June 30 Last day for a legislative measure to qualify for the Nov. 8General election ballot (Elections Code Sec. 9040).
July 1 Last day for policy committees to meet and report bills (J.R. 61(b)(13)). Summer Recess begins upon adjournment provided the Budget Bill has been passed (J.R. 51(b)(2)).

A School Tragedy Again
Our sense of relief that a federal government shutdown has
been temporarily averted paled in comparison to the tragedy that
occurred yesterday at Umpqua Community College in Roseburg,
Oregon, just as we began writing this edition of the Friday

10-Week CR Becomes Law
On Wednesday night, at about 8:00pm, President Obama signed
into law a Continuing Resolution (CR) to keep the federal
government funded at current levels through December 11, 2015,
just a few hours before the beginning of FY16 on Thursday. On
Monday, the Senate voted 77-19 to move forward on the bill, and
the House passed it on Wednesday by a vote of 277-151. The CR
temporarily averts a shutdown, but sets up a bigger battle over
full-year FY16 funding, right before Congress leaves town for the
winter holidays. The CR is considered “clean” since it doesn’t
contain a controversial policy rider that would have cut off
federal funding to Planned Parenthood, though the House passed
a separate measure to do that. For more, click on House

This week, we learned that high-level teleconferences between
Senate Majority Leader Mitch McConnell, outgoing House
Speaker John Boehner, and President Obama began in mid-
September. We also learned that the debt limit may be reached
sooner than expected, by early November, complicating the talks.

Secretary Arne Duncan Returning to Chicago
As we were about to send this to you, we learned that
Secretary of Education Arne Duncan will step down in
December after seven years in the Cabinet. The President
plans to nominate his deputy, John B. King, Jr. to replace

Jen and Jason – Wedding Bells Tomorrow!

Covino, who is marrying her fiancée Air
Force Tech Sergeant Jason Berg tomorrow
in Boston. The two of them met in
Washington’s Columbia Heights
neighborhood soon after she starting
working with us nearly four years ago. Since
then, Jason has become an extended part of
our office family, and we couldn’t be happier for the two of
them. And we know their dog Shuggie is just as excited as we
are. We’ll be at the wedding and look forward to telling you all
about it! Congratulations, Jen and Jason.
EPA Announces New Ozone Standards
On Thursday, EPA announced that it has issued a final rule
that will strengthen the National Ambient Air Quality
Standards (NAAQS) for ground-level ozone to 70 parts per
billion (ppb) from 75 ppb. The updated standards are intended
to improve public health protection, particularly for at-risk
groups including children, older adults, and people of all ages
who have lung diseases such as asthma.
We participated in a teleconference hosted by EPA yesterday,
where Administrator Gina McCarthy said that the current
ozone standard, established in 2008, was simply
“unacceptable” and that reducing ozone levels to 70 ppb will
significantly improve the health of the nation. EPA encourages
local officials to contact their Regional Offices to learn more
about the new rule. The Final Rule has not yet officially been

Choice Neighborhoods Awards Announced
On Monday, HUD announced that five communities,
including the Sacramento Housing and Redevelopment
Agency, will receive a combined $150 million to redevelop
severely distressed public housing and revitalize the
surrounding neighborhood through the agency’s Choice
Neighborhoods Initiative Implementation Grants. For more,

Build America Transportation Investment Center
On Tuesday, U.S. DOT formally unveiled its Build America
Transportation Investment Center (BATIC). BATIC will serve as
the single point of contact and coordination for states,
municipalities, and project sponsors looking to utilize federal
transportation expertise, apply for federal transportation credit
programs, and explore ways to access private capital in public-
private partnerships – similar to many of the personalized services
that you already receive from your team at Simon and Company!

