In working toward the goal for each member within HBAL to be supported and served well, we continue to make a difference for the common good in Lincoln, Lancaster County, within the State of Nebraska and yes, beyond. In serving together the end result will be greater than the individual efforts of each of us by ourselves.

Anders Lewendal moved to Bozeman, Montana in 1991 and owns Anders Lewendal Construction, Inc. Anders became

involved in sustainability in the early 1980’s working for a large commercial recycling company and then composting for the City of San Francisco after receiving a degree in business economics

at UCSB. Anders earned a general B professional builders certification from the California State License Board in 1988 and retains that certification. Currently, Anders is active chairing the

Green Building Committee for SWMBIA, is a board member of SWMBIA and its 2010 Chairman. Anders continues to study and produce safe, efficient and affordable homes in Bozeman.

Anders is also an NAHB Certified Green Professional, an Energy Star builder and lives on the North side of Bozeman in the only

100-year-old Energy Star certified home in America.

Jake Lewendal has lived in Bozeman, Montana for 20 years. Jake works with his father, Anders, and is excited to continue in the family business. Jake recently graduated from Montana State University with a marketing degree and also became a

Certified Green Professional through NAHB’s Green Council. Jake has developed a keen interest in energy efficiency and

environmentally sustainable building practices during his studies at Montana State University and would like to see Bozeman

become a leader in energy efficient home building. Future plans include building the first American Passive Home in 2012.

NAHB/First American Improving Markets Index

NAHB/First American Improving Markets IndexThe list of housing markets showing measurable improvement ex-panded by 29 metros in February to include a total of 98 entries on the National Association of Home Builders/First American Improv-ing Markets Index (IMI), released last month. Thirty-six states are now represented by at least one market on the list.

The index identifies metropolitan areas that have shown improve-ment from their respective troughs in housing permits, employment and house prices for at least six consecutive months. The February index adds some metropolitan areas that have been particularly weak; this is due to the fact that the IMI measures improvement from a bottom, and some of the hardest hit markets are showing signs of coming off of extreme lows. Keeping this in mind, notable new en-trants to list in February include Miami, Fla; Boston; Detroit; Kansas City, Mo.; Portland, Ore.; Memphis, Tenn.; and Salt Lake City.

“The number of improving housing markets has risen for six con-secutive months, and 36 states now have at least one metropolitan area on the list,” noted NAHB Chairman Bob Nielsen, a home builder from Reno, Nev. “This indicates that despite the many challenges that continue to drag on a housing recovery – including the tight lending environment for builders and buyers – improving conditions are slowly but surely spreading from one housing market to the next.”

“While many of the markets on the February IMI are far from fully recovered, the index points out where employment, home prices and housing production are no longer retreating and have held above their lowest recession troughs for six months or more,” said NAHB Chief Economist David Crowe. “This is a sign that a large cross section of the country is starting to turn the corner as local economic conditions stabilize.”

“The fact that there are nearly 100 markets now on the improving list shows that the momentum is building for a housing recovery and that more buyers and sellers are starting to feel confident

enough to return to the market,” said Kurt Pfotenhauer, vice chair-man of First American Title Insurance Company.

The IMI is designed to track housing markets throughout the coun-try that are showing signs of improving economic health. The index measures three sets of independent monthly data to get a mark on the top improving Metropolitan Statistical Areas. The three indica-tors that are analyzed are employment growth from the Bureau of Labor Statistics, house price appreciation from Freddie Mac, and single-family housing permit growth from the U.S. Census Bureau. NAHB uses the latest available data from these sources to generate a list of improving markets. A metropolitan area must see improve-ment in all three areas for at least six months following their respec-tive troughs before being included on the improving markets list.

Seven markets dropped from the NAHB/First American Improving Markets Index in February as they experienced softening house prices. These metros include San Jose, Calif.; Washington, D.C.; Kankakee, Ill.; New Orleans; Worcester, Mass.; Jackson, Miss.; and Sherman, Texas.

Nebraska Builders Home & Garden ShowFebruary 9-12, 2012

Overall Attendance: Over 15,000 people with Saturday’s attendance of over 7,000 people.

Exhibitors: 290 exhibitors utilizing 612 booths plus Kid’s Square, Seminar Room, Cafés and Student Display areas.

Remodelers Council Food Bank House: Collected 4,689 pounds of food bringing our cumulative total to 50,535 pounds of food since the project began in 2003.

Next Year: The 2013 Home & Garden Show will be February 7-10 with contracts to be sent out in late July/early August.

“Economic Impact of Home Building in Nebraska”Dr. Elliot Eisenberg, Senior Economist with NAHB delivered the keynote address at the Nebraska Investment Finance Authority’s annual conference in Omaha on January 24-25, 2012. Building Code Changes starting March 1, 2012The Lincoln City Council passed the IRC in a 6-0 vote with implementation to start March 1, 2012. Watch for further updates or check with Plan Review for new requirements before heading to the counter. These may include: elevations on your site plan, carbon monoxide detectors, ice shield, additional water barrier behind veneered stone or brick products, changes to insulation systems or Res-check verification.

