PRESENTATION BY THE SAN JOAQUIN VALLEY AIR POLLUTION CONTROLDISTRICT REGARDING THE HEALTHY AIR LIVING OUTREACH CAMPAIGN. JohnCadrette, Compliance Manager for the San Joaquin Valley Air Pollution Control Districtfrom the Modesto Office spoke regarding the Healthy Air Living Outreach Campaignwhich included a PowerPoint presentation and a video.

There was Council Member discussion regarding if the pollution generated in the BayArea reach this area, how much pollution is generated and by what types of pollutants,how the Bay Area communities coastal onshore breezes and cooler temperatures allowfor high pollution levels and better air quality, if you exceed the standard in onecommunity in the San Joaquin Valley it counts the entire San Joaquin Valley, howMerced County has better air days then neighboring communities, the fairness of thesituation and regulations in sight of the economic issues.

JOE SOUSA: Thanked Ann McCauley for all her hard work on the Movie Night, spokeregarding the National Conference for Community Action Agency that he recentlyattended and noted the number of people living at the poverty level, the September 9,2012 Annual Flag Raising Ceremony at Volta School in honor of 9-11 and encouragedall to attend and acknowledge those who have served and always remember and neverforget and thanked Ms. Susanna Hempworth and Ms. Whitehurst at for putting the eventon.

ELIZABETH STONE: Attended Movie Night and spoke to how absolutely incredible theevent was and thanked Ann McCauley for organizing the event, PG & E and Ronny'slandscaping for helping make it happen, reminded everyone about the Salute to SeniorFair being held on September 30, 2011 at the Community Center.

TOM FARIA: Reminded all about the 9-11 events being held on September 11, 2011,thanked all who had something to do with protecting us, how everyone works to protectus and he is the master of ceremonies at the 9-11 event. He noted how the schools arerunning quite well, Los Banos High School is shrinking and Pacheco High School isgrowing, not nearly so crowded on campus and everything is running smoothly, peaceand prosperity to all.

SCOTT SILVEIRA: Attended Movie Night with his family and how it was a great nightand a great time, thanked Ann McCauley for all her work, Annual Smorgasbord Dinnerbeing held at St. John's Lutheran Church being held on October 11, 2011, he statedthat he dropped his shoes off at the UPS store to add to the 9-11 Collection, and heechoed all the sentiments stated about 9-11 and encouraged all to attend.

MAYOR MICHAEL VILLALTA: Absent.

Background:

The City of Los Banos currently participates in the Merced County Regional EnterpriseZone which was established December 17, 2006 and has jurisdiction over the existingzone and proposed expansion area.

The Enterprise Zone can be expanded to include those businesses that are either newto the area or were missed during the initial Enterprise Zone process. Land includedwithin the expanded area is zoned for industrial, commercial or has a conditional usepermit for business.

Approving this Resolution would allow the City to participate in the Expansion of theZone.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LOS BANOSAPPROVING THE EXPANSION OF THE MERCED REGIONAL ENTERPRISE ZONE

BOUNDARIES

WHEREAS, the City of Los Banos currently participates in an enterprise zone that wasestablished on December 17, 2006 and has jurisdiction over the existing zone (Exhibit A) as wellas proposed expansion areas; and

WHEREAS, the City of Los Banos wishes to expand the boundaries of its enterprise zone toinclude the geographic areas set forth in the attached boundary map (Exhibit B), as inclusion intothe zone has been requested by the business owners; and

WHEREAS, land included with the proposed expansion area is zoned for industrial orcommercial use or has a Conditional Use Permit; and

WHEREAS, basic infrastructure is available to the area that would be included in the proposedexpansion area; and

WHEREAS, the City ofLos Banos will submit a written request as required to the CaliforniaDepartment ofHousing and Community Development to have its enterprise zone boundariesexpanded.

NOW THEREFORE, BE IT RESOLVED that the City ofLos Banos does hereby support andapprove the Merced County Regional Enterprise Zone expansion into the areas as shown inExhibit B.

The foregoing resolution was passed and adopted by the Los Banos City Council on September21 2011, by the following vote:

Dear Mr. Nunn:Enclosed is Merced Regional Enterprise Zone's completed expansion application. I am sub­mitting this application for your review and approval of the Merced Regional Enterprise ZoneExpansion #2 to include an additional 67.34 acres. Included in this application is the com­pleted Expansion application, the required documents, exhibits B-G, zoning verification ofCommercial Use Permits, and Resolutions provided by 7 jurisdictions that make up theMerced Regional Enterprise Zone.