FTA Proposes Rule on “State of Good Repair”
On Wednesday, FTA issued a proposed rule that would require
public transportation agencies to monitor and manage their capital
assets to achieve and maintain a state of good repair. Comments
are due by November 30. The Administration’s “GROW
AMERICA Act” transportation reauthorization proposals contain
significant new funding for State of Good Repair. For more, click

Senate WOTUS Hearing
On Wednesday, the Senate Environment and Public Works
Committee’s Subcommittee on Fisheries, Wildlife, and Water
held an oversight hearing on the Army Corps of Engineer’s
participation in the development of the Clean Water Rule,
featuring Assistant Secretary of the Army for Civil Works Jo
Ellen Darcy. The WOTUS rule remains controversial and the
inclusion of a provision suspending it in appropriations bills has

Congress Extends FAA Funding for Six Months
On Tuesday, soon after the House acted, the Senate passed a
six-month extension of funding for the Federal Aviation
Administration. FAA programs are authorized through March 31,
2016. There is great interest on the part of airport advocates in an
expansion of the passenger Facility Charge (PFC) and perhaps
even being part of an infrastructure finance plan based on

Body Worn Camera Grants
The Bureau of Justice Assistance announced $19.3 million
worth of awards for the FY15 Body-Worn Camera (BWC) Pilot
Implementation Program to respond to the immediate needs of
local and tribal law enforcement organizations. This program was
put together in response to Ferguson and other incidents around
the country and is likely to grow over time. Federal funding for
Body-Worn Cameras was a recommendation of the President’s
21st Century Policing Task Force, which delivered its final report

Pipeline Safety Hearing
On Tuesday, the Senate Commerce Committee’s
Subcommittee on Surface Transportation held a hearing titled,
“Pipeline Safety: Oversight of Our Nation’s Pipeline

Priority Enforcement Program and EB-5 Visas
On Tuesday, we participated in a meeting hosted by the U.S.
Conference of Mayors where we learned more about PEP and
EB-5 from the DHS officials who directly oversee those
programs. EB-5 is now being kept alive as part of the CR. The
Administration continues to push PEP as an alternative to

Local Economic Recovery Remains Incremental
A new NLC report shows that municipal finances have
stabilized in the wake of the recession, but the recession’s
effects are still evident in city budgets across the nation. For

DHS’s New Office for Community Partnerships
DHS Secretary Jeh Johnson announced the creation of a
new Office for Community Partnerships, which will be
dedicated to the mission of countering violent extremism by

Speaker John Boehner Announces His Resignation
While we were writing
today’s edition of the Friday
Report, we learned that
House Speaker John
Boehner plans to resign
from Congress on October
30, 2015, setting up a special
election in Ohio to replace
him. During a press
conference, he said, “Prolonged leadership turmoil would do
irreparable damage to the institution.” This announcement is still
reverberating around Capitol Hill and will lead to a new dynamic
in Congress. It’s worth noting that the last six Speakers have
departed the House through resignation, defeat, or loss of party
control, and that Tip O'Neill was the last to step down in a
normal way. As of now, the most likely person to replace Speaker
Boehner is current House Majority Leader Kevin McCarthy,
who we have worked with here in Washington. We’ll update you
when we learn more about next steps!

“Clean” Continuing Resolution Under Debate
On Tuesday, the Senate introduced a Continuing Resolution
(CR) that would fund the federal government from October 1
to December 11, 2015. The measure continued spending for
most programs at current levels, and included a one-year
prohibition on federal funding for Planned Parenthood or its
affiliates unless such entities certify they will not perform or
fund abortions. It also extends certain expiring authorities for
the duration of the continuing resolution, including the Internet
Tax Freedom Act, the E-Verify program, and the Federal
Aviation Administration. On Thursday, soon after the White
House issued a tersely-worded veto threat against the measure,
the Senate voted 47-52 against the CR because of the
controversial provisions related to Planned Parenthood.
Immediately after the vote, Senate Majority Leader Mitch
McConnell filed a “clean” CR without the Planned Parenthood
language, and he later confirmed that a vote to move forward
on the bill would occur on Monday at 5:30pm. Shortly after
announcing his resignation, House Speaker John Boehner
confirmed that he plans to allow a vote on a “clean” CR next
week. Without Congressional legislation, the federal
government will shut down at the end of the day on
Wednesday. Although the possibility of a shutdown now seems
less likely since the House plans to vote on a clean CR, federal
agencies already have their “shutdown plans” ready, just in

