The Chairman entertained a motion from the floor duly seconded to suspend the
rules to allow the public to address the Legislature with respect to agenda items
Holly Whalberg City of Poughkeepsie resident spoke in opposition to demolishingthe Nelson House Annex
Harvey Flad 115 Academy Street Poughkeepsie spoke to encourage the
Legislature to endorse that the space left by the demolition of the Nelson House
would retain portions of the current buildings to make a statement of the historythat took place on Market Street
Virginia Hancock 26 Loockerman Avenue Poughkeepsie requested that
preservation specialists be brought in to review the Nelson House Annex building
Nancy Cozeen former City of Poughkeepsie Mayor spoke in support of the rich
history of the City of Poughkeepsie
Zi Sanchez Yonkers architect specializing in historic preservation and
sustainable communities stated that she had issues with the report prepared bythe county specifically that nowhere in the report did it say that the building was
no longer useable She added that the report did not say that the building was in
eminent danger of collapse but was still deemed not worthy of saving She urgedthe Legislature to use $500000and remove the hazardous materials so the
county would have 26000 square feet of clean building space and not an emptylot
Carol Madrid City ofPoughkeepsie spoke on using the Nelson House Annexto
house homeless people and allowing people that were out ofwork to renovate the
building
Anthony Pratz encouraged the Legislature to renovate the Nelson House Annex
into a homeless shelter
Susie Buck Innis Avenue Poughkeepsie spoke about the beauty of the City of
Poughkeepsie and urged the Legislature to not support the demolition of the
Nelson House Annex
No one else wishing to be heard the Chairman entertained amotion from the
floor duly seconded to resume the regular order ofbusiness
Chairman Rolison entertained amotion to approve the September 10 minutes
The September 10 2012 minutes were adopted
At this time Resolution No 2012224 Confirming Appointment of William P
Tatum III as County Historian that was pulled in September was considered

GRANT APPLICATION FOR FEDERAL FISCAL YEAR 2012 WITH THE
FEDERAL TRANSIT ADMINISTRATION FOR FAREBOX EQUIPMENT
Legislators Hutchings Miccio Borchert Bolner and Perkins offer the followingand move its adoption
WHEREAS the Federal Transit Administration is authorized to make grants formass transportation projects and
WHEREAS the contract for financial assistance will impose certain obligationsupon the applicant including provision by it of the local share of project costs and
WHEREAS the Federal Transit Administration requires in accord with the
provisions of Title VI of the Civil Rights Act of 1964 that in connection with the filing of an
application for assistance under the Urban Mass Transportation Act of 1964 as amended the
applicant give an assurance that it will comply with Title VI of the Civil Rights Act of 1964 and
the Federal Transit Administration requirements thereunder and
WHEREAS it is the goal of the applicant that minority business enterprises be
utilized according to the goals of the Disadvantaged Business Enterprises DBE program in
connection with this project and that definite procedures shall be established and administered to
ensure that minority businesses shall have the maximum feasible opportunity to compete for
contracts when procuring contracts for construction supplies equipment or consultant and other
services and
WHEREAS authority is requested to submit a grant application to the Federal
Transit Administration in the amount of$220000 for capital assistance pursuant to Section 5309for State of Good Repair grant funds for a capital project to purchase farebox equipment and
software to modernize fareboxes on LOOP buses in 2012 now therefore be it
RESOLVED that the County Executive or his designee be and is herebyauthorized to execute and file an application with the Federal Transit Administration for Section
5309 capital project funds under the Urban Mass Transportation Act of 1964 as amended and to
furnish such additional information as the Federal Transit Administration may require in
connection with the application and be it further
RESOLVED that the County Executive or his designee be and is herebyauthorized to execute such grant agreement arising from such application on behalf of Dutchess
County with the Federal Transit Administration to aid in the financing of capital projectspursuant to Section 5309 of the Urban Mass Transportation Act of 1964 as amended and be itfurther
RESOLVED that the County Executive or his designee be and is herebyauthorized to set forth and execute affirmative action minority business policies in connection
with the projects procurement needs and be it further
RESOLVED that the County Executive or his designee be and is herebyauthorized to receive on behalf of the County financial assistance for capital projects pursuant to
Section 5309 of the Urban Mass Transportation Act of 1964 as amended

