Provides that, except in a medical emergency, or exceptas provided in this act, if a pregnant woman is less thaneighteen years of age and not emancipated, or if she hasbeen adjudged an incapacitated person, a physician shallnot perform an abortion upon her unless at least forty-eighthours before the abortion, in the case of a woman who isless than eighteen years of age, he or she first notifies oneof her parents; or, in the case of a woman who is anincapacitated person, he or she first notifies one of herguardians. In the case of a pregnancy that is the result ofincest where the father is a party to the incestuous act, thephysician need only notify the pregnant woman's mother orguardian.

Provides that any person who performs an abortionupon a woman who is an unemancipated minor orincapacitated person to whom this act applies either withknowledge that she is a minor or incapacitated person towhom this act applies, or with reckless disregard ornegligence as to whether she is a minor or incapacitatedperson to whom this act applies, and who intentionally,knowingly, or recklessly fails to conform to anyrequirement of this act is guilty of unprofessional conductand his or her license for the practice of medicine andsurgery shall be suspended for a period of at least threemonths.X

and controversies before it, and engaged in judicialactivism by significantly rewriting the state law againstdiscrimination. By failing to answer the question uponwhich the court had granted review, by disregarding aproperly adopted state rule, by needlessly overturning thecourt's own recent precedent, and by importing into statelaw a substantive rule adapted from federal statute, thecourt has effectively legislated from the bench.

Finds that the law changed by the court is of significantimportance to the citizens of the state, in that it determinesthe scope of application of the law against discrimination,and that the court's deviation from settled law wassubstantial in degree. The legislature reaffirms its intentthat the law against discrimination affords to Washingtonresidents protections that are wholly independent of thoseafforded by the federal Americans with disabilities act of1990, and rejects the opinion stated by the majority in McClarty v. Totem Electric.X

Provides that, for contracts awarded to small businesseswith gross revenues under two hundred fifty thousanddollars annually, a state agency or authorized localgovernment may waive the payment and performance bondrequirements of chapter 39.08 RCW and the retainagerequirements of chapter 60.28 RCW, and assume theliability for the contractor's nonpayment of laborers,mechanics, subcontractors, materialpersons, suppliers, andtaxes imposed under Title 82 RCW. If the state agency orauthorized local government assumes this liability, it hasthe right of recovery against the contractor for anypayments made on behalf of the contractor.X

(2) Provide a central inventory of state and otherpublicly owned land and buildings that may be suitable tobe marketed, sold, leased, or exchanged for thedevelopment of affordable housing or housing for specialneeds populations; and

(3) Facilitate the effective use of publicly ownedsurplus and underutilized land and buildings suitable forthe development of affordable housing for very low-incomeand low-income households and special needs populationsby requiring that these types of surplus property to certainpublic agencies, commissions, and local governments beoffered for an initial time period at a discount to nonprofithousing organizations and eligible public agencies for thedevelopment of affordable housing for very low-incomeand low-income households or housing for special needspopulations.X

Provides that, prior to the child returning home, thedepartment must complete the following: (1) Identify anyperson who will act as a caregiver for the child anddetermine whether the caregiver is in need of any servicesin order to ensure the safety of the child, regardless ofwhether the caregiver is a party to the dependency. Ifservices are recommended for the caregiver, and thecaregiver fails to engage in the recommended services, thechild welfare worker must promptly notify the court;

(2) Identify all adults residing in the home and conductbackground checks on those persons; and

(3) Notify the parent in the home to which the child isbeing returned that he or she has an ongoing duty to notifythe department of any persons who are residing in the homeor acting as a caregiver for the child.

Provides that, if a child is removed from home due toallegations of abuse or neglect, returned home, andsubsequently removed and placed in out-of-home care, thecourt shall hold a permanency hearing no later than thirtydays from the date of the removal to determine theappropriate action, including a change in the permanencyplan or the filing of a termination petition. The bestinterests of the child shall be the primary consideration indetermining the appropriate action.