Nebraska Legislative BanquetThe Nebraska State Home Builders Association will be hosting their 2012 Legislative Banquet on March 7, 2012. It is an opportunity to receive a legislative update from our NSHBA lobbyist, Radcliffe & Associates and share with your State Senators how these issues will affect your business and our communities. 2012 International Builders Show (IBS)With the economy showing signs of recovery, the attendance was up nearly 10% with more than 51,000 registered attendees and over 900 vendors. One of the top draws this year was a rare appearance by Federal Reserve Chairman Ben Bernanke, who addressed an open session of NAHB’s Board of Directors on Friday, February 10, 2012. Next year’s show will be in Las Vegas, NV, January 22-25, 2013.

Bernanke Addresses IBS AttendeesA chief focal point of the Federal Chairman, Ben Bernake’s address was the tight credit conditions that persist in the housing sector and are impeding an economic recovery. “Banks remain reluctant to make loans, both to mortgage borrowers and home builders,” the Chairman observed. OSHA Extends Fall Protection Enforcement Compliance Policy

While at the IBS, OSHA’s Director of Construction, Jim Maddux, announced at the Construction Safety and Health Committee meeting that his agency would extend its temporary policy regarding enforcement and compliance of the fall protection requirement for residential construction. This welcomed development is a direct result of a meeting that NAHB’s Senior Officers and staff recently had with the White House’s Administrator of the Office of Information and Regulatory Affairs, Cass Sunstein, in which we respectfully asked for his assistance in reducing compliance uncertainties regarding fall protection.

Originally issued in September 2011 and set to expire in March 2012, the policy outlines the steps OSHA is taking to highlight the fall protection issue and provide assistance to those needing help in developing and implementing compliance strategies. The extension means now through September 15, 2012:

1) OSHA will make it a priority to provide compliance assistance to the residential construction industry;

2) OSHA will allow an up-to-10% “good faith” reduction in penalties if builders can demonstrate they have taken steps to reduce fall hazards;

3) OSHA will allow residential construction employers at least 30 days to correct fall protection violations identified during an inspection; and

4) All proposed citations will be submitted to the OSHA Regional Offices to ensure consistency and clarity.

OSHA’s willingness to extend this policy demonstrates its recognition of the challenges many builders face in complying with this standard and provides much-needed time to fully understand what must be done to protect workers. Registering on NAHBThe NAHB website is a great source for information relating to residential construction. There are a few steps you need to take to register on the website, but once you’ve done that, you have access to tons of information!

With your membership you are assigned an NAHB PIN which can be found above your name in the HBAL Directory. (If you don’t find one, call the HBAL office and we’ll let you know what it is.)

Once you have your NAHB PIN, go to www. NAHB.org and click on the “Log In” button in the upper right hand corner of the screen.

Under the “New to NAHB” heading, click on the link that says, “Create your login now.”

You will then be asked to create an account. Enter your NAHB PIN and State. You will also be required to create a username and password. Once complete, click the “Create Account” button. If you have any troubles you can always call the NAHB Member Service Center at 800-368-5242 x0 for assistance.

The 2012 NAHB Show Home Packs More Punch

in Less SpaceThe New American Home (TNAH) is a showcase home built each year in conjunction with the National Association of Home Builders’ International Builders’ Show. The 2012 edition, in Winter Park, Fla., features more technologically-advanced and environmentally-friendly features than ever before — in a home that is one of the smallest in the 29-year history of the show home program.

At 4,181 square feet, the 2012 TNAH is less than half the size of the 2011 TNAH, which was also built near Orlando, Fla. and measured more than 9,000 square feet. This reflects the current trend towards smaller, more efficiently-designed new homes. Census Bureau data shows that the average size of a new home peaked in 2007, at 2,521 square feet. The average size in 2010 was 2,392 square feet.

But the 2012 TNAH has just as many, if not more, leading-edge green building technologies, innovative construction techniques and special features than ever before.

Builder Phil Kean of Phil Kean Designs designed the home as a re-interpretation of the Classic White Box of the 1960s and ’70s. It is displayed as a two-bedroom floor plan that will appeal to empty nesters, but with four additional rooms that could be converted to bedrooms if desired.

Green technologies being used include insulated concrete forms blocks, a solar HVAC system, LED interior and exterior lighting, and solar screens. The home also takes advantage of Florida’s friendly climate with movable glass panels and motorized screens that provide a seamless flow of air and foot traffic from indoor to outdoor spaces.

The home achieved “Emerald Status,” the highest of the four levels of resource efficiency achievement recognized under the National Green Building Standard, as well as other “green” certifications including the U.S. Department of Energy’s ENERGY STAR, Florida Green Building Coalition’s “Platinum” certification, the U.S. Green Building Council LEED for Homes “Platinum” certification and the Florida Water Star “Gold” designation.

An integrated technology package with structured wiring and control systems will provide the home’s eventual owners with a high-end experience.