He met with Tacoma
Mayor Marilyn Strickland, who said, “We have strong ties
to China and have hosted more than 30 delegations from
our sister city, Fuzhou.” During his visit, President Xi
Jinping interacted closely with students at Tacoma’s Lincoln
High School and spoke before a crowd of 500 people in the

FY15 COPS Hiring Grants Announced
As we have already informed many of you, on Monday, the
COPS Office announced the award of 196 FY15 COPS Hiring
Program Grants (CHP), worth approximately $107 million. These
funding awards are aimed at creating, and in some cases
protecting, 866 law enforcement positions across the country. For

In addition, last week, the COPS Office convened law
enforcement executives and community partners from across the
country to learn from their peers about innovative strategies
aimed at building community resilience to violent extremism. For

Expediting Review for Infrastructure Projects
On Tuesday, several federal permitting agencies came together
to announce new actions by the Obama Administration to
accelerate approval of infrastructure projects, including an
enhanced Federal Infrastructure Permitting Dashboard and new
guidance to federal agencies establishing metrics for the
permitting and environmental review of infrastructure projects.

U.S. Energy Productivity and Weatherization Assistance
The Department of Energy has unveiled a strategic plan laying
out a path business, state and local governments, consumers, and
other stakeholders can use to achieve the goal of doubling U.S.
energy productivity by 2030. In addition, the Department has
released a major national evaluation of the Weatherization
Assistance Program (WAP), showing that weatherization
provides cost-effective energy savings and health and safety

White House Pushes Broadband Expansion
On Monday, the White House released a report from the
Broadband Opportunity Council with recommendations to the
President on how the federal government can more effectively
expand broadband deployment and adoption by addressing
regulatory barriers and encouraging investment and training. The
report recommends that federal agencies should take
coordinated steps in the next 18 months to expand broadband
to areas that are still poorly connected. It also recommends
overhauling federal programs to expand support for broadband
investments and give local communities the tools and resources

The White House has launched a “Stand Stronger” campaign

Supporting Sanctuary Cities
The U.S. Conference of Mayors has sent a letter to members
of the Senate Judiciary Committee opposing legislation that
would penalize so-called “sanctuary cities” for adoption of

Preventing Opioid Overdose and Abuse
The Department of Health and Human Services kicked off a
two-day intensive convening of representatives from all over
the country focused on preventing opioid overdose and opioid