Requires the criminal justice training commission toimplement by January 1, 2008, a course of instruction forthe training of law enforcement officers in Washington inthe handling of child abuse or neglect complaints. Thebasic law enforcement curriculum of the criminal justicetraining commission shall include basic training instructionon child abuse and neglect issues. The course ofinstruction, the learning and performance objectives, andthe standards for the training shall be developed by thecommission and shall be required for all new lawenforcement officers.

Directs the department of social and health services, theattorney general, and the judicial branch to identify allcases in which a dependency has been established underchapter 13.34 RCW and in which the permanency planninggoals have not been achieved within fifteen months ofwhen the child was placed in out-of-home care. Theagencies shall also identify the reasons for thenoncompliance. The department, the attorney general, andthe judicial branch shall report to the appropriatecommittees of the legislature before December 1, 2007, andbefore December 1st of each year thereafter.X

Requires that, in any proceeding under chapter 13.34RCW, if the petitioner submits a report containing anyrecommendations, opinions, evaluations, or assertions tothe court, the petitioner must provide the court withdocumentation relating to the recommendation, opinion,evaluation, or assertion, that is available to the petitionerand of which the petitioner is aware, including but notlimited to psychological evaluations, service reports,visitation reports, foster parent reports, medical reports, andother reports relevant to that particular court hearing.X

1, 2007. The pilot program shall extend through December31, 2010, to the extent that funding is provided.

Requires the department to measure the performanceand outcomes of the program, including changes in any ofthe following: Reunifications, child abuse or neglect re-referrals, continuances or delays in the court case, progressin dependency cases, caseworker satisfaction, retention,and safety. The department shall report its preliminaryfindings to the legislature by December 2009 and a finalreport by December 2010.X

Developing guidelines for plant, animal, and humantherapy research conducted in the state.

Declares that the policy of the state of Washingtonshall be as follows: (1) That research involving thederivation and use of human embryonic stem cells, humanembryonic germ cells, and human adult stem cells from anysource, including somatic cell nuclear transplantation, shallbe permitted after full consideration of the ethical andmedical implications of this research.

(2) That research involving the derivation and use ofhuman embryonic stem cells, human embryonic germcells, and human adult stem cells, including somatic cellnuclear transplantation, shall be reviewed by the humanstem cell research advisory committee, created in this act.

Requires a physician, surgeon, or other health careprovider delivering fertility treatment to provide his or herpatient with timely, relevant, and appropriate informationto allow the individual to make an informed and voluntarychoice regarding the disposition of any human embryosremaining following the fertility treatment.

Finds that the provision of housing and housing-relatedservices should be administered at the local level.However, the state should play a primary role in: Providingfinancial resources to achieve the goal at all levels ofgovernment; researching, evaluating, benchmarking, andimplementing best practices; continually updating andevaluating statewide housing data; developing a state planthat integrates the strategies, goals, objectives, andperformance measures of all other state housing plans andprograms; coordinating and supporting county governmentplans and activities; and directing quality managementpractices by monitoring both state and county governmentperformance towards achieving interim and ultimate goals.

Declares that the systematic and comprehensiveperformance measurement and evaluation of progresstoward interim goals and the immediate state affordablehousing goal of a decent, appropriate, and affordable homein a healthy, safe environment for every low-incomehousehold in the state by 2020 is a necessary component ofthe statewide effort to end the affordable housing crisis.

Requires the joint legislative audit and reviewcommittee to conduct a performance audit of the stateaffordable housing for all program every four years. Theaudit must include an analysis of the department'sexpenditures of funds from sources established by RCW36.22.178 (as recodified by this act) and all other sourcesdirected to the affordable housing for all program. The firstaudit must be conducted on or before December 31, 2010.Each audit must take no longer than six months or fiftythousand dollars to complete.

