This is to give notice that the City of La Feria has conducted an evaluation as required by Executive Order 11988, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management, to determine the potential affect that its activity in the floodplain and wetland will have on the human environment for the La Feria Flood and Drainage Improvement Project, Contract No. DRS210089 Work Order #21050; GLO No. 12-211-00-5511 funded under the Texas Community Development Block Grant Disaster Recovery Program to be paid with a portion of the total grant amount for this project of $18,474,242.

REQUEST FOR RELEASE OF FUNDS

On or about February 11, 2013 the City of La Feria will submit a request to the General Land Office for the release of CDBG Program for 2008 Supplemental Disaster Recovery Funds under Section 104(f) of Title I of the Housing and Community Development Act of 1974 as amended, to undertake the above listed project.

As a result of Hurricane Dolly on July 23, 2008, the City sustained flooding that resulted in drainage infrastructure failure. The existing drainage system infrastructure failed to function because the current systems were unable to convey the volume of water generated during Hurricane Dolly. The failure of the drainage systems to function threatened the public health, safety, and welfare of all served by these facilities due to flooding. The City is in need of adequately-sized drainage infrastructure to reduce flooding.

The City of La Feria is proposing to make improvements to existing channels (reshaping and regarding) and storm sewer system (s); perform road reconstruction to widen the existing eighteen-foot to twenty-foot (18 ft.-20 ft.) roadway to approximately thirty six feet (36) with curb and gutter; and perform site work associated with the construction. Work includes the following: 1.) Excavate new ditches as needed along existing roadways; 2.) Regrade existing ditches; 3.) Install reinforced Concrete Pipe (RCP), High Density Polythylene (HDPE), Polyvinyl Chloride (PVC), and steel and aluminum culverts and casings ranging in size from eighteen to sixty inches (18 in.-60 in.); 4.) Install new culverts at roadway crossings (round, box, or arch profiles) with headwalls, wingwalls, concrete canastas, riprap, energy dissipaters, and control gates; 5.) Cut and replace pavement, install rail guards, make utility adjustments as needed, perform materials testing, and provide other associated appurtenances. Both channels will receive culvert improvements from the outfall to the upstream tributary improvements.

A portion of project activities will occur within approximately18.26 acres of Zone AH within the 100-year floodplain. No adverse environmental impact is anticipated from the project. No alternative is feasible. The City of La Feria has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values:

The City has considered the “no project” alternative of not pursuing to make the improvements to existing channels (reshaping and regarding) and storm sewer system (s); not perform road reconstruction to widen the existing eighteen-foot to twenty-foot (18 ft.-20 ft.) roadway to approximately thirty six feet (36) with curb and gutter; and to not perform site work associated with the construction. However to purse the “no project:” alternative would be to not improve the drainage infrastructure. If the infrastructure drainage capacity is not increased, flooding will continue to occur therefore, pursing the “no action” alternative is not a practical option.

An alternative the City did consider to purse was to install a pump station however, should power become lost during a disaster the pump would not be operational. This would leave the drainage system to again fail to function which would threaten resident’s public health and safety. Installing a pump station was not considered a practical or feasible alternative to purse.

The best available option the City of La Feria has considered to pursue to improve its drainage infrastructure to reduce flooding by making improvements to existing channels (reshaping and regarding) and storm sewer system (s); perform road reconstruction to widen the existing eighteen-foot to twenty-foot (18 ft.-20 ft.) roadway to approximately thirty six feet (36) with curb and gutter; and performing site work associated with the construction. Flood and drainage improvements would improve the infrastructure drainage capacity.

FINDING OF NO SIGNIFICANT IMPACTLa Feria has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at City Hall, 115 E. Commercial Ave. La Feria, Texas 78559-5002, Attention: Sunny K. Philip, City Manager, and may be examined or copied weekdays Monday through Friday from 8:00 A.M. to 5:00 P.M.

PUBLIC COMMENTSAny individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments addressed to Sunny K. Philip, City Manager, located at City Hall, 115 E. Commercial Ave. La Feria, Texas 78559-5002. All comments received by February 7, 2013 will be considered by the City prior to authorizing submission of a request for release of funds. Commenter’s should specify which part of this Notice they are addressing.

