T E R M S A N D C O N D I T I O N S O F S A L E - L E E B R O O MLee Broom LTD, 93 Rivington Street, London, EC2A 3AY, UK (“Lee Broom”)

These Terms and Conditions (T&C) constitute the contract between Lee Broom and the customer unless Lee Broom agrees in writing

to di�erent terms. Payment of a Lee Broom Quote, Pro Forma, Invoice, or Online Order for Lee Broom products constitutes the

customer’s agreement to these T&C.

T E R M S O F S A L E F O R E U C U S T O M E R S• All payments must be made in EUR. Any bank charges must be covered by the customer.

• Stock products usual leadtime is 1-2 weeks. Leadtimes will increase due to high demand or for larger than usual order quantities.

• Made to Order products lead times range from 8 weeks to 12 weeks.

• Lead times are calculated from the date of the receipt of payment and are estimated and may increase due to high demand or seasonal

impacts.

• The pricelist, tear sheets and website contains photography and technical information. All e�orts are made to ensure these accurately

represent the products though there may be slight variances between these and the actual product.

• Lee Broom does not o�er refunds. Returns will be accepted within 10 business days for company credit or exchange only. Returns must

be pre-authorised with Lee Broom and items must be returned in original packaging and in original unused condition. A 20% restocking

fee will be applied for all returned items. No returns will be accepted on sale, clearance or discontinued products or Made To Orders

products. These items are considered �nal sale. Customer is responsible for all shipping charges incurred. Credit Notes are valid for a

period of two years from date of issuance.

• Cancellations will only be accepted if made within 5 business days of order con�rmation. Cancellations of Made To Order products

will only be accepted if made within 2 business days of order con�rmation. No cancellations will be accepted outside of these periods.

• All Ex Works London (EXW) collections must be arranged by the customer. Commercial invoice and shipping note will be supplied per

order. The supply of any other export documentation can be quoted on request.

• All EXW collections must be made within 2 weeks of being advised by Lee Broom that orders are ready after which storage charges

will apply per month (or part thereof ) at EUR150 per month or 4% of order value which is greater. If EXW goods are not collected

within 6 months, Lee Broom reserves the right to retain the goods and consider the order cancelled without refund.

• Products should be inspected on receipt and any damage or discrepancies reported to Lee Broom in writing within 5 working days. If

damage has occurred in transit, all packaging must be retained by receiver. Failure to do so will invalidate any claim.

L I M I T E D W A R R A N T Y• Products are covered by a 12 month limited warranty against manufacturing defects for the original customer who purchased the

products from an authorized reseller or dealer or distributor or from Lee Broom directly.

• Wear and tear through use, damage due to accident, misuse, abuse or negligence will not be covered and cannot be claimed under this

limited warranty.

• Lee Broom reserves the right, before having any obligation under this limited warranty, to inspect the damaged product or component,

and all costs of shipping for inspection shall be the responsibility solely of the customer. Lee Broom, shall at its choice determine whether

to repair or replace any defective product or component that it determines is covered by this limited warranty.

• Modi�cations made to any products by the customer will invalidate the warranty. All electrical products should be installed by a

professional, quali�ed electrician. The Hanging Hoop Chair and Made To Order pieces are not covered by this limited warranty.

• Limited warranty claims must be made within 10 working days of occurrence by contacting [email protected]. Failure to do so will

invalidate any claim.

S H I P P I N G – E U C U S T O M E R S• Prices include delivery to a single designated warehouse address within the UK mainland if the total order value exceeds EUR500 net.

Orders with a net value lower than EUR500 are subject to a delivery charge of EUR50+VAT. For all deliveries to non-mainland addresses,

additional charges may apply. Please enquire for details.

• Selected products are not included within the above delivery terms. Where a product has *SEE TERMS within the listing, delivery &

crating costs are not included and EXW terms apply.

O T H E R• Lee Broom shall not be liable to the customer or deemed to be in default for any delay or failure in performance resulting directly or

indirectly from causes beyond its reasonable control.

• These T&C represents the entire understanding of the parties. There are no representations, promises, warranties, covenants or

undertakings other than those expressly included. If, for any reason, any provision of these T&C is held invalid in whole or in part, such

invalidity shall not a�ect any other provision of these terms not held so invalid, such other provision shall to the full extent consistent with

law continue in full force and e�ect. These T&C and all rights, remedies, liabilities, powers and duties of the parties to the agreement shall

be governed by and construed in accordance with the laws of the England and Wales without regard to the principles of con�ict of laws.

P R I C E L I S T• EUR pricelist is only for all EU customers (de�ned as those customers not in UK, USA, Canada, non-EU Rest of World countries. No

other pricelist is applicable for EU customers. UK must use GBP pricelist, USA – USD and Canada – CAD. All other countries – GBP.

• Prices are subject to change & do not include sales taxes, shipping, insurance, assembly or installation. This price list replaces any existing

Lee Broom price list.

• A valid company EU VAT registration must be provided in order to qualify for zero rate VAT.�• All prices are in EUR and are Recommended Retail Price in EUR excluding sales tax.