Directs the department of community, trade, andeconomic development to conduct a study to evaluate thepotential development of a voluntary statewide, low-income household housing waiting list database that wouldinclude information on all low-income householdsrequesting housing assistance for the purpose of connectingsuch households with appropriate housing opportunities.

Requires the department to report the results of thisstudy to the appropriate committees of the legislature byDecember 31, 2008.

Requires the department to create or purchase, andimplement by December 31, 2009, a master affordablehousing database that includes specific information aboutexisting affordable rental housing stock in the state ofWashington.

Declares that the purpose of this act is to create a systemof clean elections for state office campaigns through publicfinancing, thereby focusing campaigns on issues and awayfrom the sources of campaign contributions. Publicfinancing of campaigns will limit the influence of largecontributors and special interests in political campaigns.

Provides that a candidate who wishes to receive publiccampaign funds must: (1) File an application with thecommission declaring his or her intent to participate in theprogram as candidate for political office. The applicationmust be filed before or during the qualifying period. Theapplication must identify the candidate, the office that thecandidate plans to seek, and the candidate's party, if any. Inthe application, the candidate shall affirm that only onepolitical committee, identified with its treasurer, shallhandle all contributions, expenditures, and obligations forthe publicly financed candidate and that the candidate willcomply with the requirements of this act and rules adoptedby the commission; and

(2) Obtain the minimum number of qualifyingcontributions by the end of the qualifying period.Candidates for the legislature must obtain at least twohundred qualifying contributions, candidates for governormust obtain at least four thousand qualifying contributions,and candidates for other state executive offices must obtainat least one thousand five hundred qualifying

contributions. No payment, gift, or anything of value maybe given for a qualifying contribution. A qualifyingcontribution must be: (a) made by a resident who at thetime of the contribution resides in the electoral district ofthe office the candidate is seeking; (b) made by a personwho is not given anything of value in exchange for thequalifying contribution; (c) in the sum of five dollars,exactly; (d) received during the qualifying period by thecandidate or on behalf of the candidate; and (e) made bycheck, money order, or credit card.

Provides that, within five business days after a publiclyfinanced candidate's name is approved to appear on theprimary election ballot in a contested election, thecommission shall distribute to the account of the authorizedcommittee of each candidate who qualifies for publiccampaign funding revenue from the citizens publiccampaign fund as follows: (1) For state legislative offices,twenty-five thousand dollars;

(2) For the office of governor, five hundred thousanddollars; and

(3) For other state executive offices, fifty thousanddollars.

Requires that publicly financed candidates in contestedraces must participate in two public debates during aprimary election period and two public debates during ageneral election period. The debates shall be conducted attimes decided by the commission and in accordance withrules prescribed by the commission. Nonparticipatingcandidates shall be invited to participate in the debates.X

The rental carbusiness receiving the written notice of the infraction shallprovide to the parking facility by return mail: (1) Astatement under oath stating the name and known mailingaddress of the individual driving or renting the vehiclewhen the infraction occurred; or

(2) A statement under oath that the business is unable todetermine who was driving or renting the vehicle at thetime the infraction occurred because the vehicle was stolenat the time of the infraction. A statement provided underthis provision must be accompanied by a copy of a filedpolice report regarding the vehicle theft.

Declares that timely mailing of this statement to theparking facility relieves a rental car business of any liabilityunder this act for the notice of infraction. In lieu ofidentifying the vehicle operator, the rental car business maypay the applicable penalty.X

(2) The amount of certified capital invested in eachcertified capital company;

(3) The cumulative amount that each certified capitalcompany has invested as of September 30, 2012, and thecumulative total each year thereafter;

(4) The cumulative amount that the investments of eachcertified capital company have leveraged in terms ofcapital invested by other sources of capital in qualifiedbusinesses at the same time or subsequent to investmentsmade by a certified capital company in such businesses;

(5) The total amount of tax credits granted under thisact for each year the credits have been awarded;

(6) The performance of each certified capital companywith regard to the requirements for continued certification;

