjoy my work at the maga-zine. I am so proud of our entire team our staff, the columnists and collabo-rating contributors, and our Editorial Advisory Board members for making LP Gas the premier source of informa-
tion in the propane industry. They made it a joy to come to work every day. But this unique opportunity in the industry that I already know and enjoy was one I just could not pass up.
As an editor, youve covered PERC for many years. Is it hard to imagine working for the council now?Pat: I never imagined working for the council or leaving LP Gas Maga-zine before discussing this opportunity with Roy Willis in February. My working familiarity with the organization, its staff and many of the state executives that I will be
working with certainly was a substan-tial draw to the job.
Can you tell us about this new role and your responsibilities with PERC?Pat:The position includes a variety of responsibilities, including management of PERCs state rebate program and its Partnership with the States Program. But the primary duty is to lead and oversee key aspects of the PERC en-gagement with the propane industry and, in particular, the state organiza-tions through which assessment rebates are allocated. In a nutshell, I will be the liaison between the states and the council.
Youve built many lasting relationships in the industry. I know you cant name every-one, but who has been a positive influence on you in your time with the magazine?Pat: First and foremost, former LP GasEditor and Publisher Zane Chastain,
who introduced me to the industry and to the mission of the magazine. So many others, in no particular order: Dan Myers, Dwain Willingham, Carl Hughes, Ray Murray Jr., Ralph Rooney, Ed Varney, Harold Poland, Tom Jae-nicke, Jay Johnston, Kate Caskin, Tom Klein, Joe Rose, Bill McHenry, Daniel Dixon, Baron Glassgow, Larry Osgood, Tom Nunan, Bob Myers, Sam McTier and Bob Mayer. All good people who care not only about their businesses, but the propane industry as a whole and the end-use customers that it serves. I am a better person and profes-sional for having known each and every one of them. I thank them for all the years of counsel, support, encourage-ment and friendship.
Youve undertaken some big projects and stories over the years. Are there any in par-ticular that give you the most satisfaction for their importance to the industry?Pat: Zane Chastain taught me that the magazine was where the industry goes to meet itself. I hope that some of our stories helped inform and edu-cate readers in ways that fostered a stronger, safer industry. That said, Im especially proud of our annual State of the Industry Report as well as stories about factors behind falling propane sales over the last decade and safety concerns with tipping bobtails and rust beneath the plastic sleeves on 20-pound cylinders. The Propane Education & Research Coun-cil (PERC) chose Swanson Russell as its new lead communications agency, the council announced.
The Lincoln, Neb.-based company was chosen from more than a dozen firms that submitted proposals last December.
The council authorized PERC President and CEO Roy Willis to develop a working agreement with Swanson Russell and begin collaborating with the agency on a communications program that supports the research and development of new propane-fueled products and the coun-cils safety and training programs.
In other PERC news, the council named
Pat Hyland and Mike Taylor to key roles. Hyland, formerly editor in chief of LP
Gas Magazine (see page 6), joined PERC as director of industry programs. He will be the eyes and ears of PERC with state asso-
ciations, Willis said.Taylor is now PERCs
director of autogas business development after serving as director of fleet manage-ment at Heritage Propane for the last four years.
Willis said PERC is filling vacancies and not
adding new staff positions. Additional staff changes will be announced soon, he said, as PERC moves into the implementation phase of sweeping organizational changes announced last fall.
Coalition takes stand against pipeline rate hikeThe U.S. Federal Energy Regulatory Commission rejected two tariff rate increase proposals filed by Enterprise TEPPCO.NPGA and a coalition
of 58 large and small propane marketers, state propane associations and other shippers on the pipeline protested the rate increase.
Amendment favoring natural gas defeatedAn amendment that would have given prefer-ential tax treatment only to natural gas and natural gas vehicles was defeated with the help of the industrys grassroots con-tacts, NPGA announced.Meanwhile, the indus-
try continues to push for the passage of The Propane Gas Act, which would extend fuel, vehi-cle and infrastructure tax credits for five years.