COUNTY BUDGET AS IT PERTAINS TO MASS TRANSPORTATION ET5680
LEGISLATORS Hutchings Bolner Miccio Borchert and Perkins offer the followingand move its adoption
WHEREAS a Resolution to authorize the filing of a grant application with the Federal
Transit Administration for Section 5309 State ofGood Repair grant funds under the Urban Mass
Transportation Act of 1964 as amended is being submitted concurrently with this resolutionand
WHEREAS the Commissioner of Planning and Development will be advised that the
Federal Transit Administration will grant funds to Dutchess County in the sum of $220000under Section 5309 State of Good Repair to purchase farebox equipment and software to
modernize fareboxes on LOOP buses in 2012 and
WHEREAS the State matching portion ofthis grant is $27500 and
WHEREAS State MassTransportation Capital Aid is available to fund projects approvedby the Commissioner ofTransportation and
WHEREAS Dutchess County desires to advance the project by making a commitment of
advance funding ofthe non-localshare and funding of the full local share ofthe costs associated with
this project and WHEREAS
it is necessary toamend the 2012 Adopted County Budget to provide for receipts
and expenditureof grant funds now therefore be it RESOLVED
that the County Executive beand he is hereby authorizedtoexecute any necessary
agreements arising from such application on behalfofDutchess County with the New York
State Departmentof Transportationtoaid in the financingof this project and beit further RESOLVED
that the CommissionerofFinance isauthorized empowered and directed to

FOR USE ON COUNTY HIGHWAY SYSTEM Legislators
Hutchings Bolner Borchert Miccioand Perkins offer the following and moveits adoption WHEREAS
Article6Secfion 135-a ofthe New York State Highway Law provides authorization forthe County to empower the Commissioner of Public Works to enter into agreements with
designated towns for the purpose of renting town-owned snow andice control equipment for use
of the County Highway System and WHEREAS it is
inthe best interest of the County and the safety and transportation needs ofresidentsand usersofthe highways in outlying areas of the County to enter into such agreements for the
rental of equipment as may be needed to supplement existing County government forces andresources and WHEREASacopy
of the proposed InternTUnicipal Agreement forthe Provision of Snow Removal and
IceControl Services isannexed hereto and WHEREAS the Commissioner
of Public Workshas determined and recommended based onexistingneeds that it is essential to rent such snow and ice control equipment from various towns withinthe County for said public safety purposes and atsuch terms and rental rates as maybe determined
and prescribedbythe Department of Public Works now therefore be itRESOLVED with the
approval ofthis Legislature that the Commissioner of Public Worksis hereby
authorized to arrange for such equipment rentals supervise these activities and order payment forsuch rental of equipment as may be necessary for these purposes during the 2012-2013 winter season
andbeit further RESOLVED that the County
Executive is authorized to execute Intermunicipal Agreements for the Provisionof Snow Removal and Ice Control Services in substantially the same form as annexed hereto

WHEREAS
by Resolution No 207 of 1992 this Legislature authorized an Intermunicipal
Agreement between theCounty of Dutchess and the Town ofBeekman for the construction
and maintenanceofa sand/salt storageand handling facility inthe hamlet area of the Town
ofBeekman and WHEREAS that
Agreement expiredinAugust 2007 and pursuant toits terms by Resolution
No 207167 was amended and extended for anadditional 15-year term expiringinAugust 2022and WHEREAS the parties
desire to further amend this agreement toprovide for the construction of an
addition to the sand/salt storage and handlingfacility and WHEREAS theproposed amendment
agreement will benefit both the Town and the County now
therefore beit RESOLVED that the County
Executive is hereby authorized to execute in substantially the same form
as annexed hereto the proposed amendment agreement to the Intermunicipal Agreement between the
Countyof Dutchess and the TownofBeekman for the sand/salt storage and handling

