Foreword This Logan Basin draft Resource Operations Plan has been prepared for public consultation and provides the opportunity for interested parties to make submissions.

When finalised, this plan will implement the outcomes and strategies specified in the Water Resource (Logan Basin) Plan 2007. Together the plans will provide an enhanced level of certainty and security for human consumptive water use and for the natural environment.

The water resource plan and resource operations plan are complementary parts of a water planning framework that will ensure that the water resources of the plan area are managed for the benefit of future generations.

While the water resource plan strives to achieve a sustainable balance between meeting human needs and those of the environment, the resource operations plan is concerned with the practical business of sharing and managing the water resources from day to day in a way that meets water resource plan objectives.

The relationship between the two plans is set out in the Water Act 2000, which specifies that the resource operations plan must ensure that strategies established in the water resource plan for advancing sustainable water allocation and management are implemented. To this end, monitoring arrangements will be implemented and refined under the resource operations plan. These monitoring arrangements will be crucial in assessing whether or not the water resource plan’s environmental flow and water allocation security objectives are being met.

The resource operations plan contains arrangements for:

• converting existing supplemented water authorisations in priority area one into tradable water allocations

• dealing with unallocated water

• operation of infrastructure and management of water use in the Logan River Water Supply Scheme including rules for sharing water amongst water allocation holders and rules for permanent and seasonal trading of water

• establishing unsupplemented water allocations

• dealing with water licence applications

• monitoring and reporting.

I encourage interested parties to read the plan and make a submission if you wish to raise any issues in regard to the finalisation of the draft plan.

Chapter 1 Preliminary

1 Short title (1) This resource operations plan may be cited as the Logan Basin Resource Operations

Plan 20081.

(2) Reference in this document to ‘this plan’ means the Logan Basin Resource Operations Plan 2008.

2 Commencement of the resource operations plan This plan commences on the first business day after this plan is notified in the Queensland Government Gazette.

3 Purpose of plan This plan implements the Water Resource (Logan Basin) Plan 2007.

4 Interpretation of words used in this plan The glossary in Attachment 1 provides further information on particular words used in this plan.

5 Plan area This plan applies to the area shown as the plan area on the map in Attachment 2(a).

6 Water to which this plan applies This plan applies to the following water in the plan area—

(a) water in a watercourse or lake;

(b) water in springs not connected to—

(i) artesian water; or

(ii) subartesian water connected to artesian water.

7 Water management areas—Water Regulation 2002, section 56(4A) A water management area shown on the map in Attachment 2(b) is a water management area for this plan.

8 Resource operations plan zones (1) Each of the zones shown on the maps in Attachments 2(c) and 2(d) is a resource

operations plan zone (‘zone’) for this plan.

(2) Each zone includes—

(a) each part of a watercourse, lake or spring that lies within the zone; and

(b) those sections of tributaries where there is access to flow or pondage from a watercourse or lake within the zone.

9 Information about areas (1) The exact location of the boundaries of the plan area, resource operations plan zones

and water management areas, is held in digital electronic form by the department.

(2) The information held in digital electronic form can be reduced or enlarged to show the details of the boundaries.2

10 Purpose of a water allocation (1) Water taken under a water allocation must only be used for the purpose stated on that

water allocation.

(2) Subsection 1 does not apply to water taken under seasonal assignment.

11 Resource operations licence holder (1) A resource operations licence holder for this plan is the resource operations licence

holder for the Logan River Water Supply Scheme;

(2) The area managed under the resource operations licence for the Logan River Water Supply Scheme is shown on the map in Attachment 2(e).

12 Departmental water monitoring data collection standards (1) Where this plan requires monitoring by a resource operations licence holder or a water

licence holder, including measurement, collection, analysis and storage of data, the resource operations licence holder or water licence holder must ensure the monitoring is consistent with the Water Monitoring Data Collection Standards.3

(2) The Water Monitoring Data Collection Standards may be reviewed and updated by the chief executive at any time.

(3) The chief executive must notify the resource operations licence holder and any water licence holder mentioned in section 158 at least 20 business days before any substantive changes are made to the Water Monitoring Data Collection Standards.

13 Departmental water monitoring data reporting standards (1) Where this plan requires transfer of data or reporting by a resource operations licence

holder or any water licence holder mentioned in section 158, the resource operations licence holder and any water licence holder mentioned in section 158 must ensure the

transfer or reporting is consistent with the Water Monitoring Data Reporting Standards4.

(2) The Water Monitoring Data Reporting Standards may be reviewed and updated by the chief executive at any time.

(3) The chief executive must notify the resource operations licence holder and any water licence holder mentioned in section 158 at least 20 business days before any substantive changes are made to the Water Monitoring Data Reporting Standards.

14 Interim program (1) The chief executive, the resource operations licence holder, and any water licence

holder mentioned in section 158 must implement requirements of this plan as soon as is practicable.

(2) Subsections 3 to 11 apply where a resource operations licence holder or any water licence holder mentioned in section 158 is unable to meet the requirements of this plan.

(3) The resource operations licence holder or any water licence holder mentioned in section 158 must—

(a) Within two months of commencement of this plan, submit a statement of programs currently in existence, to the chief executive for approval; and

(b) Within six months of commencement of this plan, submit a program for meeting the requirements of this plan to the chief executive for approval, including a timetable and interim methods to be used.

(4) The resource operations licence holder or any water licence holder mentioned in section 158 may, where an emergency or operational incident results in an inability to comply with any rules or requirements of this plan, submit an interim program for meeting the requirements of this plan to the chief executive for approval, including a timetable and interim methods to be used.

(5) Where the submitted program relates to the Water Monitoring Data Collection Standards, the program must include the accuracy of methods currently used.

(6) The chief executive, in considering any submitted program, may request additional information.

(7) The chief executive, in considering any submitted program, may either—

(a) approve the program with or without conditions;

(b) amend and approve the amended program; or

(c) require the resource operations licence holder or water licence holder to submit a revised program.

(8) Within 10 business days of making a decision on a program submitted under this section, the chief executive must notify the resource operations licence holder or any water licence holder mentioned in section 158 of the decision.

(9) Following approval of the program by the chief executive, the resource operations licence holder or any water licence holder mentioned in section 158—

(a) must implement and operate in accordance with the approved program; and

(b) publish details of the approved program on their internet site.

(10) Where there is conflict between the provisions of this plan and the provisions of an approved program, the approved program prevails for the time that the program is in place.

(11) Where this section applies, the resource operations licence holder or water licence holder mentioned in section 158 may continue to operate under the existing program until the program submitted under this section is approved.

15 Operating and environmental management rules and monitoring requirements (1) The operating and environmental management rules and monitoring requirements of

this plan do not apply in situations where carrying out those rules and requirements would be unsafe to a person or persons.

(2) Under circumstances where subsection 1 applies, the resource operations licence holder—

(a) must comply with the reporting requirements for operational or emergency incidents in accordance with chapter 8 of this plan; and

(b) may submit an interim program for implementing the rules and requirements of this plan under section 14 of this plan.

(3) Under circumstances where subsection 1 applies, a water licence holder mentioned in section 158—

(a) must comply with the reporting requirements for operational or emergency incidents in accordance with chapter 9 of this plan; and

(b) may submit an interim program for implementing the rules and requirements of this plan under section 14 of this plan.

