INSTALLED IN VARIOUS BUILDINGS OF NIB CAMPUS(Excluding Comprehensive Maintenance of Chillers –CARRIER & TRANE make and their ATS panels only)

1. Introduction

NATIONAL INSTITUTE OF BIOLOGICALS is an autonomous Institute under the administrative control of the Ministry of Health & Family Welfare, Govt. of India. Engaged in evaluation and quality control of various biological products like vaccines, blood products, blood reagents, sera, immuno-diagnostic kits etc. produced and imported in to India. The Institute is spread over an area of 18.4 acres of land with various buildings already constructed in NIB campus.

The bidders have to operate and maintain the whole HVAC Systems installed in the various buildings of the Institute in general shift and three shift (round the clock) i. e. 24X7 mode. The HVAC plant of the Administrative Building and Cafeteria to be operated in general shift only. The HVAC plant of Laboratory & Animal House Building to be operated in three shift (round the clock) i. e. 24X7 mode. The chillers equipments of the HVAC Plant Systems of Administrative Building and Laboratory & Animal House are under separate AMC contract with the original equipment manufacturer and only operation & upkeep is covered under this contract.

Sealed Tenders are invited from experienced Firms/Agency/Contractors in the prescribed format for Annual Operation and Comprehensive Maintenance Contract for HVAC system along with their allied accessories etc. installed in the various locations/ buildings of this Institute as mentioned ANNEXURE-I of the tender document.

The bidders are required to visit these buildings of NIB to see the actual installations for them selves to asses the quantum of work involved before submitting the tender. Once the tender is submitted, it will be presumed that the bidder has seen and under stood the complete work involved for each of the system.

2. For Pre-qualifications: - a) The firm/agency/contractor should be presently rendering their services for

operating and maintaining of similar works i. e. operation and comprehensive maintenance of similar HVAC Plant Systems of not less than 2X400TR capacity of M/s TRANE/CARLYE/VOLTAS/BLUE STAR/CARRIER AIRCON etc. make, centrifugal type chilling machine along with allied accessories etc. for complete HVAC system, in any Government Sector or large reputed Private Sector enterprises, for at least

last two consecutive years satisfactorily. Necessary relevant documents to this effect to be enclosed.

b) The single order value for similar works should not be less than Rs 10 lacs for Non-comprehensive and Rs. 28.00 lakh for Comprehensive Maintenance Contract in any one year of last three financial Years.

c) The annual turn over shall not be less then Rs. 50.00 lakh (fifty lakh only) in the last two consecutive financial years for carrying out similar nature of work particularly services.

d) The Institute shall have the discretion to consider the above criteria at b & c to relax by 25% in the event of substantially responsive offers received are less than three.

e) Copy of PAN/TIN No. and Service Tax number to be furnished including Income Tax clearance certificate.

f) Tenderer should have PF and ESI registration number and same shall be indicated in the technical bid along with documentary proof.

3. Earnest Money Deposit (EMD): -The tenders are required to deposit Demand Draft of Rs.70, 000/- (Rupees Seventy thousand only) in favour of the “National Institute of Biologicals, payable at Noida/ New Delhi as Earnest Money Deposit (EMD) along with original tender documents for this work. EMD will be returned to the unsuccessful tenderers after award of the contract. No interest shall be payable by NIB on EMD.

Successful tenders in the event of the contractor failing to comply with any provision of the contract, EMD/Security Deposit shall stand forfeited.

4. Sale of Tender: -Non transferable tender document containing terms conditions and technical specification etc. can be obtained from the Account Section of this Institute on all working days at schedule date and time as per advertisement on a written request on the letter head of the firm and on payment of non returnable amount as mentioned in advertisement through crossed demand draft (non-refundable) in favour of NATIONAL INSTITUTE OF BIOLOGICALS, payable at Noida/ New Delhi towards its cost. Before buying the tender documents, tenderer may see the document particularly pre-qualification criteria in their on interest.

The Tender document can be downloaded from our web site www.nib.gov.in and Tender Fee can be deposited with the technical bid.

Tender/Bid received without tender fee is liable to be rejected.

