Vertical commonality, on the other hand, requires that the "investor and thepromoter be involved in some common venture without mandating that other investorsalso be involved in that venture." (30) In order to find the existence of verticalcommonality sufficient to establish a common enterprise between a promoter andinvestor, a direct relation must exist between the success or failure of the promoter andthe individual investor. Vertical commonality usually does not exist in a multilevelmarketing program as the success of a Member's business is independent of thesuccess or failure of the Company. C. Expectation of Profits Solely From the Efforts of Others Multilevel marketingâÂÂalso known as network marketing, direct selling, and person-to-person marketingâÂÂis a rapidly growing industry. According to the Direct Selling Association, MLM businesses employed between 9 and 12 million people in 1999, up from 5 million in 1991. Some of the best-known companies that use MLM techniques include Amway , Mary Kay Cosmetics, Pampered Chef, and Longaberger Baskets. You may find that your event offers dozens of benefits to a wide variety of people. In this case, identifying your ideal prospects can make it easier to craft your message. Rather than trying to be everything to everyone, create promotional materials that speak to your ideal prospects. For example, your personal growth seminar could, technically, benefit every person you meet. But you might find that women over age 50 are your best candidates; address their needs, desires and concerns in your marketing materials. Why 10 years? Because that amount of time really seems to matter.