WHEREAS the Sheriff has advised that the New York State Division of CriminalJustice Services has awarded the County an Edward Byrne Justice Assistance Grant JAG in the sum
of $7000 to purchase traffic scene security and safety supplies for securing and controlling crime
scenes to protect the citizens of Dutchess County through the Sheriffs Law Enforcement programsand
WHEREAS it is necessary for this Legislature to authorize the execution of the grantagreement and to amend the 2012 Adopted County Budget to accept funds and provide for the receiptand expenditure of said funds now therefore be it
RESOLVED that this Legislature hereby authorizes the County Executive to accept the

Dutchess County Jail is at an all time high and there is a lack of available space inmates housed
in other counties is continuing to rise and based on the current trend additional funds are needed
to ensure payments to these counties and
WHEREAS it is projected that the sum of$1500000 will be needed to cover
these expenses through the end of 2012 and

AMENDING THE 2012 ADOPTED COUNTY BUDGETASIT PERTAINS
TO THE DEPARTMENTOFSOCIAL SERVICES Legislators
Bolner Serino Horton and Flesland offer the following and move its adoption
WHEREAS
the County of Dutchess hassecured from New York State through theadvocacy of State Senator Stephen Saland grant funding to target the societal problemsof domestic
violence and gang related crime and WHEREAS
the grant funds will assist Dutchess County to better beable to address
systemic criminal justice issues that result in overcrowdingof the Countysexisting Jail facility
increasing demands on departments such as Probation Public Defender District Attorney
and the Sheriff s Office all while enhancing the services County government provides toassist crime victims and WHEREAS
the funding will come from New York State specifically the Division
ofCriminal Justice Services DCJS in the amounts of1 $150 000for partnership withnonprofit service provides to offset costs associated with the personnel and resources necessary
tomeet the legal needs ofthose involved indomestic violence cases2$250 000for partnership
with nonprofit service providers to train law enforcement first responders and magistrates
to identify and respond to domestic violence situations and3 $100 000for anti- gang
programs offered by the County sOffice of Probation and Community Corrections in partnership
with Catharine Street Community Centera nonprofit service providerand WHEREAS
it is necessary for this Legislature to authorize the execution ofthe grant
agreements and to amend the 2012 Adopted County Budget to accept such funds and provide
for the receipt and expenditureof said funds now thereforebe it RESOLVED
that this Legislature hereby authorizes the County Executive to accept
the grant awards from New York State in connection withthe above projects and further authorizes
and empowers the County Executivetoexecute said grant agreements on behalfofthe County
of Dutchessand be it further RESOLVED
that the CommissionerofFinance ishereby authorized empowered anddirected toamend the 2012 Adopted County Budget as follows

WHEREAS the Dutchess County Health Department is mandated by New York
State Department of Health through Public Health Law Article 6 to wnduct a CommunityHealth Assessment CHA which involves implementation ofacounty-widesurveyand WHEREAS
the Commissioner ofHealth has advised that Health Quest will commit
upto $10 000St Francis Hospital will contribute $10 000and The Foundation for Community
Healthwill contribute $5000towards thisproject and WHEREAS
the Commissioner ofHealth requests authorizationtoaccept said funding
donations andto appropriate said funds for expenditure and WHEREAS

ACCEPTING PAYMENT BY CREDIT CARD TO SATISFY
FINANCIAL OBLIGATIONS OWED TO THE COUNTY
LEGISLATORS Borchert and Miccio offer the following and move its adoption
WHEREAS pursuant to the authority granted it in Resolution No 2010166Dutchess County authorized the acceptance of credit card debit card and automated clearinghouse ACH banking transactions for payments to Dutchess County Departments for fees and
services and
WHEREAS pursuant to the authority granted it in Resolution No 2010166 all
County credit card payment or electronic interest payment programs shall be operated in
accordance with industry standards at no expense to the County and
WHEREAS General Municipal Law Section 5c provides that it shall be the
option of the governing board of the local government to require as a condition of acceptingpayment by credit card that such person offering payment by credit or charge card pay aservice
fee to the local government not exceeding costs incurred by the local government in connection
with the credit or charge card payment transaction including any fee owed by the local
government to the financing agency or card issuer arising from that transaction now thereforebe it
RESOLVED that the County Executive be and is hereby authorized without the
necessity of further legislative action to permit departments of Dutchess County to charge a
service fee as acondition ofaccepting payments by credit or charge card and be it further
RESOLVED that such service fee shall not exceed costs incurred by the Countyin connection with the credit or charge card payment transaction including any fee owed by the

