    LEASE OF RESIDENTIAL HOUSE

    This agreement made and entered into at _______________________,Philippines, this ____th day of _________________, 20____, by and between

    _________________________, of legal age, single (or, married to after called thelandlord, and _______________________, of legal age, single, (or, married to_____________________), and a resident of________________________, hereinaftercalled the tenant, evidences that the parties have agreed as follows:

    1. In consideration of the rent and the tenant's covenants hereinafter reserved andcontained, the lessor hereby demises and leases to the tenant a certain residential housesituated at #______ ________________ street, __________________________belonging to the landlord and registered in the office of the Register of Deeds of

    ______________________________.

    To hold to the tenant for the term of___________(___) years, commencing the___th day of___________, 20____.

    Yielding and paying therefor during said term, rent at the rate of_________________________Pesos (Php ________) yearly and proportionally for anyfraction of a year, by equal _____(___) payments to be made on the first _____days ofeach___________, of which the first shall be made on the ___th day of___________,20______.

    2. The tenant hereby covenants with the landlord as follows:

    (a) To pay the rent as aforesaid without the necessity of express demand therefor,at the residence of the landlord;

    (b) To keep the leased premises in good and habitable condition, making thenecessary repairs and painting inside and outside the house;

    (c) Not to make alterations and improvements on the premises without the writtenconsent of the landlord, and, in case of such authorized alterations and improvements onthe premises, any and all such improvements shall become the property of the landlord atthe expiration of this lease;

    (d) To use the premises as a private dwelling house only and not for any otherpurpose, nor to construct or maintain a stable for the keeping of horses, cows, etc.,detrimental and obnoxious to the neighborhood;

    (e) To surrender or yield up quietly and peaceably, to the landlord the premiseswith all the fixtures, other than the tenant's fixtures at the termination of this lease in thesame condition in which he shall have found them, ordinary wear and tear, reasonableuse, and other unavoidable losses expected;

    (f) To pay from time to time during the term of this lease, all charges for water,electric current, telephone and such other services in the leased premises;

    3. The landlord hereby warrants the peaceful possession and enjoyment of the

    leased premises by the tenant.

    (g) Not to assign or sublease the premises hereby leased or any part thereofwithout the written consent of the landlord, and any breach of this condition shall be aground for the termination of this contract at the option of the landlord; and

    (h) To permit the landlord or his agents to enter and view the condition of thepremises at reasonable hours and in a convenient manner.

    3. The landlord hereby warrants the peaceful possession and enjoyment of theleased premises by the tenant.

    4. In case the premises or any part thereof be destroyed or damaged by fire or anyunavoidable casualty so as to be unfit for use and occupation, the rent shall beproportionately reduced and adjusted, or the lease contract terminated, at the option of thelandlord.

    5. Should the tenant fail to pay the rent herein stipulated in accordance with theterms above mentioned, or violate the terms of this contract, the landlord shall have theright to eject the tenant from the premises, and to collect and recover from him all accruedrents.

    6. It is further agreed that the tenant shall be responsible for all the acts andomissions of his family, servants etc., and any and all other persons by him allowedaccess to the leased premises.

    7. In case of court litigation by virtue of nonpayment of the agreed rents of anyother breach of this contract on the part of the tenant, the landlord shall be entitled tocollect __________________________________ Pesos (Php ________) as liquidateddamages and ________________________ Pesos (Php ______ ) as attorney's feesexclusive of cost legally taxable.