16 Sustainable management of water This plan, in implementing the Water Resource (Logan Basin) Plan 2007, provides for the sustainable management of water by—

(a) allowing for the allocation of water and contributing to the fair, orderly and efficient allocation of water to meet community needs, including economic development in accordance with ecologically sustainable development principles, by—

(i) stating processes for dealing with unallocated water;

(ii) granting authorisations for the taking of and interfering with water;

(iii) establishing water allocations that are tradable and separate from land; and

(iv) specifying rules for water trading;

(b) protecting the biological diversity and health of natural ecosystems and contributing to the protection and, if practicable, reversing the degradation of water, watercourses, lakes, springs, aquifers, natural ecosystems and other resources by—

(i) detailing the operating, environmental management and water sharing rules for the Logan River Water Supply Scheme;

(ii) detailing arrangements for the collection and assessment of data by the chief executive relating to Water Resource (Logan Basin) Plan 2007 general and ecological outcomes; and

(iii) detailing water and natural ecosystem monitoring responsibilities of the resource operations licence holder and any water licence holder mentioned in section 158;

(c) contributing to improving the confidence of water users regarding the availability and security of water entitlements by—

(i) stating processes for dealing with unallocated water;

(ii) detailing the operating, environmental management and water sharing rules for the Logan River Water Supply Scheme;

(iii) detailing the operating rules for infrastructure identified in section 158;

(iv) detailing change rules for water allocations in the Logan River Water Supply Scheme;

(v) detailing water and natural ecosystem monitoring responsibilities of the resource operations licence holder for the Logan River Water Supply Scheme;

(vi) detailing water monitoring responsibilities for infrastructure identified in section 158;

(vii) detailing processes for dealing with applications for water licences relating to unsupplemented water in watercourses, lakes and springs;

(viii) detailing arrangements for the collection and assessment of data by the chief executive relating to Water Resource (Logan Basin) Plan 2007 outcomes; and

(ix) detailing stated amendments under section 105(5) and 106(b) of the Water Act 2000 that can be made to this plan;

(d) contributing to increasing community understanding and participation in the sustainable management of water by—

(i) providing opportunities for community participation and submissions as part of plan development; and

(ii) clearly specifying rules and arrangements for the allocation and management of water in the plan area, including explanatory notes that provide details of the intent and application of each section of this plan.

17 Addressing water resource plan outcomes (1) This plan addresses Water Resource (Logan Basin) Plan 2007, outcomes by—

(a) specifying processes, rules and limits, the application of which are consistent with environmental flow objectives and water allocation security objectives specified in the Water Resource (Logan Basin) Plan 2007; and

(b) providing monitoring and reporting arrangements to assist in the ongoing assessment of whether water management arrangements in the plan area will contribute to the achievement of Water Resource (Logan Basin) Plan 2007, outcomes.

(2) Attachment 3 lists the outcomes of the Water Resource (Logan Basin) Plan 2007 and how the rules of this plan are linked to those outcomes.

Chapter 2 Unallocated water

Part 1 Preliminary

23 Scope of Chapter 2 This chapter states a process for making available and dealing with, unallocated water mentioned in sections 25, 27 and 29 of the Water Resource (Logan Basin) Plan 2007.

24 Record of volume of unallocated water (1) The chief executive must develop a register of the volume of unallocated water

available.

(2) This register must be updated after the granting of an entitlement

25 Unallocated water reserves Unallocated water is held as—

(a) strategic reserve;

(b) town water supply reserve; and

(c) general reserve.

Part 2 Strategic reserve

26 Availability of strategic reserve The volume of water held in the strategic reserve is detailed in Attachment 4 Table 1.

27 Process for granting a water allocation from the strategic reserve—Water Act 2000, section 122 (1) An application may be made for a grant of water from unallocated water in the strategic

reserve only where the proposed grant of the water is in accordance with section 27 of the Water Resource (Logan Basin) Plan 2007.

(2) The application must—

(a) be made to the chief executive, in writing;

(b) be accompanied by the prescribed fee; and

(c) be supported by sufficient information to enable the chief executive to assess the application against the matters prescribed in section 23 of the Water Resource (Logan Basin) Plan 2007.

(3) The chief executive may, by written notice given to the applicant, require—

(a) the applicant to give additional information about the application within the reasonable time specified within the notice; and

(b) any information included in the application, or any additional information required under subsection (a) to be verified by statutory declaration.

(4) If the applicant fails to provide the information required by the chief executive within the time specified in the notice the application lapses.

(5) For deciding the application for granting a water allocation, the chief executive must consider—

(a) the application and any additional information given about the application;

(b) the matters prescribed under section 23 of the Water Resource (Logan Basin) Plan 2007; and

(c) the public interest.

(6) Subsection (5) does not limit the matters the chief executive may consider in deciding an application for granting a water allocation.

(7) If the chief executive is satisfied the application should be approved, or approved in part, the chief executive must grant the water allocation with or without conditions.

(8) The chief executive’s decision in subsection (7) must be consistent with section 17 of the Water Resource (Logan Basin) Plan 2007.

28 Granting a water licence from the strategic reserve—Water Act 2000, section 212 (1) An application may be made for a grant of water from unallocated water in the strategic

reserve only where the proposed grant of the water is in accordance with section 27 of the Water Resource (Logan Basin) Plan 2007.



(b) be accompanied by the prescribed fee;

(c) specify the source and location from which the water is proposed to be taken;

(d) indicate the maximum volumes of water proposed to be taken daily, monthly and annually;

(e) specify the maximum instantaneous rate at which water is proposed to be taken; and

(f) be supported by sufficient information to enable the chief executive to determine whether the application meets the matters specified in section 23(1)(a) to (e) of the Water Resource (Logan Basin) Plan 2007.

29 Additional information may be required (1) The chief executive may, by written notice given to the applicant, require—

(a) the applicant to give additional information about the application within the reasonable time specified in the notice; and


(2) If the applicant fails to provide information required by the chief executive within the time specified in the notice the application lapses.

(3) The chief executive may give a copy of the application and any additional information to any entity the chief executive considers appropriate.

30 Matters the chief executive must consider (1) For deciding the application, the chief executive must consider—

(a) the application and any additional information given about the application; and

(b) the public interest.

(2) Subsection (a) does not limit the matters the chief executive may consider.

31 Deciding an application for a grant of water (1) If the chief executive is satisfied that the application should be approved, or approved in

part, the chief executive must grant a water licence under section 212 of the Water Act 2000—

(a) for all or part of the application;

(b) for a stated period;

(c) with or without conditions.

(2) If the chief executive is not satisfied that the application should be approved, the chief executive must refuse the application.

Part 3 Town water supply reserve

32 Availability of town water supply reserve The volume of water held in the town water supply reserve is detailed in Attachment 4 Table 1.

33 Granting a water licence from the town water supply reserve—Water Act 2000, section 212 (1) The South East Queensland Water Grid Manager may apply for the grant of unallocated

water from the town water supply reserve mentioned in section 29 of the Water Resource (Logan Basin) Plan 2007.



(b) be accompanied by the prescribed fee;

(c) specify the source and location from which the water is proposed to be taken;

(d) indicate the maximum volumes of water proposed to be taken daily, monthly and annually;

(e) specify the maximum instantaneous rate at which water is proposed to be taken; and

(f) be supported by sufficient information to enable the chief executive to determine whether the application meets the matters specified in section 23(1)(a) to (e) of the Water Resource (Logan Basin) Plan 2007.

34 Additional information may be required (1) The chief executive may, by written notice given to the applicant, require—

(a) the applicant to give additional information about the application within the reasonable time specified in the notice; and


(2) If the applicant fails to provide the information required by the chief executive within the time specified on the notice the application lapses.

(3) The chief executive may give a copy of the application and any additional information to any entity the chief executive considers appropriate.

35 Matters the chief executive must consider (1) For deciding the application, the chief executive must consider—

Chapter 3 Granting, amending and converting authorisations

Granting of a resource operations licence—Water Act 2000, section 107

43 Resource operations licence (1) The chief executive must grant a resource operations licence to the Queensland Bulk

Water Supply Authority for the Logan River Water Supply Scheme.

(2) The infrastructure associated with the resource operations licence for the Logan River Water Supply Scheme is described in Attachment 5.

Part 2 Rules for amending water licences for taking unsupplemented water

44 Amending a water licence for taking unsupplemented water (1) When amending a water licence in accordance with section 217 or section 218 of the

Water Act 2000, the chief executive must, under section 60 of the Water Resource (Logan Basin) Plan 2007, amend the licence to include the following—

(a) the purpose for which the water may be taken under the licence;

(b) the annual volumetric limit for the licence as determined under section 61 of the Water Resource (Logan Basin) Plan 2007;

(c) the maximum rate at which water may be taken under the licence as determined under section 62 of the Water Resource (Logan Basin) Plan 2007; and

(d) the flow conditions for the licence.