Legislators Traudt and Flesland offer the following and move its adoption
WHEREAS the Department ofPublic Works is proposing to demolish the existingremains ofthe Nelson House and Nelson House Annex located at 28 Market Street along with the
attached building located at 44 Market Street in the City of Poughkeepsie and extend its adjacentparking lot into the building footprint and
WHEREAS the Department of Public Works has prepared and reviewed a full
environmental assessment form which concludes that the proposed project 1 constitutes an unlisted
action pursuant to Article 8 ofthe Environmental Conservation Law and Part 617 ofthe NYCRR
SEQRA and 2 will not have asignificant effect on the environment and
WHEREAS it is the purpose ofthe Legislature in adopting this resolution to adoptand confirm the findings ofthe Department of Public Works and
WHEREAS a true copyof the full environmental assessment form and the NegativeDeclaration reflecting the finding ofnon-significanceareannexed heretoand made apart hereof now therefore

Part 1 D Informational details
There are three separate but attached structures that are to be demolished as part of the
involved project
The largest component consists ofthe Nelson House Annex that was constructed in or
around 1930 It is asix-storystructure plusbasement and measures approximately SSftX 80ft
in plan This componentisa steel-framed structurewith concrete floor slabs and exterior brick
masonry wallsIthas a defunct elevator anexterior metal stair and both wood and
metal double hung windows The remains
ofthe Nelson House isthe second component which was constructed inthe late nineteenth
centuryItwas originally afoot-story structurebutafifth-story was added whenthe1930
component was constructed Itmeasures approximately 23ft X45ftinplan and is
a wood framed structure with load bearing masonry walls It contains aluminum replacement hopper windows
withonlyone remaining original double hung windowThe County willsalvage and retain this window as well as the plaque dedicated to the historyofthe site The smallest structure located
at44Market Street is aone-story plus basement wood framedstructure with load bearing
masomy wallsandasingle wood framed window It measures 16ftX60ft in
plan Around 1970 the remains of
the Nelson House and its Annex were converted from an oldhoteltoprovide office space
for Family Court Supreme Court Public Defender Probation and the Youth BureauComplaints from judges department heads and concerns from the CSEA regarding
thesafety of this facility led toa phased migration from the Annex tomoreappropriate space beginning in 1988 and culminating in1996 At that time theState
Office of Courts had declared these buildings the worst inthe State occupied by the Court System
Thebuildings have stood vacant since December 1996 whenall occupants were relocated
due to reasons of life safety building code compliance ADA accessibility antiquated and
failing building systems anda lackoffunctional space usage The two
structures are separated by inoperable weight-activated sliding fire doorsatitsconnectionsSome floor levels are not aligned between the two structures and are connected by steps
The Nelson House Annex was originally designed asahotel and hasnoadaptive re-use potential for County government offices

The involved structures have reached an extreme state of disrepair A 1998 City of
Poughkeepsie water main break flooded the basement ofthe Nelson House Annex with
five feet ofwater and rendered the electrical system inoperable There is extensive water
damage throughout the structures stemming from this water main break as well as from
roofleaks and infiltration through windows and saturated masonry This prevented the
County from maintaining the building arid resulted in the accelerated deterioration ofthe
Nelson House Annex None of the building systems electrical HVAC plumbing etchave been operational since this time The lack of heating or ventilation in this vacant
building for more than fifteen years resulted in abuild-upof moistureand humidity whichcaused severe damage to the interior spaces as well as the roof and exterior masonry
skin The interior spaces are covered indebris The
constant water infiltration andlack of ventilationxesultedin extensive mold growth throughouttheNelson House Annexhi August 2007 due to the reported mold conditions
and lrnown asbestos hazards the Dutchess County CommissionerofHealth issued
a directive that precluded entry into the Nelson House Annex by anyone without the
required New York State Departmentof Labor asbestos awareness trainingand without
proper respirator protection and associated medical clearance forthe same Since
1988 Dutchess County has commissioned fourstudies ofthe remainsofthe Nelson House
and its Annex Each study reported similar conclusions and recommended theremoval
or demolitionofthe remainsofthe Nelson House and its Annex In 2012 the County
commissioned another Building Conditions Assessment Report that indicated significant
structural deficiencies existed inthe involved buildings The CountysCode Enforcement
Officerhasrecently declared the buildings unsafe unfit for human occupancy
and that they posea public safety concern Thus he has issueda condemnation
orderfor the structures and recommended tothe County Executive thatthese
structures bedemolished assoon as practicable In response Dutchess County ExecutiveMarcusJ Molinaro signed Executive Order4of 2012 declaring the existenceof
an emergency affecting thelife health or safety of inhabitantsofDutchess County withrespectto the structures locatedat28 and 44 Market Street

