Executive Summary

State Context

The main stakeholders involved in ATM in the Republic of Slovenia are Ministry of Infrastructure and Spatial Planning (MzIP), Civil Aviation Agency of the Republic of Slovenia (CAA), Aircraft Accident and Incident Investigation Service, Slovenia Control Ltd. and Slovenian Environment Agency (ARSO), both designated ANS providers, Ministry of Defence (MoD) and Aerodrom Ljubljana, Ljubljana Jože Pučnik Airport operator. The MzIP regulates and supervises civil aviation in compliance with Aviation Act and regulations issued on its basis. The MzIP is competent for administrative matters, continuing oversight and supervision of implementation of aviation regulations and legal acts in force and applicable in the Republic of Slovenia, and for minor offence proceedings with regard to these rules, referring in particular to the access to air routes, public service obligations, and fixing of air traffic prices, transport in international air traffic, access to the ground handling market at airports, allocation of slots at airports. The Civil Aviation Agency of the Republic of Slovenia (CAA) has been established in 2011 and it is independent public agency with responsibilities determined by the Aviation Act: it is responsible for adjudication in administrative matters, continuing oversight and supervision of implementation of aviation regulations and legal acts in force and applicable in the Republic of Slovenia, and for minor offence proceedings with regard to these rules, referring in particular to the flight safety and commercial aviation operations, airports, and air traffic management, protection of civil aviation, safety related to other aviation activities, personnel and devices used in civil aviation, operating licence, and other safety oversight duties, determined by the implementing regulations of the European Union, the Government and the ministry responsible for transport, except supervision of implementation of aviation regulations and minor offence proceedings performed directly by European Union authorities. The functions of National Supervisory Authority (NSA) in accordance with EU Reg. No. 549/2004 are performed by the CAA. ANS providers in Slovenia are: - Slovenia Control Ltd., which provides ATS, AIS, CNS services and - Slovenian Environment Agency (ARSO), which provides MET services. Slovenia Control Ltd. was established on the basis of the Act on the Provision of Air Navigation Services, in accordance with the Companies Act and the Public Utilities Act, and in connection with the Aviation Act. The owner and founder of the company is the Republic of Slovenia. Slovenia Control Ltd. is the holder of the certificate for the provision air navigation services – ATS, AIS, CNS services. The company provides the technical and operational capacity for providing air navigation services in a manner that is safe, free of disruption, flexible in capacity, advantageous in terms of price, cost-effective, close-to-nature and of the very highest quality, adapting constantly to the actual current or future air traffic density in the given airspace. Slovenian Environment Agency (ARSO) is certified to provide MET services. ARSO is affiliated body to the Ministry of Agriculture and Environment. Military Aviation Authority (MAA) was established in 2004. It is the highest military aviation authority of Slovenian Armed Forces and it is independent part of General Staff of Slovenian Armed Forces within the Ministry of Defence (MoD). MAA carries out a range of regulatory and supervisory functions and services relating to safety and technical aspects of military aviation. Aircraft Accident and Incident Investigation Service is functionally independent body as set by Aviation Act and secondary legislation, organisationally placed within the MzIP.

Aerodrom Ljubljana, joint-stock company, is the operator of the largest public airport with scheduled international traffic in the Republic of Slovenia - Ljubljana Jože Pučnik Airport. The operator is owned by the Republic of Slovenia (50.67%) and other entities.

ESSIP Objective Implementation

The implementation progress of Pan European and Multinational Objectives is satisfactory. The majority of the objectives for 2013 are completed. Main part of ATC objectives will be completed in following years but some of them to be completed in 2014/2015 and it is connected with the implementation of the new ATCC centre. Due to implementation of new ATCC some of the ATC objectives are indicated as being late.

Introduction

The Local Single Sky ImPlementation documents (LSSIPs), as an integral part of the ESSIP/LSSIP mechanism, constitute a five-year plan containing ECAC States’ actions to achieve the Implementation Objectives as set out by the ESSIP and to improve the performance of their national ATM System. The LSSIP document – Year 2013 describes the situation in the State at the end of December 2013.

