2. Announcements – There were no announcements.
3. Review and Approval of October 10, 2017, Legal Action Report and Minutes – Member Clark asked that references to his name in the Report be corrected to indicate “Member Clark” rather than “Member Scott,” With this change, Member Elias moved for approval of the Legal Action Report. The motion was seconded by Member de la Torre. The motion passed unanimously by a voice vote of 3-0.
4. Water Service Request – 30 W Camino del Emperador
a. Report from Tucson Water Staff – Mr. Sarti provided a summary of the Tucson Water
Service Area Policy (SAP), and an explanation of the Water Service Area map, including areas which Tucson Water is obligated to serve, those already being served, and those that are considered non-expansion zones. He explained that a residential parcel located

in a non-expansion zone of unincorporated Pima County must be smaller than 20 acres and must be bordered on three sides by parcels already receiving Tucson Water service, in order to qualify for new water service. Mr. Sarti indicated that the parcel at 30 W Camino del Emperador is located in unincorporated Pima County and is bordered on two sides by parcels receiving Tucson Water Service. He indicated that the parcel is bordered by private land on the north and state land on the east. He explained that the parcel did not meet the criteria for new service under the SAP, and was denied service accordingly.
Board members asked for additional details about the parcel and about neighboring properties that receive Tucson Water service. Tucson Water staff indicated that the parcel in question was the only parcel in the subdivision without Tucson Water service. The property owners explained that the parcel had been split from the neighboring parcel to the west, which receives Tucson Water service. The owners indicated that they had installed a manufactured home on the site; the owners and a representative of Clayton Homes, the homebuilder, indicated that the parcel had been sold with the understanding that Tucson Water service was available. Staff explained that the nearest alternative water provider is Vail Water Company, whose services are located three miles away; the builder indicated that installation of a well could cost about $40,000 and would require drilling to a depth of 800’ below the surface.
b. Response from Appellant – Mr. and Mrs. Newhard provided a brief history of their ownership and development of the parcel. They indicated that they had selected their property based on a belief that water service would be available; the previous owner, the Realtor, and the home builder, Clayton Homes, all indicated that Tucson Water service was available on site. They explained that they learned about the Tucson Water SAP only after purchasing the property and installing a manufactured home on it. A representative of Clayton Homes stated that the Service Area Map seems to indicate service is available in the area of the parcel. Chair Elias asked the representative if Clayton Homes had contacted Tucson Water prior to building the home. The representative indicated that he had not contacted the utility, and had assumed that water service was available due to the presence of a water meter on the neighboring parcel. Mr. Avery indicated that the subdivision in which the parcel is located was platted in 1969, at which time water service was provided by Citizens Utilities (CU). He explained that Tucson Water acquired water service in the area by condemning CU, which may have held a certificate of convenience which covered the entire subdivision. Such a certificate, he explained, could obligate CU and any superseding entity to serve any future parcel in the subdivision. He recommended that staff be allowed time to research the history of the subdivision to determine the extent of any legal obligations.
c. Call to the Audience – Ivy Schwartz, representing the Community Water Coalition (CWC), addressed the Board. Ms. Schwartz indicated that the CWC supports the work of Tucson Water staff and its continued efforts to abide by the Water Service Area Policy as it is written.
d. WSARB Deliberation, and Recommendations or Decisions – Member Clark moved for the Board to accept Mr. Avery’s advice, and to wait for additional information about the case before making a decision to uphold or deny the denial of water service. He stated that, in his view, the intent of the SAP was to prevent sprawl and discourage the proliferation of private wells. Member Clark indicated that that the parcel in question,

located within an existing platted subdivision, is an ideal candidate to be considered for an appeal, and observed that it would be reasonable to expect water service for such a parcel. He expressed disappointment that the Realtor provided incorrect information about the parcel, but belief that the homeowner and builder had proceeded with due diligence. He stated that water service for the parcel would not breach the intent of the SAP.
Member De La Torre seconded Member Clark’s motion to wait for additional information about the case. He clarified that the Board should continue the item for 10 days, while staff worked to determine if a commitment exists to serve the entire subdivision in which the parcel is located. The motion passed on a voice vote of 3-0. [NOTE: On February 1, 2018, the Tucson City Attorney’s Office issued the opinion that Tucson Water is authorized to provide water service to the parcel in question, and indicated that no further action would be required by the Board in this case. A copy of the City Attorney’s decision has been filed with the Legal Action Report for this meeting.]
5. Call to the Audience – Ms. Bolger addressed representatives of Clayton Homes, and expressed her hope that the company is now aware of the Tucson Water SAP.
Kathy Chavez, Pima County Water Policy Manager, addressed the Board. She conveyed the County’s continuing concerns with the Water Service Area Policy, and what the County considers the SAP’s limiting effect on economic development and infrastructure planning. Ms. Chavez referred to the action plan of the City/County Water & Wastewater Infrastructure, Supply & Planning Study (WISP), which included shared goals and recommendations for regional water resource management. She indicated that the County considers certain growth areas to be suitable for development, and that the City of Tucson, as the recipient of the largest CAP municipal allocation, should have an obligation to serve such areas. Ms. Chavez identified these areas as the Houghton corridor, the Southlands area, and the Southwest area. She conveyed the County’s desire to amend the Tucson Water Service Area Policy to support economic development and encourage growth adjacent to existing built areas, where she said the City and County stand to benefit.

Chris, Thank you for providing this legal opinion as requested by the Board.
Based on these considerations, I agree with the conclusion that the subject property is in the City's obligated service area and it is no longer necessary for the Board to take action on this matter.
Richard, Please advise the applicants of this and let them know it has been determined by staff that they are within the City's obligated service area.

>>> Christopher Avery 2/9/2018 5:10 PM >>>Dear Members of the Water Service Area Review Board: Attached is a legal opinion from this office regarding whether the property at 30 West Camino del Emperador is within the City's obligated service area. The memorandum concludes that there are several persuasive indicators--the most relevant of which is a copy of a legal description of the former Citizen's Utilities Certificate of Convenience and Necessity--that the subdivision in which the parcel is located was platted in 1969 and had obtained a determination of "adequacy" prior to 1973, when the City condemned the Citizen's service area. Given these facts, the City also acquired Citizen's Utilities' obligation to provide service to the subdivision. It is therefore not necessary for the Board to consider whether water should be provided to the parcel under the terms of the Water Service Area Policy.