In tough times, transparency be-comes an important value. Its the only safe way for us to sort truth from fiction.Over the years, I have written a few
columns on insurance, and two most notable were Insurance safety solu-tions in June 2008 and Insurance buyers: Beware to be safe in March 2007. The columns can be found under my byline at www.lpgasmagazine.com. I stand by my convictions.
The big rap on insurance carriers has always been lack of consistency and competition. That was then and this is now. In fact, marketer insurance pre-miums have maintained consistently competitive pricing for the past four to five years. Hasnt that been the goal?
The 2012 insurance marketplace for propane marketers will remain stable. Propane marketers who have held on while navigating the unstable weather and product pricing of 2011 should appreciate the importance of stability. However, those marketers who are con-sistently looking for the cheapest deal, regardless of quality, will have a hard time lowering the bar in 2012.
Insurance cycles have traditionally been the result of combined loss ratios (expenses plus losses) and available capital capacity. Never forget that all insurance programs must be profitable to pay claims and stay in business.
Short-term, knee-jerk reactions, to greatly increase premiums or cut prices to buy market share out of desperation, usually leave a wake of questionable practices when the results are tallied.
One of the greatest scams utilized by startup insurance programs is the ri-diculous inference that insurance pro-
grams currently writing in the market-place do not understand the propane business. Such sales tactics sound good and sell well to the cheap deal seekers, but they offer no credibility.
Best-practice propane marketers should look for credibility in an insur-ance carrier. Can they keep premiums in line with their costs to provide cov-erage while making a profit? Will they be there with the money? Those are credible questions.
New in 2012 is the question of pre-mium audits for prior-year exposures. Some bean counters got together with a few MBA marketing wizards and came to the misguided conclusion not to per-form audits. This sold well to marketers because they could grow without cost and be less accountable about their gal-lons. I have long maintained that audits are essential to an insurance companys ability to inspect what they expect. How do you know that the gallons
declared by the agent are actual? A change in the exposure should
indicate a change in the premium up or down.
I believe that most propane market-ers expect to be audited and get pre-mium back for undelivered gallons in 2011-12. Marketers with no audit poli-cies are probably out of luck.
When you expect something from
nothing, sometimes thats what you get.Obviously growth, or lack thereof, is
a key factor to such discussions.Years ago, in a soft market, I had a
client who bullied an insurance carrier into estimating more gallons than he would sell at a discounted compos-ite rate per gallon. When the smoke cleared, he had gotten the discounted rate up front and 20 percent back at audit time. The insurance carrier im-mediately issued a new policy of 10 per-cent maximum returns on audits.
On the other hand, I spoke to a marketer who fell 30 percent short of expected gallons. His carrier does not perform audits, nor will they do them upon request. I shared the insight that he should lower his gallons to actual levels at renewal. That works well for the marketer but badly for the insur-ance company if 2012 is a cold winter. Lowering gallons also can be a costly strategy if the insurance carrier audits and next year you grow. You live by the sword and die by the sword.
Here is the good news for 2012: Similar to my forecasts in 2007 and 2008, those marketers who insure with credible insurance providers and dem-onstrate audited safety practices will find insurance costs to be competitive and affordable in relation to other, less-stable industry costs.