5. The tender is to be submitted in two separate sealed envelops as under: 5.1. Technical Bid (Envelop No -1)

a) The tender document in original including the unfilled PRICE-BID Proforma (ANNEXURE-V) duly signed and stamped as a token of acceptance, along with deviation sheet with deviation if any, from particular tender conditions in a

separate sheet (ANNEXURE –IV). The following additional documents shall also be enclosed and sealed, superscript with name of the tender i. e.

i) The attested copy of registration certificate.ii) The attested copies of experience certificates of carrying out similar nature of

work as per pre-qualification criteria particularly annual maintenance contract of HVAC Systems in Government/ Semi Government/ PSU’s or large reputed private organization etc. for at least last two years satisfactorily. They may also enclose work order copies to meet the experience criteria.

iii) The attested copies of the balance sheet/ audited statement of accounts or any other relevant document to prove the minimum average annual turnover required as per pre-qualification criteria in preceding last two financial years in maintenance and services.

iv) Earnest Money Deposit (EMD).

5.2 Price Bid (Envelop No. 2)The Price Bid as per Performa given in the tender documents as ANNEXURE-V shall be photo copied and then price filled up and submitted in Envelope No -2, duly sealed superscript with name of tender. Any conditions given in the Price Bid may cause rejection of Bid.

6. Pre Bid Meeting and Clarification of Bids: 6.1 A Pre Bid meeting will be organized by NIB before the last date for submission of

bids at NIB Noida. Bidders may seek any clarifications from NIB on their written request regarding the tender document.

6.2 During evaluation of bids NIB may, at its discretion ask the bidder (s) for clarification of their bid. The request for clarification and the response shall be in writing and no change in prices or substance of the bid shall be sought, offered or permitted.

7. Submission of Bids:The Envelop No. 1 & 2 shall be sealed separately and placed in a third Envelope which also shall be sealed and duly super scribed with the name of the tender.

Bid with all complete relevant documents must be addressed to the Director, National Institute of Biologicals, A-32, Sector – 62(Institutional Area, Noida-201307 not later then 15:00 Hrs on scheduled date as mentioned in the advertisement.

8. Bid Opening:i) Bid shall be opened in the office of this Institute at Noida, an hour after the

prescribed time for the bid submission in the presence of tenderer who may wish to be present at 16:00 Hrs. on a date as mentioned in the advertisement.

ii) The technical bid shall be opened first. The Price Bid (Envelop No 2) will be opened only of those tenderers whose technical bid is found to be in order and for which they shall be intimated separately about date & time by fax/ telephone.

iii) The bidder who do not submit the documents as per pre-qualification criterion and tender conditions, have major deviations, do not submit proper EMD and

experience certificates etc. then their tender may be treated as non responsive and their Price Bid (Envelop No. 2) shall not be opened.

iv) The successful firms/ agencies/ contractors will be intimated and contract agreement will be entered into initially for a period of one year. The preparation of the contract agreement with proper stamp etc. would be done by the bidder in consultation with NIB. If the firm’s services/ performance is found to be satisfactorily in the sole opinion of NIB, the contract is be extendable on the same terms & conditions for a further period of two years on yearly and performance basis.

v) The firms/ agency/ contractor are required to submit their most competitive price offer in the format (ANNEXURE –V) in concurrence with the list of major equipment, scope of work, list of consumables/spares, technical specifications, terms & conditions and deviations sheet etc enclosed herewith as (APPPENDIX-A & B and ANNEXURE – I, II, III, & IV).

9. Awards of Contract:(i) NIB will award the contract to the successful bidder whose quotation has been

determined to be substantially responsive and determined as the lowest evaluated quotation, provided further that the bidder is determined to be qualified to perform the contract satisfactorily.

(ii) Period of Contract – One year, extendable on existing rates and terms for another two years on yearly and performance basis.

(iii) Foreclosure of contract due to abandonment or reduction in scope of work - If at any time after acceptance of the tender, National Institute of Biologicals shall decide to abandon or reduce the scope of the works of any reason whatsoever and hence not require the whole or any part of the works to be carried out, the NIB shall give notice in writing to that effect to the contractor and the contractor shall act accordingly in the matter. The contractor shall have no claim to any payment of compensation or otherwise whatsoever, on account of any profit or advantage which he might have derived from the execution of the works in full but which he did not derive in consequence of the foreclosure of the whole or part of the works.