This is Merced Regional Enterprise Zone's second expansion application. The initial zonewas set at 42,7300.96 acres. Using the expansion formula provided by the State of CaliforniaDepartment of Housing and Community Development the Merced Regional Enterprise Zonemay expand up to 6,410 acres. The Merced Regional Enterprise Zone is requesting an expan­sion of the existing zone of 185.66, leaving 4347.17 acres left for any future needs. The185.66 acres proposed for inclusion in the Merced Regional Enterprise Zone are both Con­tiguous and Non-Contiguous, and is comprised of 75.45 acres for Commercial and 110.21for Zoned Agriculture with attached Commercial Use Permit (CUP).

Since its inception on December 17, 2006 The Merced Regional Enterprise Zone has helped444 businesses create 1700 new jobs and retain up to 7768 existing jobs. With this expansion,we expect to increase those numbers.

" Recommendation:That the City Council receive the staff report in regards to the Regional TransportationImpact Fee (RTIF), and provide direction to staff in regards to this matter.

Background:The following is a brief timeline in regards to the Regional Transportation Impact Fee(RTIF).

A) In May 2005, the City Council adopted a Resolution approving the initial RTIFstudy prepared by Merced County Association of Governments (MCAG).

B) Effective August 1, 2005, the cities of Atwater, Dos Palos, Los Banos,Merced, and the County of Merced began collecting RTIF fees through theirpermitting process.

C) In August of 2008, the City Council adopted a Resolution approving theimplementation of the updated RTIF study.

D) On April 15, 2009, the City Council adopted Ordinance No. 1086 (seeAttachments) which established new non-residential RTIF fees, per theapproved updated RTIF study.

AN ORDINANCE OF THE CITY COUNCIL OF THECITY OF LOS BANOS AMENDING CHAPTER 18OF TITLE 3 OF THE LOS BANOS MUNICIPALCODE RELATING TO THE REGIONALTRANSPORTATION IMPACT FEE (RTIF)

The City Council of the City of Los Banos does ordain as follows:

WHEREAS, the City Council in May 2005, adopted a Resolution approving theinitial RTIF Study prepared by Merced County Association of Governments (MCAG);and

WHEREAS, in accordance with State Law requiring annual RTIF review, theMCAG Governing Board at their January 17, 2008 meeting, completed its annual reviewof the RTIF program with the approval of an updated RTIF Study; and

WHEREAS, the City Council in August 2008, adopted a Resolution approving theimplementation of the updated RTIF Study; and

WHEREAS, provisions in the Municipal Code relating to the RTIF need to beupdated.

Sec. 3-18.01 Intent.

(a) The City Council of the City of Los Banos finds that future development within theCounty of Merced to the year 2030 will result in traffic volumes in excess ofcapacity on the regional system of arterials, highways, and freeways asdesignated in this Ordinance.

(b) The City Council of the City of Los Banos finds that failure to expand the capacityof the existing circulation system will result in new development causingunacceptable levels congestion on the arterials, highways, and freeways of theregional system.

(c) The City Council also finds and declares that, in the absence of this chapterimposing a fair-share traffic fee upon new development, existing and futuresources of revenue are inadequate to fund substantial portions of the regionaltransportation system improvements needed to avoid unacceptable levels ofcongestion and related adverse impacts caused by new development.

Sec. 3-18.02 Purpose.

(a) The City Council of the City of Los Banos finds and determines that adoption ofthis regional transportation impact fee ordinance will raise additional revenuesneeded to construct improvements to accommodate traffic that will be generatedby new development within the County and City of Los Banos.

(b) The City Council also finds and declares that the Regional Transportation ImpactFee Study (MCAG, January 18, 2008) has determined the extent to which thenew development of land will generate traffic volumes impacting the roadwaysystem and that this chapter establishes a fair and equitable method fordistributing unfunded costs of transportation improvements necessary toaccommodate traffic volumes generated by such development.

Sec. 3-18.03 Specific Findings.

The need for regional transportation improvements and for the regionaltransportation impact fee established by the ordinance codified in this chapter arebased on the finding of the Regional Transportation Impact Fee Study prepared bythe Merced County Association of Governments whose Governing Board iscomposed of City Council members and County Supervisors from the County's six(6) cities and the County Board of Supervisors. The study has established thatgrowth to the year 2030 will affect the entire regional transportation system andtherefore that the area of impact for future development is appropriately the entireCounty of Merced. The Study made the following additional findings:

(a) PopUlation and employment within the County of Merced is anticipated toincrease by ninety-eight (98%) percent and eighty-two (82%) percent,respectively by the year 2030 and will result in Levels of Service E and F (asdefined in the Highway Capacity Manual, 6th edition) on existing arterials,highways, and freeways.