(7) The classification of the companies in which eachcertified capital company has invested according toindustrial sector and size of company;

(8) The total gross number of jobs created byinvestments made by each certified capital company usingcertified capital and the number of jobs retained;

(9) The location of the companies in which eachcertified capital company has invested;

(10) The total amount invested in qualifiedmicroenterprise development organizations, the number ofsmall businesses that received financial assistance fromthese organizations and the number of jobs created andretained by such businesses;

(2) Uniform interpretation and enforcement of the lawsgoverning pawnbrokers and second-hand dealers can befacilitated through precise clarification of the current law,and such changes in the law should discourage those whosteal metal properties from seeking the most lenientjurisdiction in which to sell their stolen property; and

(3) Provisions must be made to ensure the appropriatedocumentation of transactions to assist law enforcementagencies to identify, recover, and return stolen property toits owner and to ensure, as reasonably as possible, thatpawnbrokers and second-hand dealers are less likely to beused as conduits for the liquidation and disposal of stolenmetal property.

Requires that, for every transaction that involvesproperty valued at more than one hundred dollars, everypawnbroker and second-hand dealer doing business in thestate shall require the party with whom a transaction maybe made to sign a declaration. The declaration must beprovided as a document separate from any other documentsrelating to a transaction and must be printed in type that isbold face, capitalized, underlined, or otherwise presented ina conspicuous manner.

Provides that the declaration must include, in theseller's own handwriting, identification of the source of theproperty that is subject to the transaction.

Requires the declaration to be signed and dated by theperson with whom the transaction is being made.

Requires the pawnbroker or second-hand dealer or hisor her employee to witness the signing and dating of thedeclaration and sign the declaration accordingly before anytransaction may be consummated.

Requires a copy of the signed declaration to be open toinspection by any commissioned law enforcement officerof the state or any of its political subdivisions, at all times

Provides that, in determining whether an individual isof appropriate character, suitability, and competence toprovide child care and early learning services to children,the department may consider all child abuse and neglecthistory information whether founded, unfounded, orinconclusive regarding a prospective child care provider.No unfounded allegation of child abuse or neglect asdefined in RCW 26.44.020 may be disclosed to a providerlicensed under this act.

Authorizes the department to make available on apublicly accessible web site all inspection reports andnotices of enforcement actions involving child day-carecenters and family day-care providers. The departmentshall include in the inspection report a statement of thecorrective measures taken by the center or provider.

Requires the department and an agency to, at the firstopportunity but in all cases within forty-eight hours of

If the department is unable to learn theinformation required under this act, the department shallonly investigate cases in which: (a) the department believesthere is a serious threat of substantial harm to the child; (b)the report indicates conduct involving a criminal offensethat has, or is about to occur, in which the child is thevictim; or (c) the department has a prior founded report ofabuse or neglect that is within three years of receipt of thereferral;

(2) Unless the report is screened-out or beinginvestigated by a law enforcement agency, conduct aninvestigation within time frames established by thedepartment in rule, but in no case shall the investigationextend longer than ninety days from the date the report isreceived; and

(3) Make a finding that the report of child abuse orneglect is founded or unfounded at the completion of theinvestigation.

Declares that a care provider may not be found to haveabused or neglected a child under chapter 26.44 RCW or bedenied a license pursuant to chapter 74.15 RCW and RCW74.13.031 for any allegations of failure to supervisewherein: (1) The allegations arise from the child's conductthat is substantially similar to prior behavior of the child;and

(2) The department failed to disclose that the child wasa sexually reactive youth, had high-risk behaviors, or wasphysically assaultive or physically aggressive as requiredby RCW 74.13.280.

Provides that allegations of child abuse or neglect thatmeet the provisions of this act shall be designated as"unfounded" as defined in RCW 26.44.020.X

(2) A statement under oath that the business is unable todetermine who was driving or renting the vehicle at thetime the infraction occurred because the vehicle was stolenat the time of the infraction.