(2) Where subsection 1 applies to an amendment to a licence to take water from a waterhole or lake, the chief executive must amend the licence in accordance with section 19 of the Water Resource (Logan Basin) Plan 2007.

Part 3 Water licences to be granted

45 Water licences to be granted to the South East Queensland Water Grid Manager

The chief executive must grant to the South East Queensland Water Grid Manager a water entitlement in accordance with Attachment 6(a)—

(a) to replace the continued authority under section 360ZDP5 of the Water Act 2000; and

(b) mentioned in—

(i) section 45(1)(a) of the Water Resource (Logan Basin) Plan 2007 for the taking of water from Albert River; and

(ii) section 45(1)(c) of the Water Resource (Logan Basin) Plan 2007 for the taking of water from Tingalpa Creek.

46 Water licences to be granted to the Queensland Bulk Water Supply Authority The chief executive must grant to the Queensland Bulk Water Supply Authority a water entitlement in accordance with Attachment 6(b)—

(a) to replace the continued authority under section 360ZDP5 of the Water Act 2000; and

(b) mentioned in—

(i) section 45(1)(a) of the Water Resource (Logan Basin) Plan 2007 for interfering with the flow of water in Albert River; and

(ii) section 45(1)(c) of the Water Resource (Logan Basin) Plan 2007 for interfering with the flow of water in Tingalpa Creek.

47 Water licences to be granted to the Gold Coast City Council The chief executive must grant to the Gold Coast City Council water entitlements to replace the authority mentioned in section 45(1)(b) of the of the Water Resource (Logan Basin) Plan 2007 and originally authorised by Order in Council dated 7 July 1966—

(a) a water licence to take water from the Albert River in accordance with Attachment 6(c); and

(b) a water licence to interfere with the flow of water in the Albert River in accordance with Attachment 6(c).

Part 4 Rules for converting to and granting of water allocations

48 Application of Part 4 This part sets out the rules for converting existing water authorisations and the granting of water allocations in accordance with the schedule of water allocations in Attachment 7.

Division 1 Converting to and granting of supplemented water allocations

49 Application of Division 1 This division applies to existing water authorisations in the medium priority and high priority groups in priority area 1 of the Water Resource (Logan Basin) Plan 2007.

50 Rules for converting existing water authorisations to supplemented water allocations

The existing water authorisations must be converted to supplemented water allocations as follows—

(a) the person granted the water allocation must be the person who holds the existing water authorisation from which the water allocation is converted;

(b) the location for the water allocation must be the zone that includes the place on a watercourse, lake or spring from which the water could be taken under the existing water authorisation;

(c) the purpose for the water allocation must be in accordance with section 49 of the Water Resource (Logan Basin) Plan 2007;

(d) the nominal volume for the water allocation must be in accordance with section 51 of the Water Resource (Logan Basin) Plan 2007;

(e) the priority group for the water allocation must be in accordance with section 52 of the Water Resource (Logan Basin) Plan 2007.

51 Granting of supplemented water allocations The chief executive must grant supplemented water allocations for existing water authorisations converted under section 50 of this plan in accordance with Attachment 7 Table 1.6

Division 2 Converting to and granting of unsupplemented water allocations

52 Application of Division 2 This division applies to existing water authorisations for taking unsupplemented water in priority area 1 other than authorisations for taking water for stock or domestic purposes.

53 Rules for converting existing water authorisations to unsupplemented water allocations

The existing water authorisations must be converted to unsupplemented water allocations as follows—

(a) the person granted the water allocation must be the person who holds the existing water authorisation from which the water allocation is converted;the location for the water allocation must be the zone that includes the place on a watercourse, lake or spring from which the water could be taken under the existing water authorisation in accordance with section 48 of the Water Resource (Logan Basin) Plan 2007;

(b) the purpose for the water allocation must be in accordance with section 49 of the Water Resource (Logan Basin) Plan 2007;

(c) the nominal volume for the water allocation must be in accordance with section 54 of the Water Resource (Logan Basin) Plan 2007;

(d) the annual volumetric limit for the water allocation must be in accordance with section 55 of the Water Resource (Logan Basin) Plan 2007;

(e) any daily or monthly volumetric limit for the water allocation must be in accordance with section 56 of the Water Resource (Logan Basin) Plan 2007;

(f) the maximum rate for the water allocation must be in accordance with section 57 of the Water Resource (Logan Basin) Plan 2007;

(g) in deciding the conditions under which water may be taken under a water allocation to take unsupplemented water, the chief executive must consider the conditions stated on the existing water authorisation in accordance with section 58 of the Water Resource (Logan Basin) Plan 2007;

(h) the water allocation group for the water allocation must be in accordance with section 59 of the Water Resource (Logan Basin) Plan 2007.

54 Granting of unsupplemented water allocations The chief executive must grant unsupplemented water allocations for existing water authorisations converted under section 53 of this plan in accordance with Attachment 7 Table 2.7

Part 5 Granting a resource operations licence to meet future water requirements

55 Application of Part 5 This part states a process under section 108 of the Water Act 2000 for granting a resource operations licence to meet future water requirements.

56 Applying for a resource operations licence—Water Act 2000, section 108 (1) This section applies to the proposed owner of infrastructure identified in any of the

following—

(a) a project declared under section 26 of the State Development and Public Works Organisation Act 1971 to be a significant project;

(b) the SEQ regional plan or instruments that implement the plan; or

(c) a regional water security program.

(2) The chief executive may give notice to the proposed owner that the proposed owner must apply to the chief executive for a resource operations licence.


(a) be in the approved form; and

(b) include the following—

(i) details of the proposed infrastructure; and

(ii) an assessment of the impact of constructing the infrastructure on—

(A) the supply of water managed under existing resource operations licences;

(B) the operating arrangements under existing resource operations licences;

(C) existing water licences to take water;

(D) other existing authorisations, other than water permits, that may be affected by the proposed infrastructure;

(iii) the applicant’s proposal for minimising the impact assessed and mentioned in subparagraph (ii);

(iv) proposed operating arrangements for the infrastructure;

(v) written evidence that the applicant has been granted approval by the Coordinator General for the infrastructure; and

(vi) any other information the applicant considers will enable the chief executive to decide the application;

(c) be accompanied by the prescribed fee.

(4) The chief executive may give a copy of the application to any entity the chief executive considers appropriate.

57 Additional information may be required (1) The chief executive may, by notice, require—

(a) the applicant to give additional information about the application; or


(2) An applicant must provide information where requested within the time requested otherwise the application lapses.

58 Matters the chief executive must consider (1) In deciding the application, the chief executive must consider—

(a) the application and any additional information given about the application;

(b) any conditions which are appropriate for the application if it were to be approved and granted; and

(c) the public interest.

(2) Subsection 1 does not limit the matters the chief executive may consider.

59 Deciding an application for a resource operations licence (1) Where satisfied the application should be approved, the chief executive must approve

the application either—

(a) wholly; or

(b) in part.

(2) In approving the application under subsection 1, the chief executive may specify conditions.

Part 6 Amending a resource operations licence

60 Application of Part 6 This part states a process under section 111A of the Water Act 2000 for amending a resource operations licence.

Division 1 Amendment by the chief executive

61 Amending a resource operations licence by the chief executive (1) The chief executive may, at any time amend—

(a) a resource operations licence granted under section 59 of this plan to the extent the chief executive considers necessary to meet future water requirements; or

(b) any other resource operations licence to the extent the chief executive considers necessary as a consequence of amending a resource operations licence granted under section 59 of this plan.

(2) Before the chief executive acts under subsection 1, the chief executive must give the resource operations licence holder notice of the proposed amendment.

