Overview

In recent years, NHS England & Improvement (NHSE&I) have prioritised capital funding to support the delivery of the Transforming Care Programme and to deliver the national service model as set out in Building the Right Support.

The NHS Long Term Plan renews the commitment to reduce the over reliance on inpatient beds and strengthen the community infrastructure to support people with learning disabilities, autism and mental health conditions to live well in their communities.

COVID-19 has shone a harsh light on some of the deep health inequalities that persist in our society. Like nearly every health condition, COVID-19 has had a disproportionate impact on people with a learning disability, autism or both. As we move forward, we need to support commissioners and providers across health, housing and social care to support the right types of accommodation and support to help address underlying inequalities in line with the Long Term Plan.

At the same time, NHSE&I continues its support for the integration of health systems at a local level and next year it is likely that learning disability capital funding will be distributed and decisions on spending made at ICS level. Therefore, clear alignment between the Learning Disability and Autism programme priorities and the wider ICS investment plans will be required.

In preparation for next year’s capital planning cycle, we are seeking Expressions of Interest from commissioners, and those providers working with commissioners, for capital funding to be spent in 21/22 on local priorities as identified by your Transforming Care Partnership or the ICS workstream which incorporates learning disabilities, autism and mental health.

To ensure we maximise the benefits from the capital resources, we will:o Provide clear advice as to what can and cannot be funded o Provide access to the standard legal documentation and details of the NHSE&I

approval requirements, including the details of the standardised legal charge and grant agreement

o Prioritise those projects that are local priorities and; - have a strong likelihood of delivery - support the discharge of inpatients- prevent inpatient admissions- support CYP to be supported in their communities close to home, rather than in hospitals

Require completion of documentation, including PIDs, by set deadlines, and will withdraw the in-principle support from schemes where this is not achieved so that funding can be reprioritised for other projects in-year.

How can the funds be used?

The funding is available to support the discharge of inpatients and can be used for the acquisition and/or adaption of homes for people with learning disabilities, autism or both in addition to supporting innovative new build developments.

Funding can also be used for alternative accommodation to inpatient beds, for example step up/step down accommodation and crisis accommodation which is based in the community.

All grants will be made by NHSE&I and secured by legal charge (in perpetuity), on behalf of the relevant commissioner. NHSE&I’s powers to make grants are defined in legislation and are restricted to making grants to specific types of organisation:

o Local Authoritieso Registered Social Landlords (RSLs)o Voluntary Organisations

NHSE&I cannot fund capital investment of NHS providers or Independent Sector (for profit) providers. Such providers must internally fund capital investment or seek investment from the relevant funding bodies.

Where bids are successful in the Expressions of Interest stage, the bid will be shared with regional finance colleagues and form part of the wider local financial planning and capital investment decision making process of the ICS for 21/22.

If your expression of interest is supported, your named Housing Senior Manager will start working with you to develop up your full PID proposals. All work on the PID is done at risk.

We will share with you as soon as we have confirmation from regional finance colleagues that the funding has been agreed in principle to support your project.

The approval to incur the expenditure is only secured through PID approval and funding will be released only once the legal work on the transaction is completed or in agreed tranche payments for larger value schemes.

It is important to note that funding is only available in the year specified and cannot be carried forward into the subsequent years.

NHSE&I will expect the bidders to fund NHS England & Improvement’s legal costs incurred to complete the grant (typically of c£2-3k). This can be included in the costs of the project (and is therefore recoverable on completion).

Having the involvement and explicit support of both the CCG(s) and Local Authority (s) from the outset.

Being very clear on the service model and how this meets the needs of the population served by the Learning Disability and Autism Programme, and how it will help achieve the ambitions set out in the NHS Long Term Plan.

Having agreement on the revenue funding from Local Authority and CCG Commissioners prior to submitting a capital bid

Having a dedicated project lead who plans the delivery of the project from concept to completion and can bring together all the relevant contributions from the different parties and coordinate the completion of the application.

Having a realistic timeline for delivery; in our experience -o Open market purchase and adaptations for an individual takes 6-9 monthso Redevelopment and remodelling of an empty existing asset 12-18 monthso New build to deliver a new accommodation solution not available locally 18-24 months

Stage 1:

The first stage requires commissioners to submit an expression of interest that provides a summary of the proposal and key information on how the proposal will support the relevant TCP and associated reduction in inpatient use/prevention of admissions.

We strongly encourage you to contact your NHSE&I Housing Senior Manager to discuss your EOI prior to completing the form.

The EOI template is attached in Annex A. This template will be shared with Experts by Experience who will form part of the assessment panels, so please ensure you complete the form in accessible language.

Deadline for submissions - All Expressions of Interest need to be submitted no later than 5pm on 16th November 2020.

Assessment Panels

There will be a panel convened for each of the two North regions North West (including Greater Manchester) and North East and Yorkshire. Panels will be made up of Experts by Experience, regional finance colleagues, strategic estates colleagues and policy leads for regional programme and representatives from the ICS/TCPs. The panels will meet in November to assess the EOIs.

Stage 2:

For those EOI’s that are supported in principle by the panels and regional finance/ICS colleagues, commissioners will need to complete a Project Initiation Document (PID) and submit their final PID, to their Housing Senior Manager within agreed timescales. The PID document and supporting documentation templates will be provided by the Housing Senior Manager upon confirmation of EOI support. If you wish to see these at this stage, please request these. Each completed PID will need to be include:

Evidence of need: describe the service gap/areas of demand to be met Service description: describe new service offer: what is in and out of scope, who will benefit

and what will be the benefits from the new offer/accommodation Options appraisal: set out all viable options explored, including the preferred option Designs: plans for new, or refurbished accommodation as applicable Capital costings: to include professional fees and works costs Revenue costs: “As is” and “to be” revenue costs for new service Evidence of strategic support by the LA and CCG

We intend to hold online workshops early in the New Year to support bidders to prepare their full applications (PIDs).

Stage 3:

NHSE&I approval - this has several stages and can take 6-12 weeks to complete depending on the value of the capital grant.

Stage 4:

Following NHSE&I approval, NHSE&I Legal will appoint solicitors to progress the completion of the requisite capital grant agreement. Only once the grant documentation is finalised and completed, the first payment can be made.

Stage 5:

The transaction must be completed within the financial year that the scheme is budgeted for and all grants must be spent within 12 months of approval.