(iv) Subletting -The contract shall not be assigned or sublet without the written approval of the NIB.

10. Right to accept any Quotation and to reject any or all Quotation:The NIB reserves the right to accept or reject any quotation, and or to annul the bidding process and or reject all quotations at any time prior to award of contract, without thereby incurring any liability to the affected bidder or bidders or any obligation to inform the affected bidder or bidders of the grounds for NIB`s action.

11. Notification of Award:11.1 Prior to the expiration of the validity, NIB will notify the successful firm in writing

by speed post/ registered letter or by fax, that his quotation has been accepted.

11.2 The notification of award will constitute the formation of the contract.

11.3 Upon furnishing of Performance Security by the successful bidder’s, NIB will promptly intimate each unsuccessful bidder/s and will release their EMD.

12. Signing of Contract:At the same time NIB notifies the successful bidder that his quotation has been accepted and NIB will send a work order to the bidder describing the works to be carried out and the same shall be returned duly acknowledged affirmatively by the bidder, as a token of acceptance and a contract agreement will be signed between both the parties.

13. Performance Security:13.1 Within 21 days of receipt of work order from NIB, the successful firm shall furnish

the Performance Security equivalent to 10% of the contract value in the form of Bank Guarantee (from any Nationalized/Schedule Bank) valid for 60 days beyond expiry of the contract paid, in the format as per APPENDIX- A or inform of Demand Draft/Pay Order in favour of “National Institute of Biologicals” payable at “Noida/Delhi”.

13.2 Failure of the contractor to comply with the requirement of contract shall constitute sufficient grounds for the annulment of the awards and forfeiture of the performance security, in that event NIB may get done the work at the risk cost of the Contractor.

14. Payment:14.1 Contractor will submit monthly Pre Receipted (affixing the Revenue Stamp) bills

dully supported with necessary check list, log sheets etc. along with the proof of deposit of ESI, PF and Service Tax (if applicable) etc. NIB will make payment to the contractor within 15 days after receipt of the bills and after deduction of applicable taxes/TDS etc.

14.2. If the check list, log sheets and instructions of the Institute do not shows proper compliance of works to be done by the contractor as per schedule; NIB will make suitable deduction from the contractor’s bills. If the contractor fails to maintain the operation and maintenance of services as per contract, in such event NIB will deduct actual cost incurred on this work plus 5% extra for departmental service charges.

14.3 In case of short deployment of manpower as given in the contract Institute will make suitable deduction from the bills on the basis of minimum wages as applicable.

14.4 The contractor shall be responsible for proper maintenance of decorum, punctuality, discipline and work out put. The personnel so deployed should be in a proper neat & clean well-dressed uniform. Providing of uniform etc to deployed staff shall be the responsibility of the contractor. If the staffs are not present in uniform, a penalty @ Rs 10/per day/per person will be levied and deducted from the bill. The choice of colour of the uniform will be decided by NIB.

14.5 Levy/Taxes payable by contractor - Sales Tax/ VAT or any other tax on materials in respect of this contract shall be payable by the contractor and National Institute of Biologicals shall not entertain any claim whatsoever in this respect.

All tendered rates shall be inclusive of all taxes and levies payable under respective statutes but exclusive of service tax which will paid at the applicable rate. However, pursuant to the Constitution (46th Amendment Act, 1982, if any

further tax or levy is imposed by Statute, after the last stipulated date for the receipt of tender including extensions if any and the contractor thereupon necessarily and properly pays such taxes/levies, the contractor shall be reimbursed the amount so paid.

15. Applicable Law:15.1 The contract shall be interpreted in accordance with the Laws of the Union of India.

Contractor shall be solely responsible for compliance of all labour laws, payment of fair wages/ salaries and allowances to his personnel that might become applicable under any new act, law or order of Government of State / Centre. NIB shall have no liability whatsoever in any manner. The Contractor has to show the proof of payment of fair wages to his workers as and when asked for the same by NIB.

15.2 Minimum wages at to be complied with - The contractor shall comply with all the provisions of the Ministry Wages Act, 1948, and Contract Labour (Regulation and Abolition) Act, 1970, amended from time and rules framed hereunder and other labour laws affecting contract labour that may be brought into force from time to time.