(3) The notice must—

(a) state the following—

(i) a summary of the proposed amendment;

(ii) the reasons for the proposed amendment;

(iii) that written submissions may be made by the resource operations licence holder about the proposed amendment;

(iv) the day by which, the person to whom, and the place where the submissions must be made; and

(b) include a copy of the proposed amendment.

(4) The day stated under subsection 3(a)(iv) must be at least 30 business days after the notice is given.

62 Matters the chief executive must consider (1) Prior to deciding whether to amend a resource operations licence, the chief executive

must consider—

(a) any submissions made by the resource operations licence holder about the proposed amendment;

(b) the public interest; and

(c) the original application under section 56 of this plan for the resource operations licence and any additional information given about the application.


63 Deciding whether to amend a resource operations licence After considering the matters mentioned in section 62 of this plan and any other matters the chief executive considers appropriate, the chief executive may amend the resource operations licence to the extent the chief executive considers necessary.

Division 2 Amendment on application by the holder

64 Amending a resource operations licence on application by the resource operations licence holder (1) The holder of a resource operations licence first granted under section 108 of the Water

Act 2000 may apply to the chief executive to amend the resource operations licence under section 111A of the Water Act 2000.


(a) be in the approved form;

(b) include a summary of the amendment required and the reasons for the amendment; and

(c) be accompanied by the prescribed fee.

(3) The chief executive may give a copy of the application to any entity the chief executive considers appropriate.

(4) This section does not apply where the chief executive is satisfied that the infrastructure is substantially complete and the infrastructure may be regarded as operational.

(5) Where subsection 4 applies the chief executive must amend this plan in accordance with section 188 of this plan.

65 Additional information may be required (1) The chief executive may by notice, require—

(a) the applicant to give additional information about the application; or


(2) An applicant must provide information where requested within the time requested otherwise the application lapses.

66 Matters the chief executive must consider (1) In deciding the application, the chief executive must consider—




67 Deciding an application to amend a resource operations licence (1) Where satisfied the application should be approved, the chief executive must approve

the application either—

(a) wholly; or

(b) in part.

(2) In approving the application under subsection 1, the chief executive may specify conditions.

Chapter 4 Dealing with water licence applications

73 Scope of Chapter 4 This chapter sets out a process for dealing with applications for water licences to take or interfere with water from a watercourse, lake or spring.

74 Dealing with applications (1) The chief executive must not make a decision that—

(a) would increase the average volume of water allowed to be taken under authorisations in the plan area as per section 19 of the Water Resource (Logan Basin) Plan 2007;

(b) results in the inability to meet any of the outcomes in Part 3 of the Water Resource (Logan Basin) Plan 2007; or

(c) results in the inability to meet any of the objectives in Part 4 of the Water Resource (Logan Basin) Plan 2007.

(2) The chief executive must deal with the application in accordance with Chapter 2, Part 6, Division 2, Subdivisions 1 and 2 of the Water Act 2000 if the chief executive is satisfied that the granting of the application would not have any of the effects mentioned in subsection 1.

(3) The chief executive must refuse the application if the chief executive is satisfied that the granting of the application would have any of the effects mentioned in subsection 1.

Chapter 5 Logan River Water Supply Scheme

80 Scope of Chapter 5 This chapter applies to—

(a) the resource operations licence holder for the Logan River Water Supply Scheme; and

(b) all water allocations associated with the Logan River Water Supply Scheme.

Part 1 Operating and environmental management rules

81 Use of watercourses for distribution The resource operations licence holder must only use the following watercourses for the distribution of water—

(a) Burnett Creek from and including the impounded area of Maroon Dam downstream to the confluence of the creek with the Logan River (approximately AMTD 27 km to AMTD 0 km);

(b) Logan River from the confluence with Burnett Creek downstream to the end of the supplemented section at Maclean Bridge (approximately AMTD 165.4 km to AMTD 65 km); and

(c) sections of tributaries of the Logan River and Burnett Creek, which contain water from the impounded area of infrastructure in this water supply scheme as detailed in Attachment 2(e), or water from natural waterholes located in the reaches described in (a) and (b) above.

82 Waterhole or lake management The water level in any waterhole or lake must not be drawn down for the purpose of supplying water for a water allocation, except where a water allocation has a condition that allows drawdown of the waterhole or lake.

83 Operating levels for infrastructure (1) The minimum operating levels, nominal operating levels and full supply levels for

infrastructure in the Logan River Water Supply Scheme are specified in Attachment 5 Table 6.

(2) The resource operations licence holder must not release or supply water from any infrastructure when the water level in that infrastructure is at or below its minimum operating level.

(3) The resource operations licence holder must not release water from any infrastructure unless the release is necessary to—

(a) meet daily releases mentioned in section 85;

(b) supply downstream demand; or

(c) maintain the downstream infrastructure at its nominal operating level.

(4) Despite subsection 3, if the water level in Maroon Dam is greater than 207.14 m AHD, releases must be made to return the water level to 207.14 m AHD.

84 Rate of release from infrastructure The resource operations licence holder must minimise the occurrence of adverse environmental impacts by ensuring that any change in the rate of release of water from Maroon Dam occurs incrementally.

85 Releases from infrastructure (1) The resource operations licence holder must make daily releases—

(a) from Maroon Dam—

(i) equal to the volume of inflow, when inflow to Maroon Dam is less than or equal to 4 ML/day; or

(ii) 4 ML/day when inflow to Maroon Dam is greater than 4 ML/day.

(b) from Bromelton Weir—

(i) equal to the volume of inflow, when inflow to Bromelton Weir is less than or equal to 5 ML/day; or

(ii) 5 ML/day when inflow to Bromelton Weir is greater than 5 ML/day.

(c) from Cedar Grove Weir—

(i) equal to the volume of inflow, when inflow to Cedar Grove Weir is less than or equal to 5 ML/day; or

(ii) 5 ML/day when inflow to Cedar Grove Weir is greater than 5 ML/day.

(2) The volume of water released in accordance with subsection 1 may be included as water released to supply downstream demand.

(3) The resource operations licence holder must develop and submit to the chief executive for approval within 40 business days of the commencement of this plan, storage inflow derivation techniques for infrastructure mentioned in subsection 1.

(4) When making releases, the resource operations licence holder must preferentially use—

(a) from Bromelton Weir—

(i) the fish way; then

(ii) the outlet valve.

(b) from Cedar Grove Weir—

(i) the fish lock; then


(c) from South Maclean Weir—

(i) the fish way; then


86 Operation of Bromelton Off-stream Storage (1) The resource operations licence holder must only divert water from the Logan River to

Bromelton Off-stream Storage when the following conditions are satisfied—

(a) Bromelton Off-stream Storage is less than full supply level;

(b) flows over Bromelton Weir, measured at the gauging station located downstream of Bromelton Weir, are greater than 150 ML/day; and

(c) flows over Cedar Grove Weir, measured at the gauging station located at Cedar Grove Weir, are greater than 150 ML/day.

(2) The resource operations licence holder must cease diverting water from the Logan River to Bromelton Off-stream Storage when flows past the pump station on the Logan River are less than 150 ML/day.

(3) The maximum rate at which the resource operations licence holder may divert water using the pump station on the Logan River is 249.8 ML/day.

(4) The maximum rate at which the resource operations licence holder may release water from Bromelton Off-stream Storage into the Logan River is 115 ML/day.

87 Supply of water In supplying water, the resource operations licence holder will manage releases in order to minimise water losses.

Part 2 Water sharing rules

Division 1 Announced allocations

88 Announced allocations The resource operations licence holder must—

(a) determine an announced allocation for each priority group for use in defining the share of water available to be taken under water allocations in that priority group;

(b) use the water sharing rules specified in this part, to calculate announced allocations throughout the water year;

(c) calculate and set the announced allocation for each priority group to take effect on the first day of each water year;

(d) following the commencement of a water year—

(i) recalculate the announced allocation to take effect no later than five business days following the first day of the month;

(ii) reset the announced allocation if a recalculation indicates that the calculated announced allocation would—

(A) increase by five or more percentage points; or

(B) increase to 100 percent; and

(e) within five business days of setting an announced allocation under subsection 1(c) or the first calendar day of every month when resetting the announced allocation under subsection 1(d)—

(i) publish details of the announced allocation; and

(ii) publish details of the announced allocation, including parameters for determining the announced allocation, on the resource operations licence holder’s internet site for the Logan River Water Supply Scheme.