Only six legislative days until the end of the fiscal year with not
even a short-term spending deal in sight – that drama and more
this week, as Washington gets ready for a tumultuous greeting
for His Holiness Pope Francis, Tuesday through Thursday. And
do we ever need him now! Here’s the highlights.
Twelve Days Until Shutdown
There are twelve full calendar days or six
legislative days before the end of Fiscal
Year 2015, and Congress has yet to pass
legislation that keeps the federal
government functioning after September.
The biggest development of the week on
the appropriations front came from Senate
Majority Leader Mitch McConnell who
predicted, on Wednesday, that when
Congress does ultimately agree to a full-year spending bill, that it
will raise spending levels equally for both defense and domestic
programs, as Democrats have long demanded. Raising these caps
would essentially counteract the automatic sequestration cuts that
would go into effect for FY16. He indicated that he is in
discussions with senior leaders in the House about how to pass a
short-term Continuing Resolution (CR) to keep the federal
government open while negotiations take place on a full-year
“omnibus” bill.
Senate Rules Committee Chairman Roy Blunt told reporters
that he expects a CR to last until “sometime around the end of
November [or] early December.” House Budget Committee
Ranking Member Chris Van Hollen said that Democrats in both
chambers are demanding that any short-term CR be “clean,” or
free of any additional controversial policy provisions. On
Thursday, House Speaker John Boehner said, “We had a good
conversation with our members yesterday about the CR. We’re
going to continue those conversations, but we haven’t made any
decisions yet.” Leaders of the conservative House “Freedom
Caucus” are continuing to demand that the House GOP leadership
team attaches a measure to a CR that cuts off federal funding to
Planned Parenthood, and that failure to do so could threaten
Boehner’s Speakership. We’ll continue to monitor the
appropriations and budget negotiations closely and update you
on any developments!
Transportation Debate Punted to October
Although the House Transportation
and Infrastructure (T&I) Committee
had tentatively scheduled its first
mark-up of a multi-year
transportation reauthorization on
September 17, the markup has now
been postponed to October. During
our meetings on Capitol Hill with transportation staffers this
week, we heard that the markup might be scheduled during the
week of October 5. Current transportation spending authority
expires on October 29. Committee Chairman Bill Shuster told
reporters that the goal is to have a markup “late this month,
[or] early October… We can do a six-year bill, but if there’s no
money for it, it doesn’t go anywhere. I don’t want to do what
the Senate did and have a six-year policy bill and pay for three
years,” referring to the Senate’s DRIVE Act passed in July.
One possible explanation for the delay: after House Ways
and Means Committee Chairman Paul Ryan had a lengthy
meeting with Senate Finance Chairman Orrin Hatch and
Senator Chuck Schumer last week, Chairman Ryan told
reporters that he may delay a planned international tax
overhaul, which was expected to provide the additional funding
the House needed for a longer-term bill. On Tuesday,
Chairman Hatch opened the door to the possibility of
shortening the Senate’s DRIVE Act from six years to three
years to make negotiations with the House easier, saying, “I’m
open to it. That’s as far as we could push the Democrats: three
years.” Some House Democrats remain dissatisfied with what
they have seen from Chairman Shuster so far, with T&I
Committee Ranking Member Pete DeFazio saying, “At this
point, we have something that looks essentially like a status
quo bill in terms of funding. We don’t find that acceptable.”
Also this week, Transportation Secretary Anthony Foxx
provided clarification on the health of the Highway Trust Fund.
He said that the idea that the Trust Fund will be “out of the
woods” for many months to come is “hardly the case.” The
Trust Fund will have more than $0 until June 2016, but DOT
considers a “prudent level” in the Fund’s Highway Account to
be $4 billion. To keep the money flowing to states reliably,
DOT may need to implement its emergency cash management
procedures as soon as November 20, 2015, when the Highway
Account is projected to hit the $4 billion mark. The Highway
Account currently has about $6.4 billion and the Mass Transit
Account currently has about $2.9 billion. For more, click on

Updated College Scorecard and Improved FAFSA
Over the weekend, the White House rolled out two major policy
announcements related to higher education. The Department of
Education went live with an updated online College Scorecard, to
provide the clearest, most accessible, and most reliable national
data on college cost, graduation, debt, and post-college earnings.
Additionally, President Obama announced a new initiative to
allow students and families to apply for financial aid earlier,
starting in October as the college application process gets
underway, rather than January, using the Free Application for
Federal Student Aid (FAFSA). For more, click on Better Online

U.S.-China Climate Leaders Summit
This week, Los Angeles Mayor Eric Garcetti
hosted a Climate Leaders Summit, bringing
together local and state leaders from throughout
the U.S. and China to discuss policy solutions to
confront the long-term threat of climate change,
and to sign a declaration affirming commitments
by cities, states, and provinces to meet
emissions targets that exceed national goals established by their

“Smart Cities” Initiative
On Monday, the White House announced a new “Smart Cities”
Initiative that will invest over $160 million in federal research
and leverage more than 25 new technology collaborations to help
local communities tackle key challenges such as reducing traffic
congestion, fighting crime, fostering economic growth, managing
the effects of a changing climate, and improving the delivery of