16. Resolution of Dispute: 16.1 All disputes arising out of this contract shall be referred to the sole arbitration of a

person selected by the contractor out of the panel of three persons nominated by the Director NIB, and his decision /award shall be final and binding on both parties. The Arbitration shall be governed under the Indian Arbitration Act 1996 or any statutory modifications or re-enactment thereof and rules made there under and for the time being in force shall apply to the arbitration proceeding under this contract.

17. Force Majeure:17.1 Notwithstanding the provisions stated above, the service provider shall not be

liable for forfeiture of its performance security, penalty or termination for default, if and to the extent that, its delay in performance or other failure to perform its obligations under the contract is the result of an event of force majeure.

17.2 For purposes of this clause, “Force Majeure” means an event beyond the control of the service provider and not involving the contractor/service provider’s fault or negligence and not foreseeable. Such events may include, but are not limited to, acts of the service provider either in its sovereign or contractual capacity, wars or revolutions fires, floods, epidemics, quarantine restrictions and freight embargoes.

17.3 If a Force Majeure situation arises, the contractor/ service provider shall promptly notify the NIB in writing of such conditions and the cause thereof. Unless otherwise directed by the employer in writing, the service provider shall continue to perform its obligations under the contract as far as is reasonably practical, and shall seek all reasonable alternative means for performance not prevented by the force majeure event.

ANNEXURE – IISCOPE OF WORK

The Scope of work as mentioned below are the minimum expected from the firm / agency / contractor apart from break down maintenance and any other work required for operation and comprehensive maintenance in proper way as per the operation and maintenance manuals of respective equipments and as per good engineering practices will be required to be done under this scope of work .Successful bidder will make Performa for recording the following minimum work schedule / parameters and show to NIB to ensure proper accomplishment of these tasks.

A. WORK TO BE DONE ON EVERY DAY BASIS:

1. The readings of the suction and discharges pressure, oil pressure, oil & gas level, suction and discharges pressure of pumps, Voltmeters & Ammeters etc shall be checked and recorded in the LOG-BOOK (provided by firm/agency/contractor) on hourly basis. Necessary action is to be taken if the readings are not normal.

2. To check all the electrical motors and their bearings for abnormal noise / heating and to take necessary action if found normal.

3. To check the water level in the make–up water tank in the Cooling Towers and check functioning of float valve. See proper function of the Cooling Towers.

4. To drain out water and clean the AC Plant Room / Cooling Towers/AHU`s etc as and when required / scheduled.

5. The inside ambient conditions i.e. DB, WB & RH of all the AHU`s shall be recorded on hourly basis. Filters of the AHU`s/ Fresh Air inlet etc are to be cleaned regularly as per schedule. The HEPA Filters installed at different places are to be given special attention.

6. The temperature of each room shall also be measured for any corrective action specially in Laboratory & Animal rooms area and these are to be recorded in LOG- BOOK.

7. To keep the machine rooms equipment such as chilling plant area, AHU`s, Exhaust fans neat and clean including their room floor, wall ceiling etc. in an orderly manner.

8. Any other work required by the equipment for proper functioning.

B. WORK TO BE DONE ON WEEKLY BASIS:

1. To check the refrigeration system.2. To clean all the strainers and the filters of the Cooling Towers. 3. To check the lugs/ thimbles/ terminal points of the electrical motor, switches,

starters single phase preventors and the indication lights .etc4. To check the alignment / looseness of all the belts driven equipment and rectify if

required.5. Filters of AHU`s/ Fresh Air inlet etc. are to be cleaned regularly as per services

maintenance schedule.

C. WORK TO BE DONE ON MONTHLY BASIS:

1. To check the gland / seal, coupling of Pumps and Cooling Towers.2. To check the solenoid valve, safety controls Mechanical, Electrical/ Electronics and

the inter-locking of the various equipment.17

3. To check and clean the nozzles of the Cooling Towers and to clean the basin and sump of Cooling Towers. Look for water escaping from sides or from overflow and take remedial measures.