The LSSIP documents are structured into 6 chapters to better differentiate the Stakeholder(s) accountable for the information contained in each of them:

Chapters 1 to 5 present the key players in the State, and set the institutional and geographical scenes to help the reader understand the specifics of the State and interpret the rest of the document correctly. It also presents a short description of the main national and regional projects in which the national Stakeholders are involved.

Chapter 6 contains high-level information on progress and plans of each ESSIP Objective. The information for each ESSIP Objective is presented in boxes giving a summary of the progress and plans of implementation for each Stakeholder. The conventions used are presented at the beginning of the section.

Note: Chapter 6 is completed with a separate document called LSSIP Level 2. This document consists of a set of tables organised in line with the list of ESSIP Objectives. Each table contains all the actions planned by the four national stakeholders to achieve their respective Stakeholder Lines of Action (SLoAs) as established in the ESSIP.

1.2.3.1 General information

In the Republic of Slovenia there are three public airports with international traffic, where the ATS are provided and one civil-military airport Cerklje ob Krki:

1.2.4 Military Authorities

Military Aviation Authority (MAA) was established in 2004. It is the highest military aviation authority of Slovenian Armed Forces and it is independent part of General Staff of Slovenian Armed Forces within the MoD. The MAA carries out a range of regulatory and supervisory functions and services relating to safety and technical aspects of military aviation.

With regard to the Aviation Act (Official Gazette No. 81/2010) the MAA's fields of work are:

Airworthiness,

Personnel licensing,

Flight safety,

Safety and quality control,

Military air traffic,

Airspace surveillance and control.

The regulatory functions include among other: military aircraft airworthiness certification and registration; certification of organisations involved in military aircraft maintenance; approval and supervision of maintenance systems; training programmes and manuals approval; publishing safety bulletins; forming exam commissions; licensing, endorsements, ratings validation; military personnel licensing; safety programmes approval and supervision; certification of surveillance sensors; preparation of regulations and standards; military organisations audits.

The MAA performs its tasks in accordance with the aviation regulations, standards and recommended practices.

With regard to the Act on the provision of air navigation services (Official Gazette of the Republic of Slovenia, No. 30/2006 and 109/2009) national ANSP Slovenia Control Ltd. provides services for GAT and OAT.

The MAA’s regulatory service provision and user roles in ATM are detailed above.

1.2.4.3 User role

1.2.4.4 Flexible Use of Airspace (FUA)

In year 2013 Decree on the implementation of the Commission Regulation (EC) laying down common rules for the flexible use of airspace has been published. At the moment the establishment of the AMC is in progress.

1.2.5 Accident/incident Investigation Body

1.2.5.1 Technical investigations

Technical investigations of accidents and incidents are conducted by the Aircraft Accident and Incident Investigation Service (AIB). The AIB is organisational unit within the MzIP, but functionally independent from it. AIB is also independent from CAA. AIB is also independent from any other entities, whose interests might be in conflict with its authority as an accident/incident investigating body. AIB conducts the investigation of accidents and incidents under the provisions of Regulation (EU) No. 996/2010, Annex 13 to the Convention on International Civil Aviation and in accordance with the provisions of national legislation.

1.2.5.2 Collection, Evaluation & Processing of Data

Under the provisions of the national Decree on the civil aviation occurrence reporting AIB performs the collection, evaluation, process and storing of all information occurrences in the ECCAIRS data base, as well as making this information available to the other EU States according to EU Regulations.

1.2.5.3 Civil-Military Accidents/Incidents

Accidents and incidents of military aircraft are investigated by the permanent Military Aviation Investigation Board, appointed by the minister responsible for defence. This permanent Board is functionally independent from the Military Aviation Authority, and ensures implementation of professional and administrative task related to: airworthiness, certification, aviation operations, maintenance, licensing, air traffic management and airports, and is also independent from other bodies and subjects whose interests might be in conflict with its authority as an accident/incident investigating body. The investigation may be monitored by an observer from the AIB who shall be determined by the leader of the investigating body. If a military aircraft was involved in an accident or serious incidents of a civil aircraft, a member from the Military Aviation Investigation Board shall also be appointed to the investigating commission which shall be appointed by the head of the Military Aviation Investigation Board.
