    LivingWithHistoricDistrictZoning

    HistoricZoningTheOregonDistrict,thefirsthistoricdis-trict,wasdesignatedin1972.TodayDaytonhastenHistoricDistricts,eachuniqueincharacterandarchitecture.TheLandmarkCommissionwasestablishedasaninemembercitizenboard,appointedbytheCityCommission,toencouragesensitiveandcompatiblemodificationstohistoricstruc-turesandtoprotecttheintegrityofHistoricDistrictsandStructures.TheLandmarkCommissionconsistsofatleasttworegis-teredarchitects,threehistoricdistrictresi-dents,andonerepresentativefromtheMontgomeryCountyHistoricalSociety.AllmembersoftheLandmarkCommissionmustdemonstrateapositiveinterestinhistoricpreservation.

    DutiesoftheLandmarkCommissionandStaffTheLandmarkCommissionreviewsallMajorModificationsandappealsofPreser-vationOfficerdecisions.ThestafftotheLandmarkCommissionisdesignatedbytheDirector

    of

    the

    Department

    of

    Planning

    andCommunityDevelopmentandconsistsof

    theSecretarytotheLandmarkCommissionandtheHistoricPreservationOfficer. TheSecretaryandthePreservationOfficermaintainrecordsandminutesoftheLand-markCommission,approve,modify,ordisapproveminorarchitecturalmodificationsandmajormodificationsspecificallyas-signedbytheLandmarkCommission.ThePreservationOfficeralsomaintainsrecordsofeachhistoricproperty.TheserecordsareavailableforreviewbyrequestthroughtheDepartmentofPlanningandCommunityDevelopment.

    CertificateofAppropriatenessBeforemodificationismadetoapropertyinaHistoricDistrict,theownermustseekaCertificateofAppropriateness forthepro-

    posedactivityfromtheDepartmentofPlanningandCommunityDevelopmentbycalling(937)333-3670.TherearetwoclassesofModifications:MinorandMajor.MinorModificationsconsistofrepaintingexisting

    paintedsurfaces,replacementofdoors,windows,guttersystems,etc.,whichmatchtheexisting,minorrepairofsurfaces,repairorinstallationoffencingandlandscaping.MajorModificationsconsistofconstructionorremovalofbuildings,additions,accessorystructures,porches,constructionorremovalofdecorativedetails,constructionorre-movalofdoorandwindowopenings,orthealterationofsignificantstyleelementslikeslateandtileroofs.HowtoObtainaCertificateofAppropriatenessToobtainaCertificateofAppropriateness,simplyfillouttheappropriateformavailablefromtheDepartmentofPlanningandCom-munityDevelopment.Thecompletedappli-cation,alongwiththerequestedattach-ments,willbereviewedbythePreservationOfficer.IftheproposedmodificationisminorandincompliancewiththeBlueprintforRehabilitation,2ndedition,thePreserva-tionOfficerissuesaMinorCertificateofAppropriateness. Ifthemodificationismajor,oriftheapplicantisappealingthedecisionofthePreservationOfficer,theproposalisreviewedbytheLandmark

    postponeortabletheproposal,whichre-quiresasimplemajority,ortomodifyordenytheproposal,whichrequiresamajorityoftheappointedmembers.ThedecisionoftheLandmarkCommissionwillbeissuedinwritingbytheSecretarywithinsevendaysofthehearing.AppealoftheLandmarkCommissionDecisionThedecisionoftheLandmarkCommissioncanbeappealedtotheBoardofZoningAppealsasprescribedintheR.C.G.O.150.256bynotifyingtheSecretaryoftheBoardofZoningAppealswithin14daysaftertheLandmarkCommissionrendersitsdecision.TheBoardofZoningAppealswillaffirm,reverse,orremandthedecisionoftheLandmarkCommissionbasedononeofthefollowing:A) ThattheLandmarkCommissionerredinitsapplicationofthearchitecturaldesignstandardsorB) ThattheLandmarkCommissioncom-mittedproceduralerrorwhichsubstantivelyaffectedtherightsoftheapplicantortherightsofanyinterestedpartyofrecordtoaCertificateofAppropriateness.

    CommissionatthenextscheduledLand-markCommissionMeeting.Theapplicationmustbefilledoutcompletely,legibly,andallrequestedinformationmustbeincluded.Theapplicationmustbereceivedatleasttwoweeksbeforethemeetingtobeplacedontheagenda.LandmarkCommissionmeet-ingsareeverysecondandfourthThursdayat3:00PM,sixthfloortrainingroom,CityHall.

    HearingBeforetheLandmarkCommissionTheapplicantwillreceivenoticeofthehearingbymailoneweekpriortothemeet-ing.TheproposalispresentedtotheLand-markCommissionbystaffatthepublichearing.ThepresentationconsistsofslidesandoverheadswhichareprovidedbytheDepartmentofPlanningandCommunityDevelopment,andtheinformationsubmitted

    bytheapplicant.Afterthestaffpresentation,thereisanopportunityfortheapplicanttoaddresstheLandmarkCommissionandanswerquestions.TheLandmarkCommis-sionwillthenhearanypubliccommentsanddeliberate.ThedecisionoftheLandmarkCommissionwillbeeithertoapprove,