The involved site originally was home to Stephen Hendriclcsons Inn and later the Forbus
House In 1876 the Nelson House was erected where those building previously stood
A substantial part of that four-storystructure was demolished an additional floorwas added
and substantial renovation donewhen the Nelson House Annex was erected around 1930
Most ofthe remaining Nelson House was demolishedinthe 1960sto facilitate the construction
ofthe Dutchess County Office Building The balcony where Franklin Delano
Roosevelt delivered speeches from was demolishedatthat time Since 1930 significantrenovationby the County was done in 1972 to convert the buildingto makeshift
offices and courtrooms Nearly all of what isleft standing on Market Street isthe
circa 1930sAnnex which hasno functionalor operational value tothe County In
1988 and 1989 the County funded reports on the conditionsofvarious county buildingsprepared byEinhorn Yaffee Prescott EYP EYP isa firm which isinternational
recognizedforits historic preservation workIn its report EYP cited certain
county buildings as quality buildingsof historical significancebut excluded the involved
buildingsas having any architectural significance Historically theynoted that virtually
nothing remained from the original 1876 construction To
commemorate thehistory of the involved site and the Nelson House the County will retain
and display the only remaining original double hung window and lintel from the oldest
remaining portionof the buildings and the plaque and hitching post dedicatedtothe
long history of occupation thesite by the Nelson House and previous inns and hotels The
mechanical demolitionofthe involved structures will ensure that there are no impacts
off the site The demolition process will contain all debris onsite and the wetting
of the structure and resulting debris will keep dust emissionstoa minimum Impact

Robert Balkind Acting Commissioner ofPublic Works spoke regarding the
environmental finding for the demolition of the Nelson House Annex He stated
that the Nelson House Annex demolition would be by mechanical demolitionremoving the building piece by piece with the entire demolition pile beingtreated as asbestos affected because there would be no prior asbestos
abatement He added that the air quality would be continually tested with the
safe disposal of all material He added that the property was not designated as
an historic site and that the City ofPoughkeepsie had issued a Certificate of
Appropriateness to demolish the structure He stated that the hitching postplacard and various brick work would be salvaged
Legislator White referred to Zi Sanchezscomments that it was not in eminent
danger ofcollapse
Robert Balkind stated that the structure was condemned because of the 4 or 5
studies that had been done He added that it wasuninhabitable it its current
state and that if the building went through another freeze/thawcycle there was risk
of stone falling to the ground He also added that there was an extensive mold
problem Legislator
White questionedifthe county could waitamonth and try to work with
Zi Sanchez whowas a licensed architect in preservation renovation Robert
Balkind stated that waiting wasnot an option Legislator
Tyner asked for Robert Balkindsguarantee thatno one would get sickRobert
Balkind stated that he would not guarantee thatbut added that all of the
water used tocontrol dust was required to be removed through state regulated
methods and all state requirements would befollowed Legislator