Each of the electronic systems in the home will be connected to an advanced, cost-effective home automation system that can be controlled with a smart phone. The home also includes structured wiring for telephone, television, Internet, audio, video and communications.

Other aspects of the high-tech home’s electronics systems include advanced lighting controls, motorized shades, a smart phone-controlled security system, video surveillance, two media systems and a central vacuum.

As NAHB’s official show home, TNAH displays design trends, construction techniques, and materials that can be used in any new or remodeled home in any price range. The products in the home are provided by members of the National Council of the Housing Industry, who are the leading manufacturers and suppliers for the construction industry.

City of Lincoln: Building & SafetyPlan Submittal Revisions in the 2009 IRC

Due to the number of new houses that have been constructed with the top of the foundation too low to comply with the International Residential Code for both clearance from grade, and drainage away from the building, Building and Safety with the support of the IRC Task Force and the Code Study Committee has made the following changes in the 2009 IRC:

The site plan submitted with the plans and application for a building permit of a new house shall include elevations of the curb gutter adjacent to the lot, the height of the top of the foundation, and the elevations of all lot corners. Elevations of the side lot lines adjacent to the house will also be required. On daylight basements, Building and Safety will require elevations of the lowest openings in those walls. On walkouts, the elevation of the lowest floor will need to be shown. In addition, you must provide the elevation of the highest grade point on the lot. This information can be included on the site plan for the building, or in a separate drawing. Grading or drainage flow lines shall also be shown. A licensed surveyor is not required for this information.

Example: If the curb gutter for the lot is at 100.0 feet, the top of the foundation will need to be at least 102.0 feet. The property corners must be no lower than 101.0 to ensure that the foundation is at least 12 inches above grade. If there is not at least 10 feet between the foundation and a lot line, or you have less than 12 inches between the top of the foundation and the property line, then a swale will need to be created which will slope the grade at least 2% away from the foundation and divert the surface water to an approved point of collection or public way.

R106.2 The construction documents submitted with the application for permit shall be accompanied by a site plan showing the size and location of new construction and existing structures on the site and distances from lot lines. The site plan shall include elevations of existing property lines, street and proposed foundation as per R403.1.7.3. In the case of demolition, the site plan shall show construction to be demolished and the location and size of existing structures and construction to remain on the site or plot. The Building Official is authorized to waive or modify the requirement for a site plan when the application for a permit is for alteration or repair or when otherwise warranted.

R317.1 (5) Wood siding, sheathing and wall framing on the exterior of a building having a clearance of less than 6 inches from the ground or less than 2 inches measured vertically from the concrete steps, porch slabs, patio slabs and similar horizontal surfaces exposed to the weather.

R403.1 Surface drainage shall be diverted to a storm sewer conveyance or other approved point of collection that does not create a hazard. Lots shall be graded to drain surface water away from foundation walls as per the approved grading and drainage plan. The grade from the foundation shall fall a minimum of 6 inches in the first 10 feet in accordance with Section R401.3. The grade at the property line shall not be changed/altered.

Exception: Where lot lines, walls, slopes or other physical barriers prohibit 6 inches of fall within 10 feet, drains or swales shall be constructed to ensure drainage away from the structure. Impervious surfaces within 10 feet of the building foundation shall be sloped a minimum of 2% away from the building.

R403.1.7.3 On graded sites, the top of all exterior foundation walls shall be a minimum of 12 inches higher than the finished grade elevation 10 feet from the perimeter of the foundation. The floor of a walkout basement shall be a minimum of 12 inches higher than the grade 10 feet from the foundation. The top of the foundation wall below a daylight window shall be a minimum of 12 inches higher than the finished grade elevation, 10 feet from the perimeter of the foundation. Alternate elevations are permitted subject to approval of the Building Official, provided it can be demonstrated that the required drainage to the point of discharge and away from the structure is provided at all locations on the site.

NSP Carrier Enforcement Town Meeting Schedule

The Nebraska State Patrol Carrier Enforcement Division has scheduled the following town meetings. Locations and times of all town meetings are listed below.

During the town meetings information will be provided on the Federal Motor Carrier Safety Administration (FMCSA), Compliance, Safety, Accountability (CSA 2010) program.

Implemented in Dec. 2010, the program increases the monitoring of motor carrier on the road performance, and institutes new penalties for unsafe driving behaviors.

An update on Nebraska’s Truck Safety Regulations and changes in the Hazardous Materials Regulations will also be provided.

The meetings should be attended by anyone who operates any of the following vehicles:

• A pickup pulling a trailer (over 10,000 lbs combined weight or gross combination of weight rating).

• A pickup or truck weighing over 10,000 lbs

• A pickup, trailer, truck or semi requiring a class A, B, or C Commercial Driver’s License.

• Any motor vehicle transporting hazardous material of any quantity.

• Any farm truck displaying farm plates and registered for more than 16 tons

• Any passenger carrying vehicle designed or used to transport 8 or more passengers, including the driver for compensation.

• Any passenger carrying vehicle designed or used to transport 15 passengers, including the driver and not used to transport passengers for compensation.