(b) The Regional Transportation Plan (MCAG, 2007) modeled and evaluated theeffect of projected growth to the year 2030 on all major arterials, highways, andfreeways in Merced County and found that without expansion, the transportationsystem would suffer severe congestion. Further, the plan showed that therecommended transportation improvements would accommodate the trafficanticipated in the year 2030 at the desired Level of Service D.

(c) Existing and future sources of public revenues are insufficient to fund all theneeded transportation improvements.

(d) The revenues generated by this regional transportation impact fee will provideadditional funds necessary to construct the transportation improvements and willhelp provide the additional capacity needed in the year 2030 to accommodatethe traffic generated by new development in the Cities and County of Merced.

(e) The regional transportation impact fee is a fair and equitable method ofdistributing the cost of transportation improvements among the development thatwill generate the increased traffic.

(a) "Merced County" means the unincorporated areas of the County of Merced andthe incorporated areas of the six (6) cities within Merced County.

(b) "Regional system" means the following street, road, and highway segments:

(c) The "Regional transportation plan" means the document adopted by the MercedCounty Association of Governments on May 17, 2007.

(d) "Average weekday peak-hour trips" mean the average number of peak-hourvehicle trips to or from a designated land use Monday through Friday.

(e) "Peak-hour" means the one-hour long period during which the maximum amountof traffic occurs. Often the peak-hour is a rush period when commuters travel toand from work.

(f) "Trip generation rate" means the number of average weekday peak-hour tripsgenerated by a particular land use. The land use categories correspond to thoseused in the regional travel model maintained by MCAG. The trip generation ratefor each land-use category is the rate published by the Institute of TransportationEngineers, 6th Edition. The land use categories and peak-hour trip generationrates are as follows:

(g) "Development" means any discretionary or ministerial action by the City resultingin the issuance of grading, building, plumbing, mechanical, or electrical permits,conditional use permits or certificates of occupancy issued by the City toconstruct, to change the use of, a building or property.

Where development applies to a change in use of, or enlargement of an existingbuilding, the average weekday peak-hour trips shall be only the additional trips inexcess of those associated with the existing use.

(h) "Merced County Association of Governments" means the joint powers agencydelegated to manage and administer the regional transportation impact fee andwhose members are the incorporated Cities and the County of Merced.

(i) "Merced County Association of Governments Regional Transportation ImpactFee Trust Fund" or "trust fund" means the account to which regionaltransportation impact fees collected under this chapter are deposited with theMerced County Treasurer by the Cities and County for any lawful use asprovided in this chapter.

(j) "Regional Transportation Impact Fee Policy Board" (RTIF Policy Board) meansthose members of the MCAG Governing Board whose appointing jurisdiction hasadopted the ordinance codified in this chapter.

Sec. 3-18.05 Applicability.

This chapter shall apply only to new development and to any reconstruction ofexisting buildings that will generate additional vehicular trips. The provisions of thischapter shall take effect May 15, 2009.

Sec. 3-18.06 Establishment of regional transportation impact fee.

(a) The regional transportation impact fee is not intended to be the sole source offunding for construction of the regional system. Furthermore, the total amount offees collected pursuant to this chapter shall not exceed the cost of constructionof the regional system.

(b) The Merced County Association of Governments has calculated the regionaltransportation impact fee according to the following procedure:

(1) MCAG determined the total costs of the regional transportationimprovements.

(2) MCAG established a capital improvements program. This will include eachregional transportation improvement project with its total project cost, and

sources of funds to pay for the project, specifically showing the amount foreach project to be funded through the regional transportation impact fee.

(3) MCAG determined the total amount to be funded by the fee by summing thefee shares of each project in the capital improvements program.

(4) MCAG determined the total number of peak-hour trips associated with newdevelopment, for each land use category listed in Section 3-18.04(f) of thischapter, by using the MCAG traffic model and subtracting the number ofpeak-hour trips generated in Merced County by each category in the year2005 from the number of such trips generated by the same category in theyear 2030.

(5) MCAG determined a per-trip cost by dividing the total amount to be funded bythe fee by the total number of trips associated with new development.

(6) MCAG determined a cost per unit of development for the land use categorieslisted in Section 3-18.04(f) of this chapter. This cost will be calculated bymultiplying the per-trip cost by the average peak-hour trips per unit ofdevelopment. Units of development will be dwelling units for residential landuses, and 1,000 square feet of floor area for commercial, industrial, and otherland uses.

