difficulties in accessing the Draft EIR and associated technical appendices and requests an extension to the Draft EIR public review period.

Upon receiving notification of complications accessing the Draft EIR, County staff immediately employed several corrective actions to resolve difficulties in retrieving the information. It should be noted that these actions are not as a result of failure to comply with §15105 of the State CEQA Guidelines related to public review and distribution, rather, reflect a good-faith effort by the County to provide alternative access to the Draft EIR for those who raised concerns. Planning Staff evaluated requests for an extension of the public review period and concluded that an extension of the public review period to December 29, 2017 was appropriate. Response 23-b: The commenter asserts opinions regarding the necessity of the proposed project and

states a concern that the private road serving his property could become an access point for the project. Although the commenter doesn’t note a specific road, based on this and other comments it is presumed to be Northgate Drive.

The project proposes two access locations, one accessing Boyle Road, south of the site, and the other accessing Old Alturas Road, north of the site. The Draft EIR does not describe or analyze if any of the access points to and from the project site have legal access rights. This is not an environmental concern that needs to be addressed. Pursuant to State CEQA Guidelines §15358(b), effects analyzed under CEQA must be related to a physical change in the environment. Therefore, it is not appropriate for discussion in the Draft EIR.

It is important to note that since preparation and circulation of the Draft EIR it has been determined that the proposed emergency access as Northgate Drive is not required and therefore has been omitted from the proposed project. No further response is necessary.
