LICENSING SUB-COMMIITTEE – SUMMARY OF DECISIONS Licensing Sub-Committee – Thursday 26 February 2015 10.00am Tesco, Basement And Ground Floor, 33 Villiers Street, WC2 (St James’s Ward / not in stress area) – The Applicant company applied for a new premises licence with off-sales Monday to Saturday 08:00 to 23:00 and Sunday 10:00 to 22:30. The Applicant’s Representative wished to emphasise that the ‘Tesco To Go’ would not be a traditional supermarket. It was much smaller and fewer types of alcoholic drinks were available. The Police and Licensing Inspector had particular concerns about the sale of alcohol at this location including as a result of street drinking by rough sleepers. The Sub-Committee shared these concerns and whilst granting the licence for the hours applied for, attached a number of conditions to ensure the licensing objectives were not undermined. These included that there would be no self-service or self-checkout of alcohol on the premises, a personal licence holder would be on the premises at all times, no single cans of beer or ciders would be sold at the premises and there would be strict limits on the sale of super-strength alcohol. In addition the Applicant would be required to regularly assess the need for the use of SIA security guards at the premises, taking into account the views of the Police. Fresco, Basement Front And Ground Floor, 25 Westbourne Grove, W2 (Lancaster Gate Ward / Bayswater Stress Area) – The Applicant applied for a new premises licence with late night refreshment and on-sales of alcohol. It was clarified during the hearing that the Applicant was proposing to operate within the Council’s Core Hours policy (a terminal hour of 23:30 Monday to Thursday, midnight Friday to Saturday and in the case of on-sales 22:30 on Sunday). The Applicant had agreed the conditions proposed by Environmental Health and the Police, including the Council’s model restaurant condition. The capacity would be 30 and all licensable activities would be restricted to the ground floor. The Police had withdrawn their representation and Environmental Health’s and South East Bayswater Residents’ Association’s concerns had been addressed by the proposed hours and conditions. The Sub-Committee granted the application. Pall Mall Fine Wines, 6-8 Royal Opera Arcade, SW1 (St James’s Ward / not in stress area) – The Applicant applied for a variation of the premises licence with a proposed extension of two and a half hours in respect of the terminal hour on Monday to Saturday until 23:30. The Applicant also applied for Core Hours on Sunday. There were three representations from businesses objecting to the application. The Applicant advised that the landlord of the Arcade provided the necessary twenty four hour a day security which was of concern to the businesses. The Sub-Committee noted that the Applicant had agreed Environmental Health’s proposed conditions and Members amended one of these so that patrons leaving the premises to smoke would not be able to take any drinks or open containers with them. Members considered that the conditions attached to the licence promoted the licensing objectives. The conditions included there being a Challenge 25 proof of age scheme, waiter or waitress service for the supply of alcohol and licensable activities permitted on the ground floor only. The application was granted without prejudice to any concerns the tenants might have with how the landlord would run the arcade such as the operating of the gates during the later hours.

1)To increase the capacity of the premises to 175 including staff and as such amend condition 37 to read: "the maximum number of persons permitted on the premises at any one time, including staff, shall not exceed 175 persons". 2)To amend condition 25 of the premises licence, which currently states "All sales of alcohol for consumption off the premises shall be in sealed containers only and shall not be consumed on the premises" to read: "All sales of alcohol for consumption off the premises shall be in a sealed container and not consumed on the premises save for persons seated outside the premises before 9pm" 3)To add further conditions to the premises licence to promote the licensing objectives, as detailed in section M of the application from, and in accordance with the enclosed track changed licence. 4)To vary the existing plans of the premises to regularise minor changes to layout and in accordance with the proposed condition 39, as shown on the plans attached to this application.