(f) not reduce the announced allocation during a water year;

(g) round the announced allocation to the nearest percent; and

(h) ensure the announced allocation is not less than zero or greater than 100 percent.

89 Announced allocation for high priority water allocations (1) The announced allocation for high priority water allocations must be as follows—

(a) 100 percent where the announced allocation for medium priority group water allocation is greater than zero percent;

(b) when the announced allocation for medium priority group water allocations is zero percent, the announced allocation percentage for high priority water allocations must be calculated using the following formula—

91 Taking water under a water allocation (1) The total volume of water taken under a water allocation in a water year must not

exceed the nominal volume for the water allocation.

(2) The total volume of water that may be taken under a water allocation in a water year, other than during stream flow periods, must not exceed the nominal volume of the water allocation multiplied by the announced allocation and divided by 100.

(3) During a stream flow period for the zone to which a water allocation applies, water may be taken under the water allocation in addition to that which may be taken under subsection 2.

92 Stream flow period access conditions (1) A stream flow period for a zone is a period of time that starts and ends at such time that

the resource operations licence holder notifies under subsection 2.

(2) The resource operations licence holder for the scheme must notify the water allocation holders for the zone of the start and end of a stream flow period.

(3) The resource operations licence holder may start a stream flow period whenever the following requirements for the zone are being met—

(a) the announced allocation for the medium priority group is less than 100 percent; and

(b) Cedar Grove Weir is equal to or greater than 20.5 m AHD, or will be equal to or greater than EL 20.5 m AHD during the stream flow period; and

(c) South Maclean Weir is equal to or greater than EL 10.50 m AHD, or will be equal to or greater than EL 10.5 m AHD during the stream flow period; and

(d) for zone BUCSB—

(i) Bromelton Weir is equal to or greater than EL 40.70 m AHD, or will be equal to or greater than EL 40.7 m AHD during the stream flow period; and

(ii) the flow rate in Burnett Creek downstream of Maroon Dam is greater than any release made in accordance with section 85(1)(a), plus any supplemented water releases from Maroon Dam;

(e) for zone LORSA—

(i) Bromelton Weir is equal to or greater than 40.70 m AHD, or will be equal to or greater than EL 40.7 m AHD during the stream flow period; and

(ii) the flow rate at Forest Home gauging station (145003B) on Logan River is greater than 15 ML per day.

(f) for zone LORSB—


(ii) the flow rate at either Rathdowney gauging station (145020A) on Logan River or Deickman’s Bridge gauging station (145010A) on Running Creek is greater than 15 ML per day;

(g) for zones LORSC, LORSD and LORSE—


(ii) the flow rate at Round Mountain gauging station (145008A) on Logan River is greater than 15 ML per day;

(h) for zones LORSF and LORSG—

(i) the flow rate is greater than 15 ML per day at Teviot Brook overflow gauging station (145012A); or

(ii) the flow rate is greater than 15 ML per day at Bromelton Weir tailwater gauging station (145025A), when Bromelton Weir is equal to or greater than 40.70 m AHD or will be equal to or greater than EL 40.7 m AHD during the stream flow period.

(4) The resource operations licence holder must notify the water allocation holders for a zone of the end a steam flow period whenever any of the requirements in subsection 3 for the zone are no longer being met.

Division 2 Critical water sharing arrangements

93 Critical water sharing arrangements During times when critical water sharing arrangements are in force the resource operations licence holder for the Logan River Water Supply Scheme must calculate the announced allocation for high priority water allocations in accordance with section 89(1)(b) of this plan.

Part 3 Dealing with water allocations

94 Application of Part 3 This part provides for dealings with water allocations managed or distributed by a scheme licence holder for the Logan River Water Supply Scheme.

Division 1 Subdivision or amalgamation of water allocations

95 Permitted subdivisions or amalgamations (1) Subdivision of a water allocation is permitted where—

(a) the sum of the nominal volumes of the new water allocations is equal to the nominal volume of the water allocation that is being subdivided; and

(b) the location, priority group and any flow conditions of the new water allocations is the same as that of the water allocation that is being subdivided.

(2) Amalgamation of water allocations is permitted where—

(a) the nominal volume of the new water allocation is equal to the sum of the nominal volumes of the water allocations that are being amalgamated; and

(b) the locations, priority group and any flow conditions of water allocations that are being amalgamated are the same.

96 Prohibited subdivisions or amalgamations (1) Subdivision of a water allocation is prohibited where—

(a) the sum of the nominal volumes of the new water allocations is not equal to the nominal volume of the water allocation that is being subdivided;

(b) the location and priority group and any flow conditions of the new water allocations are not the same as that of the water allocation that is being subdivided.

(2) Amalgamation of water allocations is prohibited where—

(a) the nominal volume of the new water allocation is not equal to the sum of the nominal volumes of the original water allocations that are being amalgamated;

(b) the location and priority group and any flow conditions of water allocations that are being amalgamated are not the same.

Division 2 Water allocation change rules

Subdivision 1 Permitted changes

97 Location (1) A change to the location for the taking of water under a water allocation is permitted

provided the change would not result in a total nominal volume in a zone that—

(a) exceeds the maximum total nominal volume for a zone for a priority group; or

(b) is less than the minimum total nominal volume for a zone for a priority group.

(2) For this section, the maximum and minimum total nominal volumes for the priority groups for each zone are identified in Attachment 5 Table 12.

(3) For this section, the total nominal volume in a zone is the total nominal volume of all water allocations of the same priority group—

(a) for the zone; and

(b) for which relevant valid change certificates have been issued under section 129 of the Water Act 2000.

Subdivision 2 Prohibited changes

98 Prohibited changes (1) The following changes are prohibited—

(a) a change to the location of a water allocation if the change would result in a total nominal volume in a zone that—

(i) exceeds the maximum total nominal volume in Attachment 5 Table 12 for the zone for a priority group; or

(ii) is less than the minimum total nominal volume in Attachment 5 Table 12 for the zone for a priority group; or

(iii) is to a location that is not a zone listed in Attachment 5 Table 12.

(b) a change that would result in the nominal volume of the new water allocation not being expressed as a whole number, unless an existing water allocation to be changed specifies a nominal volume that is not a whole number.

(c) a change to a priority group that is not specified in the Water Resource (Logan Basin) Plan 2007.

(2) For this section, the total nominal volume in a zone is the total nominal volume of all water allocations of the same priority group for the zone.

Subdivision 3 Other changes

99 Application for changes not specified as permitted or prohibited An application for a change to a water allocation that is not specified as permitted or prohibited may be made in accordance with section 130 of the Water Act 2000.

Part 4 Seasonal water assignment rules

100 Maximum water use For this part—

(a) the maximum volume of water that may be taken in a zone in a water year for the Logan River Water Supply Scheme is the maximum allowable water use volume indicated in Attachment 5 Table 13 for each zone; and

(b) total water use in a zone is the total volume of water used under water allocations for all priority groups managed and distributed by the resource operations licence holder for the zone.

101 Seasonal water assignment rules (1) The resource operations licence holder may approve a seasonal assignment of a volume

of water provided that the total volume of water use in a water year for each zone does not exceed the maximum allowable water use volume in Attachment 5 Table 13 for each zone.

(2) The resource operations licence holder is responsible for dealing with applications for seasonal water assignment where the resource operations licence holder distributes to the assignee.

Chapter 6 Rules for unsupplemented water allocations

Part 1 Water sharing rules

107 Application of Part 1 This part provides the water sharing rules for unsupplemented water allocations located in the Burnett Creek and Logan River water management areas.

