COMPETENT PERSON

• Each Operation with at least one MRF having a CCS rating of “Major” or “High” shall have a Competent Person assigned on site, in charge of the construction and/or operation of such facility.

• An individual with a recognized engineering degree / registered professional engineer (where jurisdictions include such legislated professional associations, such as Australia, Canada, South Africa, UK, the United States, etc.) and extensive experience in Mineral Residue facility design, construction, operation and closure.

• The Competent Person will manage and coordinate EoR scope, schedule, and activities, acting as first point of EoR contact with the Operation. Together with the EoR, shall document and approve all changes.

• The Competent Person will coordinate Technical Review Panel (TRP) activities and meetings and shall make the TRP aware of the material changes regarding the mineral residue facilities.

• The Competent Person shall ensure proper completion, sign-off, and control of the 25 required documents including the CCS.

• The Competent Person shall implement and monitor the Standard and the

Critical Controls at the respective MRF to which they are assigned.

• The Competent Person shall be the main contact for the Operator

• Identify, scope, budget, and schedule Stay-In-Business (SIB) project

requirements consistent with the short term and master deposition plans.

• Conduct routine internal (short form and long form) facility inspections.

• CP is one of the five pillars of our Technical Standard, and aligned with

international best practice and the ICMM governance framework

• The role provides an essential level of assurance that we cannot do without

• We as the Owner retain all accountability, we cannot out-source it

• CP is involved throughout the life cycle of the mineral residue facilities

• CP interacts with the key stakeholders on mineral residue facilities

ENGINEER OF RECORD (EoR)

• Professional engineer/consulting organization with experience in the design and/or construction of tailings dams

• Typically, the engineering company or entity that is either:

– The Design Engineer who completed the detailed engineering, construction drawings and specification to construct the structure, or

– A replacement of the Design Engineer when the latter is no longer available, the company does not exist anymore, or duties of the Design Engineer have been transferred to another engineering company for various reasons.

• Qualifications meeting those defined by local professional engineering associations for dam design professionals

• Long term relationship providing continuity

• Essential partner in safe design, construction, operation, maintenance, and closure

• Provides professional assurance of awareness of the safety conditions and records of the tailings dam

EoR

The EoR’s scope of work, and professional qualifications, must enable

them to state the following:

The construction, operation, maintenance, and surveillance of the

tailings facility is consistent with design intent and good practice, and

the tailings facility is in a fully satisfactory condition.

The safety of the associated dams meets or exceeds all applicable

design criteria and regulatory requirements.

• The EoR is not a person/organization to which Anglo American

“outsources” accountability for the safety of our mineral residue

facilities.

• The Owner is ultimately responsible, and accountable, for the safety

and operation of these facilities during construction, operation, and

closure.

• A number of parties (including the EoR) are delegated responsibility,

but only one (the Owner) is accountable.

THE NEED FOR THE EoR

• Provision of design expertise not typically retained within the Owner’s organization

• Provision of single-point and integrated multidisciplinary expertise (engineering geology, geotechnical engineering, civil engineering, dam engineering, hydrology, hydraulics) not typically retained within the Owner’s organization

• Experienced, qualified Professional Engineer(s) assigned to oversee construction and operating practices

• Continuity of oversight at the given facility

• Effective risk management

• Effective management of change

• Identify and address dam safety issues, or issues that if unchecked can develop into dam safety issues, before they fester and develop

• Improved communication and document control

• Single and key point of technical contact

• Minimize lost time and interruption/delays related to short contracts renewals

• Development of relationship and trust with Ops & BUs

WHAT IS A TECHNICAL REVIEW PANEL?

A technical advisory body comprising highly experienced, respected and capable technical experts providing us with independent opinions and advice pertaining to the safety and integrity of our mineral residue management facilities.

TRP attributes:

• A structured, formalized mechanism for technical review

• Independent (third party) – no previous involvement with the facility, and fully independent of the Engineer of Record and of Anglo American operations

• Multi-disciplinary with a broad range of expertise and experience

• Nationally/internationally-recognized experts with > 20 years experience

• Advisory body only

• Consistent with leading world practice, and Anglo American’s commitment to attaining that standard

TRP OBJECTIVES

1. To assist in identifying and reducing potential liabilities to the Group

arising from current and future tailings storage and water management

facility(s) at the operations covered under the TRP’s mandate.

2. To provide independent opinions and guidance on the physical integrity,

safety, behaviour, and performance of earth structures and water

management appurtenances associated with the existing tailings storage

facility(s) management system and planned additions, expansions,

modifications and closure of this system(s).

3. To provide independent review of the design and operation of the tailings

storage facility(s) with respect to sound engineering and sound

management practice.

4. Provide independent assurance to Executive level.