A RESOLUTION AUTHORIZING THE ISSUANCE OF $1767500 SERIAL
BONDS OF THE COUNTY OF DUTCHESS NEW YORK TO PAY THE
COST OF THE DEMOLITION OF STRUCTURES OWNED BY DUTCHESS
COUNTY LOCATED AT 28 AND 44 MARKET STREET CITY OF
POUGHKEEPSIE NEW YORK IN AND FOR SAID COUNTY
WHEREAS all conditions precedent to the financing of the capital project hereinafter
described including compliance with the provisions ofthe State Environmental Quality ReviewAct
as a Type IIAction have been performed and
WHEREAS it is now desired to authorize the financing of such capital project NOW
THEREFORE
BE IT RESOLVED by the County Legislature ofthe County of Dutchess New York as
follows
Section 1 The cost of the demolition of structures owned by Dutchess County
located at 28 and 44 Market Street City of Poughkeepsie New York in and for the County of
Dutchess New York including incidental expenses in connection therewith is hereby authorized
at a maximum estimated cost of$1767500 said buildings being no longer of any use or value
or having become dangerous or detrimental to human life health or safety
Section 2 It is hereby determined that the plan for the financing of the aforesaid
maximum estimated cost is by the issuance of$1767500 serial bonds of said County hereby
authorized to be issued therefor pursuant to the provisions ofthe Local Finance Law
Section 3 It is hereby determined that the period of probable usefulness of the
aforesaid specific object or purpose is ten years pursuant to subdivision 12-aof paragraphaof Section
1100ofthe Local Finance Law
Section 4 The faith and credit of said County of Dutchess New York are hereby
irrevocably pledged for the payment of the principal of and interest on such bonds as the same
respectively become due and payable An annual appropriation shall be made in each year
sufficient to pay the principal of and interest on such bonds becoming due and payable in such year
There shall annually be levied on all the taxable real property of said County a tax sufficient to pay
the principal of and interest on such bonds as the same become due and payable
Section 5 Subject to the provisions of the Local Finance Law the power to authorize
the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the
serial bonds herein authorized including renewals of such notes is hereby delegated to the
Commissioner of Finance the chief fiscal officer Such notes shall be of such terms form and
contents and shall be sold in such manner as may be prescribed by said Commissioner ofFinance
consistent with the provisions of the Local Finance Law
Section 6 Such bonds shall be in fully registered form and shall be signed in the name
of the County of Dutchess New York by the manual or facsimile signature ofthe Commissioner of
Finance and a facsimile of its corporate seal shall be imprinted or impressed thereon and may be
attested by the manual or facsimile signature of the County Clerk
Section 7 The powers and duties of advertising such bonds for sale conducting the
sale and awarding the bonds are hereby delegated to the Commissioner of Finance who shall
advertise such bonds for sale conduct the sale and award the bonds in such manner as she shall
deem best for the interests of the County provided however that in the exercise of these delegated
powers she shall comply fully with the provisions of the Local Finance Law and any order or rule
of the State Comptroller applicable to the sale of municipal bonds The receipt ofthe Commissioner

ofFinance shall be a full acquittance to the purchaser of such bonds who shall not be obliged to see
to the application ofthe purchase money
Section 8 All other matters except as provided herein relating to such bonds including
determining whether to issue such bonds having substantially level or declining annual debt service
and all matters related thereto prescribing whether manual or facsimile signatures shall appear on
said bonds prescribing the method for the recording of ownership of said bonds appointing the
fiscal agent or agents for said bonds providing for the printing and delivery of said bonds and if
said bonds are to be executed in the name of the County by the facsimile signature of the
Commissioner of Finance providing for the manual countersignature of a fiscal agent or of a
designated official of the County the date denominations maturities and interest payment dates
place or places of payment and also including the consolidation with other issues shall be
determined by the Commissioner of Finance It is hereby determined that it is to the financial
advantage of the County not to impose and collect from registered owners of such serial bonds any
charges for mailing shipping and insuring bonds transferred or exchanged by the fiscal agent and
accordingly pursuant to paragraph c of Section 7000of the Local Finance Law no such charges
shall be so collected by the fiscal agent Such bonds shall contain substantially the recital ofvalidity
clause provided for in section 5200 ofthe Local Finance Law and shall otherwise be in such form
and contain such recitals in addition to those required by section 5200of the Local Finance Law as
the Commissioner of Finance shall determine
Section 9 This resolution shall constitute a statement of official intent for purposes of
Treasury Regulations Section 1150 - 2Other than as specified in this resolution nomonies are
orarereasonably expected to be reserved allocated onalong-term basis or otherwise set aside with
respect to the permanent funding ofthe object or purpose described herein