108 Announced period (1) Water may only be taken under a water allocation during an announced period.

(2) The chief executive must develop procedures for determining the start and finish of an announced period during which the stream flow exceeds the flow conditions specified for the water allocation.

(3) The chief executive must notify holders of water allocations of—

(a) the start and end of an announced period; or

(b) the conditions under which an announced period starts and ends.

(4) Details of flow conditions for water allocations taking unsupplemented water are described in Attachment 7 Table 3.

Part 2 Data collection and transfer rules

109 Application of Part 2 This part provides the data collection and transfer rules for unsupplemented water allocations located in the Burnett Creek and Logan River water management area.

110 Water allocation holder data collection and transfer (1) For water taken during an announced period, the water allocation holder and any

assignee must record meter readings—

(a) at the start of taking water; and

(b) at the end of taking water.

(2) The water allocation holder and any assignee must transfer the data recorded under subsection 1 to the chief executive in the approved form within one business day following the end of taking water.

Part 3 Dealing with water allocations

111 Application of Part 3 This part states the rules for dealing with unsupplemented water allocations located in the Burnett Creek and Logan River water management areas.

Division 1 Subdivision or amalgamation of water allocations

112 Permitted subdivisions or amalgamations (1) Subdivision of a water allocation into two or more water allocations is permitted

where—

(a) the new water allocations have the same flow conditions and location; and

(b) the nominal volume, annual volumetric limit, any daily or monthly volumetric limit, and maximum rate of each of the new water allocations is in the same proportion as the nominal volume, annual volumetric limit, any daily or monthly volumetric limit, and maximum rate of the water allocation that is being subdivided; and

(c) the combined sum of the nominal volumes, annual volumetric limits, any daily or monthly volumetric limits, and maximum rates of take of the new water allocations is equal to the nominal volume, annual volumetric limit, any daily or monthly volumetric limit, and maximum rate of the water allocation that is being subdivided.

(2) Two or more water allocations may be amalgamated into a single water allocation where—

(a) the water allocations have the same flow conditions and location; and

(b) the nominal volume, annual volumetric limit, any daily or monthly volumetric limit, and maximum rate of the new water allocation are equal to the sum of the nominal volumes, annual volumetric limits, any daily or monthly volumetric limits, and maximum rates of the water allocations that are being amalgamated.

113 Prohibited subdivisions or amalgamations (1) The subdivision of a water allocation into two or more water allocations is prohibited

where—

(a) the new water allocations do not have the same flow conditions and location; or

(b) the combined sum of the nominal volumes, annual volumetric limits, any daily or monthly volumetric limits, and maximum rates of the proposed water allocations are not equal to the nominal volume, annual volumetric limit, any daily or monthly volumetric limit, and maximum rate of the water allocation being subdivided.

(2) The amalgamation of two or more water allocations into a single water allocation is prohibited where—

(a) the existing water allocations being amalgamated do not have the same flow conditions and location; or

(b) the nominal volume, annual volumetric limit, any daily or monthly volumetric limit, and maximum rate of the proposed water allocation is not equal to the sum of the nominal volumes, annual volumetric limits, any daily or monthly volumetric limits, and maximum rates of the existing water allocations that are being amalgamated.

114 Application of Division 2 This division provides the change rules for unsupplemented water allocations located in the Burnett Creek and Logan River water management areas.

115 Prohibited changes The following changes are prohibited where—

(c) a change that would result in the nominal volume not being expressed as a whole number, unless an existing water allocation to be changed specifies a nominal volume that is not a whole number.

116 Application for changes not specified as permitted or prohibited An application for a change to a water allocation that is not specified as permitted or prohibited may be applied for in accordance with section 130 of the Water Act 2000.

117 Application of Part 4 This part provides the seasonal assignment rules for unsupplemented water allocations located in the Burnett Creek and Logan River water management areas.

118 Seasonal water assignment rules The chief executive may approve a seasonal assignment of an unsupplemented water allocation—

(a) where the location of the seasonally assigned volume is not changed;

(b) where the flow conditions under which water may be taken under seasonal assignment is the same as the flow condition for the water allocation that is being seasonally assigned;

(c) if the volume of the seasonal assignment is—

(i) less than the annual volumetric limit of the water allocation – where the maximum rate and any daily or monthly volumetric limit for the seasonal water assignment is in proportion to the volume of water that is being seasonally assigned; or

(ii) equal to the annual volumetric limit of the water allocation – where the maximum rate and any daily or monthly volumetric limit for the seasonal water assignment is the maximum rate and any daily or monthly volumetric limit for the water allocation that is being seasonally assigned.

Chapter 7 Monitoring and reporting requirements

124 Water monitoring (1) The chief executive must measure or collect and keep publicly available, records of—

(a) water quantity;

(b) water taken;

(c) groundwater levels;

(d) prices for water permanently traded;

(e) the number of permanent trades and seasonal assignments; and

(f) nominal volume of water permanently traded and seasonally assigned.

(2) The chief executive may use information collected to support water resource assessment and reporting.

125 Natural ecosystem monitoring The chief executive must collect and keep publicly available information on—

(a) ecological assets that are linked to the ecological outcomes of the Water Resource (Logan Basin) Plan 2007; and

(b) the critical water requirements of ecological assets, including the provision of these requirements under the Water Resource (Logan Basin) Plan 2007.

126 Assessment The chief executive must make ongoing assessments of whether the trends in the data measured, collected and recorded under section 124 and section 125 of this plan indicate that outcomes specified in Water Resource (Logan Basin) Plan 2007 are being achieved.

Chapter 8 Resource operations licence holder monitoring and reporting

132 Scope of Chapter 8 This chapter specifies the monitoring and reporting requirements that apply to the resource operations licence holder for the Logan River Water Supply Scheme.

133 Monitoring data must be made available The resource operations licence holder must provide any monitoring data required under this chapter to the chief executive upon request and within the time requested.

Part 1 Resource operations licence holder monitoring

Division 1 Water quantity

134 Stream flow and infrastructure water level data The resource operations licence holder must record infrastructure water level and daily flow data in accordance with Attachment 5 Table 14.

135 Releases from infrastructure (1) This section applies to the following infrastructure—

(a) Maroon Dam;

(b) Bromelton Weir;

(c) Bromelton Off-stream Storage;

(d) Cedar Grove Weir; and

(e) South Maclean Weir.

(2) The resource operations licence holder must measure and record for each release of water from infrastructure—

(a) the daily volume released and component volumes for each release;

(b) the release rate and for each change in release rate—

(i) the date and time of the change; and

(ii) the new release rate.

(c) the reason for each release; and

(d) the device used for release.

136 Announced allocations The resource operations licence holder must record details of announced allocation determinations including—

(a) the announced allocations for medium and high priority water allocations;

(b) the date announced allocations are determined; and

(c) the value of each parameter applied for calculating the announced allocation.

137 Water taken by water users The resource operations licence holder must record the total volume of water taken, by each water user for each zone as follows—

(a) the total volume of water taken each quarter;

(b) the total volume of water entitled to be taken at any time; and

(c) the basis for determining the total volume of water entitled to be taken at any time.

138 Water diversions (1) The resource operations licence holder must measure and record the daily total volumes

of water delivered to—

(a) Bromelton Off-stream Storage from the pumping station located on the Logan River; and

(b) Logan River from the Bromelton Off-stream Storage.

(2) The methodology for determining the daily total volumes for subsection 1 must be approved by the chief executive.

139 Seasonal water assignment of water allocations The resource operations licence holder that approves a seasonal water assignment must record details of seasonal water assignment arrangements including—

(a) the name of the assignee, volume and location of water that has been seasonally assigned by an assignor;

(b) the name of the assignor, volume and location of water that has been seasonally assigned to an assignee; and

(c) effective date of seasonal water assignments.

