1. Introduction

GHD has prepared this Livestock Facility Siting License Application on behalf of Olson Dairy Farms,Inc. (Farm or Site). The purpose of this Application is to provide approval for a Farm that housesgreater than 500 animal units (AUs) located in Shawano County, Wisconsin. As required byOrdinance Number 1-18: Shawano County Livestock Facilities Licensing Ordinance of the ShawanoCounty Code, the Wisconsin Department of Agriculture, Trade & Consumer Protection (WDATCP)Livestock License Application Form and Worksheets (WDATCP Application) for livestock facilitiesare included in Appendix A.

2. Site Description

Olson Dairy Farms, Inc. is an existing dairy operation located at N9124 Butternut Road,Birnamwood, Shawano County, Wisconsin. The legal description for the Farm is the SW¼ NW¼T28N, R11E, Section 12 and SE¼ NW¼ T28N, R11E, Section 12. The Farm generally consists ofthe farmstead and the cropland owned and operated by the Farm.

The Farm is located in the North Branch Embarrass River-Embarrass River Watershed (HUC:0403020212). In accordance with number 9 of the WDATCP Application:

• Figure 1 presents the location of Olson Dairy Farms, Inc. including the existing livestockstructures, roadways, navigable waters, residences within 2 miles of a livestock structure, andresidences and high use buildings within 2,500 feet (ft) of a livestock structure.

• Figures 2 and 3 present the property lines within 2 miles of a livestock structure and topographiccontours at 10 feet (ft) elevation intervals, respectively.

In accordance with Worksheet 3, Part B of the WDATCP Application:

• Figure 2 presents the fields where manure and wastewater will be applied. It should be notedthat the crop fields shown on the figure are limited to the area within the current scale of thefigure. Copies of the manure and wastewater land application maps for all fields included inOlson Dairy Farms, LLC nutrient management plan (NMP) are included in Appendix B.

In accordance with number 10 of the WDATCP Application:

• Figure 4 presents the existing livestock structures including buildings, property lines, roadways,navigable waters, and known karst features within 1,000 ft of a livestock structure at the Farm.

• Figure 5 presents the existing and proposed livestock structures with 2 ft topographic contoursfor the area within 300 ft of the livestock structures including buildings, property lines, roadways,navigable waters and known karst features.

The Farm consists of one (1) milking parlor and holding area, one (1) freestall barn, two (2) heifer barn, two (2) calf barns, one (1) dry cow barn, one (1) concrete cow alley, one (1) concrete lot, one (1) commodity shed, one (1) machine shed, a gravel feed storage area for AgBags, one (1) storage

shed, one (1) old waste storage facility, one (1) round concrete waste storage tank, one (1) house and one (1) garage. In addition, the farm maintains two outdoor earthern lots – east and west.

Olson Dairy Farms, Inc. plans to complete an expansion of their existing dairy facility in order to accommodate the addition of robotic milkers. The Project will include construction of a new freestall barn with a robotic milking system (333 feet (ft) by 178 ft), a new concrete waste storage tank (WST) (326 ft diameter by 12 ft deep) and a new concrete feed pad (500 ft by 200 ft) with leachate collection system. In addition, the existing concrete WST (146 ft diameter by 12 ft deep) will be utilized to collect feed leachate and precipitation runoff from the feed storage area.

Multiple structures will be abandoned during this project including: the existing milking parlor and holding area (165 ft x 45 ft), the existing dry cow barn (135 ft by 45 ft) and drive by concrete feed alley (260 ft by 15 ft), an existing concrete lot (approximately 11,000 square feet (ftP

2P)), the existing

waste storage facility (96 ft by 92 ft by 8 ft deep) and the east and west earthen lots.

The waste storage pond, waste transfer systems and feed storage area with leachate collection system were designed in accordance with USDA-NRCS Conservation Practice Standard (CPS) 313- Waste Storage Facility, CPS 634-Waste Transfer, and CPS 629-Waste Treatment. Plans & Specifications for the entire project have been submitted to WDNR and Shawano County LCD for approval. A breakdown of the existing and proposed animal numbers along with animal unit calculations and housing location is included in Appendix C. As discussed in this application, the Farm seeks to expand to 1,373 animal units.

The proposed manure and wastewater volumes to be generated by animals identified in this Livestock Facility Siting License Application are summarized in Table 1. It should be noted that the Farm does not maintain any solid manure storage facilities, however, headland stacking locations have been included in the Farm’s NMP and daily haul of solid manure will be used when possible. If headland stacking and daily haul is not feasible due to weather conditions, solid manure will be added to the proposed WST. The solid manure will be mixed with the liquid manure using agitators and land applied according to the Farm’s NMP. It is anticipated that this practice will be utilized in February and March for disposal of approximately 108 tons of the 652 tons of solid manure generated annually. This practice will reduce the days of liquid storage by approximately one (1) day to 206 days.

3. Location of Livestock Structures

Existing and proposed livestock structures with the exception of the proposed freestall barn complywith the livestock structure setback requirement as specified in Shawano County Ordinance 1-18and the existing and proposed waste storage facilities comply with road and property line setbacksas specified in Ordinance 1-18. Shawano County approved a variance (LFLO-V-1-19) to theButternut Road right-of-way setback in Ordinance 1-18 for construction of the proposed freestallbarn on March 14, 2019.

3.1 Wells

There are three (3) existing wells located at the Farm, as shown in the Table below and on Figure 5.