Section 10 The validity of such bonds and bond anticipation notes may be contested
only if
1 Such obligations are authorized for an object or purpose for which said
County is not authorized to expend money or
2 The provisions of law which should be complied with at the date of
publication ofthis resolution are not substantially complied with
and an action suit or proceeding contesting such validity is commenced within twenty days after
the date of such publication or
3 Such obligations are authorized in violation of the provisions of the
Constitution
Section 11 This resolution which takes effect immediately shall be published in
summary form in The Poughkeepsie Journal and the Southern Dutchess News the official
newspapers of said County together with a notice of the Clerk of the County Legislature in
substantially the form provided in Section 8100of the Local Finance Law

the
County Executive has declared an emergency concerning the present physical conditionof the structures locatedat28 Market Street Nelson House Annex and 44 Mazket Street City
of Poughkeepsie and WHEREAS the
County Executive inconsultation with the Commissioner of Public Works the
County Attorney and the County Director ofRisk Management has determined that the only practical
solution to remedy the emergency istodemolish the structures and WHEREAS Section
32 01bofthe Dutchess County Administrative Code provides that theCounty Legislature approve thecontract for the demolition ofaCounty owned building and WHEREAS the
Department of Public Works has prepared and published a request for bids for
the purpose of entering intoa contract withaqualified contractor to demolish the structures inasafe
ewnomic and efficient manner and WHEREAS the
County will salvage the plaque hitching post the only original double- hung window
lintel and other portions ofthe Nelson House Annextothe extent practicable and WHEREAS since
it is necessary to accomplish the demolition before the winter months in
order to protect the life health and safety of persons and property due to the deteriorating conditionofthe structures time isofthe essence now therefore beit RESOLVED that
theDutchess County Legislature approves the intended demolition ofthe structures

the DayofUnityin October 1981 conceived bythe National Coalition
Against Domestic
Violence NCADV and WHEREAS the intent of this day was to connect advocates across the
nation who were workingto end violence against women and their children to join together and devote
arange of activities conducted at the local state and national levels toeducate and inform the
publicof this
continued violence and WHEREAS in October 1987the firstDomestic Violence
Awareness Month was observed That same year also marked the initiation ofthe firstnational
domestic violence toll-
free hotline and WHEREAS in1989 theUSCongress passedPublic Law 101-112
designating OctoberasNational Domestic Violence Awareness Month Since then legislation has been
passed every year beginning with theDay ofUnity being celebrated on the first Mondayofevery
Octobertokickoff Domestic Violence Awareness
Month and WHEREAS theDutchess County Legislature established theCitizens Advisory CommitteeonDomestic Violence in1990 following a seriesof public hearingsand presentations relating totheissueofdomestic violence within the community The County
Legislature noted the profound effect that violence has within families and asaresult within the
community and WHEREASthe CitizensAdvisory Committee has met onaregular basissince July 1990Themembers appointed bythe County Legislature include representatives
from many groups These groups include law enforcement advocacy groups family courts

Whereas Make a Difference Day was created by USA WEEKEND Magazine which is owned
by the Gannett Co Inc For the past 20 years USA WEEKEND magazine and Points ofLight volunteer
organization have joined together to sponsor the event along with help from numerous other
organizations and
Whereas the Gannett Co Inc owns and produces the Poughkeepsie Journal This year the
Journal staff will be tackling two projects on Make a Difference Day one is a food drive for the Food
Bankof the Hudson Valley and the second is a park cleanup in conjunction with the environmental group
Scenic Hudson and
Whereas the Dutchess County Legislature is encouraging the citizens ofDutchess County to
take the time to look around their community and on Make a Difference Day millions ofAmericans are
expected to roll up their sleeves to help others and

