COURSE DETAILS The course is delivered in four sections:

1. Basic communication etiquette;2. Negotiating a contract;3. Drafting a contract; and4. Master class.

The course aims to prepare participants to confidently engage with English drafting of commercial agreements and addresses the three stages that lead to the drafting of the contract: the preliminary stage of communication between the parties; the negotiation stage of the contract; and the final drafting of the contract’s terms.

Every session starts with teaching of the basic principles and conventions applicable to the legal drafting requirements of each stage. In the second part of each session, participants are provided the opportunity to apply those principles onto case studies and develop their drafting skills through practical exercises.

Finally, the course is concluded with a master class session whereby participants have the opportunity to fully apply the knowledge acquired and the skills developed through the previous sessions and receive feedback from the tutor.

TARGET AUDIENCE This course is aimed at non native English speakers legal practitioners, such as Arabic native-speaking practitioners, who have a confident command in the English language.

COURSE MATERIAL Participants who will complete to full program will receive a Lexis Nexis / MDX Dubai Certificate of Completion.

SAMANTHA JAYNE ROBERTSSamantha is a Senior Lecturer in Law and the Campus Programme Coordinator for Undergraduate Law and Politics at Middlesex University Dubai. Prior to joining Middlesex University Dubai in 2016, Samantha held faculty positions at various UK institutions including: Coventry University; BPP University; University of Westminster; University of West London; and Birkbeck College (University of London). Samantha has extensive experience teaching UK Qualifying Law Degree programmes. Her current teaching interests include Land Law, Employment Law, Medical Law and Legal Skills. Samantha also facilitates courses in UK Common Law and Legal English across the GCC. Having completed an LLB Law degree at King’s College London, Samantha continued her studies there to obtain an MA in Medical Ethics and Law before completing a Postgraduate Diploma in Legal Practice at BPP Law School, London. Samantha also holds a Postgraduate Certificate in Higher Education.

LISA RIDDLERLisa is a Lecturer in Law teaching on the International Foundation and Undergraduate Programmes at Middlesex University, Dubai. Lisa’s current teaching interests include: English Legal Systems, Equity and Trusts and Alternative Dispute Resolution. Lisa is also responsible for the International Foundation Programme Law pathway. Lisa has also facilitated courses in UK Common Law and Legal English in the GCC. Prior to joining Middlesex University, Dubai, Lisa worked in education; working in international private schools in Dubai, South Korea and Thailand, teaching English. She holds an LLB Law degree from Manchester Metropolitan University; a Post Graduate Certificate in Legal Practice from the College of Law and has just completed an MA in Education with Applied Linguistics with the Open University, UK. Lisa is a UK qualified Solicitor with experience in Family and Children Law and Crime. Lisa practiced for 6 years in the UK. She has particular expertise in Public Law and Domestic abuse.

PROGRAMME - 4-day course:The delivery of the course will consist of seminars, guided case analyses and group workshops. It will focus on important communication and writing training that will better equip participants with the legal English skills that are required in practice, by covering the following topics:

BASIC COMMUNICATION ETIQUETTE - PRINCIPLES AND CONVENTIONS OF EFFECTIVE DRAFTING IN ENGLISH COMMON LAW

This session will enable participants to understand the foundations and principles of effective legal drafting and appropriate etiquette. The first part will cover the fundamental principles of drafting basic legal professional documentation in the framework of effective communication between parties, clients and colleagues. In the second part, participants will apply the above foundations and principles to working examples and case studies, in order to improve confidence and get hands on exposure to professional communication.

NEGOTIATING A CONTRACT – ENGLISH LEGAL DRAFTING

This section will enable participants to understand and apply principles and conventions of formal legal communication during contract negotiation within legal practice. The session will involve hands on applications of legal drafting focusing on letters of offer, settlement and negotiation of contracts and other commercial agreements. The first part of the session will cover the fundamental principles of basic legal drafting required at the state of negotiation of contracts and commercial agreements. A range of examples will be shared during this session. In the second part of the session, participants will apply the above conventions to working examples and case studies, in order to improve confidence and get hands on experience in legal drafting required during contract negotiation.

Day 3 - 16 Sept. 2020 - 17:00 - 20:00

DRAFTING A CONTRACT – ENGLISH LEGAL DRAFTING

This section will enable participants to understand and apply principles and methodology of creating a contract structure and drafting clauses for commercial agreements. The session will build on the two previous ones and involve hands on applications of legal drafting focusing on the structure and the terms of commercial agreements. The first part of the session will introduce the methodology to be followed when finalising the structure and drafting the clauses of contracts. A range of examples will be shared during this session. In the second part of the session, participants will apply the above methodology to working examples and case studies, in order to improve confidence and get hands on experience in legal drafting required during contract agreement.

Day 4 - 17 Sept. 2020 - 17:00 - 20:00

MASTER CLASS This is an entirely practical component of the course and, as such, takes place at the end of the course. It builds on the knowledge and the skills developed throughout the three previous sessions. During this session, participants will be provided with a scenario and they will be asked to draft correspondence, negotiation memos and the final structure and terms of a contract.