Contamination from surface runoff and risk from traffic damage to the wells is minimal due to the proximity of the wells to the livestock facility and motor vehicle traffic. Construction of the wells was completed in accordance with NR 811 and NR 812 with appropriate WDNR approvals. It should be noted that both the heifer barn well and parlor well will require a variance under NR 243.15(2) due to their proximity to existing animal waste handling facilities on the Farm which are considered reviewable structures under NR 243-Animal Feeding Operations. GHD will submit the necessary variance requests to WDNR for review and approval.

3.2 Odor Score Evaluation

For purposes of this permit application, three (3) residences were evaluated for the odor score including houses located at N9062 Butternut Road, W17101 County Road N, and N9179 Butternut Road. A figure showing the distances from each house to each odor producing structure at the Farm used in the odor calculation, as well as the corresponding odor score spreadsheet is included in Appendix C.

Based on the odor score calculation, the nearest affected neighbor was determined to be located at N9062 Butternut Road. However, this neighbor has affirmatively agreed in writing to be excluded from the odor score calculation as allowed in ATCP 51.14(2) Wis, Admin Code. A copy of the signed neighbor letter is included in Appendix C. Based on this neighbor being excluded from the odor score, a new closest affected neighbor had to be determined.

Of the other two houses evaluated, the nearest affected neighbor was the residence located at W17101 County Road N. The odor score was calculated using distances from each residence to existing and proposed odor generating items at the Farm specified in ATCP 51. The occupied area for each structure is based on the portion of the structure to which animals have access and in which manure may accumulate. The occupied area does not include the feed alley or storage areas in the barn. A summary table that includes the structures on the Farm is included in Appendix C.

The numbering system on the odor score figures correlates to the specific line in the odor score spreadsheets included in Appendix C. Five (5) existing and proposed odor producing components were used to calculate the odor score for the Farm including two (2) heifer barns, the existing and proposed freestall barns and one (1) proposed waste storage tank.

Best management practices (BMPs) for odor reduction are utilized as appropriate to manage odor at the Farm. BMPs utilized in animal housing included diet manipulation and cleaning frequently. Diet manipulation is achieved by only feeding protein sources at a level which matches the animal’s growth and production requirements. Olson Dairy Farms, Inc. utilizes a professional nutritionist to balance the animal diets based on growth stage, animal type and production level (milk, reproduction, or growth). The frequent cleaning BMP was utilized for the two freestall barns because

they will employ automatic alley scrapers and manure will be removed from animal housing at least three times per day.

The two (2) bedded pack calf barns (4,000 ftP

2P and 4,800 ftP

2P) were excluded from the odor score

calculation as they occupy less than 7,500 ftP

2P each, which meets the applicable exemptions

specified by DATCP. In addition, the leachate collection tank (top footprint of approximately 16,742 ftP

2P) was not included as an odor producing component in the evaluation as there is no research

available to calculate the odor generation factor for a structure of this nature. ATCP 51-Livestock Facility Siting only includes odor based on science from manure storage structures.

As previously discussed, the nearest affected neighbor for this Livestock Facility Siting License application is the neighbor located at W17101 County Road N with a separation score of 756, a management score of 80 and a predicted odor of 136 resulting in an odor score of 700. A passing odor score must be 500 or greater.

3.3 Employee Training Plan

Olson Dairy Farms, Inc. has developed an employee training plan in compliance with number 12 of the WDATCP Application to provide information to employees on issues related to the daily operation of the livestock facilities. Following completion of the expansion, the Farm will employ approximately 2 full-time employees and 4 part-time employees. Training topics include: Nutrient Management, Odor Management, Runoff Management, Manure and Wastewater Handling, Employee Safety and Environmental Incident Response. The employee training plan is provided in Appendix D.

One of the subjects on which training is provided is nutrient management. The Nutrient Management Plan (NMP) for Olson Dairy Farms, Inc. is completed by Chuck Bolte and Katelin Bradley, Ag Source Laboratories, both Certified Crop Advisors (CCA) in Wisconsin. The most recent NMP update was completed in 2019 and submitted to Shawano County and will be submitted to WDNR to accompany the pending WDPES permit application.

4. Environmental Incident Response Plan

An Environmental Incident Response Plan has been developed for the Farm in accordance withnumber 13 of the WDATCP Application and is included in the employee training plan in Appendix D.This plan will ensure immediate action is taken if an incident were to occur at the Farm. Incidentscovered in the Environmental Incident Response Plan include overflows and spills from the wastestorage facilities, catastrophic system failures, manure spills during transport and application,movement of manure during or after application, and catastrophic mortality disposal emergency.Records will be kept of incidents requiring immediate response or implementation of this plan. Theserecords will be kept on file at Olson Dairy Farms, Inc. Kurt Olson, Jr. will serve as the Farm’s point ofcontact if an environmental incident were to occur.

5. Odor Management Plan

An Odor Management Plan was developed for Olson Dairy Farms, Inc. in accordance with number14 of the WDATCP Application and is included in Appendix E. Odor complaints will be addressedand logged using the format in Appendix E. It should be noted that Olson Dairy Farms, Inc. hasvoluntarily developed this plan and has not taken the 20 bonus points allowed in the odor score.

6. Other Laws and Permits

The laws and permits that apply to the operation of Olson Dairy Farms, Inc. are shown inAppendix F in accordance with number 15 of the WDATCP Application. The approved permits willbe kept on file at Olson Dairy Farms, Inc.
