disputes in the last five years; such as breach of contract, employment contracts, UCC disputes. Applicant must be prepared to discuss evaluation, strategy, issues and results, including discovery and post judgment proceedings.

207 Applicant must qualify for Major Business Litigation and demonstrate familiarity with and

ability to analyze anti-trust issues. Applicant must have represented clients in at least two litigated anti-trust matters and have the staff capacity to handle such matters.

210 Major Business Litigation: Applicant has handled through trial or settlement after substantial

discovery has been completed, at least five matters in Supreme Court or Federal District Court. Applicant has brought or defended against at least two summary judgment motions. Applicant demonstrates familiarity with provisional remedies, including injunctions, declaratory judgment actions. Applicant must also qualify for 0205 and be experienced in discovery and post-judgement enforcement proceedings.

Level 3: Estates up to $2.5 million and/or unusual asset transferability/ valuation problems.

Applicant must have practiced law for at least five years, completed five estates at Level 3 ($600,000+ in assets), attends CLE and/or lectures in field, and/or subscribes to various publications and attends seminars in this field. Also, must devote 20% of practice to 0400 matters and have $500,000 in liability insurance.

Level 4: Estates over $2.5 million and/or multinational assets, highly complex issues,

international income & estate planning. Applicant must have practiced law for at least five years, completed 8 estates, two of which were at Level 4. Attends CLE and/or lectures in field and/or subscribes to various publications and attends seminars in this field. Devotes 20% of practice to 0400 matters and has $1,000,000 in liability insurance.

403 Level 2: Estates up to $600,000. Applicants must qualify for 0401 plus have completed at

least three plans involving estates of more than $250,000. Level 3: Estates up to $2.5 million. Applicant must qualify for Level 2 plus have completed at

least two plans involving assets in excess of $2 million and have liability insurance of $500,000.

Level 4: Estates over $2.5 million and/or substantial multinational assets and/or international

income and estate planning. Applicant must have practiced law for at least five years, completed five estate plans, two of which were at Level 3 or above; attends CLE and/or lectures in field and/or subscribes to various publications and attends seminars in this field. Devotes 20% of practice to 0400 matters and has $1 million or more liability insurance.

Your descriptions must include a summary of specific matters, the amounts and issues involved, the discovery, investigation or other preparation you directed, the final results, and how your client benefitted from your counsel or representation.

(b) A straight bankruptcy proceeding involving a business or professional practice. (c) One of the following: 1. A State Court Receivership 2. A corporate dissolution, where assets were liquidated for the benefit of creditors. Individual Insolvencies (a) Applicant has handled through final discharge at least four bankruptcy proceedings in the

past five years. (b) Applicant has sufficient knowledge regarding the provisions of Chapter XIII of the

Bankruptcy Act, to inform a debtor about it and advise said debtor whether it would be in the debtor's interests to file a Chapter XIII

Applicant agrees to either file a Chapter XIII for the debtor, if upon receiving such advice the debtor elects to so file, or in the alternative, applicant agrees to contact the Lawyer Referral Service for an attorney who will handle a Chapter XIII.

Creditors Right

Applicant must have represented a creditors in three insolvency proceedings within the last three years.

involving potential taxes of less than $25,000 for an individual or $50,000 for a business, no potential tax fraud problems.

At least two year's experience with the IRS or state tax authority; or at least one year's experience in tax matters in private practice; and access to a tax library.

Level 2 Matters involving detailed working knowledge of the tax laws, regulations, rulings and case

laws, but less complex than Level 3; matters involving potential taxes of less than $100,000; no allegations of tax fraud.

An LL.M in taxation or licensing as a CPA (MBA in taxation or finance and substantial CLE studies will be considered); and either (a) at least two year's Tax Court experience with a state tax authority or (b) three years (Level 2) or five years (Level 3) experience in tax matters in private practice. Attendance at (or lecturing at) at least one continuing legal education course on taxation in the subcategory in every two years (Level 2) or plus attendance at (or lecturing at) at least one continuing legal education course on any major changes in the tax laws in any year in which there has been major tax legislation. Access to a full tax library. Substantial involvement in and/or the writing of opinion letters in at least five matters at that level of complexity within the last five years in each subcategory for which the person is listed. (In the case of litigation or audit, the handling of at least five cases of that type within the last three years and the achieving of favorable results in at least three of those cases; and in the case of tax returns, the preparation of at least five (Level 2) or ten (Level 3) long-form tax returns of the type in question each year for the past three years).

An alternative to the involvement in and/or writing of tax opinions as set forth above could be substantial related published writings, substantial related published writings, substantial related lecturing at CLE courses and/or related teaching at an accredited law school, or substantial reputation in the field.

1703 Civil Service: Applicant must have completed representation of five civil service matters in the

past five years, at least two of which involved contested hearings. 1704 Pensions: Applicant must demonstrate familiarity with pension and ERISA issues and have

represented clients in at least five matters involving the payment of a pension.

It is helpful for lawyers wanting referrals in the 1800 categories to be members of some recognized professional group dealing with international problems. This could include an organization such as the International Bar Association, or the international law sections of the American Bar Association of appropriate state or local bar associations.

It is also helpful to know what procedures the applicant uses in selecting and employing local counsel in foreign jurisdictions and what law firms abroad the firm has worked with.

1803 Have assisted in the obtaining of reparations from foreign governments for war and economic
