    The creation of any of the organizationalstructures listed above is authorized bySection 18 of the Local Government Code

    the LGUS shall have the power and authority

    to establish any organization that shallefficiently and effectively implement itsdevelopment plans, programs and projects.

    More specifically, the UDHA has devolved

    to the LGUS the task of implementing thesocialized housing program in theirrespective jurisdictions.

    Legal Basis Section 43 of RA 7279

    Sec. 43. Socialized Housing Tax Consistent with theconstitutional principle that the ownership and enjoymentof property bear a social function and to raise funds forthe Program, all local government units are hereby

    authorized to impose an additional one-half percent((0.5%) tax on the assessed value of all lands in urbanareas in excess of Fifty thousand pesos (P50,000.00).

    DOF Local Finance Circular No. 1-97 dated April 10, 1997

    provides for the implementing rules and regulations forthe SHT.

    Sec. 18. Balanced Housing Development - TheProgram shall include a system to be specifiedin the Framework plan whereby developers of

    proposed subdivision projects shall be requiredto develop an area for socialized housingequivalent to at least twenty percent (20%) ofthe total subdivision area or total subdivisionproject cost, at the option of the developer,

    within the same city or municipality , wheneverfeasible, and in accordance with the standardsset by the Housing and Land Use RegulatoryBoard and other existing laws.

    The balanced housing development as hereinrequired may also be complied with by thedevelopers concerned in any of the followingmanner:

    Development of new settlement;

    Slum upgrading or renewal of areas for prioritydevelopment either through zonal improvement programsor slum improvement and resettlement programs;

    Joint-venture projects with either the local governmentunits or any of the housing agencies; or

    Participation in the community mortgage program.

    (l) "Disaster Prevention"- the outrightavoidance of adverse impacts of hazards andrelated disasters.

    It expresses the concept and intention to

    completely avoid potential adverse impactsthrough action taken in advancesuch as construction of dams or embankments that eliminate

    flood risks, land-use regulations that do not permit any settlement

    in high-risk zones and

    seismic engineering designs that ensure the survivaland function of a critical building in any likelyearthquake.