140 Critical water sharing arrangements The resource operations licence holder must record—

(a) the effective period of critical water sharing arrangements; and

(b) the reason for introducing critical water sharing arrangements.

Division 2 Impact of infrastructure operation on natural ecosystems

141 Water quality The resource operations licence holder must monitor water quality in relation to relevant infrastructure listed in Attachment 5.

142 Bank condition (1) The resource operations licence holder must inspect banks for evidence of collapse or

erosion within the impounded areas associated with infrastructure listed in Attachment 5 and downstream of that infrastructure following instances of—

(a) rapid water level changes;

(b) large flows through infrastructure; or

(c) other occasions when collapse or erosion of banks may be likely.

(2) For subsection 1, the distance downstream is the distance of influence of infrastructure operations.

143 Fish stranding The resource operations licence holder must record and assess instances of fish stranding in watercourses and impounded areas associated with the operation of infrastructure listed in Attachment 5.

Part 2 Data transfer

144 Monitoring data must be made available The resource operations licence holder must transfer any monitoring data required under this part to the chief executive, in an electronic format as specified by the chief executive, within the time requested.

145 Daily data transfer For infrastructure mentioned in section 135(1) the resource operations licence holder must transfer the following data to the chief executive as soon as possible at the commencement of each day—

(a) stream flow and infrastructure water levels;

(b) the daily volume released and component volumes for each release;

(c) the release rate; and

(d) the device used for release.

Part 3 Resource operations licence holder reporting

146 Reporting requirements The resource operations licence holder must provide—

(a) quarterly reports;

(b) annual reports for the previous water year;

(c) operational reports; and

(d) emergency reports.

Division 1 Quarterly reporting

147 Quarterly report (1) The resource operations licence holder must submit a quarterly report to the chief

executive within 30 days after the end of each quarter, of every water year.

(2) The report should contain the following data—

(a) stream flow and infrastructure water levels – all records referred to in section 134 of this plan;

(b) the total volume of water for each quarter—

(i) taken for each zone; and

(ii) entitled to be taken for each zone;

(c) water quality – all records referred to in section 141 of this plan;

(d) a summary of bank condition monitoring and incidences of slumping carried out in accordance with section 142 of this plan; and

(e) the details and status of any programs implemented under section 14 of this plan.

Division 2 Annual reporting

148 Annual report (1) The resource operations licence holder must submit an annual report to the chief

executive within three months after the end of each water year.

(2) The annual report must include—

(a) water quantity monitoring results as required under sections 134 to 139 of this plan;

(b) details of the impact of infrastructure operation on water quality as required under section 141 of this plan;

(c) a discussion paper on any issues that arose as a result of the implementation and application of the rules and requirements in this plan.

149 Water quantity monitoring—annual report The resource operations licence holder must include in the annual report—

(a) a summary of announced allocation determinations including—

(i) an evaluation of the announced allocation procedures and outcomes; and

(ii) the date and value for the initial announced allocation and for each change made to an announced allocation;

(b) instances where critical water sharing arrangements have been implemented including—

(i) an evaluation of the effectiveness of the arrangements and outcomes; and

(ii) the commencement date(s) and time period(s) for each stage of the arrangements and outcomes;

(c) the total annual volume of water taken by all water user, specified by zone, namely—

(i) the total annual volume of supplemented water taken;

(ii) the total annual volume of supplemented water entitled to be taken; and

(iii) the basis for determining the volume entitled to be taken;

(d) details of seasonal water assignments, namely—

(i) the total number of seasonal water assignment arrangements; and

(ii) the total volume of water seasonally assigned;

(e) all details of changes to infrastructure or the operation of infrastructure that may impact on compliance with the rules in this plan; and

(f) details of any new monitoring devices used such as equipment to measure stream flow; and

(g) a discussion on any other issues that arose as a result of the implementation and application of the rules in this plan.

150 Impact of infrastructure operation on water quality—annual report The resource operations licence holder must include in the annual report—

(a) a summary of environmental considerations made by the resource operations licence holder in making operational and release decisions; and

(b) a summary of the environmental outcomes of the decision including any adverse environmental impacts.

(c) a summary of bank condition and fish stranding monitoring and assessment, including—

(i) results of investigations of bank slumping or erosion identified in impounded areas or downstream of infrastructure;

(ii) results of investigations of fish stranding downstream of infrastructure; and

(iii) changes of operation of infrastructure to reduce instances of bank slumping, erosion or fish stranding.

(d) a discussion and assessment of the following water quality issues—

(i) thermal and chemical stratification in each water storage associated with infrastructure;

(ii) contribution of the stored water and its management to the quality of water released;

(iii) cumulative effect of successive water storages associated with infrastructure on water quality;

(iv) cyanobacterial population changes in response to water stratification in each infrastructure storage;

(v) any changes to the monitoring program as a result of evaluation of the data.

Division 3 Operational reporting

151 Operational report The resource operations licence holder must—

(a) notify the chief executive within one business day of becoming aware of any of the following operational incidents—

(i) a non-compliance by the resource operations licence holder with the rules in this plan; and

(ii) instances of fish stranding or bank slumping within the impounded areas or downstream of infrastructure listed in Attachment 5 or watercourses associated with the operation of the Logan River Water Supply Scheme;

(b) provide to the chief executive within five business days of the occurrence of any of the operational incidents, a report which includes details of—

(i) the incident;

(ii) conditions under which the incident occurred; and

(iii) any responses or activities carried out as a result of the incident;

(c) notify the chief executive upon commencement and cessation of—

(i) critical water sharing arrangements; and

(ii) any stream flow period;

(d) notify the chief executive on approval of any seasonal water assignment and transfer information including—

(i) the name and location of the assignees and assignors; and

(ii) the zone or zones where water is being seasonally assigned to and from.

(e) notify the chief executive upon making a decision relating to an initial announced allocation and/or its recalculation;

(f) transfer to the chief executive—

(i) details of any arrangements for addressing circumstances where the resource operations licence holder is unable to supply water allocations under subsection (e); and

(ii) relevant supporting information used in making a decision under subsection (e).

Division 4 Emergency reporting

152 Emergency report8 In an emergency where the resource operations licence holder cannot comply with a rule in this plan of the as a result of the emergency, the resource operations licence holder must—

(a) notify the chief executive; and

(b) provide to the chief executive within five business days upon discovery of the emergency, a report that includes—

(i) details of the emergency;

(ii) conditions under which the emergency occurred;

(iii) any responses or activities carried out as a result of the emergency; and

(iv) any rules and requirements specified in this plan that the resource operations licence holder is either permanently or temporarily unable to comply with due to the emergency.

Chapter 9 Operating rules, monitoring and reporting requirements for particular water licences

Part 1 Preliminary

158 Scope of Chapter 9 This chapter sets out the operating, monitoring and reporting requirements that apply to the holder of water licences to interfere with water for the following water supply infrastructure—

(a) Luscombe Weir; and

(b) Leslie Harrison Dam.

159 Monitoring data must be made available The water licence holder must provide any monitoring data required under this chapter to the chief executive upon request and within the time requested.

Part 2 Operating rules

160 Operating levels of infrastructure (1) The minimum operating levels and full supply levels for the infrastructure mentioned in

section 158 are specified in Attachment 8 Table 1.

(2) The water licence holder must not release or supply water from any infrastructure when the water level in that infrastructure is at or below its minimum operating level.

161 Rate of release from infrastructure The water licence holder for Leslie Harrison Dam must minimise the occurrence of adverse environmental impacts (e.g. fish stranding and bank slumping, etc.) by ensuring that any change in the rate of release of water occurs incrementally.

Part 3 Water licence holder monitoring

Division 1 Water quantity

162 Infrastructure water level The water licence holder must record infrastructure water level data in accordance with Attachment 8 Table 2.

163 Releases from Leslie Harrison Dam (1) The water licence holder for Leslie Harrison Dam must measure and record for each

release of water—

(a) the daily volume released;

(b) the release rate and for each change in release rate—

(i) the date and time of the change; and

(ii) the new release rate.