(7) The fee for each new development is calculated by multiplying the cost perunit of development by the number of units being developed.

(c) As shown in the regional transportation impact fee study, MCAG has determinedthat the cost per peak-hour trip is Three Thousand One Hundred Fifteen andNo/10aths ($3,115.00) Dollars.

(d) The regional transportation impact fee study has calculated the followingtransportation impact fee schedule for these land use categories:

(e) Should the applicant believe the land use category in subsection (d) of thissection is not appropriate for their application, the applicant may propose a moreappropriate development category, subject to the approval of the City Manager ortheir designee, and alternative trip generation rate from the ITE Trip GenerationCode noted in this chapter for use in calculation of the appropriate trip generationrate, or;

(f) Should the applicant believe the land use category in subsection (d) of thissection is not appropriate for their application, the applicant may have prepared,at their own expense, a trip generation study conducted by a licensed trafficengineer that forecasts the anticipated peak-hour trips for the proposeddevelopment. The study procedure and results shall require the approval of theCity Manager or their designee.

(a) Identifies the purpose of the RTIF;(b) Identifies the use to which the fee will be put, including specific facilities;(c) Demonstrates a reasonable relationship between the fee's use and the type of

development project on which the fee is imposed;(d) Demonstrates a reasonable relationship between the need for the public facility

and type of development project on which the fee is imposed; and(e) Shows a reasonable relationship between the amount of the fee and the cost of

the public facility or portion of the public facility attributable to the development onwhich the fee is imposed.

Sec. 3-18.08 Exemptions.

The following developments are exempted from payment of the fee required by thischapter:

The reconstruction of any building that has been destroyed by fire, flood, or naturaldisaster so as the reconstructed building both continues the prior use and generatesthe same or fewer trips as the original building.

Sec. 3-18.09 Credits.

(a) Where an applicant, otherwise subject to this chapter dedicates and/or improvesthose regional roads, highways, or freeways identified in Exhibit A of this chapterbeyond the requirements established in subsection (b) of this section, theapplicant shall receive a credit against his regional transportation impact fee.That credit shall be an amount equal to the land value of dedicated land and/orthe actual engineering and construction costs incurred at the time of thedevelopment to the extent that the MCAG has included those costs in itsestimated cost of constructing the regional system.

(b) The fee required by this chapter shall be supplementary to any fees andconditions imposed upon projects under the provisions of the Subdivision MapAct, California Environmental Quality Act, and other State and local laws,ordinances, or administrative policy which may authorize the imposition ofconditions or contributions on development and the applicant shall not be entitledto any credits for such contributions or conditions.

(c) The in-Iieu-of-fee credit for any land dedications shall be based on the fair marketvalue of the land dedicated as determined by an appraisal process withconsultation with MCAG.

(d) Should the in-Iieu-of-fee credit exceed the applicant's total fee, the differencemay be credited against any of the applicant's future development which wouldbe subject to the fee, or a reimbursement agreement may be entered into.

(e) Should a developer be required to provide improvements which benefit adjacentundeveloped land, the developer may be reimbursed for a proportionate share ofthe cost of such improvements under special agreements with MCAG andcontingent upon future fees contributed from other benefited developments. In allcases, however, reimbursements under such special agreements must be timedto coincide with construction of the transportation project as scheduled in theCapital Improvement Plan adopted by MCAG.

Sec. 3-18.10 Collection of fee.

The RTIF shall be collected at the time when the City grants an occupancy permit forresidential structures or at the time of the issuance of a building permit fornonresidential structures.

For a change of use or other development subject to this chapter, that would notrequire a building permit, the fee shall be collected at the time of the issuance of ause, development, or business license permit, whichever occurs first

Sec. 3-18.11 Regional transportation impact fee fund.

(a) All monies collected from payments of the regional transportation impact fee shallbe deposited with the County Treasurer of Merced County in the trust fund.

(b) All monies in the trust fund shall be used solely for the delivery of the regionaltransportation projects identified in this chapter. Project delivery includespreparation of environmental and engineering documents, right-of-wayacquisition, construction, project support, and fund administration. All interest orother earnings of the trust fund shall be credited to the trust fund.

Sec. 3-18.12 Appeal process.