Job-Driven Training Progress Report
The Administration released an interagency Job-Driven
Training Progress Report, laying out the steps that have been
taken since Vice President Joe Biden’s job-driven training review
last July to expand the number of pathways for Americans to gain
the skills to get better, higher-paying jobs and increase access to

Cutting Food Waste in Half
On Wednesday, the Agriculture Department and EPA
announced the first-ever national food waste reduction goal - a
50-percent reduction by 2030. The federal government will lead a
new partnership with charitable and faith-based organizations, the
private sector, and local and state governments to reduce food
loss and waste to improve overall food security and conserve our

The Justice Department has released findings from the
second National Survey of Children’s Exposure to Violence,

Congress is back and it appears that the summer predictions
are likely to be true – it is going to be one heck of a fall as the
House, Senate and Administration struggle with a boatload of
issues up against a myriad of deadlines. Here’s the details and
additional news of the week’s highlights.
FY16 Appropriations Update
All eyes are on House Speaker John
Boehner as his chamber only has about
eight legislative days remaining in
September to pass legislation to keep the
federal government open starting next
month. Meanwhile, on Tuesday, the
White House reiterated its position that
President Obama would not agree to a
“long-term” budget deal that does not
raise spending levels for both defense
and domestic purposes. The House has
already adopted fiscal policy in its FY16 budget that increases
spending by $38 billion for defense purposes, but has not yet
agreed on raising $37 billion for domestic programs.
The impasse over a longer-term spending measure has increased
the focus on the possibility of a short-term continuing resolution
(CR). As of today, Republican and Democratic leaders have not
yet met to begin serious negotiations over the size and shape of a
possible CR. Top Republican leaders began meeting behind
closed doors on Wednesday, to discuss the CR, but no decisions
have been made yet on what it would look like. Some of the more
conservative members of the House Republican caucus are
demanding that Speaker Boehner attach controversial provisions
related to federal funding for Planned Parenthood and the Iran
Nuclear deal, though nothing has been confirmed yet on those
fronts. If the Speaker can’t secure enough votes from his caucus
to pass even a short-term measure, then he will need to rely on
some votes from the Democratic caucus, led by Rep. Nancy
Pelosi. With so few days left on the legislative calendar, and the
Pope in Washington during the week of September 22, it
increasingly looks like Congress may wait, yet again, until the
last minute to pass a CR.
History may serve as a useful guide in helping us predict the
size and scope of a possible FY16 CR. A recent report from the
Congressional Research Service examined the legislative
history from 1998-2015, and found that lawmakers sent
Presidents 103 CRs that were then signed into law. Those
measures spanned an average of 24.6 days and 49 of those
measures lasted for seven days or less. During that 18 year
period, Congress passed a year-long CR three times, which
could happen again this year before Congress recesses again in

TIGER 2015 Announcements Soon
In recent meetings with Department of Transportation
officials, we learned that TIGER 2015 grant announcements
will likely be made by the agency sometime around
September 30. We’ll contact you as soon as we learn about
the official announcements.
Executive Actions on Paid Leave
On Tuesday, we participated in a teleconference hosted by
the White House to learn more about the President’s Executive
Actions to expand paid sick leave that were announced on
Labor Day. Earlier on Tuesday, President Obama spoke at the
Greater Boston Labor Council to discuss the work his
administration was doing to improve the quality of life for
American workers.
Speakers on Tuesday’s call included White House Senior
Advisor Valerie Jarrett, Domestic Policy Council Director
Cecilia Munoz, and Labor Secretary Tom Perez. Under the
President’s Executive Order, approximately 300,000 people
working on federal contracts will gain the ability to earn up to
seven days of paid sick leave each year, beginning with new
contracts in 2017. Workers will earn a minimum of one hour of
paid sick leave for every 30 hours work. Those workers would
be able to use the paid leave not just for their health or the
health of a loved one, but also for absences resulting from
domestic violence, sexual assault, or stalking.
The White House is renewing its call for Congress to pass the
Healthy Families Act, which would require all businesses with
15 or more employees to offer up to 7 paid sick days each year.