D. WORK TO BE DONE AFTER EVERY THREE MONTH:

1. To check and lubricate (if required) the bearing of the motors and keep the proper record.

2. The check the foundation bolts of the Pumps and motors and to take the necessary action if required.

3. To check and reset the relays and controls, and to maintain the proper record. Carry out servicing of the main switches/ACB,s as required. To tighten all screws, nuts, bolts of the Electrical Power / control system.

4. Check the quantity of Air flow from various out lets in each Room/ Area as per drawing and do adjustments of dampers etc as and when required.

E. WORK TO BE DONE HALF YEARLY:

1. Clean water strainer in chilled water circuit. 2. Check the overload by measuring the amperage, check anti-recycle timer

and operation of the electrical interlock, and voltage across the compressor terminal.

3. To tighten the clamps of cooling tower blades. 4. Cleaning of starters of all motors during winter shutdown. 5. De-scale the condensers. 6. Check the functioning of all controls and reset if requires. 7. Clean the cooling tower fills.

F. WORK TO BE DONE YEARLY:

1. Check dampers operation for freeness in operation clean and lubricate. 2. Check for obstructions loose boards fallen insulation on air ducts. 3. Clean all wirings for loose contacts and rectify. 4. Clean baskets of pot strainers and “Y” strainers for AHU’s. 5. Drain all water from pipe lines and fill fresh water. Do not keep water lines

without water. 6. Change the oil in oil sump. Renew filter and check oil temperature control. 7. Inspect starter contracts are shield, transformer, and motor terminals,

check connection in starter, tighten motor terminal control circuit terminals. 8. Inspect, calibrate and adjust to original specification all safety and

operating controls including low temperature and high- pressure cut outs, motor protector, oil pressure control, and fan temp. control.

9. Chemical cleaning of cooling coils twice in a year during winter shutdown after six months.

10. Meggar all the motors & electrical panels during winter shutdown.

G. OTHER WORK:

1. Overhauling of Compressor/ chillers as and when required by the OEM`s engineer as per service schedule and obtaining their clearance / report (This work are under separate AMC contact).

2. Oil/ refrigerant to be provided as and when required for proper functioning of HVAC Plant systems.

3. Check electrical overload protection system and other electrical system.4. Any other requirement to keep the whole HVAC Plant systems in proper, healthy

running condition as per operation and maintenance manual of various equipments.

5. Validation/Calibration Certificates of all instruments to be submitted with NIB as its mandatory.

5. SPECIAL REQUIREMENTS:

A specialized HEPA filters have been used in the inlet air systems of the HVAC Plants of Training Animal House. Also three HEPA filters have been provided for filtering the supply air at Laboratory entrance. Nine more HEPA FILTER BOXES are in the radiations lab outlet air and five in the class 1,000 clean sterility/ Reference Standard labs of laboratory & Animal House. Special maintenance and clearing has to be done on it. These filters have to be changed as per schedule/ system requirement, as and when required.

At a minimum, the following tests should be performed:-

1. Hepa Filter Media2. Filter Frame Leak Test3. Air flow velocities, Air changes, Pressure differential.

It is recommended these tests be performed by a qualified technician who is the familiar with the methods.

After the initial certification and recommends that these tests of calibration/ Validation be recertified at a minimum on an annual basis and the firm/contractor will submit the calibration/validation reports to NIB for record.

ANNEXURE – III

General Terms & conditions of the contract for annual operation and non- comprehensive or comprehensive maintenance contract.

1. The tender is for proper Operation and Comprehensive Maintenance of whole HVAC Plant systems of (a) Laboratory & Animal House (b) Administrative Building & Cafeteria (c) Guest House and (d) Training Animal House. Also there is a Hot Water Generating and distribution system in the interim laboratory of the Administrative building. The list of major equipment of whole HVAC and Hot Water Generation & distribution systems are given in ANNEXURE–I.

The firm / agency/ contractor who wishes to quote are required to visit and examine the whole systems and satisfy themselves before submitting their offer and to apprise themselves about the conditions of equipments as well as minor items and equipment, which are accessories but not listed in ANNEXURE–I and are part of the complete, systems.

2. LOG-BOOK for recording of parameters related to HVAC Plant systems shall be provided and maintained by the firm/ agency /contractor showing the complete working and maintenance done on the HVAC Plant systems and it should be made available to the engineer-in-charge of NIB.