Anniversary Legislators MacAvery andMiccio offer the following and move its
adoption WHEREAS it is the sense of this Legislatureto recognize dedicated effortsofindividuals who
devote themselves tothe welfare ofthe community and its citizenry
and WHEREAS attendant tosuch concern and infullaccord withitslong-standing traditions this
Legislature is justly proud to commendall past and present members of the Fishkill Historical Society on the
occasion of the 50th Anniversary and
WHEREAS the Fishkill Historical Society was founded in 1962 these dedicated citizens fought
valiantly to save the Van Wyck Homestead that wasbuilt by Cornelius Van Wyck on land purchased from
Madam Brett in 1732 and
WHEREAS during the Revolutionary War the Van Wyck Homestead was requisitioned as the
Officers Headquarters for the Continental Army assigned to the Fishkill Supply Depot from 1776 to 1783 and
WHEREAS the Van WyckHomestead now a public museum is listed on the National Register of
Historic Places as well a part ofthe Hudson River Valley National Heritage Area and
WHEREAS the Fishkill Historical Society coordinates tours with other historic sites and conducts
annual Ramble Weekends and hands-onSchool Programs about Colonial lifeespecially during the American Revolution
and WHEREAS
in 1962 this small group organizedtheFishkill Historical Society and have since devoted
their time and efforts inresearching educating and preserving history now therefore beit RESOLVED
that the Dutchess County Legislature on behalfofall the people of Dutchess County does

Condolence Lt Thomas Lasher
The Dutchess County Legislature offers the following and moves its adoption
Whereas the Dutchess County Legislature has learned with profound sadness and regretofthe recent unexpected death ofLt Thomas Lasher ofthe Dutchess County Sheriff s Office on
September 25 2012 at St Francis Hospital in Hartford CT with his wife and daughters at his
side and
Whereas Thomas Lasher was born on May 2 1963 in Poughkeepsie New York and
was a lifelong resident ofDutchess County He was the son ofLinda Moran Lasher and Peter
Lasher and attended Dover Schools and was a 1981 graduate of Our Lady Lourdes High School
in Poughkeepsie and attended Dutchess Community College and
Whereas Thomas Lasher married Carolyn Beth Kelly on December 10 1988 at the
Immaculate Conception Church in Amenia They have two daughters Mackenzie Beth and
Ariana Martha Lasher and
Whereas Thomas Lasher joined the JHKetcham Hose Company and Rescue Squad in
Dover Plains on July 6 1980 Thomas Lasher was a life member and served as a Lieutenant and
Captain and
Whereas on or about December 1987 Thomas Lasher began his law enforcement career
with the Dutchess County Sheriff s Office Lt Lasher quickly rose through the ranks ofthe
Sheriff s Department becoming a Detective in 1997 aUniformed Sergeant in 1999 aDetective
Sergeant in 2001 and aUniformed Lieutenant in 2004 Lt Lasher supervised the Sheriff s
Department Arson Investigation Unit a position that suited him well based among other thingson his 32 years of experience as a Firefighter and
Whereas Lt Thomas Lasher was instrumental in establishing the Dutchess CountyDepartment of Emergency Response Additionally during Lt Lashers career with the Sheriffs
Department he participated in several criminal investigations as an Investigator and SupervisorLt Lasher received numerous citations for outstanding work and an unparalleled level of
dedication and professionalism and
Whereas Lt Lasher served on several boards such as the Dutchess County Fire
Investigation Team the New York State Fire Investigation Chapter 23 IAAI the Police
Benevolent Association the Dutchess County Chiefs Council the Chestnut Ridge Rod and Gun
Club the Hudson Valley Volunteer FiremensAssociation Royal Order ofRed Vest and the
Dutchess County Exempt FiremensAssociation In addition Lt Lasher was a director ofthe
Valley View Cemetery Association in Dover Plains apast Chairman of the Town ofDover
Republican Committee and a parishioner ofSt Charles Borromeo Church in Dover Plains and
Whereas his passing will be mourned by his family friends and colleagues throughoutDutchess County now therefore be it
Resolved that the Dutchess County Legislature on behalfofall the people ofDutchess
County does hereby extend its deep sympathy and sincere condolences to the family and friends
ofthe late Lt Thomas Lasher and be it further