RELEASE OF FUNDS

The City of La Feria certifies to the General Land Office that Mr. Philip in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Office’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows La Feria to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

The General Land Office consider objections to its release of funds and La Feria certification received by March 4, 2013 or for a period of fifteen days following the actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of La Feria; (b) La Feria has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by GLO; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the General Land Office, Regulatory Officer at 301 Congress Avenue, Suite 600, Austin, Texas 78701. Potential objectors should contact GLO Disaster Recovery Program to verify the actual last day of the objection period.

Competitive Sealed Proposals for the purchase of Water Meters, Encoder Registers, Meter Radio Transmission Units (MTU), and the purchase and installation of other equipment all required for the development of a AMR/AMI (automatic meter reading) system, will be received at the City of La Feria, City Hall, 115 E. Commercial Ave., La Feria, TX 78559 until 2:00 PM, February 14, 2013.

Contract Documents may be examined and/or obtained at the office of Sigler, Winston, Greenwood & Associates, SWG Engineering LLC., 611 Bill Summers Intl. Blvd., Weslaco, TX 78596.

A payment of Fifty Dollars ($50.00) in cash, bank or certified check payable to the Engineer will be required for each set of the Contract Documents. No refund will be made.

Each Proposal shall be submitted in a sealed envelope bearing the name of the Project in accordance with the Instruction to Bidders and shall be accompanied by a Bid Security or a bank or certified check in the amount of 5% of the bid. Proposers may not withdraw their proposal for a period of Ninety days (90), excluding Saturdays, Sundays and legal holidays after the actual date shown above for the receipt of the proposal. The Proposer firm must be able to furnish a 100% Performance Bond, a 100 % Payment Bond, and Warranty Bond with a surety company acceptable to the Owner together with the signed Contract when the contract is presented to the owner.

The Owner reserves the right to waive any informality in or to reject any or all Proposals if deemed to be in its best interest. Award will be made to the lowest responsive, responsible proposer as determined from their proposal as well as the written and verbal response from the information section of the specifications.

The contract is contingent upon release of funds from the Texas Water Development Board (TWDB). Any contract or contracts awarded under this Invitation for Proposals are expected to be funded in part by financial assistance from the Texas Water Development Board. Neither the State of Texas nor any of its departments, agencies, or employees are or will be a party to this Request for Proposal or any resulting contract.

This contract is subject to the Environmental Protection Agency’s (EPA) “fair share policy’, which includes EPA-approved “fair share goals” for Minority Business Enterprise (MBE) and Women Business Enterprise (WBE) firms in the Construction, Supplies, Equipment, and Service procurement categories. EPA’s policy requires that applicants and prime contractors make a good faith effort to award a fair share of contracts, subcontracts, and procurement to Minority Business Enterprise and Women-Owned Business Enterprise firms. Although EPA’s policy does not mandate that the fair share goals be achieved, it does require applicants and prime contractors to demonstrate use of six affirmative steps. The current fair share goals for the State of Texas are as follows:

Any contracts in excess of $2,000.00 for construction, alteration or repair (include painting and decoration) and funded under the Clean Water State Revolving Fund and Drinking Water State Revolving Fund programs shall include the Mandatory Davis-Bacon Act Contract Conditions.

A Pre-Proposal conference is scheduled for January 29, 2013, at 10:00 AM, City of La Feria City Hall at 115 E. Commercial Ave., La Feria, 78559. Attendance is optional, however please attend if possible.

The Contract will be awarded based on the lowest Proposal received from the lowest responsive, responsible, qualified firm who submitted a complete Proposal including all requested information on or before the time and date, and at the place stated in the Invitation for Proposal. The term “lowest responsive, responsible, qualified firm” as used herein shall mean the firm whose quotation is the lowest of those firms, possessing the skill, ability, and integrity necessary to the faithful performance of work and who provides the equipment specified or its exact equivalent to obtain the desired results stated in the specifications.