3. All maintenance materials such as Lube oil, Refrigerant / Gas, oil filter, fuel filter, electric contactor, indicating lamps, HRC fuse, relays and all spares of chillers, AHU`s different type of Air filters etc shall be provided by the firm / agency / contactor for each type of the HVAC Plant systems. All spares parts and materials shall be used genuine and of same make and type as installed and a minimum quantity of spares, refrigerants (R-22, R-123, R-134a) and materials for routine maintenance may be kept at site to minimize time of maintenance. The firm / agency / contractor has to keep all equipment well maintained for each HVAC Plant systems so as to give proper output at all times.

4. Tools and equipment required for proper operation and comprehensive maintenance for whole HVAC Plant systems with their Chiller units, AHU`s, Cooling Towers and allied accessories etc. shall be provided by the firm /agency /contractor.

5. Deployment of manpower:-At least one supervisor (HVAC) having

diploma in engineering with HVAC background, one Electrician (ITI certificate) shall be made available for the whole work. Further at least one operator and one skilled helper in each HVAC Plant systems of the Administrative building, Guest House and Training Animal House respectively will be provided. Also one supervisor (HVAC), one electrician, two operators and two skilled helpers having same qualifications as mentioned above for Laboratory & Animal House’s HVAC Plant system shall be made available in three shift (round the clock0 i.e. 24X7 mode for

operation and maintenance of the Chiller units, Air Handling Units (AHUs), Cooling Tower units, and electrical panels etc. during the individual Plant’s working hours. All of them should be technically qualified and well experienced to operate the systems and attend to repairs/ maintenance work of these systems. At least one helper also has to be provided for assisting them as and when required such as Cafeteria etc. Any other manpower required shall be made available by the firm/ agency/ contractor for proper functioning. Proper supervision of firm/ agency/ contractor’s senior engineers has to be provided to over see the whole work for the smooth operation and maintenance services as and when required but at least monthly which shall be recorded in the Log-Book.

However it may be required to operate the HVAC Plant system in the Guest House occasionally in three shifts including holidays particularly when the room is occupied by guest.

The following is the table of Minimum Manpower to be deployed at NIB for these works:-

6. Qualification of Manpower:-The contractor should deploy the manpower as the following qualifications:-

a) Supervisor diploma in mechanical with 2/3 years experience in operation and maintenance of HVAC system.

b) Operator cum mechanic ITI in AC or Mechanical with min. 3/5 year Experience in this filed).

c) Electrician ITI in electrician with min. 3/5 years experience in same field.

d) Helper – with 3 years experience in relevant field.

7. The contractor himself or his representative of at least Manager / Engineer level shall meet with NIB his nominated officer once a day and attend the office whenever called by him.

8. The HVAC Plant systems, which are installed in the Laboratory & Animal House and Training Animal House, will be required to run in General shift or three shifts (round the clock operation including Saturday, Sunday and

Public holiday etc) depending upon requirement as animals would be housed in these buildings and animals are essentially required to remain in the conditioned air.

The rates shall be quoted separately for all these HVAC Plant systems for single shift and round the clock operation as mentioned in ANNEXURE-V.

9. Care shall be taken so that the HVAC Plant systems do not lead to major breakdown. In the event of any breakdown, the same will be rectified immediately failing which such rectification will be done at the risk and cost of the firm/ agency/ contractor. Similarly, if any breakdown takes place due to negligence of firm/ agency/ contractor, the whole component has to replaced/ rectified to bring it to the original condition immediately.

10. The rates shall be quoted on monthly basis which will be multiplied by twelve to make it per year; Part of the month shall be paid on proportionate basis. The rates shall be all inclusive including taxes and duties etc.

 11. Rate should be quoted in figure as well as in words as per ANNEXURE–V. 12. The Director, NIB reserves the irrevocable authority to accept or reject any

tender in part or whole without assigning any reasons.

13. The rates at any stage once quoted shall not be withdrawn. The tenderer shall send the original tender document including blank ANNEXURE-V duly signed by them in each page in token of acceptance of all the conditions of this tender, Deviation if any and additional matters any be mentioned on a separate deviation sheet (ANNEXURE-IV) and enclose with the offer. Each deviation from conditions of tender document shall show the clause number of particular item of work, page no and the ANNEXURE No. so as to co-relate Major deviations may cause rejection of the offer.