An applicant who disputes the amount of impact fee may file a written notice ofappeal with the City Manager or their designee. Within fifteen (15) days of theappeal, the City Manager or their designee shall provide written notification of his/herdecision. If unsatisfied with the decision of the City Manager or their designee, theapplicant may resubmit a written appeal to the City Council. Thereafter, the CityCouncil shall render its decision by a majority vote of those members present withinsixty (60) days of the filing of the appeal.

Sec. 3-18.13 Annual fee and program review.

(a) The City Council shall annually review, pursuant to Government Code Section66006, and if necessary amend the Regional Transportation Impact Fee Programto ensure that it continues to be a fair and equitable method to distribute thecosts of improvements necessary to accommodate traffic volumes generated byfuture growth. This review will coincide with the adoption of the five (5)-yearCapital Improvement Program pursuant to Government Code section 66006(d).In adjusting the fee program, the following shall be considered:

(1) Adding new transportation projects that meet program criteria;

(2) Deleting projects that have been completed;

(3) Adjust the average per trip cost to reflect changes in constructioncosts;

(4) Adjust the average per-trip cost to reflect changes in land values asindicated in an annual survey of local government costs for landsubject to right-of-way acquisition;

(5) Revise the average per-trip cost to reflect changes in the list ofregional projects as that list may be amended from time to time by theRTIF Policy Board.

(b) Unless otherwise amended by the City Council, the fees listed in Section 3­18.06(d) of this chapter shall be adjusted on July 1 of each year based upon theEngineering Construction Cost Index as published by the Engineering NewsRecord.

(c) Changes in the regional transportation impact fee resulting from the annualreview will have no effect on fees already paid into the trust fund.

(d) At the time of the annual review, the City Council shall make findings for any feesremaining unexpended and uncommitted in the trust fund for five (5) or moreyears after deposit demonstrating a reasonable relationship between the fee andthe purpose for which it was charged. Unless a need for such fees can bedemonstrated, the unexpended or uncommitted portion including interest that hasaccrued, shall be refunded to the current record owner of the developmentproject on a prorated basis.

If anyone or more of the terms, provisions, or sections of this chapter shall to anyextent be adjudged invalid, unenforceable, or void, by a court of competentjurisdiction, each and all of the remaining terms, provisions, and sections of thischapter shall not be affected thereby and shall be valid and enforceable.

Sec. 3-18.15 Effective date.

The ordinance codified in this chapter shall go into effect and be in full force andoperation thirty (30) days after its final passage and adoption. The City Clerk shallcertify to the adoption of the ordinance codified in this chapter and cause the sameto be posted and published once within fifteen (15) days after passage and adoptionas may be required by law; or, in the alternative, the City Clerk may cause to bepublished a summary of this chapter and a certified copy of the text of this chaptershall be posted in the Office of the City Clerk five (5) days prior to the date ofadoption of the ordinance codified in this chapter; and, within fifteen (15) days afteradoption, the City Clerk shall cause to be published, the aforementioned summaryand shall post a certified copy of this chapter, together with the vote for and againstthe same, in the Office of the City Clerk.

The following transportation projects are those which when completed will togethermitigate the traffic impacts on the regional transportation system of future growth tothe year 2030 throughout Merced County. The City Council, upon adoption of thischapter, shall amend the Circulation Element of the General Plan to include theseregional projects and any amendments.

The Regional Transportation Impact Fee shall be solely for funding environmentalclearance analysis and reports, design engineering, right-of-way acquisition,construction, fund management, project support, and other necessary expenses forthe delivery of Regional System projects and any other purpose consistent with thischapter. BACKGROUND

The Regional Transportation Impact Fee (RTIF) program collects one-time fees from newdevelopment to mitigate their impact on the regional road network.

Effective August 1, 2005, the cities of Atwater, Dos Palos, Los Banos, Merced and the County ofMerced began collecting RTIF fees through their permitting process. The City of Gustine begancollecting the fee effective August 22, 2005. The City of Livingston has not adopted an ordinanceor resolution to implement the RTIF program fee collection.

MCAG Governing Board and member jurisdictions are updated on the status of the fee collectionand the proposed transportation projects through staff report updates.

NOTICE IS HEREBY GIVEN THAT a Public Hearing will be held by the Los BanosPlanning Commission to consider a recommendation to the Los Banos City Council tomake minor revisions to the comprehensive Zoning Ordinance amending Title 9,Chapter 3 of the Los Banos Municipal Code.

A PUBLIC HEARING on this matter will be held at the next scheduled meeting of thePlanning Commission on Wednesday, September 28, 2011 at 7:00 p.m. in the CouncilChambers of Los Banos City Hall located at 520 "J" Street.