will soon announce the winners of its “Paid Leave

Secretary Foxx Keeps up Momentum on Transportation
On Tuesday, Transportation Secretary Anthony Foxx spoke at
the National Press Club, urging Congress to think more broadly
about transportation policy than merely keeping the Highway
Trust Fund solvent. He called the Fund merely a “tool” and that
legislators should think more critically about how the money is
being used and what it’s being used for. Over the summer, DOT
analysts found that the cost to maintain current traffic congestion
levels is $400 billion over six years. While the Secretary
applauded the efforts of the Senate in passing the DRIVE Act, he
argued that the spending increase, about 5%, still wasn’t enough.
It is worth noting that recent DOT estimates show that the
Highway Trust Fund currently has enough cash to last until the
end of June 2016, six months later than legislators estimated
when they injected about $8 billion into the fund before the

Hearing on EPA and Western Water Pollution
On Wednesday, the House Science Committee held a hearing
titled, “Holding EPA Accountable for Polluting Western Waters.”
to examine the 3 million gallon toxic waste spill at the Gold King
Mine in Colorado caused by an EPA contractor. Witnesses
included Durango Mayor Dean Brookie and EPA Assistant
Administrator for the Office of Solid Waste and Emergency

Young Adults and the Criminal Justice System
On Tuesday, Attorney General Loretta
Lynch delivered opening remarks at a
panel discussing justice-involved young
adults. The purpose of the panel was to
bring together public officials and other
leaders to discuss the unique challenges
facing young adults who come into contact with the criminal
justice system, as well as to examine new ways to approach these

Urban Stabilization and Revitalization
On Wednesday, Comptroller of the Currency Thomas Curry
discussed urban stabilization and revitalization during remarks at
the City Club of Cleveland. He noted how, since the end of the
recession, his office has raised its expectations regarding banks’
credit underwriting and loan portfolio management, while
recognizing that those expectations may be hard to meet,
especially in areas that are already under financial distress. His
office supports innovative efforts to increase credit availability
such as the Cleveland-area Land Bank and the Greater University

The Surgeon General: Start Walking!
On Wednesday, U.S. Surgeon General Vivek Murthy issued a
call to action to address major public health challenges such as
heart disease and diabetes. He is calling on community planners
and local leaders to create more areas for walking and wheelchair
rolling and to prioritize the development of safe routes for

Pay for Success
A new report from the Government Accountability Office
(GAO) shows that the innovative financing mechanism known
as “Pay for Success” (PFS) or “Social Impact Bonds” offers
potential benefits to all parties in the project, and recommends
that OMB establish a formal means for federal agencies to
collaborate on PFS. Under PFS, investors provide capital to
implement a social service. If the service provider achieves
agreed-upon outcomes, the government pays the investor,
usually with a rate of return, based on savings from decreased
use of more costly remedial services, such as incarceration. For

The Future of Cities
On September 18, at 9:30am, the President’s Council of
Advisors on Science and Technology (PCAST) will hold a
public meeting at the National Academy of Sciences to discuss
the future of cities and on technology for older Americans.

Nominations of members for a new Federal Advisory
Committee for the sustained National Climate Assessment are
due no later than Monday, September 14. Individuals are
sought with expertise in communications, engagement, and
education; risk management and risk assessment; and other

Manufacturing Day
This year’s “Manufacturing Day”
is being held on Friday, October
2, highlighting the benefits of the
manufacturing sector for the
American economy. More than
1,000 sites across the country have
already signed up to help inspire the next generation of
manufacturers. Event organizers encourage companies in local
communities to participate, whether through a plant tour for
community partners or an open meeting with elected officials
