Iowa’s HIV criminalization statute 

is outdated.

The current law does not require intent to transmit 

the virus, nor actual transmission of the virus, for felon sentencing.

HIV is currently singled out and treated 

differently than all other communicable diseases.

The National HIV/AIDS Strategy calls for state legislatures to 

reconsider criminalization statutes that may act as barriers to public health prevention goals and may 

interfere with public health strategies to reduce transmission 

of HIV/AIDS.