(2) The water licence holder for Leslie Harrison Dam must record for each infrastructure outlet—

(a) the reason for each release; and

(b) the inlet level used and reason for deciding to release from that particular inlet level.

164 Water taken by water users The water licence holder must measure and record the total daily volume of water taken from—

(a) Leslie Harrison Dam off-take works; and

(b) Luscombe Weir off-take works.

Division 2 Impact of infrastructure operation on natural ecosystems

165 Water quality The water licence holder must monitor water quality in relation to relevant infrastructure mention in section 158 in accordance with the requirements of the department’s Water Monitoring Data Collection Standards.9

Part 4 Water licence holder reporting

166 Reporting requirements The water licence holder must provide—

(a) quarterly reports;

(b) annual reports for the previous water year;

(c) operational reports; and

(d) emergency reports.

167 Quarterly report (1) The water licence holders must submit a quarterly report to the chief executive within

30 days after the end of each quarter, of every year.

(2) The report should contain the following data—

(a) infrastructure water levels – all records referred to in section 160 of this plan;

(b) releases from Leslie Harrison Dam – all records referred to in section 163 of this plan;

(c) the total volume of water taken – all records referred to in section 164 of this plan; and

(d) water quality – all records referred to in section 165 of this plan.

Division 2 Annual reporting

168 Annual report (1) The water licence holder must submit an annual report to the chief executive within

three months after the end of each water year.

(2) The annual report must include—

(a) water quantity monitoring results as required under sections 160, 163 and 164 of this plan;

(b) details of the impact of infrastructure operation on water quality as required under section 165 of this plan;

(c) a discussion paper on any issues that arose as a result of the implementation and application of the rules and requirements of this plan.

169 Water quantity monitoring—annual report The water licence holder must include in the annual report—

(a) the total annual volume of water taken;

(b) all details of changes to infrastructure or the operation of infrastructure that may impact on compliance with rules in this plan;

(c) details of any new monitoring devices used such as equipment to measure infrastructure water levels; and

(d) a discussion on any other issues that arose as a result of the implementation and application of the rules in this plan.

170 Impact of infrastructure operation on water quality—annual report The water licence holder for must include in the annual report—

(a) a summary of environmental considerations made by the water licence holder in making operational and release decisions; and

(b) a summary of the environmental outcomes of the decision including any adverse environmental impacts.

(c) a discussion and assessment of the following water quality issues—

(i) thermal and chemical stratification in each water storage associated with infrastructure;

(ii) contribution of the storage and its management to the quality of water released;

171 Operational report The water licence holder must—

(a) notify the chief executive within one business day of becoming aware of a non-compliance by the water licence holder with the rules in this plan; and

(b) provide to the chief executive within five business days of the occurrence of any of the operational incidents, a report which includes details of—

(i) the incident;

Division 4 Emergency reporting

172 Emergency report10 In an emergency where the water licence holder cannot comply with a rule in this plan of the as a result of the emergency, the water licence holder must—

(a) notify the chief executive upon discovery of the emergency; and

(b) provide to the chief executive within five business days upon discovery of the emergency, a report that includes—

(i) details of the emergency;

(ii) conditions under which the emergency occurred;

(iii) any responses or activities carried out as a result of the emergency; and

(iv) any rules or requirements specified in this plan that the water licence holder is either permanently or temporarily unable to comply with due to the emergency.

(c) a reduction or removal of state, resource operations licence holder or water licence holder monitoring requirements, if the chief executive is satisfied that no further information or benefit is to be gained from the continuation of the monitoring requirements.

183 Amendment to infrastructure details An amendment may be made to the infrastructure details in Attachment 5 of this plan, provided the amendment is—

(a) an amendment to facilitate the installation of a fish transfer system on any infrastructure; or

(b) an amendment to facilitate the installation of infrastructure of, or modification to, inlet works on any infrastructure.

184 Amendment to critical water sharing arrangements An amendment may be made to this plan to add or amend critical water sharing arrangements.

185 Amendment to gauge station specification An amendment may be made to this plan to amend the specification of gauge stations.

186 Other amendments to this plan (1) An amendment may be made to this plan if the chief executive is satisfied that the

proposed amendment would not cause any significant detrimental impact on—

(a) existing water entitlement holders; or

(b) the availability of water for—

(i) ecological assets; or

(ii) natural ecosystems.

(2) The amendments under subsection 1 may include, but are not limited to, the following—

(a) an amendment to the process for granting or amending a resource operations licence contained in Chapter 3 of this plan;

(d) an amendment to provide for granting unallocated water from the strategic reserve in accordance with section 27 of the Water Resource (Logan Basin) Plan 2007.

Attachment 1 Glossary

TERM DEFINITION

AHD The Australian Height Datum, which references a level or height to a standard base level.

Announced

allocation

For a water allocation managed under a resource operations licence means a number, expressed as a percentage, which is used to determine the maximum volume of water that may be taken in a water year under the authority of a water allocation.

Announced period The period of time, as determined and announced by the chief executive, when water may be taken in a water year under the authority of a water allocation.

Assignee The person or entity to whom an interest or right to water is being transferred (e.g. seasonally assigned).

Assignor The person or entity that transfers an interest or right in water to an assignee (e.g. a seasonal assignment).

Cease to flow level For a waterhole, the level at which water stops flowing from a waterhole over its downstream control.

Component volumes

The volume of water associated with a particular release. For example, a component volume may be released via a fish way or valve.

Critical water sharing arrangements

For the purposes of this plan critical water sharing arrangements has the same meaning as ‘critical water supply strategy’ in the Water Resource (Logan Basin) Plan 2007.

Device used for release

The device used to release water from infrastructure. Devices include, but are not limited to, outlet valves, fish locks, or fish ways.

EL Means elevation.

Existing water authorisations

A water licence, interim water allocation or other authority to take water that has effect immediately prior to the commencement of this plan.

Fish stranding

Fish stranding means when fish are stranded or left out of water on the bed or banks of a watercourse, on infrastructure such as spillways and causeways, or left isolated in small or shallow pools, from which they cannot return to deeper water. Fish stranding also applies to other aquatic species.

Headwater The watercourse immediately upstream of a dam, weir, or other hydraulic structure.

Impounded area Area of inundation at full supply level of a dam or weir.

Infrastructure A dam, weir or other water storage and any associated works for taking or interfering with water in a watercourse, lake or spring.

Inlet Infrastructure comprised of an entrance channel, intake structure, and gate or valve which allow for water to be taken from the impounded area of a storage, dam or weir.

Location

For a water allocation, means the zone and/or place from which water under the water allocation can be taken.

For a water licence, means the section of the watercourse, lake or spring abutting or contained by the land described on the water licence at which water may be taken.

Megalitre (ML) One million litres.

Minimum operating level

The level or elevation of water within the impounded area of a storage, dam, or weir below which water cannot be released or taken from the infrastructure under normal operating conditions.

Minimum operating volume

The specified minimum volume of water within the impounded area of a storage, dam, or weir below which water cannot be released or taken from the infrastructure under normal operating conditions.

Nominal operating level The nominal operating level is the level in a weir that must be maintained.

Outlet Means an arrangement on a storage, dam or weir that allows stored water to be released.

Resource operations plan zone

Refer to section 8 of this plan.

Stream flow Includes flow of water resulting from tributary inflows, and does not include releases of supplemented water.

Tail water The flow of water immediately downstream of a dam or weir. Tail water includes all water passing the infrastructure, for example controlled releases and uncontrolled overflows.

Valid change certificate A certificate issued under section 129 of the Water Act 2000.

Waterhole A part of a watercourse that contains water after the watercourse ceases to flow, other than a part of a watercourse that is within the impounded area of a dam or weir on the watercourse.

Water losses Watercourse transmission and operational losses that may occur in operating the Logan River Water Supply Scheme.

Water use Refers to actual take of water.

Water year The period from 1 July to 30 June.

d) Words to the effect of “That, if at any time the supply of water