14. No advance payment will be made at any circumstances. However, on successful completion of every month, payment will be released within 15 days from submission of bill.

15. No addition / alteration / deletion in the tender document is allowed. If certain clause is not accepted deviation may be given on separate deviation sheet (ANNEXURE-IV). If necessary more sheets can be added in ANNEXURE-IV.

16. Late tenders/ unsigned quotations may be rejected.

17. No correspondence will be entertained in this regard unless otherwise sought from tenderer by this office.

18. In case of a local firm/agency/ contractor, they may deliver/ submit the tender personally in NIB’s TENDER-BOX on or before the due date and

time. Postal delay for tender submitted by post shall also not be  accepted and all tender submitted in time only would be considered.

19. The services required are for initial a period of one year. The contract may

be extended on mutual consent subsequently. The contract may be terminated at any stage solely at the option of NIB with an advance notice of one month without assigning any reason.

20. Precaution against any fire hazards or other damages to Plant and equipment shall be arranged by the firm. NIB shall remain indemnified by the contractor from any encumberances /loss on this account.

21. The firm/ agency/ contractor shall fulfill the requirement of various law enforcing agencies / local authorities, such a Pollution control Board, Directorate of Electricity Safety etc by taking their approvals as and required.

22. Electricity and Water for this work will be provided by NIB free of cost. The

furniture for sitting purpose of their deputed staff should be provided by the firm/ agency/ contractor. 

23. The firm/ agency/ contractor will be responsible for the safety of their deputed staff during the performance of their duty at site.

24. In case any of staff is not found upto mark and not able to do work properly,

he will have to be changed as per the instruction of NIB. 25. In case of any problem with the equipment, the firm/agency/contractor’s

deputed staff will keep NIB informed immediately.

26. All disputes are subject to DELHI Jurisdiction. 27. The firm/ agency/ contractor shall keep the equipment well maintained,

neat and clean and adhere to the operation and maintenance schedule of various equipment given in the respective manuals. Upon placement of work order they will prepare the maintenance schedule and discuss the same with NIB`s engineer for its implementation. This may be revised from time to time as per the requirement.

28. The tender shall be kept valid for acceptance for a period of 120 days from the date of opening.

4. In case of Non-Comprehensive Maintenance contract all Routine working consumables like Cleaning cloth, Cleaning consumables, Brushes, Emery Paper, Lapping paste etc. and which are not going permanently into the installation will be deemed to be covered under the charges as quoted under column – 1 and will be supplied by the contractor to his workmen.

5. Director, NIB has the authority to periodically appoint Technical Auditor or some other agency to evaluate the maintenance work done by the contractor and recommendations made thereof for compliance in letter and spirit. This is primarily to ensure that the Reliabilty of the system is not compromised with due to lack of Maintenance.

6. Formula for Evaluation of the Bids:In case NIB decides to award the contract on Comprehensive Basis then the Works will be awarded based on the charges as quoted in Column –2 .

In case NIB decides to award the works for Operation and Non-Comprehensive Maintenance then the following formula will be used to arrive at the most competitive bid:

Total O& M Charges = Charges as in Row6/ Column 1 + % as in Row 7x(Charges as in Row6/ Column 2 minus Charges as in Row6/ Column 1)

For Example:-

If NIB decides to place the order for operation & non-comprehensive maintenance i.e Supply of spares to NIB Account, then the Lowest Bid will be evaluated as below:

Let the total, (as in Row 6 of the above table) of the amount quoted by you as in Column 1 towards operation & non-comprehensive maintenance be Rs 2.0 lacs and the amount quoted by you as in Column 2 towards operation &

comprehensive maintenance be Rs 4.6 lacs. Let the % quoted by you as in Row 7 of the above Table be 20%. Then as per the above formula the:-

Total Evaluated O&M charges for Operation and Non-Comprehensive Maintenance where the Spares will be procured by you on need basis =

Rs2.0 lacs + 20% of Rs(4.6- 2.0) = Rs 2.52 Lacs. This figure will be compared for all the bidders to arrive at the most competitive bid.

7- This guarantee will not be discharged due to the change in the constitution of the Bank or the Contractor(s).