An important element in the prosecution of lawsuits filed by plaintiffs is the financial costs and potential recovery related to a given claim. A potential game chang-er in this consideration is third-party funding of litigation.
When claimants pursue a lawsuit, they anticipate financial recovery. Third-party funders appeal to the desire of claimants to get their money now. There are many reasons for this desire of an early payout, including medical needs and daily living needs. However, once the loan is made to a claimant by a third-party funder, the case outcome can be impacted greatly.
In one case, a defendant made a set-tlement offer, and the plaintiffs lawyer recommended that his client accept the offer. The third-party funder nixed the deal because the settlement would not cover its loan to the plaintiff. The case was tried to verdict, and the plaintiff lost and got nothing. The third-party funder also got nothing, as these types of loans are only recoverable if the plaintiff gets a recovery.
Some plaintiff lawyers also contract for this type of funding in expensive cases such as mass torts and class ac-tions. If this funding was not available, these funded cases may never have seen the inside of a courtroom. Again, the lawyer may be compromised in his decisions on what money is needed to resolve the case. This situation can create serious ethics concerns for the lawyer involved.
When a successful settlement or trial does occur, these loans often can consume most, if not all, of the recov-ered amounts in a very short time.
In a recent case, a plaintiff took out a $9,000 loan, and when the verdict was returned 18 months later she was required to pay the third-party funder $24,000 of her $27,000 share of the settlement proceeds. In another case, a plaintiff received a settlement of $168,000, and she owed the third-party funder more than $220,000. These ex-amples raise serious questions about the nature of these funding arrangements.
A closer lookThese funding companies claim that what they are offering are not loans but investments. They argue that part of the agreement they make is that if the plaintiff does not obtain a favorable settlement or trial verdict they dont get their money back.
However, these same companies use the word loan in much of their adver-tising. In addition, these companies do a good degree of due diligence before making these loans. Before any money changes hands, they do their level best to make sure the case has merit. In fact, the actual data shows that very few of these loans ever go unrecovered.
There are also problems with disclo-sure of confidential information related to this type of funding. Remember, be-fore these third-party funders will loan funds, they want to determine if the
case has merit and what would be a re-alistic recovery. This type of analysis is very sensitive and is normally only dis-cussed between counsel and the client. One federal court recently ruled that this communication with a third-party funder is not privileged. A lawyer who suspects that an opposing party or the client has received third-party funding can obtain this information and the opposing partys analysis in discovery. This is not usually available.
These funding companies are try-ing to create laws in at least eight states that would designate the communica-tions between the lawyer/client and the third-party funder as confidential and not subject to discovery. So far these ef-forts have been unsuccessful. The trend in the United States today is to limit the attorney-client privilege. Time will tell if these efforts by third-party funders will achieve their desired goal. I have my doubts.
This new development is wide-spread. A recent Internet search brought back more than 3 million hits for litigation funding. This type of funding will only encourage more lawsuits and demands for more money to satisfy the greed of these third-party funders.
Hopefully the more that is known about this funding vehicle the more it can be relegated to a memory. This funding is a growing cancer on the liti-gation system in our country. LPG

Since 2007, we have raised more than $100,000 for re-search. This is in the form of donations, annual golf event dollars that are matched by Safeway dollar for dollar and other fund-raising methods. The propane industry has stepped up in many ways. Our sponsors for the golf event donated time and money to these events. The Texas Pro-pane Gas Association undoubtedly has been a tremendous part of our success by completely managing our golf events to date. Our championship trophy is named in honor of Mr. Bill McHenry, former NPGA president and industry gentle-man who succumbed to prostate cancer.
We have had several celebrities help us in raising funds and participating in events. We have been fortunate to team up with Major League Baseball and have enjoyed the company of such greats as Art Howe, Kevin Millwood, Jack Lazarko, John Matlick, Brad Lincoln, Tom Grieve and many others.
With June being such an important month, we have decided to team up with LP Gas Magazine and have our fifth-year event in conjunction with the LP Gas annual golf tournament on June 14-17 at the Reunion Resort and Club in Orlando, Fla.
There is no better way to celebrate Fathers Day than to play a few rounds of golf with your dad, brother, uncle or anyone else close to you who needs to be aware of the as-pects of prostate cancer. In addition, the Reunion Resort is a great family place that has a water park and restaurants, and is minutes from Disney World and all of the other Or-lando attractions.
I would ask to seriously consider the trip for a good cause and to take a break and celebrate your family at this event. And by the way, get yourself checked. LPG

PRESS RELEASE
BASE Engineering Inc. has reached an important
milestone with the shipment of it's 50,000th fuel
control system. Company President and CEO Steve
Belyea expressed his "sincere appreciation to all of our
customers and distributors worldwide as well as to our
great staff for sixteen years of steady growth".
The 50,000th BASE system was shipped to Pacific Truck Tank
of Sacramento, California and installed by Pacific on a brand new
Amerigas LPG bobtail. It featured BASEs ASKWAX system with radio remote
control of the trucks Hose Reel, Power Take Off, Pump RPM, and Emergency Stop.

Our refurbished tanks are abrasive blasted to bare metal, zinc rich epoxy primed and top coated with an urethane nish. This system is used on water towers, bridges and off shore rigging. Valves are then replaced with RegO valves. We hold no expense on the products we use to rebuild tanks. Our goal is to create a better product than what was manufactured and we believe we do. Thats why we are one of the longest running refurbishing companies around!
